The Washington Post reported on Tuesday:
Two former high-ranking Shiite government officials charged with kidnapping and killing scores of Sunnis were ordered released Monday after prosecutors dropped the case. The abrupt move renewed concerns about the willingness of Iraq's leaders to act against sectarianism and cast doubts on U.S. efforts to build an independent judiciary.
The collapse of the trial stunned American and Iraqi officials who had spent more than a year assembling the case, which they said included a wide array of evidence.
"This shows that the judicial system in Iraq is horribly broken," said a U.S. legal adviser who spoke on condition of anonymity because he was not authorized to discuss the case publicly. "And it sends a terrible signal: If you are Shia, then no worries; you can do whatever you want and nothing is going to happen to you."
Prime Minister Nouri al-Maliki's decision to allow the case to proceed to trial was considered a significant step toward proving his Shiite-led government could hold Shiite officials accountable for sectarian crimes. The case was heard at the multimillion-dollar Rule of Law Complex, protected and supervised by the United States, which has said that the development of an impartial justice system is essential to Iraq's long-term stability.
Fans of irony will note that Lewis "Scooter" Libby was convicted of perjury and obstruction of justice a year ago today. How did the U.S. government's dedication to an "impartial justice system" work out there... anyone remember?
I wrote about this intended trial at my own blogospheric backwater in November, unable to resist needling the metaphor of a "Rule of Law Complex" in Baghdad that was (as I put it) "hiding out in a fortified bunker in Baghdad, in fear of the Iraqi government as much as anyone else." The Post's report lets us know not much has changed:
Witness intimidation has been one of the most significant concerns in the trial. Many of the witnesses agreed to testify only because they believed their names would be kept secret, but their names were leaked and supporters of the former Health Ministry officials threatened to kill them or their families if they didn't recant their testimony, American officials said. Many of the witnesses did not show up at the trial, though Iraqi law allows their testimony to be read if they do not attend.
The New York Times quoted a Sunni politician who was upset over the trial's collapse, and smelled U.S. complicity:
“I don’t think that there was any fairness in this matter,” said Saleem Abdullah, a member of Parliament and a spokesman for Tawafiq, the main Sunni bloc. “We are still wondering what happened to Ali al-Mahdawi, who entered the Ministry of Health and didn’t come out. So where is he?”
Mr. Mahdawi, a Sunni, was the director general of health for Diyala Province. He attended a meeting at the Ministry of Health on June 12, 2006, and vanished. Mr. Abdullah blamed the Americans for failing to push Iraqis to hold a more rigorous trial.
The Americans “also have the suspicions, but they have political considerations too,” he said. “Maybe because Sadr recently froze the Mahdi Army, they are trying not to criticize or provoke him,” he added, referring to Mr. Sadr’s recent decision to extend a cease-fire for six more months.
Ahh, but never fear, Mr. Abdullah! Our government may not be willing to hold Iraq's Shiite regime accountable in court for sectarian murders committed by its militias, but (as Hilzoy at Obsidian Wings noted in writing about the trial) we are willing to arm and pay Sunni militias to counter them.
All in a day's work bringing Dubya's "freedom agenda" to fruition, I guess.

They would rename it the Alberto Gonzales Advanced Rule of Law Center.
I find it hard to criticize Iraq for not prosecuting their leaders when we are doing the same thing here.

That would explain their understanding that a Constitution is conditional.
Starting with Nixon, and perhaps before, I haven’t noticed the “rule of law” being high on the Republican agenda. Imagine what President McCain’s views and actions will be on the concept of the rule of law.
Actually my understanding of Scalia and the Constitution is it’s not only NOT conditional, it’s graven in stone and since it says nothing about torture or women’s rights or racial discrimination, those items are not unconstitutional

Exactly what have Bush (before his first pres term), or HRC or Obama or McCain done to cross it or not cross it? McCain flew a plane in combat, does that mean he crossed it, He is war monger? Does that mean he crossed it? Very Serious Village Idiots kiss his ass on TV? Does that mean he’s crossed it?
I think maybe understanding concept of rule of law, and constitutional roles of exceutive and legislature might be an operational definition, at least a comprehensible starting place. Rather than total, meaningless noise and BS.
And the Bush crowd has been practicing ’stealth law’ for almost eight years. And getting away with it. I wonder how many have perished in Iraq via interrogation methods employed by the Iraqi and U.S. governments since the Bush regime has come to power. If I remember correctly, when Bush had Saddam hung, when he fell through the trap door he was decapitated.

There is the biggest problem I have with Scalia. He does see it as conditional because Congress, in ratifying a treaty, (like, say, The Geneva Convention) makes law. That is according to the Constitution. To say that there is nothing in the Constitution about torture is the most absurd thing ever uttered by a very evil little man. He could obviously not care less for or about the Constitution.

Well, he’s parsing his words as good or better than anyone. By ratifying the treaty, it is made illegal but there is nothing directly stated in the Constitution so it is not unconstitutional. If the treaty gets overturned, then there’s nothing inherent to the Constitution to block torture.
Semantics of course but that’s how he’s reasoning it seems.

I’ll stay here. I have to lob 14 80lb bales of hay off my truck to the shed every week. Usually, I get weak after about 4 of the bales…after a couple of weeks of intense yoga, I noticed a huge surge of strength and flexibility and lobbed 10 out of 14 with no problem…it was eye-opening!

There’s not a yoga class in my area. Is there a good video instruction or book you can recommend? I need to get stronger and back to my old flexible self.
Margot, there are lots of good Videos/DVDs on Yoga, just remember to stop stretching when you feel pain, rest for a minute in between and not to over do any exercise. Oh, and do not attempt the head stand unless you have an instructor …
In case that first point isn’t clear, when doing any yoga pose, don’t try to stretch as much as the instructor, they have had years of practice. Stretch until it starts to hurt and back up a bit … do not go further. Every time you do the yoga, you will become more flexible, but yoga should never be a painful experience …
I have Dish TV and the Veria station 9575…the Yoga is on at 11:00 A.M. CT everyday. The teacher is Kurt Johnson or Johnston. He teaches flow yoga. You can get info from Veria.com, plus he has a website, but there are many DVDs and tapes out there. Petro could probably better recommend than me. It really has helped me though. It’s pretty amazing.

I used to take modern dance classes and they used some yoga exercises…this was as a teen. I remember doing the headstand. Most definitely not going to try that for a long time!
