As any of you who read this site regularly know, good writing is incredibly important to us at FDL. It’s what separates us from The Right Wing Blogoshpere the animals. We’re happy to support the Writers’ Guild of America in their efforts to ensure fair and equitable payment for the writers striking all over the country.
FDL is a community of activists, concerned citizens, and proud Americans, and the thing that brings us here to this place each day is the power of the written word to educate, to inspire, and to entertain. We want to get use our megaphone to help folks get acquainted with what’s really going on here rather than relying on the corporate media’s take on it. Remember that the People Who Own the News are the very corporations that are trying to screw the writers out of what they’ve earned.
And the big news is…if you happen to be in Los Angeles tomorrow, you can join in a rally at Fox Studios (10201 Pico Blvd.) at 10:00 am for a massive demonstration. There’s three hour free parking at the Westfield shopping mall with purchase, and with the War Against Christmas just around the corner, who doesn’t need a little Paco Rabanne Pour Homme for a stocking stuffer?
And who will be there to provide the battle music?

Former Pakistan PM Benazir Bhutto Placed Under House Arrest

Streets were filled with police officers carrying batons and shields, and trucks blocked roads, trying to prevent access to a protest rally that Ms. Bhutto had helped organize in Rawalpindi, the garrison city adjacent to the capital of Islamabad.

Oh, gosh. Sick kitties are The Single Most Awful Thing in the World. I can’t stand to see them suffer. I just can’t stand it.
And yet when one of my babies is sick, you have to order me away from the patient for things like bathing, eating, things which I do mechanically, miserably, just praying that my poor baby will feel better soon.
Juan C has been really, really sick twice in his life, once when he was a baby and once right after the divorce. I think I would have jumped in front of a bus if I thought that would make him better. If he had died I think they would have had to put me on suicide watch.
I can’t imagine what it must be like to have sick children. Ye gods.

thanks! the only consolation i have is my/our kitty is 15-1/2, and he doesn’t seem to be suffering, The vet says the type of cancer isn’t usually painful, but that we’ll be able to tell if he’s in distress because we know him. He seems more tired the last few weeks, might see if he’ll tolerate some alternative things.
I say we, the netroots, should demand answers to the question from the prez wannabe’s: why were you not there to vote and if you can’t do the job you are currently holding, why the hell should i vote for you to do an even bigger job?

Mukasey was asked whether waterboarding is torture. Even though I would oppose anyone that Bush would have as his AG, including this one, I think it’s a stupid question. Does it do any good to keep dumbing down the dialogue like that? If you ask a lawyer that type of question, of course he can’t answer it. It depends what you mean by “waterboarding.” It depends what you mean by “torture” etc. Under what law? Under what definition?
Did they ever ask him any real questions? Like should the US be able to violate the Geneva convention? How far does executive privilege extend? Can the President violate the FISA laws with impunity? If so, under what circumstances? Are we in the kind of “war” that justifies the use of extraordinary war powers? If so, when does the “war” end? There are so many questions should have asked. Did the ask any of them? Or were they only interested in creating headlines and news bites?

It emerged last night that Siemens, one of the world’s largest engineering groups and based in Germany, has pulled out of all new business dealings with Iran after pressure from the US and German governments. This follows the decision by Germany’s three biggest banks, Deutsche, Commerzbank, and Dresdner, to quit Iran after a warning from US vice-president Dick Cheney that if firms remain in Tehran, they are going to have problems doing business in the US.

Well, today was the first treatment. They put me in The Spine Traction Machine, which is like a giant infant car seat that they strap you into and it pulls your legs one way and your upper body the other.

I’d like to thank all the people who contributed to the last thread’s little sub-discussion about the whole County of Santa Clara v. Southern Pacific Railroad/”myth of corporate personhood” thing.
Sorry, y’all, as far as I’m concerned the arugments simply don’t withstand scrutiny.
Here’s the reality, as I see it (keeping in mind that IAAL, and have a strong tendency to think like one).
1. By the time of the founding of the United States, the notion that corporations were juridical persons, with a legal existence separate and distinct from their owners, was deeply entrenched in the English common law. See 1 Blackstone, Commentaries on the Laws of England, at 455-56 (1765).
2. By the time the Fourteenth Amendment was adopted, the notion that corporations were persons was equally deeply entrenched in American law. The Dartmouth College case, decided by the Supreme Court in 1819, and its progeny make this too clear to be misunderstood.
3. The drafters of the Fourteenth Amendment must, as a matter of ordinary principles of statutory construction, be presumed to know the then state of the law.
4. It must also be presumed, as a matter of ordinary principles of statutory construction, that the when the drafters of the Fourteenth Amendment used the word “citizen” in the first clause of the second sentence of Section 1, and used the word “person” in the second clause, they meant to denote two different things.
5. At the time, the word “citizen” was clearly understood to apply only to natural persons. The word “person” was equally clearly understood to apply to both natural and juridical persons.
6. As a result, it is simply beyond dispute that the drafters of the Fourteenth Amendment intended the Due Process and Equal Protection Clauses of the Fourteenth Amendment to apply to corporations.
7. And that’s why Justice Waite told counsel for the parties at the oral argument in Santa Clara County not to waste any of their alloted time arguing that point. It was well settled law.
8. And once the Supreme Court started down the road, beginning in the 1940s, of saying that the Fourteenth Amendment’s guarantee of due process meant that the Bill of Rights applied to the states — a doctrine, BTW, without which most of the civil liberties that we have until recently taken for granted could be trampled on by state legislatures — it was essentially inevitable that corporations would get to go along for the ride.
There may be cogent arguments — heck, there may be compelling arguments — for restricting corporate speech. But the road that y’all are trying to take to get there is a dead end. And I don’t really think that y’all want to re-fight the battle over whether the Bill of Rights is incorporated in the Due Process Clause of the Fourteenth Amendment. You won’t win, and even if you did you would quickly see that to be a Pyrrhic victory. You’re just going to have to argue it under the current state of First Amendment law.

Yep, he’s got em. He always looks a little disgruntled when his girl picks him up because when younger she was always stuffing him into pink hawaiian shirts, etc and insulting his manly dignity.
Well, yeah, the machine helped. I kind of got lost in the feeling after a bit, once I stopped going, “Am I doing this right?” and second guessing myself, because I realized that it was pretty much impossible to screw up. Duh. Lie there and let the machine do its thing, stupid.
Then they put me on my stomach and put little electrodes on my back that tingled in patterns and I thought, “You know? This is, like, massage therapy for Republicans and other people who don’t like to be touched.”
I have been feeling a hundred times better over the last couple of days, so I didn’t go in feeling a whole lot of pain. Tonight, from the cracking and stretching, I am a little bit sore, but it’s, like, after-workout sore, not OH GOD I’M DYING PLEASE KILL ME NOW sore.
He gave me a lift to put in my shoe. My left leg is slightly longer than my right, which is where the problems are coming from.
The good news (really good news) is that there’s no permanent damage to anything in my back. All the discs are in good shape, nerves and muscles all functioning.
He said that he expects to have everything completely symmetrical and aligned within 90 days and I can probably start swimming by next week.
Exercise is my plan to keep this from happening again, particularly exercise in the water, which I infinitely prefer to land-based exercise.

Hey y’all – we’ve got a bad fire down the coast highway in Big Sur but if the winds don’t get too wild the firemen hope it may stay contained enough thru the night until the helicopters can start dumpbing water at daybreak.
Just got back from fetching a friend and her pets and helping settle them with family in Monterey. Hold good thoughts for a happy ending for all creatures great & small and the majestic Redwoods and those courageous firefighters working through the night. The fire jumped highway one north of Esalen a few hours ago and is very worrisome for all concerned. Damn! ;~(

Yes, it almost does. There’s really no reason to suppose that one particular way of inflicting torture wouldn’t be torture, so the idea that it might not cover all days of the week, while facetious, is probably equally valid. (Of course, there’s also legal precedent that it’s torture).

About ten years ago I was doing some day labour at a food processing plant for a day. I got picked to dump huge burlap bags of onions into a tweenty foot high onion ring maker.
The problem was the processor would start to process the onions before I was done dumping the bag. The onion blast made me cry and made my nose run.
I often had to take off my face mask to sneeze and blow my nose, right next to the machine. I wonder how often that machine was cleaned? Sure the onions were later deep fried and that should kill most germs I think.
But I still think we have to do something about mass produced food after all not everything is deep fried yet!

Nancy wants to end the war by telling Bush no new war funding unless we have a pullout by 2008. But nobody at this Lefty blog is posting or doing cartwheels of joy in the comments I’ve seen. But once we would have.
Not that I am either, but it does seem worth mentioning. By promising a Democratic majority could end the war we waited in January then again for September only to be told that “we can’t because”.
Now we don’t care because we don’t believe, well we still care about ending the war we just don’t believe Nancy really will do anything this time.

And here is where you go astray. The reference in the 14th Amendment to persons could very well mean something different than “citizen”. The 14th and 15th Amendments were separable, with only the latter conferring CITIZENSHIP upon the freed slaves. The 14th conferred RIGHTS AS PERSONS. It also applied to any other individual within the jurisdiction of the United States…including Indians, foreign residents and traders, etc.
The placement of these two principles in separate Amendments was an effort to make sure that at least the 14th would pass, even if the abolitionists were not able to obtain the necessary support to ratify the 15th Amendment.
Certainly there was a recognition of associations and groups(and states and nations) having legal rights under English law. Contracts and treaties were recognizeable as conferring privileges and responsibilities between associations. But that’s different than asserting that such an entity is a “person” with ALL the Rights that apply whenever “person” is mentioned in the Constitution. These so-called “juridical personhood” rights were always constrained.
A case in point are the exceptions noted in the Constitution/Bill of Rights. In the First Amendment it specifically notes only one “non-person” as having rights that individuals have.
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
Why would the Framers not simply have said “freedom of speech”…but also “of the Press” if they regarded the Press to be incorporated as an individual protected by Freedom of speech?
They were being careful to make sure that ONE PARTICULAR TYPE of association was accorded Freedom of Speech…the same Freedom that individuals had.
Whether other types of Corporations have this Freedom is disputable. It certainly is not explicit (as it is for the Press) in the First Amendment.

Plumbing systems that connect shower and sink drains to toilets and use gray water to flush are now illegal under state law, but the Athens-Clarke Commission could pass an ordinance legalizing them, Wenger said.
Several county commissioners have said they’re interested in revising plumbing and building codes to allow or even require gray water systems.

Well, we know that a regular diploma has limited value so an “equivalence” can’t really be expected to be more. The point of my work was to look at why they quit, why they went back and the meaning they attached to the experience. My study was prompted by an “econometric” work that said “you can’t make a silk purse out of a pigs ear”. The motivations are varied as are the results. Two important things I think. One, quitting school is a very good option for many. Two, there has to be a mechanism for folks to have that second chance. I got my GED in Korea in 1967 so it was a long and winding road.

I stopped using the anti-bacterial soaps a while back and don’t allow a drop of bleach down the lines b/c of having a septic system so, at least from my perspective, I call bullsh*t, too. Hell’s bells and codfish….the d*mn plants are gonna die anyway and if they can limp along on gray water ’til a few drops fall from the sky, tante mieux. Next on the agenda is catching what I can in containers during showers.

The reason I ask is from watching a rerun of the Tuesday hearing with Nord from the Consumer Product Safety Commission earlier this morning in which he was one of the questioners. First I had ever seen of him.
GAK! That woman turns my stomach sour. One of the things she was there to do was rebut some of the negative things that have been said recently about the agency. She was asked whether it was true there was only one employee testing toys. Not accurate, said she; there are a “number” of full-time employees doing toy product testing. Of course, there were thugs there to get that response but what was totally frustrating was that she gave the same response to a Dem who was too “dim” to dissect her answer. As in…..give me a “specific” number of full-time employees AND do each of them work “full-time” on ONLY toy testing? You gotta wonder whether these people have enough brain cells to rub together to produce a spark.
I was sort of hoping for a Texas Cage match between Sonny and Charlie Crist to decide the water issue….Winner takes the Chattahoochee.

just catching up on the mukasey vote last night. i couldn’t watch the kabuki of senators speaking out against his nomination, but not being willing to actually do anything to block it. what fuckery.
so, the mukasey nomination passed 53 to 40:
without the unanimous consent agreement it would have taken 60 votes to pass. which means that some dems voting no (or not voting) really wanted the nomination to pass but wanted to pretend otherwise. the rest of the dems, even those voting “no”, helped to draw the curtain over what happened by not objecting to the unanimous consent agreement – which would have forced senators to cast real votes.
