Waterboarding has become worldwide symbol of America’s torture. Even though you claim to be opposed to torture, you refuse to say anything about what constitutes torture. It’s like saying you’re opposed to stealing but not sure whether bank robbery would qualify.… You once again refuse to state the obvious. You refused to discuss that the Administration did use waterboarding and no one is being held accountable. CIA continues to use stress positions, every bit as abusive as waterboarding, illegal and ineffective. Would waterboarding be torture if it were done to you?
Marcy really pioneered the liveblogging of hearings during the Libby trial, and nobody brings the level of detailed knowledge and insight she does to this matter.

Oh, before I go, I read this morning on Raw Story that the President has signed a new Executive Order in which he directs the government agencies to ignore all future earmarks that Congress attaches to any new legislation (paraphrased.) Can’t the Congress then just refuse to appopriate funds to run the agencies that ignore the earmarks? Has anybody else seen anything on this?

So basically this is a confirmation hearing, except that they gave him the job first so there’s nothing they can do to him, right?

Every morning I wake up for the last few years, the distinct impression that overrides all is that I am in an insane asylum called America where up is down, and lies are truth as mouthed by paranoid schizophrenics, borderline sociopaths, and outright psychopaths. Kool aid is passed out every morning at 8:00 am and taken willingly with relish, and if you don’t take it the scene before you is so horror inducing that you wish you could take the kool aid too, but it is not an option that you want to exercise, because you know deep down in your soul that it is imperative that you stand, even if it is alone.

It’s just so jarring to watch this testimony in the context of the status of the PAA retroactive immunity debate.
Pressing for immunity is admission that multiple actors, obviously including the White House were acting illegally over the span of multiple years. “I can’t imagine a situation in which the President would act outside of statute…” my *ss. How can Mukasey say that with a straight face? Admin and major corporations violate the law…aw, whatever.
When are these guys really going to stand up and do something to hold people, anyone to account?

Can you be tested for being drunk with power? one of the symptoms is intellectual blindness inducing a rose colored view of reality having no basis in fact, and it seems to be endemic and no party line immune to its symptoms.
Just on the basis of the fact that Mukasey has, as a Judge, relied on evidence obtained from victimes of waterboarding to make judicial determinations should be enough for him to appoint a Special Prosecutor in the investigations.
Mukasey is personally affected by the outcome of this investigation, and is a potential witness.
His cases as a judge could be determined to be founded upon evidence that was obtained in confessions made under extreme duress. He was either deceived about this by the individuals that obtained warrants from him, or he knew and considered such torture as acceptable. In either case he is a witness, and his actions are personally subject to review.
He’s an interested party…and incapable of making fair determinations in the situation. He needs to appoint an independent Special Prosecutor.
