According to the Senate website, the schedule for this afternoon is as follows (Note: all are in ET):
2:00 p.m.: Convene and begin a period of morning business.
3:00 p.m.: Resume consideration of S.2248, the Foreign Intelligence Surveillance bill.
8:30 p.m.: Proceed to the House of Representatives for the president's State of the Union address.
We are planning to be watching every step of the way, and keeping you all informed as the day progresses.
First up in terms of voting will be the cloture vote that Sen. McConnell moved on Friday, regarding closing debate on S.2248. If the "no" votes take it, then there is a subsequent cloture vote to allow for a 30-day extension of the PAA, as I understand it, so that both the House and Senate can take time to go through the materials on NSA domestic spying that the Bush Administration finally turned over to the House Intel committee late last week. (Piles and piles of paper, which they have been pouring over all weekend, I hear.)
If that fails, then we are potentially back to debate on S.2248 and all of the proposed amendments that various groups have been trying to put forward to improve the bill -- or change it in some way, depending on the amendment. And we are again facing the potential of a Dodd filibuster, among other efforts to block wholesale passage of telecom immunity and basket warrants, among other constitutional and legal problems with the bill.
Or Sen. Reid could remove the bill from consideration altogether if the 30-day extension is not agreed to, the PAA would expire on Friday, and we would then go back to the FISA bill as it stood before this whole chain of idiocy began -- and we could start fresh with the House RESTORE Act as a base for negotiations potentially. Or any number of other scenarios that can be spun out from there.
Dan Eggen sums up the Bush WH position thusly:
A senior administration official, who spoke on the condition of anonymity because of ongoing negotiations with Congress, said lawmakers "have had six months to not pass a bill -- they don't need 30 more days to not pass a bill."
Say hello to Ed Gillespie, boys and girls, king of the non-substantive swipe -- I'd bet money on it. Never mind that he is speaking for an Administration that has stalled, petulantly threatened and tried to bully its way around every accountability moment despite their dismal ratings and lame duck-ish-ness, up to and including demanding immunity for their accomplices in the telecom industry so that no finger ever gets pointed directly at the real culprits in this wholesale lawbreaking: the Bush Administration and their neocon excuse-makers. (See, e.g., the WSJ. Nothing like fudging the facts and the law for your party's CYA, eh?)
A huge thank you to all of you for all the calls and FAXes. I have heard from a number of sources that Senate offices were getting multiple calls -- some were telling me in the thousands -- over the last week and a half on this issue. You guys rock. (But keep calling and FAXing, please, we aren't done yet!)
Whatever happens, we'll be watching along with you...and trying to liveblog as we move forward. We will no doubt be treated to an interesting day of debate and posturing from the likes of McConnell, Kyl, Hatch, Bond, and Cornyn, who will do their best to obscure the facts in favor of covering Dick Cheney's ass with their own rhetoric. But I have a feeling that folks like Sens. Dodd and Feingold -- who have done superb work on this issue -- will be standing up for the rule of law.

Just spoke to very nice, if a little nervous, staffer named David in DiFi’s office (thanks, Christie for the phone#) He says that she isn’t sure how she will vote, wants to listen to debate before the vote. I was very nice, thanked him for his work and willingness to pass my remarks to the Senator. Told him that listening to the debate this afternoon was not an excuse for not already having decided to vote ‘no’ on cloture, that everyone who had been following this issue already knew what was on the table and what was at stake, that immunity for the telecoms was simply an assurance for immunity for the administration’s illegal wiretapping of US citizens. I told him that the citizens of this country were desperate for the Dems to stand up for the Constitution and the rule of law and that by not doing everything in her power to convince other Senators to do the same was tantamount to saying to us that they were willing to let this administration break the law with impunity and abandon their oaths to defend the Constitution of the United States.
Won’t be the last time.

It would be a nice ‘natural experiment’ if Bush totally slammed smeared sullied and baited and lied about Democrats on FISA in his pathetic incoherent and dishonest diatribe, er… I mean, important dignified constitutionally mandated address tonight. And the Democrats stood their ground. I bet Congress’ approval ratings would go up if that happened.
I understand the importance of this but Hillary Clinton is irrelevant on FISA. She has done nothing to help Senator Dodd.
As a New Yorker, I am mortified that we sent the Clintons to the Senate as a springboard for the scurilous and pointless (lacking any social ultility) presidential campaign now being waged by the Clintons. Bill Clinton is a disgraced person by any reasonable standard and the Clintons attempts to tie Obama to dope dealing, fairy tales and Jesse Jackson ought to be enough for all of us to wish a for a world where the Clintons never made it to the national scene.

As Krugman noted a couple days ago, the folks on the upper income levels will sock away their stimulus checks, and the rest of us will use them to pay down our credit cards and mortgages. The banks will get all the “stimulus” and it won’t enter the larger economy.

Inaction and temporizing on FISA has given the lie to both Clinton and Obama regarding the first’s claim to battle hardened experience in getting tough stuff done, and the second’s vague calls for ‘change.’ Edwards not much better, to be honest. Both Clinton and Obama can partially redeem themselves by doing some leadership this week. Let’s hope and see what happens.

I diagree with Krugman today in NY Times. Much of poor recovery from last recession was due to poorly designed and ineffecive fiscal policy from Bush/Cheney. Now we are repeating that exactly. Also, some of housing bubble due to irresponsible, but perhaps necessary, improvisation on monetary policy to make up for bad fiscal policy. Now Bush/Cheney and GOP proposes to repeat that mistake in an election year. They are running a big risk of creating a mess right before an election when they are already in deep trouble because of bad foreign policy. They must have a poltical death wish.

I read on TPM last night Obama issed some kind of statement that he is against immunity, and will back filibuster. But he seems to be very quiet about it.

Do Senators take acting lessons? The vote was worked out over the weekend…Harry and Miss McConnell already know what the final vote on cloture is..but they still have yo put on the show. My guess is that cloture will fail and then Harry will ask for a cloture vote and that will fail then???????.

The latest indication is that Democrats will successfully block cloture on the bill today — and thus proceed to debate and vote on the rest of the amendments — but will fail to get the votes for a 30-day extension.
That’s a possibility. And it would have the Senate on the subject of FISA for a day or two until the parliamentary path became clear. The choice between SSCI and extension of PAA doesn’t have to be settled tonight. If Reid doesn’t get cloture on the extension, he’ll vote NAY and move to reconsider the cloture vote, so the Senate can have a cloture vote do-over on short notice. A Reid cloture vote do-over on short notice would be an attractive option if the Senate (Dodd) successfully blocks timely passage of the SSCI version later in the week, and the Senate becomes unable to deliver SSCI to the House.
The parliamentary posture will be crystal clear in a few hours. Interim debate gives hints as to when and where S.2248 is headed.

He just wants his amendment to be voted on. He knows it would be voted down, so debating and voting on the amendment is harmless to the administration. He gets cover from all angles, being against retroactive immunity (sort of, see quote above), but not stepping on the administration’s crank.

I’ll send you all the cookies you want. Specter’s office was telling callers earlier today that he would vote no on cloture. I suspect Haggis will do exactly that. Then when push comes to shove further down the road he’ll support immunity. His no vote on cloture will be safe, and he can go back to his constituents and tell them how independent he is…
Scottish Haggis upset that his amendment won’t be considered and so will vote against cloture. It’s not that the PAA is awful legislation. It’s that McConnell has hurt Specter’s feelings.
