2.–Ordered, That all pending amendments to S. 2248, a bill to amend
the Foreign Intelligence Surveillance Act of 1978, to modernize and
streamline the provisions of that act, and for other purposes, be
withdrawn, except Amdt. No. 3911, offered by the Senator from West
Virginia (Mr. Rockefeller), in the nature of a substitute.
Ordered further, That the following be the only first degree
amendments remaining in order to the bill, with no second degree
amendments prior to a vote, except as specified in this agreement; that
any time for debate with respect to amendments be equally divided and
controlled in the usual form.
Ordered further, That the following amendments be subject to a
majority vote threshold, with a motion to table any of these amendments
in order:
Amdt. Nos. 3941 & 3938, offered by the Senator from Missouri
(Mr. Bond), each with a modification–20 minutes of debate on each;
Amdt. No. 3907, offered by the Senator from Connecticut (Mr.
Dodd) and the Senator from Wisconsin (Mr. Feingold)–2 hours of debate;
Amdt. No. 3927, offered by the Senator from Pennsylvania (Mr.

Ordered further, That the final four amendments listed be subject to
a 60 affirmative vote threshold, and that if an amendment does not
achieve that threshold, the amendment be withdrawn:
Amdt. No. 3919, offered by the Senator from California (Mrs.
Feinstein)–2 hours of debate;
Amdt. No. 3930, offered by the Senator from Maryland (Mr.
Cardin)–60 minutes of debate;
Amdt. No. 3920, offered by the Senator from Rhode Island (Mr.
Whitehouse)–60 minutes of debate; and
Amdt. No. 3910, offered by the Senator from California (Mrs.
Feinstein), with modifications if agreed upon–90 minutes of debate.
Ordered further, That upon disposition of all amendments, the
substitute amendment, as amended, be agreed to, the bill be read a third
time, and the Senate then vote on the motion to invoke cloture on the
bill; provided, that upon passage of the bill, the Senate then proceed
to Calendar No. 517, H.R. 3773, a bill to amend the Foreign Intelligence
Surveillance Act of 1978 to establish a procedure for authorizing
certain acquisitions of foreign intelligence, and for other purposes;
provided, that all after the enacting clause be stricken, and the text
of S. 2248, as amended, be inserted in lieu thereof, the bill be
advanced to third reading, passed and the motion to reconsider be
considered made and laid upon the table; provided further, that passage
of S. 2248 be vitiated and then returned to the Calendar. (Jan. 31,
