Harry Reid is anxious to get it off the table so Senate can get out of town:
We have to finish FISA this week. Everyone should be aware of that point. We have to finish it this week. I know there are important trips people want to take. We have the very important economic conference in Davos that Democrats and Republicans alike would like to go to.
If it does come down to a filibuster (after the Dodd/Feingold amendment to strip retroactive immunity is defeated, which it almost certainly will) we’ll be here for the long haul. So stock up on popcorn, grab your pjs and join us here at FDL tomorrow for something Republicans, whose holds are always honored, never have to do.
In the meantime, consider this an open FISA thread.
Edwards is also going to be on Olbermann tonight — so we’ll be having an Olbermann watching party.

Procedurally, what is pending is a Leahy substitute amendment – which is the version as passed by Judiciary. The pending substitute amendment does not include the telecom amnesty, and it has other features that the administration will certainly object to.
Before cheering this development (the bill is in a different procedural posture than it was in last December, when the Intelligence Committee bill was pending, and the immunity would have to be stripped out), Senator Reid has suggested that the substitute amendment be disposed of by a motion to table.
A motion to table is a parliamentary “nuclear option.” It is NOT debatable, so there is no way to empower objection to voting on a motion to table. Because a motion to table is not debatable, there is no lay for the cloture process. A motion to table carries with a simple majority vote.
Under a threat of a motion to table, the only device I know of to burn time is to hold the floor so no other senator can make the motion to table.
Has anyone mentioned Kennedy or Sanders position?

I worry that Dodd or Clinton or Obama can hold together on this, also that Dodd not going to Davos could be quite a shift. Oh the fun they are all going to have. I pick that both of them duck out of town or do not even show. If they do and the new majority does not go to Davos…well that is not going to happen. Dodd is also from a banking state and chair of some good stuff.
To bad the Dem presidential front runners have nothing to say new on fixing this stuff other than short term consumer tax rebates, and have no articulated plans/vision for what sort of things they will do and change the way the system works. If they skip of for wine and cheese and more of the same that is going to be a problem – especially with barely passable answers on Presidential powers and Presidential records. Davos is like damn they are all going to go and make up lies and everyone knows it. Well good like with making history if you can do it. Good luck with thinking past Bush – I mean the Dems don’t even commit to things because they claim – who the hell knows what will be happening in 1 year do to Bush – but do nothing to try and check him or impeach.
Somehow I doubt they are holding out a super duper secret plan to not get the Bush criminals until after he is out of office to avoid any pardons they can – and then they are going to dig up the Constition and tack it back on the wall (at least dust it off a bit for God sake).

Simple solution to all of this is that they allow retroactive immunity to be stripped from the FISA bill, give their own base, us, whatever we want, and finish the bill to our satisfaction. That will get them all out in time, no problem. They needn’t point fingers, but they should know that if they do, I will point back.

When I called Sen Rieds office. The staffer said he supports Sen Dodd in his filibuster and doesn’t want Tele-com immunity. I laughed and asked why did it get to this point then. Staffer told me there was a vote before Christmas. I asked why the Senator Ried allow that vote to come to the floor or why Ried let thi bill just sunset or why he forces Senator Dodd filibuster and not republicans. The staffer said and I quote, “Senator Ried does not support tele-com immunity.” I said that does not answer my question. (crickets) I gave him another chance. No answer. I then told the staffer maybe its time for the Senator to step down and let some real leadership in like Seator Dodd. I thanked him. Recieved no reply and hung up.
I wish someone would ask George H.W. Bush if he still thinks it was worthwhile pulling all those strings to get little boots that MBA.

You know I’m just a brain in a box, but over the holidays I thought about other avenues I could take to counter the telco lobbyists pushing for retroactive immunity. I wondered:
* How much is retroactive immunity worth to the telcos?
* How much do they think it would cost them if they DIDN’T get it?
* How much are they spending to get it? Who is getting the money?
I did some research and found out the names of a handful of financial analysts and market analysts that the media call when they want to get a quote about telcos. These analysts might not be the best, but they are the ones that the media call so their word might have a bigger impact in the minds of the media.
It might be interesting to contact them and ask them:
1. What would it cost the companies if they lost this retroactive immunity fight?
2. Is the loss of this fight factored into any financial models?
3. Do they know about the efforts being made to battle immunity in the blogs?
4. Are the bloggers who can mobilize a group of people even part of the equation or are they discounted in favor of “real people.” aka lobbyists?
I’ve found that when your actions impact the money making ability of a corporation the corporation responds. Our actions might cost the telcos money. This act can be identified by the media and it can move the story into a new angle. An angle that doesn’t have to be about republican and democrat but about losing money or making money. People going to jail or staying out of jail.
Pointing out that it’s not just about the principles but the money is something that might get “real people” to understand the lengths that the telcos will go to get the retroactive immunity.
It looks like his speech on the podeum is about two inches thick. Quick, somebody get him a losenge, he’s gonna need it.
There is no doubt in my mind that Dodd gets it!

It will just go down, hopefully not much more than 20% from peak. Also the stock markets are just one small part of the us/global econ. For US 73% consumer spending, etc. Its all those houses, construction, banks, the people that got stuck with those AAA rated bonds that might be worth nothing on their mortage assets, etc. Lots of range in the US econ, and lots of range in the global econ.
Also lots of Countrywide walking out of a failed corp with 110 million – as 1 is a hell of a lot.

I didn’t hear a threat; if he starts with the assumption that he can draw in Republican/Independents that she can’t, then it would follow that if she’s the nominee, she might not get all his supporters.

I really like John Edwards. Obama lost my vote with his comment tonite. It was like a little GOP attitude coming out there….Sounds like he is much more interested in himself and not taking the country back. I’m sure he’ll say it was taken out of context though. I will not vote for him.

I didn’t hear a threat; if he starts with the assumption that he can draw in Republican/Independents that she can’t, then it would follow that if she’s the nominee, she might not get all his supporters.
However, he could have said, “if she’s the nominee, I’ll do everything I can to bring my supporters to support the Democratic ticket,” but he didn’t. The question he was asked didn’t invited that, however.

IIRC, at that time both Edwards and Hillary basically said of course, what a stupid question. Obama said Hmmmmmmmm.
Each candidate is making some version of the argument, “only I can win.”
Obama = only I can get the Repubs and the Indies
Clinton = only I can withstand the vetting in the general campaign
Edwards = only I can attract voters in certain states that allow me to beat McCain.
So each is also implicitly saying that if the others get the nomination, they may not win because they can’t overcome the hurdle that only he/she can.

Not sure on spoliers from KO since its news. But Bill Clinton went off on the media (partially for good reason, not covering issues – but kind of pot calling the kettle out) – then he sort of ground at the specific person as well. He they did not answer a second question and scolded them for trying to get two stories out of it – just one – just one – as he walks out the door.
No big deal, but more media push around on all sides (and by the media as well). I just do not see this sort of scornfull lecture is going to draw many people, especially if the supporters want to focus on the strength of Hillary Clinton (and do not think that Bill is one).
I just wish they were willing to call out how the media operates when it matters.

I learned this the other day: with the new FDL system, you have to enter a name for your link, highlight the name, then click on the “chain” at the top of the window and enter the URL. The result will be the name you gave it, in red, which contains the link. If you just click on the chain and enter the URL, nothing happens, you get no link. IIRC with the old site it would prompt you for the name after you entered the URL.

One thing that I learned while working for Dean’s campaign is that I am not the mainstream voter, and it was a very frustrating but insightful lesson to see what people expect in a presidential candidate.

When HRC and Edwards were offering ideas to boost the economy, he offered none but said that it would be him that would be implementing those ideas a year from now. Arrogant, confrontational, demeaning, and a little on the lazy side too. Really didn’t sit well with me.

Not at all. I think most of JRE supporters (including myself) are deeply committed to our candidate because we believe he is right on so many issues; because we believe he is speaking the truth; and we believe he is the only one of the three who is not paid for by lobbyists and special interests.
My comment was that JRE’s supporters would not automatically default to Obama, were Edwards to drop out.
I don’t agee. I think quite a few may. If McCain gets the nod, he is looking so over the hill, there are lots who will say, forget it. And he has all those negatives with the fundies. If it is Romney, the latter just looks slick. Obama conveys candor, straight forwardness. I also think that the country would love to ave someone who reallyknows how to speak English (unlike McCain or Romney -McCain said “my friends” about 100 times in NH.
Turns out Kerry isn’t so safe, is he? I spent so many hours on his campaign. So disappointed now.
