It is a portion of the FISA statute that says the only permitted procedures/justification for snooping for foreign intelligence information are contained exclusively in the FISA statute. It’s an attempt to say that there are no residual “executive powers” in excess of the snooping parameters described and defined in the statute.

A “Motion to Table” is not debatable, by Senate Rules, and therefor needs on a simple majority to pass.
McConnell objected to Feingold setting aside the pending amendment, to make room for offering one of his. Feingold’s move didn’t fit with Senator Reid’s intention for procedure (timing mostly), so McConnell’s objection wasn’t necessary.
It’ll be interesting if Republicans object to taking up amendments. That sets up time delays from a different angle, an angle that is tougher for Reid to manage in that Reid wants Feingold and other amendments to come to the floor and be rejected fair and square. If the GOP objects to the amendments even getting to the floor, Reid won’t want to file a cloture motion to advance the bill — assuming Dodd, Feingold or somebody else is putting the brakes on.

Rockefeller’s amendment seems, to me, to “give more privacy rights” to Americans outside of the country, than pertain to Americans inside the country. (scare quotes, because I think privacy rights exist outside of statutory enactment)

I think Reid also voted AYE. If I heard correctly, he entered a motion to reconsider the vote, and he needed to be on the prevailing side in order to do that.

Even though Jello Jay is up there trying to allay some of the concerns who might vote against the bill, trying to cut the legs out from under the oppopsition, it’s a *good* sign that he and Bond are having to do this at all. Remember, he was pretty sure they’d get what they want, and I thought he was the one who called for the 2 pm vote. This may be a sign that things aren’t going according entirely according to plan for them, too.

I’d bet Brian Lamb has a lot to do with choosing the music. It is usually very descriptive of the tenor of actions on the floor, often not complimentary at all, in the gut-level feeling it brings. This choice today was a bit to perky for events, but still helped cheer this aging musician.

I usually use something like, I am an ordinary American (true) and I don’t understand why you would choose lots of campaign goodies over protecting the rights of ordinary Americans and the rule of law and the Constitution (very true).
