No more squirrelly half-truths and not-quite-fully-honest nondisclosures. No more sitting back in silence and hoping to wait the bastards out of office. No more failure on the backs of other people’s children without facing the costs of your piss poor decisions.

Such agreements, the White House is quick to point out, are not usually subject to congressional approval. That is true. But this truth will not suffice, since the administration is still aiming for an agreement that moves far beyond the traditional scope of these limited military accords. We should not allow false advertising to serve as a cover for a constitutional fait accompli.
For example, the administration plans to exempt civilian contractors from prosecution under Iraqi laws. Military personnel also enjoy this exemption, but they can be court-martialed. These military tribunals have no jurisdiction over civilian contractors. Indeed, many of them will be immune from prosecution anywhere. Current federal law only subjects contractors working in support of the Defense Department to prosecution in American courts for felonies in Iraq. Yet those working for the CIA or the State Department could be left operating in a "no-law" zone if the president had the power to commit America unilaterally. If that happens, contractors could shoot Iraqi civilians without cause or commit sexual assaults against their fellow contractors without facing prison time. No existing status of forces agreement, including those used in such places as South Korea and Germany, contains anything like this wide-ranging exemption.
And for good reason. As commander in chief, the president has the constitutional power to make unilateral agreements concerning military personnel and those directly supporting them. But the Constitution only makes him commander in chief of the "army and navy" — not all Americans working overseas. He can’t reach an agreement with Iraq that exempts independent contractors without Congress getting into the act. At the very least, Congress should not give its consent without amending existing statutes to assure that all civilians granted immunity from Iraqi law can be held criminally responsible in American courts.
And further, from Ret. Lt. Gen. William Odom, via Nieman Watchdog:
Finally, the most questionable aspect of the surge concerns the consolidation of power by sheiks and other local leaders. Most weak states in the world have strongly consolidated local leadership. That is why their central governments remain weak. Once such enclaves of power are created by local strongmen, they almost never yield, or even share it more than temporarily, with the central government.
Political consolidation is achieved almost without exception through civil wars. Is that not the American experience? And the English experiences with their Welsh, Scottish, and Irish clans? In Iraq, even Saddam never succeeded in breaking the clan structure, only in buying them off from time to time. The Ottomans never tried. Can U.S. forces achieve the centralization that has eluded all previous regimes there?
Perhaps the president ought to be asked to explain why his answer is yes….
Withdrawing from Iraq will not turn the economy around, but the billions of dollars that would be saved could certainly defray the cost of an economic stimulus package, lessening the likelihood of ensuing inflation.
Accurate assessments of the war’s cost are not available, but the figure is most likely between a trillion and one and a half trillion dollars. What if that money were available for dealing with health care demands, public infrastructure underfunding, and the like? To talk about recession without tying it to the war is to give the administration a pass.

And just when you think you’ve had as much as you can possibly stomach, when you can take no more lies and idiocy and mendacity…read Scott Horton’s piece on the Valentine’s Day torture trifecta. As usual, well said by Ackerman. He also testified at the Clinton show trial in the Senate.
In relation to the quote from Ackerman and Hathaway, I interpret this as part of an intentional strategy designed to ultimately lead to a completely extralegal mercenary military that cannot be touched by the legislature or judiciary, and answers to no one but the President. And why a President would want to have a nice private army?
Unfortunately, it seems that there will be never be
accountability for the Coaltion Provisional Authority.

The entire op-ed is very well done. I encourage everyone to click through the links and read them this morning. They are all on point and explain my testy feeling better than I could sum it up in a singular piece. It’s as though the idiocy and medacity is building to an enormous crescendo lately…
The extra-legal approach that they have taken on this leads me to believe that most of the interrogations for which there are problems, including the black sites issues, were outsourced to contractors to attempt to avoid legal liability complications. And even though we know some truly heinous things, I wonder how much worse it really has been if they are going this extra mile to keep people from knowing the whole of it.
One of these days, we’ll be able to unravel the entire thing, from start to finish, but it will take years of digging until that happens. And, until then, the key is going to be setting up preventive measures whereever possible that seek to uphold the rule of law and provide for oversight.

It is nothing more than the logical outcome of the National Security Act
of 1947. The extraconstitutional apparatus permits a state of constant

have any peace. Rename the defense department back to war department to
undo the first of the Orwellian tricks that have led down this road to

Exactly. When they testify that the CIA hasn’t waterboarded for the past few years, they never say that “agents” of the US are not torturing. In fact, I’d wager that whoever they have outsourced the torture to, is torturing much worse than the CIA ever did…
They can also claim that it is “legal”, because there is no law that says that “contractors” can’t torture. I wonder if that is what Mukasey is always hinting at…that Congress has to make a law covering “everybody”. We know W has authorized torture…we just don’t know who is actually doing it. The US is holding 20,000 prisoners in Iraq alone.
I am afraid we are going to lose this FISA argument. If we lose, it will not be on the merits, but will be based on the venue of the debate.
Unfortunately, most of our national political discourse take place on TV. That particular medium dramatically favors the simplest construct. If you have to string several paragraphs together to make your case, television punishes you.

Saudi Arabia is threatening terrorist attacks against innocent civilians in Britain. This might be considered an important story. But too much exposure might unravel the web of lies constructed since 9-11. This is more evidence that “Al Qaeda” s a fraud cooked up by the Bin Laden and Bush families. Pakistan and Saudi Arabia provide the manpower, money and cover for this “terrorist” army.
Former Saudi Amabassador, and close friend of the Bushies, “Prince” Bandar has been receiving bribes for British Weapons deals. (Bandar, and Pakistan’s ISI also helped finance the 9-11 Hijackers.) Saudi Arabia successfully blackmailed Britain to end the bribery investigations. If not, Saudi Arabia has threatened another 7-7 Al Qaeda attack against Britain. Saudi Arabia is a terrorist nation that threatens the citizens of Britain and the United States. It also seems the British and US governments have committed treason against their own citizens, by protecting and helping the Saudi warlords.

Part of why it feels like things are building , I think, is that Bush and the White House seem to be on an all-out push to consolidate all the power they’ve grabbed over the last seven years, and, if possible, to gain even more. Look at just how over-the-top Bush has been on immunity for the telecoms and FISA. he’s practically thrown a two week long hissy fit. This move to make what are in essence are treaty agreements on presidential authority alone is just another move to expand the president’s power at the expense of Congress. As the lyric puts it “A king ain’t satisfied till he rules everything, and Bush and the White House can feel the deadline looming that will end their chances to grab as much power as possible.
On a slightly related note, one of my all-time favorite songwriters, Australian Paul Kelly’s latest release, “God Told Me To” is an intense, provocative look inside the mind of a fundamental religious terrorist. Plus, it’s a really cool video.

As a lawyer, Christy, is there any realistic possibility of holding Bush and Cheney accountable in a court of law after they leave office? The Chinese have taken down a satellite thus signalling their ability to engage the US directly in the weaponizing of space. Reagan’s and the neo-cons and the military industrial complexes dream of a new frontier and all the spoils that go along with those great contracts.
However, the US is engaged in three wars. Afghanistan is one, and the appeals and lectures to NATO for help by Gates indicates it aint going so well.
Iraq is number two. The fact the US has begun to bribe Sunni tribal sheikhs is an indication that things are going rather raggedly there too.
The third front is the American mainland where there is still indeed a threat of terrorist attacks that needs constant vigilance(not endless diaper filling fearmongering).
So now China is pushing the US to further strap their economy with a whole new war frontier. One they can collude with Russia and tag team the US.
Add in the lunacy of the neo-con/McCain factions who desire to open up new fronts in Syria and Iran.
The US could find itself in the Soviet Unions shoes in short order unless this lunacy ends.
But, ‘we’re number one’, the ‘most powerful nation in the world’ and we never lose a fight.

It scares me to think about why they are still grabbing as hard as they can for further unchecked power, when Bush’s term ends in less than a year.

They avoid a declaration to avoid oversight by the congress. The national
“emergency” allows the executive to brief their friends on the hill when
they feel like it or, more likely, to simulate oversight. The whole NSC
apparatus, according to col. lawrence wilkerson, was set up to make
another FDR impossible… Wall Street, CIA, Defense, all smoke screen
for Brown Brothers Harriman Bush Rockefeller to keep the war contracts
flowing, end result is no domestic civilian economy… dead end like
the Spain of Phillip II.
It’s very difficult to do so without a lot of public opinion pushing it and without a pile of “smoking gun” revelations behind it. Not to say that the evidence wouldn’t be there for specific people and specific charges — but it would have to be rock solid and have a substantial public outcry for it to have it done. All this to say, even with the evidence, there are a lot of intangibles that would have to be factored in, because it would be a political action as much as a legal one and those are always difficult to get started without a huge push behind them.

There isn’t going to be a declaration of dictator. Military sentiment is decidedly not there for it, and neither is law enforcement. It just isn’t going to happen — especially not with so many in the GOP beyond fed up with the idiocy and ready to heave them overboard as soon as possible, too.

Worrisome, isn’t it. Immunization from prosecution is one reason, ie telecom immunity, but that seems to be only a small part of what is going on.

I believe that international courts do not give a sweet damn what the US declares legal or illegal. Their names will be on every damn data base of every other country in this world and woe betide them if they try to travel.

I can’t explain it, but I understand the comment someone made about your blood boiling over the atrocities of the Bush Adm. I feel certain that something will happen this year, what, I don’t know. Will they leave office before their terms ends, will something happen to suspend the elections, or do they just actually leave?
Say you’re Bush and Cheney, you’re down to the last months in office nd you know all of the illegalities that your administration has committed. Some you know will never see the light of day, some others may come out eventually after you leave office. So what do you do? Do you issue a pardon for the entire administration before walking out the door? Are we going to start seeing a number of “accidental deaths” of people involved and/or realted to the administation that helped carry out the many illegal acts? What becomes of the DOJ Atty scandal, the Valerie Plame’s and so on? Its 24/7 election news right now and that is what the current adm is counting on, too many people are distracted by that, including the networks.
I’m not trying to be funny or conspiracy minded here. Its something we need to look at now and be proactive about. They are not going to leave office, by leaving themselves wide open to further prosecutions. If you were Bush and Cheney, what would you do to protect yourself?

One thing cooking is the investigation into Bandar Bush ongoing in this country…while simultaneously the news that Bandar threatened Blair is coming out in Britain.
It would be really fantastic if the point could be made to the public that the Administration does the bidding of the Saudis and that it was Saudis who attacked the US.
A commenter on Kos yesterday pointed out that an enormous pull out of cash from the banks in the US occurred in August, 2001, which may have something to do with the Saudis, but that’s all I know…at the moment.
Point being…investigations are ongoing…and they do lead to Bushco.
Someone in the administration knows the real reason for why we attacked Iraq. That’s the place to start digging. If we can get hold of that then perhaps some people can be indicted. Too bad someone took impeachment off the table. I am rather furious at that.

I’m a half breed (1/2 white and 1/2 Cherokee). So it necessarily follows I’m only 1/2 surrounded. And I strongly promote that pronouns are important. ;0)

The old Texas finally died when Yale turned down Poppy Bush’s prez
library and it came to Texas A&M. The militarist bent of the Bushes
was a perfect fit for the war nostalgia soaked Corps program there…
add the Bush School that cranks out little experts that have taken
over local governments down here and you begin to get the picture
they have in mind for the whole country. There needs to be 0 influence
from Texas in the next administration, absolute 0 except for Jim Hightower.
