Over at my home blog, my co-blogger MEC informs me that with the issuance of Executive Order 13457, “Protecting American Taxpayers From Government Spending on Wasteful Earmarks”, Bush has broken the law yet again and given himself a line-item veto:
In effect, the Executive Order declares the Bush has the power to reject against any part of the budget passed by Congress that Bush doesn’t like: a de facto line-item veto. Never mind that the Supreme Court ruled in 1998 that the Constitution does not permit the president to decide, item by item, which parts of the budget to accept or reject. If Bush doesn’t have the power of line-item veto before he signs the budget bill, he doesn’t have it afterward, either.
That's not the worst of it. As MEC notes, this Executive Order doesn’t go into effect until Fiscal Year 2009 (beginning October 1, 2008). By the time it has any effect (if enforced), Bush will be out of the White House.
In other words, Bush just gave himself the power to decide how the next Administration spends the taxpayers’ money.
Ironically, Bush and his media enablers were all fine with earmarks when the earmark-happy Republicans controlled Congress with an iron fist:
The use of earmarks grew exponentially during President Bush’s years in the White House when the Republican Party controlled Congress. According to the watchdog group Citizen’s Against Government Waste, in 2001 there were 6,333 earmarks totaling $18.5 billion in the federal budget. By 2005, that number had ballooned to $27.3 billion for 13,997 projects. In 2007, the first year the Democrats controlled Congress, the numbers dropped dramatically to $13.2 billion for 2,658 earmarks.
How serious is this? My other co-blogger, Charles, notes that when Nixon tried this, it was called "impoundment" and was listed as an impeachable offense.
Of course, the Democrats could make a point of questioning this illegal and unconstitutional maneuver, or they could just treat this EO with the same respect and consideration that former FBI chief and Republican judge Louis Freeh (one of the many Republicans Bill Clinton hired in a gracious bipartisan gesture who then backstabbed him by way of thanking him for his generosity) gave to President Clinton's eminently needed Executive Order 12963, which required financial-background checks of government employees working with classified info. That is to say, they could ignore it.
Ignoring Clinton's EO 12963 was a bad thing: Louis Freeh, so fixated on helping the Republican Congress of the time bring down President Clinton, was blind to the corruption of Robert Hanssen, the FBI agent turned Soviet spy, who thanks to Freeh would remain undetected right up until 2001.
Ignoring Bush's EO 13457, on the other hand, would be a good thing: It's not only itself illegal, it's disgusting. Rather like the person who issued it.

AFAIK the next President can just get rid of this EO if he or she wants. It sounds on par with Bush submitting a 2009 budget. The Democrats are going to try to hold over all the major spending bills until the inauguration. If they do, Bush can wave his pen about as effectively as he can wave his . . . well you know what I mean.

As a GI and again as a gov’t contractor, Secretclearances required basically contacting the cops where ever you’ve lived and a fingerprint and criminal records check.
Top Secret clearances required more in depth investigation including FBI and DIS interviews of friends, families, references, co-workers, enemies, anyone they can get thier hands on.
Alphabet soup/”need to know”/Special Compartmentalized Information type clearances, went into even more detail.

These line item vetoes, Democratic cave-ins and signing statements have effectively reduced Congress to impotency. Checks and balances, how quaint a notion that has become. Congress is complicit in the President’s lawlessness.

When does the congressional act (was it a spending bill) go into effect on which bush Bush added the signing statement that he could spend the money any damned way he pleases? When do we need to start checking on whether he stopped spending our money on those premanent Iraq air bases?
That will be serious impeachment time, and no one who give a tinker’s damn about democracy of any kind could ague otherwise.
If Bush acts on that signing statement and Congress does not start an investigation with impeachment as possible outcome, then Congress has ceased to exist as a serious legislative body.
I thinkt the DLC and blue dog and very careful types like Pelosi are hoping that they can just hang on for 11 months and twenty odd days, and nothing really awful will happen before Bush Jr. goes away. That is idiotic. First of all, dangerous precedents happen when you stand by and let some one do break the law or commit a tort.

I had secret clearances both as a GI and civilian contractor (read: never got caught).
When I was put in for TS, they didn’t like my responses to the face-to-face interview so took all the clearances. Turns out, I was a little too honest for their purposes.
We should also watch AZ….. even tho kos has AZ for HRC, I have a feeling it will be Obama with the Gov cutting ads for him. Now watching the Carolyn Kennedy ad for him. Obama has had three campaign offices here for several months and HRC just opened at the first of the year.

I don’t think there will be elections next fall. A late september or october terrorist attack will take care of that…
HR 4986, the National Defense Authorization Act for Fiscal Year 2008, was signed into law by Bush on January 28, 2008. I believe Bush’s signing statement about permanent bases and oil, etc. was in reference to this bill. The EO is about fiscal year 2009 beginning October 1, 2008.
Of course, no votes. It is after all Fat Tuesday followed by Low Calorie Wednesday.

I agree that this particular signing statement smells exactly like lawsuit bait. Team W is slapping every member of Congress right in the face and daring them to make him stop. And if it goes to the SCOTUS, Team W will likely win, not on the merits but because SCOTUS is stacked. And if it’s not challenged, then Team W will find some other even more audacious thing to try, until eventually there’ll seem to be no choice but to challenge it.
It’s like “Let’s Play Global Thermonuclear War” — the only way to win is not to play.

The soverienty of “We the People” is laid out in the Constitution. When our goernment no longer acts in our best interest it is time to file suit against ALL of these criminals whether perpertrator or colluder. Zappa would agree as well as Vonnegut and Al Gore.

This is no news - she has been hyping him non-stop on her show for weeks and weeks. I like her show - but can’t listen any more. I am a Edwards supporter leaning to Obama now - but still find it difficult to listen for 3 hours to someone who does not really discuss all sides of issues without prejudice.
“Wilding” sounds good at first, but I really think this is more disciplined than that — all a deliberate, planned push to get one or more SCOTUS decisions legitimating Team W’s power grabs. Once that happens, there’s no appeal, and no brakes on the office of the President, ever again. End of America.
