On Wednesday, Senate Judiciary chairman Sen. Pat Leahy (D-VT) will hold a full committee hearing on the nomination of Mark Filip, a federal judge in Chicago, to become the Deputy U.S. Attorney General.

Great post, Blue Texan. Funny thing is, I remember Romney’s campaign (vaguely, I had other concerns in 1968), but I don’t remember anyone even batting an eye at his Mormon faith.

Speaking of HRC (slightly OT I know), I read an interesting bit in the Economist the other day (12/15 p77) that was a piece about Peter Chernin, the COO at Newscorp. It was mentioned as an aside that he’s “helping Hillary Clinton’s presidential campaign”. A little searchy found that to be so.
I for one would prefer that our candidates not get that sort of help (tainted Murdoch money).

George Romney was not only a Mormon, but he was born on a Mormon mission town in Mexico…some say established outside the US borders to maintain polygamy. Technically he was the first Mexican-American candidate!
If he had been elected he would have been the only US President ever to be born outside the United States…but some have argued that it would have posed a Constitutional crisis because of the provision that a candidate be a “natural born citizen”. Others argued that George Romney was both since his parents were technically US citizens (though also Mexican citizens).

The “no ex post facto law provision inthe Consitution has always been interpreted to prevent criminalizing behavior after the fact, that was not criminal when committed.

Fascinating CA! I was wondering when Mitt’s dad was going to be brought up because I do remember him being a liberal, but I didn’t know his early background. The one thing I do remember about the “natural born citizen” clause was that when Goldwater was running in ‘64 (I was in 6th grade BTW) people were saying he couldn’t be pres because he was born in the AZ territory - before it became a state.

Ex post facto deals with increasing a penalty or instituting a criminal act AFTER THE FACT. It does not deal with reducing penalties after the fact, which, of course occurs all the time.
People frequently have their sentences commuted or are pardoned when a law is vacated from the books by the Courts or the Legislature. And there are many cases where a President has issued mass commutations or amnesties. Washington did it for many of those convicted during the Shay’s and Whiskey Rebellions. Lincoln did it when he suspended the punishment of hundreds of thousands of ex-Confederates that signed loyalty oaths. Carter did it with VietNam draft evaders.
Don’t think that approach is gonna fly Perris. But one could argue that the PROPER Constitutional power for this sort of amnesty lies with the President, and doesn’t require Congressional approval. But if the President pardons
the individuals are incapable of pleading their 5th Amendment right to not testify against themselves in criminal matters…and thus could be compelled by Grand Jury or Congress to testify.

I don’t think Perris is nearly as concerned with criminal prosecutions of the telecoms as he is in citizens being deprived of their right to, in *civil* litigation, recover for actual damages incurred, should they be capable of proof, and problems of standing overcome, etc.
I think he makes a good point. And, as devil’s advocate, if the telecoms *did* have proper and legal justifcation for their actions, or if a particular compnay were to turn out to have had no involvement at all (but would still suffer damage to its reputation on the assumption that it did), those rights might well be improperly taken away, by mooting the case(s) in which they’re involved.

I think most Constitutional Scholars accept that “Territories” qualify for “natural born” status since they are underv the sovereinity of the US. Thus, McCain, who was born in the Panama Canal Zone can be President. I think that there a few other candidates born in Territories before they became States (plus one or two in “Possessions” like the Philippines). But George Romney was definitely a very debatable case. But many Constitutional lawyers (IANAL) argue that anyone that qualifies under the two general provisions that do not require “naturalization” are “natural born” (those are jus soli [born on US territory] and jus sanguinus [born of US blood]). George Romney would have qualified by the latter.
BTW there are several US Presidential candidates in the past who may not have fulfilled the “continuous residency” requirements for President as well.

I must be a little dense because I’m not sure I understand this. Are you saying that a Presidential pardon is like granting immunity? Because immunity is the only thing I heretofore have ever heard of precluding a person from claiming their 5th amendment right. If it’s not like immunity, what probable cause would you use to subpoena an individual to bring him in front of a grand jury if he’s already pardoned of the crimes? And what kind of pardon? See what I mean, I just don’t quite understand.
The pardons of Confederate soldiers were issued by Lincoln and Andrew Johnson…although they were authorized by Congress under the laws enacting the penalties of forfeiture and fines to those involved in the insurrection. The President would have had such powers in any case under the Constitution though.

Candidates were still nominated in the party conventions. Kennedy’s religion really wasn’t debated until after he was nominated. Then all of the sourthern pastors started sermonizing about the Pope dictating policy for teh U.S.. I was dating a girl from the largest Baptist church in the world, First Baptist in Dallas, and the Reverend W.A. Criswell delivered long anti-Kennedy/Catholic sermons every Sunday.
Likewise, George Romney hadn’t really gotten close to being nominated when he withdrew due to the “brainwashed” statement. If the Republican convention had nominated him, we would have heard some of the same fundamentalist arguments.

Once one receives a pardon or commutation for a criminal action one is no longer susceptible to punishment for that crime. Thus one could be called before a Grand Jury which is investigating OTHER individuals. Take, for example, Lewis Libby, HE could be called upon to testify against others and not be able to utilize his 5th Amendment defenses for the crimes he had already been convicted and pardoned for. Libby insisted on appealing, which held up the issue for a time…but he is NOW susceptible to GJ testimony on any points he may have plead the 5th on during his testimony.
Similar someone already convicted and pardoned cannot be tried again on those charges…and thus can also be called before Congress regarding that case. They are not susceptible to criminal charges anymore, thus are not able to say their testimony can lead to punishment. Congress need not even issue “use immunity” to that individual. However, if they lie or refuse to testify they can be convicted of perjury or Contempt of Congress (or Court).
