There are days when I walk around with an idea for a post all day. The idea usually comes to me while I’m having coffee or feeding the cats in the morning and I turn it over and over in my mind for a few hours. Generally by the time I get to work, I’ve got a pretty good idea about what I’m going to say. Sometimes I’ll call Jane or Pach and bounce some ideas off of them and get to writing once I’ve handled the day’s paperwork and (mostly) cleared off my desk for the night.
However, some days I think I’ve got the post to end all posts lined up in my head and I will discover to my shock and chagrin that Digby or Glenn Greenwald has already written about it, and I’m totally hosed. Approaching a topic after one of those two has already handled it is kind of like approaching the all-you-can-eat food bar at Ryan’s Steakhouse after Rush Limbaugh has come through. There’s, like, nothing left.
It reminds me of something I said months ago (with apologies to Dorothy Parker):
I had finished this post and put it in for publication when I went over to Digby’s and read what I meant to say said better. We need a verb for that. “D’oh! I got Digby’d!” which means, “I felt I had something terribly important to impart, but then Digby said it so much more eloquently that I am forced hang my head in shame and go back to eating pudding cups on the couch.”
Oh, sagacious Digby. You are the most emphatic Still Small Voice I’ve ever heard.
When compelled I am
To try an epigram,
I never take the credit.
I simply say that Digby said it.
Well, today, it was Glennzilla.
See, several nights ago, I got another hectoring email from the Melanie Morgan crowd, crowing their delight about the recent decline in violence in Iraq. They seemed to think that I was going to be somehow downcast that incrementally fewer people on both sides are being killed and maimed in our nation’s most spectacular foreign policy cock-up ever. That, of course, couldn’t be further from the truth. If the fucking “Surge” is working, then by God, Surge On!
And let’s declare victory and get the fuck out of there, okay? OKAY?!
Of course, it isn’t that simple, and now Rightard boot-licker Howie Kurtz is presenting yet another, “This doesn’t look good for the Democrats…!” wheeze, in the mold of so many that have come before, another, “The Democrats are moving/have moved/will move too far to the left, and that’s going to be a Big Problem for them.”
(Why do I always hear that pronouncement in the voice of Mara Liasson?)
Well, I had all these great things to say about that, but G2 got there first.
Whenever one thinks that our discourse regarding the Iraq War just can’t get any more inane, it always manages to find a way. If the violence in Iraq continues to decrease — and even if one accepts the most dubious of premises in order to see it all in the best possible light (the decrease will endure, it’s because of the Magical Surge, the de facto ethnic cleansing can reverse itself, etc.) — that rather obviously doesn’t mean that the war has achieved anything positive, either in that country or for our own. It just means that we have begun to contain some of the monstrous harm which our invasion unleashed there.
Yes, thank you, Mr. Greenwald, for putting that so elegantly and succinctly that it leaves me with pretty much nothing else to add. But, please, do go on.
Acting as though a decrease in violence is now a positive reflection on the invasion itself is irrational in the extreme. It’s basically akin to someone sitting on their couch and chewing up food and spitting it all over the floor and the walls and the furniture month after month until it piles up and congeals and grows into mold, turning the room into a repulsive, health-threatening mess. Guests come by and run away in horror at how repugnant it all is.
Then, one day, the person decides to pick up some of the congealed food from the floor and scrapes a little bit off the walls, making it a bit less filthy. Then he starts calling his friends, announcing: “You must come over. I’ve completely redecorated my home and it looks beautiful now. You have to see what I’ve done to it.”
Um, ew. But yes, how true.
That what David Broder’s prescient prediction was all about when, last January, he announced that “at the very moment the House of Representatives is repudiating his policy in Iraq, President Bush is poised for a political comeback.”
Ah, yes, the much-vaunted comeback of Gee Dubya. What are those most recent poll numbers again? Oh, right! Lower than Nixon at his worst. Oh, and support for the war? Lower than ever.
WASHINGTON (CNN) — Opposition to the Iraq war is at an all-time high despite reports of a reduction of violence in the country, according to a CNN/Opinion Research Corp. poll released Thursday.
Sixty-eight percent of poll respondents opposed the war, setting a record. The level of opposition is slightly up from last month and 1 percentage point higher than the previous record of 67 percent, first set in December 2006 in a CNN/Opinion Research survey.
Support for the war in Iraq among Americans has dropped to 31 percent from 34 percent last month, the new poll found.
But the Beltway Bitchez will continue to paint the situation as dire and desperate for the Democrats, and the only people who will believe it? The goddamn Democrats.
But, hey, thank god we have the stellar wisdom of Serious Beltway Insiders like Howard Kurtz, who will always be there to explain to us how every burp, hiccup, and fart that happens in Iraq is good for the Republicans and bad for Democrats, that opposing the war is bad for America, and that Michelle Malkin is a good person.
Down is up. Black is white. Ignorance is strength. And we have always been at war with EastAsia. Yee haw. Thank god the DC establishment never listens to us Dirty Fucking Hippies. Otherwise there might be some kind of impediment to the Right running our country into the ditch and destroying our standing in the world forever and ever.
And Lord knows, we can’t have that.

On topic, I heard Blitzer earlier today talking with whomever his senior correspondent is. The guy was saying how Falluja had been a success and had been a model for how to win over the Sunnis. He then said that the surge had been a success and that maybe people would start rethinking how we were doing in Iraq.

I think the most helpful thing we could do would be to find a way to get rid of corporate personhood, which was a fraud anyway – the court case that supposedly established it never mentioned corporate personhood. It was in a headnote written by the court reporter, which was not legally binding, but once it was used as precedent for other cases, it stuck.

Note that Mukasey left the bench in 2006 for the stated reason that he owed it to his family to make more then his $165,000 per year salary as a judge. After all this enormous sacrifice, it was time to join a law firm in which the partners were earning $1 million per year. After all, what respectable person should really have to live on less than that? So what now? We’re back to the public salary again. But I’m sure the will be followed by some pretty substantial pay back.
The thing that amazes me about these guys is that they object to things like extending health coverage to “rich” kids. But, at the same time, people like Mukasey and Tony Snow act like a salary and benefits probably totaling about $200,000 per year is like living on table scraps.

Many people point to the 1886 Santa Clara County v. Southern Pacific Railroad case as the judgment that gave corporations ‘personhood’ with the same rights as human beings, citing the Bill of Rights and the Fourteenth Amendment (which granted ex-slaves equal protection under the law). However, on closer inspection, it turns out that the actual decision by the Supreme Court mentioned no such rights for corporations. The court reporter, J.C. Bancroft Davis – a former railroad president – added a commentary called a headnote (which has no legal status) which stated: “The defendant Corporations are persons within the intent of the clause in section 1 of the Fourteenth Amendment to the Constitution of the United States, which forbids a State to deny to any person within its jurisdiction the equal protection of the laws.” There has been much speculation ever since as to whether the Waite court actually agreed with the idea of corporate personhood – it might have – but the bottom line is that corporate personhood was not addressed in the decision itself. The headnote was immediately seized on by corporate lawyers, who used it at every opportunity, and once the Supreme Court quoted it in subsequent cases, the doctrine of corporate personhood became law.
Up until that point, corporations were included in ‘artificial creations of the state’ such as unions, churches, unincorporated businesses, civic clubs, and even governments. Human beings have rights. Artificial legal constructs have privileges. With this decision, corporations became legally human – with all the rights but none of the vulnerabilities of humans.
Corporations had been looking for a case to use the 14th Amendment argument on, and this was the one.

My wife’s family is Nova Scotian . . she’s still Canadian . . . they went to Boston . . . The Currie’s . . . don’t recall which town in Nova Scotia.
Nova Scotia has produced some FINE FINE FINE musicians of the acoustic folk/oldtimey/bluegrass/traditional fiddle variety in the past generation . . . I’ve been quite lucky to see many of them at Strawberry Musc Festival over the years . . . held here in CA outside of Yosemite.

So once again, the caucus scenario must have been that 20-odd Dems were willing to filibuster to stop the nomination; and a dozen or so said, “We’d like the chance to vote against him, but only if we’re sure he’ll be confirmed.” Knowing the count, the 20-odd didn’t even try to force a cloture vote, and consented to the debate decree.
At least Feinstein was honest enough to stab us in the face.

I dunno, I’ve suspected that the situation in all of this has been that the Bushies are telling Musharraf not to do stuff that will make them look bad, and the response from Musharraf has been “or what?”
Being a sharper tool than our preznit, he knows they’re heavily invested in him, so they won’t risk pulling support, and thus all that money has bought them no leverage at all.
President Plays Virtual Soldier

So the President was down in San Antonio today, visiting the rehab center at Brooke Army Medical Center, where lots of wounded Iraq War vets go for further treatment.
As is usually the case in these kinds of visits, the President took a tour, shook some hands, and gave a speech. But we got a hold of a copy of the pool report of the visit, and the President apparently also got a chance to play a little virtual soldier on his tour:
Bush saw a number of cutting edge virtual reality games that allowed recovering soldier to simulate riding a car or boat. One game simulated shooting in a Baghdad neighborhood, a game she said POTUS participated in with two other soldiers there and helped shoot the bad guys, at least virtually.
That must have been quite a scene. I wonder how it went over.

Sad to say, long gone . . . got kin in Scotch Valley . . . we all lived in San Mateo and went over 17 to Santa Cruz in past days (where we lived longer ago) of long ago, just to SEE Santa’s Village. . . . long gone it is . .
But the hollers and hollows and mountains are still there, from hiway 92 in San Mateo thru to south of Santa Cruz . . . the coastal hills are FULL of poor and rich, straight and not so . . . . and an old hippie COULD find a spot to settle and get by . . . to this day . . . I know some who have. ;-)
There’s a lot of easy meat to be had wandering them woods . . . and a little plot of the right crop under or UP in the redwoods (some growers plant buckets upside down in redwood trees and the choppers from CAMP never find them) can make for a lucrative living year round.
Hell, we all may be forced to this lifestyle soon . . .

Just looking at it from a marketing perspective “success and victory” are probably easier to sell than “failure and defeat”.
The downward trend in support for the war reversed in July even though the media coverage was very negative. Seems reasonable to expect positive coverage will accelerate the upward trend.

First off the idea or “corporate personhood” or “juristic personhood” is hardly an urban legend. The application of this concept to a corporations right to “free speech” in relation to donations to candidates has “defrauded” the public.
Here’s a simple description of “corporate” or “juristic” personhood.

The Supreme Court case in which corporatists argue gives them the right to interfere with the political process by making PAC and Corporation donations was Santa Clara County v. Southern Pacific Railroad . The court reporter’s comments in this case included a statement the Chief Justice made even before oral arguments began. He told the attorneys in pre-trial that “the court does not wish to hear argument on the question whether the provision in the Fourteenth Amendment to the Constitution, which forbids a State to deny any person within its jurisdiction the equal protection of the laws, applies to these corporations. We are all of the opinion that it does.”
Later Supreme Court opinions misinterpreted this simple statement as part of the actual legal decision, and gave it the power of stare decisis . As a result, because of the First Amendment which prevents restriction of a persons speech rights, Congress can’t make a law restricting the free speech of a corporation, a political action group or dictating the coverage of a local newspaper. Indeed, such avenues are likely protected…as newspapers are not “natural persons” or citizens yet are accorded right of criticism.
However, the Court has extended this to mean that financial contributions to candidates is “speech” as well. This is more ambivalent, since COMMERCIAL SPEECH, has been reasonably restricted by the Courts in many cases. Commercial adverising can be limited on TV/radio…or be required to be “truthful”…or carry warnings or content statements.
So could political speech, at least in regards to the support of candidates (rather than “issues” before the voters), where there is certainly the danger of bribery and influence peddling be restraned…much as it is to foreign powers or interests? It’s ironic that individuals who are long time residents of the United States cannot make a campaign contribution…but a corporation, perhaps with members of their board of directors who are foreign residents, could make substantial contributions. And could a foreign citizen contribute to a PAC, who then filters that contribution on to a candidate?
And how can an individual evade the limitations on campaign limits simply by contributing to a PAC or directly to the political party, who then can obscure the origins of that contribution by simpling giving to one or more “corporate personages”. The whole critical aspect of personhood…that of individuality constrained by ones body, is lost. Theoretically one could, by creating or contributing to scores of PACs or companies to the same candidate maxxed out on the individual limits…make hundreds of thousands in assistance.
Why couldn’t contributions be confined to only those who are eligible to vote as citizens. The roots go back to a judicial fiction that there exists stare decisis from a case were the issue wasn’t even debated and has no legal support.

Alicia~ interesting summation. The only place where a corporate entity is specifically given rights in the Constitution is the !st Amendment…where “the Press” is accorded Freedom of Speech. But clearly, by being mentioned alone amongst all forms of “corporate entities”, the Framers were NOT construing that other groups had these rights. There is also the Freedom of Association…but that doesn’t necessitate the extension of that by those collective groups to involvement in the political process (to vote, to run for office, etc.)
I was involved in my University (UC Berkeley) back in the early 1970’s where some creative political parties had run “corporate slates” for political office. Thus they had three people run as “Co-Presidents”, “Co-Vice Presidents” etc. The Student Court ruled that there was no way to read the Electoral codes and Constitution as meaning that eligibility extended to artificial associations. A person was a person.
We also noted the issues that would be raised with decision-making and powers if corporate leadership was allowed…with no explicit or implicit way to solve these issues Constitutionally. So we had to boot these tickets off the ballot…although there was two days left so they could agree on a single representative.

And those rumors of the WMD’s being secretly taken out that have been part-and-parcel of the Kool-Aid drinkers. Utter fraud.
And maybe it also means that Blair knew very well that the Niger smuggling reports were full of cr*p..because any need for yellowcake smuggling would mean a developed processing capacity…which Iraq did not have.
