Yesterday, on behalf of a large number of progressive bloggers and activists, Jane went to the FEC and filed an official complaint against John McCain's alleged campaign finance violations. We've been asking a lot of questions about this, and the answers have been less than forthcoming. So, instead of just sitting here and stewing about yet another GOP ethical problem, we decided to put our action where our concerns were.
As you'll see from the video, Jane handed over the official complaint to the FEC yesterday to get the process going:
“John McCain is a campaign finance criminal who is flouting the very regulations he championed,” Jane Hamsher commented while delivering the complaint. “He believes the law is for someone else, not him. It's the height of hypocrisy.”
As Markos of DailyKos pointed out in joining the complaint, “John McCain has officially blown past campaign spending limits mandated by his original acceptance of public campaign funding. While he has signaled his intent to withdraw from such financing, that has been hindered by the fact that he used the promise of public funding to secure a campaign loan.” Guess the campaign finance laws only apply when they aren't inconvenient for McCain's ambitions.
As you likely know, the FEC is stymied at the moment due to the Bush Administration trying to shove Hans Von Spakovsky and all of his "caging" and other alleged nefarious campaign activities onto the election commission as a GOP dirty tricks ringer. Because the Democratic-led Congress said "no way" to Hans being voted through in a bloc vote, the Administration and their pal, Mitch McConnell, have balked at any FEC commissioner vote in the Senate. Which means that in this very important 2008 election cycle, the FEC is unable to act promptly to enforce the campaign finance laws.
Even so, FEC Chairman David Mason sent McCain's campaign a strongly worded letter (PDF), letting them know that even though McCain didn't consider his word on accepting public financing binding, that the FEC was not about to let him off the legal hook. What did McCain do? He ignored the letter, secured a loan based on representations of obtaining public financing and then blew past the public financing law spending limits...and he's still raising campaign cash, too.
We decided that McCain shouldn't be allowed to get away with this without questions -- lots and lots of questions -- being asked. The hypocrisy of the so-called "maverick" violating a law which he championed because it suits his purposes this time around is horrifying. Even worse is the relative silence of the press on this, given the rank hypocrisy of violations of McCain's "signature" issue and all. Does it get to be your signature issue if you are blatantly violating it in an in-your-face maneuver after being warned not to by the head of the FEC? I think not.
If the press isn't going to ask the necessary questions, then we have to do it ourselves. You can join in, too -- sign your name to the complaint here. And help us get the word out on the need for McCain to be held accountable for any violations of the law that has his own name on it....and any other laws of which he may be in violation.

I think the saving grace of this whole issue is that in the summer and early fall, after the conventions are over, there will undoubtedly have to be some debates between the Rethug Candidate, McBush, and the ultimate Democratic Candidate, whoever that may be, and maybe including Nader (I kinda hope so, because this is just the sort of issue that Nader would glom onto.) Ultimately, these questions will inevitably come up and McCrazy will have to handle the matter. With his temper as it is, I can imagine how that will go. Should be interesting to see the old man stammering in anger and frustration, trying to blame it on Democrats for not allowing the block vote, and how the Rethugs got caught in their own “too cute by half” attempt to game the election system.

Normally, when you file something at a public agency, you go to something like a dockets office. You give them the required number of copies, all signed, and then you hand them an extra copy with a return address envelope (with stamps), asking them to stamp it as received and to send it back to you. But Jane’s way is better.
that’s my outside limit… for starters it was just going to be March, and now i’ve fallen off that wagon (but for a good reason).

I thought we would have to do that too, but you don’t. That’s the process.
I’d love to sign, but I’m unsure about an aspect of the complaint. We’re told that in the complaint that 11 C.F.R Sec. 100.152 increases the limit from 42,050,000 by 20%, and 11 C.F.R Sec 9035.1(c) increases it another 15%. I don’t know how it works in lawyer land, are we to interpret this as an increase by 35% or an increase by 20% and then by 15%. This matters, because if it is the latter, the spending cap is actually 58,029,000 since the cumulative effect would be a 38% increase. This may be picking nits because I’m sure he’ll blow right by that limit as well long before August, but I’d prefer to wait to accuse the man of breaking the law until I’m sure I understand he has in fact done that.

Actually, and unfortunately, the neocons OWN the media, and the air time it alots.
And they are buying even more of it.
Although Clear Channel’s continued capital constriction might be a sign that propaganda isn’t worth the paper it is printed on any more. Most of these media congloms are the lowest-profit portion of the portfolios they inhabit. Some are actually unp[rofitable, and drag the whole corporate total down on an annual basis.
Until 2006, it may have seemed worth keeping them as loss leaders. But now that the red tide is turning blue again, maybe some of them have decided their bottom line matters more than their party line.

Let me just add that at approximately 7:10 this morning, Fox and Friends did a fundraiser for McCain. Talked about his latest gimmick, donate $50 and maybe win a chance to join him on the Bulls**t Express. They went so far as to say things like “Wow, just fifty bucks” and “If 100 people do this…yada,yada,yada”. I’m not sure if they provided a number or website and I don’t have tivo. Is this not crossing the line? Does it violate any rules?

on the link above, called a strongly worded letter-pdf—the fec states the two things that would make it illegal to withdraw from their agreement……
but, another part of the question i have been wondering about, did he state on the loan agreement anything that is a violation of these rules?
the fec letter references two paragraphs from the bank loan agreement. that are in contention.

Just curious, is there a standard “complaint form” any of us might be able to fill out against Johnny “The Flounder” McCain? He’s the Manchurian Surrogate, riding around in his Flip-Flop Express.
Is this just something that happens in DC or can we file elsewhere?
Mush as many small and even large communities have called for Bush’s and Cheney’s impeachments, maybe if there were a lot more complaints filed in a lot more places, we might see an avalanche of support, all from Jane’s simple act of civil obedience.

Even if there was a “current” FEC head, he/she would probably be on the McCain payroll, too, considering who would make the appointment.
The point was that FoxNews was advertising it. Getting all excited that $50 could get you on the bus etc. Just wish I noticed whether or not they provided a number. But, it was 7:10 this morn and I wasn’t yet thinking straight.

yesterday I contacted the Royal Canadian Mounted Police, in order to try to get an investigation started on behalf of a client. Had NO idea how to go about it, but their web-site said that they didn’t want to hear from private citizens outside of Canada personally - wanted to be contacted by “an appropriate” law enforcement agency.
So, after the Indiana State Police turned me down, and the Attorney General’s Office didn’t return my calls, I did it myself.
GREAT people - took all of my information, got it all done, and just shot the bull for about 45 minutes.
Had me asking about emigrating there at the end. Got info about that too. Swear to all that’s holy - if Canada was warmer, I’d be there in a heart-beat….

A major news organization does a fundraiser for a candidate? He must be fair and balanced. And male and white and ready to bomb Iran.
I signed the petition. It’s a worthy effort to push for. Even with a bureaucratic stall, it provides an avenue for an ongoing media spectacle, asking the champion of campaign finance reform why he’s breaking the campaign finance rules.
I think signs like “Campaign finance reform for everyone! (Except John)” and “No More Lawbreakers for President in 2008″ ought to dog his heels.

I wish to God that there was some kinda cure for Alzheimer’s, ’cause my dad just lost his only sibling to it two weeks ago. He has signs of it too, and is painfully aware of it. My aunt died after 6 years of not being able to recognize anyone, including her husband and my father (her brother).
Could there possibly be a more cruel disease than one which takes your mind, but leaves your body intact?
