I’ve stumbled across this story a few times and don’t know if it’s true. More to the point, I don’t know if this incident occured but in a very profound sense it’s true.

During FDR’s funeral in Washington a reporter noticed a soldier standing guard at the White House. Tears were streaming down the young man’s face.

The reporter asked: Did you know President Roosevelt?

The soldier replied: No. But he knew me.

When my mother and father spoke his name it was with a noticeable reverence.

Great post… this was another of the NAFTA type deals Clinton went for
that gutted his own political party’s legacy of moderated capital
markets. Somehow his Arkansas Junior Civitan’s version merged with the
Houston Petroleum Club version to give Wall Street it’s pre-1929 dream
another go. Look where it got us… too bad the US Presidency and a
cable television show have become a 12 step destination, but let them
keep talking, I think people have figured it out, reality has intruded
into the process and isn’t responding to talk.

What we have is a mess of federal and state jurisdictions. The securities are governed by federal law, but the only way for federal courts to get jurisdiction over a foreclosure is through the bankruptcy courts. There are some definitive Supreme Court cases on this matter, most recently the BFP case authored by Scalia (I abhor Scalia, but this is a pretty well reasoned case).

As a peripheral issue, the federal Fair Debt Collection Practices Act can be used to protect a debtor facing foreclosure (by seeking money damages for abusive collection practices), but that should not be confused with the power to suspend, delay, or nullify a foreclosure action. That remains exclusively under the control of the states, except for case-by-case situations under the bankruptcy code.

Clinton talks about a foreclosure freeze. That may or may not be a good idea, but short of a constitutional amendment the federal government can’t make that happen.

Reading the FDR comment, reminded me that yesterday I heard that 60% of Michigan still support the war!!

That doesn’t seem to match up with what I recall hearing. Are you sure it wasn’t 60% of Michigan Republicans?
