Looks like the Republican's "secret session" strategy backfired, and they lost some Bush Dogs in the process.
Eleven Democrats voted "nay," and that may include some protest votes from progressives.
Leonard Boswell, one of the 21 Bush Dogs who signed the original letter to Pelosi expressing support for telecom immunity actually spoke on the floor in favor of passing this bill without it, and voted the right way. Props to his primary challenger Ed Fallon and his helpful FISSA statement, and whatever part it played in Boswell's inspirational "come to Jesus" moment.

Kucinich also voted no on the extension to the PAA, even though that would have helped the position of most Democrats. He’s been very consistent: anything that increases FISA beyond the original is bad.
As to whether Kucinich would’ve voted yes if his voted was “needed” … my prediction is he wouldn’t.

Not taking it up is allowing it to die (not good for Ds since they will be held responsible, but good for Americans). If the Senate takes it up and aproves: Bush vetoes. If the Senate will not approve: back to square one. Either way the poison pill has worked.

Technically speaking, the House amended the Senate’s amendment of a previous House bill. Thus, it goes back to the Senate for consideration — without possibility of a filibuster.
Kagro X is reasonably hopeful that this was a bit of legislative skill worked out between Nancy and Harry, to cut the power of the Senate GOP. We shall see.
Bush thinks he can add or subtract anything with the mere stroke of a pen. He will use the perfunctory, “I will interpret this law in view of my Article 2 powers as the supermysticalmagical unitary executive kingly Emperor!” That is, if he signed it. He will instead veto it as there is not enough votes in the House to override and the Senate is compromised vis a vis our liberty and Constitution and is essentially on the dark side already.

In order for a bill to go from Congress to the president, both chambers have to agree on exactly the same language. At this point, the House and Senate language is radically divergent, and the latest action is the Houses, on a bill sent back to it by the Senate. Now the Senate is in the same spot it put the House in.
I think the question of what the Senate will do next is really interesting. It has no obligation to take up H.R.3773. The Senate may decide that it doesn’t have time or the inclination to navigate something new, this year, and may well pass an extension of the PAA — an extension that reaches past GWB’s term in office.
I just called Welch’s office to complain, as I have called them every time FISA comes up, and every federal elected official from Vermont (all three…) have said they are against immunity. This makes no sense, and I’ll post the reply if/when I get one - they said they would email an answer on it.

The only filibuster (60 vote hurdle in essence) that the House-passed version can bypass is the filibuster associated with a motion to proceed. Once taken up by the full body, H.R.3773 can be blocked by 41 Senators.

The general point of “can’t amend an amendment” in this context is to prevent perpetual ping pong between the chambers. If they disagree, they are supposed to say so, and request a conference to negotiate a compromise.
The “amend and amendment” thing is supposed to apply to narrowly drawn clauses; and doesn’t fit real well when the “amendment” is in fact a hundred pages of text (substitute amendment is a fresh bill, not a “change” to a bill).
At any rate, the rules are meant to drive legislative issues toward a conclusion. When the difference isn’t amenable to a compromise, then no legislation is produced.
Well what do ya know. I can’t believe they didn’t go behind doors and cave. Can we please have impeachment now?

The choices are still myriad. The Senate can pass yet another (different) version; the Senate can pass an extension of the PAA (which by definition has no retrospective immunity provision, it just changes the date on an existing law); or the Senate can take up H.R.3773 and “tweak” it, e.g., by removing the section that permits pending cases to be handles with the telecoms presenting state secret evidence in judge’s chambers, out of sight of the plaintiffs.
Regardless, the House has spoken. The ball is now in the Senate’s hands.

Believe it or not, all 21 who were on my blue dog list voted yea, including Carney, with the exception of Cramer, who did not vote. Haven’t found the three yet, unless someone found them while I was looking. If so, please, who are they?
I concur. But if he were,(in an ideal world), ever convicted of war crimes, Mr. Bush tries my conviction on being against the death penalty. But I suppose I would take more satisfication in knowing our prez were in isolation for the rest of his life behind bars.

By the way, I think Kucinich was protesting the Democrats for ALLOWING A SECRET SESSION TO OCCUR. It was a risky move on his part. Not sure I would have done that considering the importance of this vote. Maybe he knew it was going to pass and figured voting against it wouldn’t be a risk? Could be. Not sure.
