(Note — I cannot imagine there will be any Democratic defections on the extension. There probably will not be 6o votes for cloture because the GOP does what George Bush tells them and there would need to be some Republican votes to get there, but with the House passing the 30 day tomorrow if the protections in the PAA lapse on Feb. 1 it would be on the hands of the Republicans. No doubt that’s why McConnell blinked and said he would consider a "short extension." — jh)
Cloture on the 30 day extension fails. The vote was along straight party lines. It was one of the most brazen things the Republicans have ever done in the Senate, refusing to pass an extension of protections they are always telling us are "vital" to American security — for purely political purposes.

Tomorrow, the Senate will take up the subject of the Intelligence Committee version of the FISA bill again.

The key here will be GOP defectors. Need quite a few to hustle the Senate’s version off, but even if this fails, the House bill will be in the hands of the Senate later this week.
It looks pretty clear that Congress is going to deliver a 30 day extension to President Bush.
It begins to look as if We the People need to prod these folks day by day, hour by hour. They only vote sensibly when we’re watching and supervising every minute detail!

Who will be giving the Democratic response tonight?
The Senate will have three options to deal with after tonight, basically deferring a decision to send an extension to the president.
One option or path is to amend S.2248 under some sort of mendment/vote threshold deal, and have that done, sending the SSCI bill to the House before Friday, so Speaker Pelosi can give it the royal treatment.
And if it’s clear later in the week that THIS sequence isn’t going to happen, it can take up and pass the House-passed 30 day extension. Which would be law if signed by the president.
Or, in the alternative to the 30 day extension, the Senate can create and pass a shorter extension and punt that to the House for its concurrence.
I pick door No. 2
Apologies to Ron Wyden; I thought someone had listed him as an “aye” before. FWIW, the Vermont State Democratic Committee on Saturday sent a very strong resolution to our Senators urging them to do everything to defeat telecom immunity, including filibuster. The summary of the resolution pointed out that the language of the Intelligence Committee bill is such that if at any time in the future any administration member (of any administration) were to order the violation of a law, using certain specified language, the unlawful action would thereby become lawful. Say what? Somebody says “illegal is legal,” and that makes it legal? This bill is much, much worse than we’ve been led to believe!

I suspect that tonight Bush will be unveiling the Vote for This Bill or I’ll Brand You an Islamofascistcommunistnazi Act.

We were expecting the debate on FISA to continue tomorrow. The bill on the floor is still the Intelligence Committee version; there is an amendment from Bond and Rockfeller still pending, because the cloture vote on it failed (the first vote tonight). There is no proposal for an extension as this point, because the second vote on cloture also failed.
So tomorrow, they start on the debate again, on the SIC version, with no extension; amendment can be considered (I think), but there is no agreement on whether amendments require 60 votes. At this point, they still don’t, but to close off debate on any amendment, you still need 60 votes. Transparent, no?

I got the impression this morning, when some White House somebody said the prez was gonna call on congress to pass (the right) FISA legislation that they were expecting a loss on today’s cloture vote.
And lose they did.
The vote for the Intel Bill was 13-2 with only Wyden and Feingold voting against it. I see two people doing a good job there. The rest including
alleged Democrats Bayh, Feinstein, Mikluski, and Whitehouse voted for the Intelligence Bill to go to the floor. They were part of the Cheney coverup.
I’m surprised and disappointed that Bush has lasted this long without a public meltdown. They must have him on some serious tranquilizers.

NO EXTENSION! There is no need whatsoever for an extension because A0 the Administration can order any comprehensive program or programs they want prior to the lapse of the PAA and that program(s) will stay in effect for one full year; and B) the original FISA law is reinstated. Furthermore, passage of any extension is a wolf in sheep’s clothing because is equitably removes and/or weakens many arguments and defenses that opponents to the PAA had from it’s original passage in August 2007. At the time of the original passage most congressmembers voted based upon false and misleading facts provided by the Administration, McConnell and Hayden, voted under a false fear that the country was in jeopardy of an imminent attack (another direct lie), were not aware of the secret memos produced by OLC that were legally indefensible, etc. If they now vote to extend the PAA, they not only effectively remove all those germane defenses/explanations, they also give credence to the position that there is some merit and legality to the PAA. There is absolutely no need for an extension and passing one weakens our sides position. THERE MUST BE NO EXTENSION.
A minimum is for them to write IC on the back of their prepared text and hold it up everytime he says Democrat party. Wiki says he does it every time. Did it lasts year.

if Harry Reid had any cujones, he’d withdraw the Senate Intelligence Committee bill, and introduce the House bill… demanding its passage without amendment, because the House will be on a retreat as of tomorrow, and a conference committee won’t be able to convene…and the House won’t be able to pass the conference committee version, before Friday.

The Obama camp leaked it to the media, but the actual endorsement, according to the news stories, will be made public tomorrow or Wednesday.
Thus, the folks in Topeka are telling the literal truth — but it’s apparently a done deal.
Long view is less hopeful: I fear that Reid will lose his spine [thus losing the blu dogs] as the days approach Febr deadline and some of those 12 votes will creep in.
How many? As the numbers creep towards 60 in a self-fulfilling immolation that Reids on himself [and us] he will accede – perhaps to a one-day or three-day peace offer by the MAN he perceives to be more powerful than him – McConnell – and after that he will fold entirely at or near or just after the Febr deadline.
Since we can see that Reid has no internal spine, the Q remains – will Hill and Obama and Kennedy and others forcefully lobby and force Reid to keep his spine strait, so that we can keep Repubs from getting their 12 votes back? I am inclined to agree, though I have indicated a propensity for being in the mood to hear some Bush propaganda (Hearing what the opposition is up to, and all that). The feeling here is that perhaps there is room to maneuver on this issue. Maybe some sort of compromise may be in the offing.

There is no proposal for an extension as this point, because the second vote on cloture also failed.
No, that amendment is also pending (see Daily Digest of Jan 25 for the short list of pending amendments, in proper order), and will be the first one set aside to take up further amendments. Just like the Bond/Rockefeller amendment, failure to obtain cloture does not dispose of the amendment.
If the Senate bogs down during debate of S.2248, on amendments not yet pending, and if Dodd insists on another cloture vote before voting to pass S.2248 (he’d better do that), then S.2248 can’t be ready until Friday at the earliest. Here’s the timetable:
Some debate tomorrow, things move along, and there is a request to schedule a vote on S.2248. Dodd objects and McConnell files another cloture motion. That cloture vote happens Thursday morning, then 30 hours after that, if cloture is invoked, they get to the vote on the bill. That would be mid-afternoon Friday. It can’t happen.
A short extension gets around that objection, and could set things up for the bill (S.2248, not the extension) going to the House early next week. But Dodd can bollux that up too, by objecting to vote on a short extension, and insisting on the 30 day extension. Likewise the House could signal unwillingness to do a short extension, based on a desire to review the document dump and inject that into the public psyche via debate.
Oh I agree bmaz, but good luck to you (well, us obviously) since Reid is so d*mn busy telling the country how bipartisan he is just dying to be. No cloture on an extension today so Chimpy gets to stamp and scream tonight and the Rethugs can use it in 30 second spots this fall. But, I think we need to stay on the phones, faxes, and emails to actually get the Dems to carry out their oaths of office…

It can’t happen.
“It” being getting a Senate-passed S.2248, from Friday afternoon, to the House, and the House passes it unamended in time to get it to President Bush, also on Friday.
Anyway, I figure the 30 day extension is the most likely avenue, as Congress has as much need to save face as President Bush does.
Some real leadership from the Dem Prez candidates would work wonders in the next few days. I am going to contact them and tell them that if they want my vote, they need to fight back hard against GOP propaganda. Let us see what they do.

Before the last election we heard much about his lame duck status. Now that he is truely a lame duck we need to use that phrase frequently, remind the people he is on his way out and that is why (historically) he won’t get much done. I am tired of hearing about him sprinting to the finish. (Lame)Duck season is here.
