Federal officials are routinely asking courts to order cellphone companies to furnish real-time tracking data so they can pinpoint the whereabouts of drug traffickers, fugitives and other criminal suspects, according to judges and industry lawyers.

In some cases, judges have granted the requests without requiring the government to demonstrate that there is probable cause to believe that a crime is taking place or that the inquiry will yield evidence of a crime. Privacy advocates fear such a practice may expose average Americans to a new level of government scrutiny of their daily lives.

Such requests run counter to the Justice Department’s internal recommendation that federal prosecutors seek warrants based on probable cause to obtain precise location data in private areas. The requests and orders are sealed at the government’s request, so it is difficult to know how often the orders are issued or denied.

However, the court records do reflect – and city utility documents appear to confirm – that the manner in which Austin police developed a case against Colby, and against at least three other persons, was questionable and possibly based on an illegal search. Colby’s lawyer, David Dudley, argues that APD Detective Jeff Haynes used energy-consumption information from thousands of Austin Energy customers – without those customers’ knowledge or consent – in an effort to find and focus upon AE customers who, in Haynes’ opinion, regularly consume more kilowatt-hours than he believed “typical” for the size of their residence. I was over at LGM the other day on a thread about 2nd amendment issues and commented on the inherent stupidity of rightwing interpretations. Give the wording of the actual amendment, either the “right to bear arms” is restricted to state militias (think the Swiss model) or there can be absolutely no restrictions on the right of individuals to buy weapons. Want a howitzer, rocket launcher, tank, battle ship? If you actually believe that the amendment refers to an individual (as opposed to organized state militia) right to bear arms, then you have a right to own them.

Most LEAs do Suz and they have been horribly betrayed by this administration is so many ways. It encourages the few bad apples and tarnishes the credibility of all law enforcement. FBI and CIA have always been sort of loose canons (at least at the top), but elsewhere there has generally been some respect for the rule of law.

maybe was just my dept, but we had high standards, were among the hardest to get hired at in the bay area. ethics were drilled into us daily, during briefings at the end of shift, by having an IA sgt come down to briefings quarterly and update everyone on every completed IA investigation (no names)and what the results were, including punishment up to and including termination.

I believe that Sanchez is a very patriotic guy who always wanted to do the right thing. What will get his neck stretched is the fact that he didn’t pay attention in his seventh grade civics class. Brazil shock at woman’s jail rape

Authorities in Brazil are investigating reports that a young woman was left in a police cell with some 20 men for a month and repeatedly sexually abused. The governor of the state of Para, where the reported case took place, has promised a full inquiry.

Governor Ana Julia Carepa said the age of the woman, put variously at 15 and 20, was irrelevant as she should not have been jailed with male prisoners.

Good Morning. Marion must be sleeping in but I hope that she wakes in enough time to watch Jane. I’m enjoying my cup of coffee with a slice of pumpkin cheesecake that my son made for yesterdays festivities. I went to Macy’s bright and early to purchase a leather coat that my son has been eyeing. Parking was easy and the checkout line small. Not a good sign for the holiday season I fear.

I was over at LGM the other day on a thread about 2nd amendment issues and commented on the inherent stupidity of rightwing interpretations. Give the wording of the actual amendment, either the “right to bear arms” is restricted to state militias (think the Swiss model) or there can be absolutely no restrictions on the right of individuals to buy weapons. Want a howitzer, rocket launcher, tank, battle ship? If you actually believe that the amendment refers to an individual (as opposed to organized state militia) right to bear arms, then you have a right to own them.

Plus cutting out the “In order to” part…ignores the entire PURPOSE of the Amendment. It wasn’t to allow people to have guns to defend their personal property, or to have weapons to turn against the government.

Such facile interpretations also ignore the Totality of the Constitution which clearly defines that Congress has the power to establish regulations and rules for the militias and that the State gov’t appoints the officers. Members of the militias were registered and ready for service, to SUPPRESS INSURRECTION AND INVASION.

There goes the idea that the militias exist to foment insurrection, Huh!

I’ve finally risen from the dead, only to face Bobo in the NYT. It’s Bobo and Krugman today. Bobo says that someday Rudy Giuliani will look back on this moment and wonder why he shelved one of his core convictions and didn’t run as himself. Mr. Krugman calls his column “Banks Gone Wild,” and says the subprime crisis and the credit crunch are the result of our failure to effectively reform corporate governance after the last set of scandals.
