&lt;p&gt;Obey the law - now there’s an interesting abstraction.  It comes back to that old saying, “Does a falling tree make a sound if no one is near enough to hear it?”  Or, to the point, does one break the law when law enforcement turns a blind eye?  In this context, law enforcement means the USAG and the SCOTUS.&lt;/p&gt;
&lt;p&gt;I think any notion that the Executive must obey the law is mildly flippant.&lt;/p&gt;</description>

It’s an interview with Lawrence Wright in which he generates the dangers etc. in a context for PAA, as well near to condoning torture and anticipating that emails/internet will have to be monitored. &lt;/p&gt;
&lt;p&gt;The Democrats will have to counter the fear arguement because it is so powerful and visceral; a rational civil liberties approach does not cut it.&lt;/p&gt;

The fourth amendment requires probable cause when American citizens are subjected to search. Is probable cause reasonable? Probable cause is required under FISA warrants to identify the agents being monitored as foreign agents. The Bush administration is arguing that probable cause is an unreasonable requirement, even when targeting American citizens. Bottom line, unless you accept the view that the USA is permanently at war, you will likely conclude that the Bush administration is, as KO said recently, fascist.&lt;/p&gt;</description>
