Looks like Condi Rice, Stephen Hadley, and Elliott Abrams might have a bit of ’splainin’ to do early next year. Under oath. In a courtroom. Before a judge.
Lawyers for two former American Israel Public Affairs Committee lobbyists facing espionage charges have subpoenaed Rice, National Security Adviser Stephen Hadley, Deputy National Security Adviser Elliott Abrams and several others to testify at their trial next year.
Or maybe not:
Prosecutors had challenged the subpoenas in federal court.
My guess is that the prosecution smells an attempt to set up a ‘poison pill’ or ‘graymail’ defense, the most famous recent example being in the Scooter Libby Treasongate case.
So what the heck is ‘graymail’? Christy explains here:
“Greymail” is a term that refers to substantial classified document requests on behalf of a defendant. It’s a tactic that is in bad standing with most prosecutors who deal with national security matters, because it puts you in a difficult place at times: defend your case or defend your government’s secrets.
Graymail is particularly invidious because it is likely to be most successfully employed by former officials from the heart of the government machine who subsequently face trial.
With regard to the “greymail” issue here, this is a complex subject that boils down to this for Team Libby: Scooter had a job that dealt with a lot of high level national security matters. He’d now like to use his complex job as an excuse for committing perjury, but to do that, he has to get access to a lot of the documents that crossed his desk in the service of the Veep. (Shorter Scooter: My job was hard, so you can’t hold me responsible for lying.)
I think you can see where this is heading.
Here’s what the defense wants to happen: They want to see Rice & Co. successfully defy the subpoenas on ‘national security’ grounds, at which point the defense will then say that the defendants can’t get a fair trial without Rice & Co.’s testimony, and the judge will agree — and the defendants will skate.
Now, this didn’t work in the Libby case — but then again, that turned out to be moot as Bush was always ready to swoop in and rescue the firewall that stood between Rove/Cheney/Bush and justice. Let’s see if it works this time.

For those who are abandoning their Dem voter registration might want to check with your state voting rules. In AZ if you are NOT registered as a Democrat you cannot vote in the Democratic Presidential Primary and the same applies for the Repugs. Even though Arizona has open primaries it DOES NOT apply to the Presidential primaries.
So if you want a voice in the Presidential primaries, you might want to check it out before you switch to No Party or Independent.

I have a different take on this. To my way of thinking, Schumer might as well be the one that propels Mukasey into the AG’s office, since he is the single most responsible person for this whole debacle. He’s the one that recommended Mukasey, so if someone is going to have to take a hit for this, it should be Schumer, which then takes the pressure off of everyone else. Whatever the others do doesn’t matter due to Schumer and Feinstein. If those two ever got as good as they’re giving, heaven would need to help them!

Keep in mind what is really at issue here.
Abe Lowell ain’t stupid.
His claim is that the officials subpoenaed gave the same kinds of info to his clients as Larry Franklin gave them.
Stop, digest, process.
Gov has so far said, oh nonsense, Sec. of State Rice never said anything to the lobbyists involving national defense or national security. They’ve said that in court, which is going to make it hard for “gov” in another guise to say something different later to invoke state secrets – on Rice at least.
So if those get invoked, in essence Gov will be admitting that yes, Rice et al DID give national defense info to the lobbyists. But insta-declassification doesn’t work if things are then still blocked under the state secrets mantra.
It’s all setting up to be very interesting and Lowell has his particular clients in almost (not quite, but almost) a win-win.
If the Rice testimony is blocked bc gov admits that going over her discussions will get into national security matters – then they pretty much admit that Lowell’s clients are correct, that other officials told them the same kinds of stuff as Franklin and how were they to know what they “could” or “couldn’t” hear and the question really becomes one of why Franklin was tried, but not Rice.
If Rice does testify and Lowell has any good faith basis whatsoever (and I trust his good faith before Gov’s everywhichway lately) for the claims that Rice et al told his guys all kinds of stuff, it is going to both help his case that his crew couldn’t know, and, again, skewer the leakerloyals in Bushdom.
And at some point, we may end up learning who the other two admin officials in the indictment (for also leaking classified info to the lobbyists) but not charged are (some bets are that one is Satterfield.)
With bushCo, the DEFENDANTS walking, is an intrinsic part of the plan.
Grey mail is gonna be increasingly used as a “get out of jail free” card since almost everything that this Administration in secret can be protected by having those brought to trail ask to see the dirt that is “classified” And with a compliant Administration intent on hiding those activities this is actually a very viable defense.
