It is a single sentence, on page 147 of the annual appropriations bill funding the White House, listed under the title "Additional General Provisions.”
The 18-word clause eliminates the money to pay for political appointees in each federal agency whose jobs are to approve any new regulations. By cutting the money for the positions, Congress would effectively repeal President George W. Bush’s 11-month old initiative.

Democrats are also using a tool known as "limitation” — which prevents an agency from spending money on a specific activity — to try to kill Bush’s Jan. 18 executive order requiring proposed regulations to be vetted by appointees in each agency.
…Inserting the limitation in a must-pass budget bill, [Democratic Rep. Brad Miller] said, would cut off funding for Bush’s order. "You can’t use federal money, period,” said Miller.
I love this. It’s completely below the radar, it probably won’t net the Democrats a single extra vote in 2008, but it’s The Right Thing To Do. It gives the federal agencies much-needed freedom to protect workers, consumers, and the environment from unaccountable industries run amok.
Granted, most agencies are probably too rotten with Bush appointees to use that freedom, but we have seen plenty of loyal Bushies suffer from attacks of conscience over the last 7 years. So if one of his hand-picked agency heads snaps and suddenly decides to start regulating, there won’t be a Bushie loyalty officer (The All-Seeing Eye Of Froomkin called them commissars) there to reel him in.
It will be interesting to see if Dubya is prepared to veto the entire spending bill just to block this one provision, or if he figures the agencies are sufficiently loyal even without his minders in place. It will be even more interesting to see if the Democrats become emboldened when the sky doesn’t fall, and start resisting on a more visible and significant level. Who knows, maybe they’ll even become comfortable with the concept of defunding.

How I wish it were so. But at this stage, they owe us some sustained courage. I will have their back in that event.
Let me see if I can get this straight. Congress controls the purse strings, but:
AP – President Bush and congressional Democrats are locked in a struggle over Iraq spending, with neither side budging and each calculating that its argument will be the one to resonate with voters.
I’m hoping that it’s *not* so; that they would have done this even if they knew the Republicans would scream bloody murder about it.
Never underestimate the ability of the Democrats in Congress to fold up like lawn chairs. Particularly if anyone is watching them.
But, Eli, won’t a Signing Statement simply add it back into the Omnibus Bill…?

Actually Eli, I think the key is that it is de-funding the zampolits and calling Little Boots’ bluff about how the power the Congress has is the power of the purse.. Congress is saying, “Yep, you’re right and we ain’t spending any more money for your BS here.”

He can divert funds within each Dept. as he sees fit! As long as the funds are available to the Dept… Past Signing Statements have supplanted many of Congress’s explicit intent… 8-(
Does anyone else find this absolutely sickening and among the scariest things done by this regime? They’re appointing political orthodoxy officers to enforce party loyalty throughout the Federal government… a tactic of every wouldbe despot since Caesar.
Why would there be political appointees in government agencies? Well, I know why, but why would this be legal?

Well, the “limitation” means that he *can’t* do that. But I guess that’s what he could try to negate with a signing statement.

What the Democrats should do (as we have often said here) is to propose a bill that funds the troops but stipulates that these funds can only be used to withdraw them from Iraq. If Congressional Republicans obstruct, Democrats should hammer them for not supporting the troops. If Bush vetoes this, Democrats should change a comma and resubmit the whole bill and hammer Bush and the Republicans as often as needed.
As it is, Republicans spike Democratic efforts with impunity and no threat of consequences.
Will the Democrats do this? Not unless they find a spine someplace.

I have never understood the purpose of the commissars anyway. Are they in place to ensure that the Secretary and his/her large Secretariat in every Cabinet Department, or the Bush-appointed Director in the case of subcabinet agencies, stick to the party line? Isn’t that the agency head’s job? Does the Cabinet need to be watched so closely that each member gets a minder from the White House?

You could call it preemptive disappointment – something Red Sox fans perfected for 80 some years before 2004. Goes well with samonella chicken or pork. An acquired taste, but once acquired, nearly impossible to shake.

The regs that are coming down the pike at many of these agencies favor corporate interests. Even so the worst of these can be held up in courts until after Bush leaves office. The part of the Executive Order that I found most disturbing was having these zampolits (I like that dakine1) sign off on employee evaluations and hires.
Today was a good day. Even Dan Abrams seemed to cross over from the darksyde. He just hit the ceiling about the NIE, citing lying, lying, lying…I think he just woke up!! Rachel Maddow was outstanding too, of course.

OT — We just had a runoff election for alderman in my district. There’s no party affiliation, but the guy who got his name splashed all over the local paper for stealing his opponent’s lawn signs and/or bribing people to take them down and put his up got STOMPED. I think the tide has turned. People are less afraid to challenge this administration. And Bush looks like he’s aged. All his past screw-ups didn’t faze him but it seems like being challenged is bothering the boy-king.

I would like to be optomistic here, but there have been so many letdowns that I am reserving my Snoopy dance for now. The whole signing statement scam has worked great so far, why should he stop now? Bush can do what he damn well pleases, when he wants to and so far there have been no repercussions.
And shelling out bonuses, too… I’m sure Blackwater has performed admirably… WTF?

Wish I could take full credit for the term but recall seeing it used by others here at the lake and this is the primary usage; from the old soviet to describe the political apparatchiks who watched everyone to assure their loyalty. That seems to be exactly what these political appointees were doing.

If boosh tries to use a signing statement to neutralize this provision–or chooses simply to ignore it–the obvious check and balance called for would be impeachment. That’s what the founders intended. Why is it “off the table”?

had a surreal experience today… in NY on business. A newstand guy on the street was throwing out stacks of old NY Posts.. with a visible section headline “No Civilization Here! Islamonuts…” I think an article about the Saudi rape victim sentenced to flogging. A homeless guy snatched up a pile of papers with the headliner, tore it up and started shoving it up his pamt legs… to keep warm in freezing weather. Civilization indeed.
