Heads up: Sen. Chris Dodd is set to give a speech on FISA and civil liberties on the floor of the Senate around 10 am ET. And I’m told it will be a scorcher. You might want to turn on C-Span2…
There are three branches of government. Congress has the responsibility of oversight over the actions of the executive branch, as does the judiciary for determining the lawfulness or lack thereof of actions and laws. And, despite what George Bush and Dick Cheney may think about the unilateral executive being able to tra la unfettered down the merry path to “what the President says is law” land, it’s a load of dung. Constitutionally speaking, of course. Which makes this petulant pronouncement all the more appalling:
…Neither the House Intelligence Committee nor the House Judiciary Committee has been shown the documents. Mr. Fratto noted that a bill pending in the House contained no provision for immunity from lawsuits and suggested that unless that changed, the House committees would not see the documents.
“If the committees say they have no interest in legislating on the issue of liability protection, we have no reason to accommodate them,” he said.
Mr. Fratto said the administration was generally pleased with the Senate bill, though it opposes its six-year sunset provision and is seeking changes in the language of a provision that would require court warrants for eavesdropping on Americans traveling overseas. “Over all, it’s a pretty good start,” he said.
The security agency’s program to eavesdrop without warrants on international communications of Americans and others in the United States suspected of links to Al Qaeda started with extraordinary secrecy after the attacks of Sept. 11, 2001. Congress has fought for more information on the program for several years….
First of all, the Bush Administration started trying to end-run FISA laws SEVEN MONTHS BEFORE 9/11, according to the former CEO of Qwest. Do try and report it accurately. This power grab and illegal activity began soon after the Bushies took office, and despite it 9/11 happened anyway.
Second, no one gets a pass on following the law (H/T looseheadprop) – not the President, not David Addington, no one. And despite Mr. Fratto’s public attempt at playing whiny hardball with the House legislation, the White House has no right to withhold documents for oversight. And they should not be allowed to get away with trying. Further, Americans enjoy civil liberties built into a nifty document I call the Constitution — try not to subvert that for a change.
The current FISA bill was due to sunset in February. The Democrats would make some unconvincing noise about concern for civil liberties, rule of law, yadda yadda yadda, but the only part of this bill that deals with national security — the updating of certain technology issues that allow for eavesdropping on foreign-to-foreign calls that are routed through the US — is something that everyone, even Russ Feingold, agrees needs to happen. Nobody is opposing that. A bill like that could pass tomorrow.
But George Bush won’t sign that bill. He’s made it clear he will only sign a bill that gives retroactive telecom immunity, and one can imagine that these telecom fuckers are going to be singing like a flock of canaries about those in the administration who induced them to commit these crimes if they can’t skate on their charges post haste….
The White House is trying to play bait and switch — stringing Congress along by continuously switching the rules up. Well, here’s an answer for you Tony, my lad: NO.
The White House must provide all documents. Not just the selective ones you leak to the media to make you look good — ALL documents. We saw throughout the Libby trial how you selectively release information, and we are not buying your smelly little pig in a poke. Further, there will be no telecom immunity. Why? Because to give them that is to give up all leverage on a WH that operates more like a criminal enterprise bent on subverting new territory to its control than it does as a leader keeping the interests of the nation first and foremost. Always have. And because of that, you lost the benefit of the doubt somewhere back in 2001. If you couldn’t get it through the GOP-controlled Congress back in 2006, you sure as hell shouldn’t get it now.
While I’m at it, Mr. Fratto, I’m calling bullshit on the inevitable pincer maneuver of Wurlitzer mouthpieces calling us unpatriotic and senatorial whispering that Democrats are “soft on national security.” It is time that it was called out as the utter, trumped up crap of a hissy fit that it is. You roll out that idiocy every time you are wrong on an issue and expect the public to buy it — no more, your product is stale. Henceforth, IOKIYAR is no longer operative. Why? Because every time you do that, you are really covering your asses on a vulnerable point and I see your tell on this one: true patriots stand up for American values, true patriots are not afraid, and true patriots follow the law and respect the Constitution.
The President broke the law — knowingly and willingly (H/T powwow)– and you are terrified that he’ll be held to account for it. Jane was absolutely right that the corporations would sing like canaries if they were found to be operating outside the law. (Can you hear the explanatory plotting for Congressional testimony already by all the in-house counsels who knew beforehand that they needed a lawful subpoena to turn over all this information in the first place — and now they have to practice CYA law to point the finger elsewhere?)
No, Mr. Fratto — it is high time that someone called your blustering bluff for what it is — desperation. Now I have a question for you: what are you trying so hard to hide?

Good morning Christy. What gets me is that the WH is basically saying to congress, “we don’t have to provide documents that you’re entitled to in considering information unless you agree to change laws (and laws that exempt us from liability).

3. I means all the arguments about privilege that they’ve used to withhold documents are crap; they’re perfectly willing to turn over some documents it they agree to pass immunity.

For clarity’s purposes, I would argue that we do not have three co-equal branches of government.
Instead, the founding fathers knowingly gave a type of supremacy to the Legislative branch, and to the Legislative branch alone.
That supremacy lies in the fact that only the Legislative branch has the power to remove any member of the other branches by means of impeachment.
The Executive branch cannot remove a member of the Congress nor can it remove a member of the Supreme Court.
Neither can the Supreme Court remove a member of the Executive branch nor of Congress.
Only the Legislative branch, as the “will of the people” has this supreme power.
Well, we will it! So wake up Congress and do our bidding!

True, but they could never have imagined that 5 global corporations would own 80% of the mainstream media and entertainment industry.
Remember – the American revolution was actually fought against the East India Company, the world’s first multinational corporation which held a virtual stranglehold on commerce and politics in North America.
The British troups were fighting for the rights of the East India Company. It took almost 100 years for the American public to accept corporate business in any meaningful way – it took the new technologies of railroads and steel (2 dependent forces) to do this.
As thoughtful and innovative as the US Constitution is (if actually applied), we need to recognize that the blending of corporate and political forces is actually what the founding fathers fought against in the first place!

The Dems need to point to the proposed immunity (retroactive or not) and say, loudly, publicly, that this is the ‘Publicans being soft on crime.
Also, I suspect that immunity is intended primarily to protect people in government, who would be exposed to criminal charges and impeachment if any of the telecoms or their officers were charged and tried. This is a double-whammy CYA move, with the real beneficiaries not obvious.

I am sure it will offend some, just one interpretation of history. Let’s just look at the “creepiness factors” here.
The Bush family fortune did not come from oil — it came from financing the Nazis in WW I. There was an investigation (official record) and I believe some assets were frozen and even seized.
In fact, some say the Prescotts and other powerful elites were actually behind Hitler’s rise to power in Germany. Think about this – it is a fact that the propaganda techniques had their roots in America. Was Hitler an evil genius or a stupid puppet — anyone else see some scary possibilities here.
George Bush I namesake and maternal grandfather, George Herbert ‘Bert’ Walker, was a native of St. Louis, who founded the banking and investment firm of G. H. Walker and Company in 1900. Herbert “Bert” Walker controlled Smith and Wesson. The brownshirts in the streets of 1920s Germany were armed with Smith and Wesson revolvers, which they got for free from Fritz Thyssen (of Thyssen/Krupp), who got them wholesale from Walker.
George’s grandfather, Prescott is responsible for bringing Richard Nixon into politics, set him up, and provided direction and support.
George I was involved with the CIA many years before being its director under Gerald Ford. He was involved with the Bay of Pigs. Some believe he has connections, direct or indirect, with JFK assassination. If you do not accept the Warren Commission, and most Americans don’t, then the murder of an elected president was nothing less than a coup d’etat. It is a verified fact, that the rest of the world accepts though it was never given the press it deserved, that chimpy did not win in 2000 – another coup d’tat?
If you think the JFK case is convoluted and full of lies – check of the RFK murder! Most certainly this paved the way for tricky dick to get into the Whitehouse (remember, this is Prescott’s main man). Isn’t this, in many ways, a coup too? While we’re at it – Martin Luther King’s murder was the result of a conspiracy – at least that is what a judge and jury decided when they heard the evidence. How come the rest of America never heard the evidence?
Nixon could not have possibly resigned over the Watergate burglary — this is minor league stuff, especially by today’s standards. What possibly could have been on that 18-minute gap that cannot be recovered with today’s technology? You know that you cannot actually erase your hard-drive this clean. A secretary certainly did not erase these tapes in this matter by herself. No — this is not a direct Bush thing, unless there was direct, indirect involvement with JFK murder. Any other speculation as to what was on that tape?
The “Reagan Revolution” was enabled by treason – George Bush Sr. negotiated with the Iranian hostage takers to hold U.S. citizens captive until AFTER the election. This, coupled with the “mighty Wurlitzer” mainstream media undermined President Carter and threw the election to Ronald Reagan. This “October Surprise” was actually a coup detat against a sitting president. Reagan did not start his presidency as a wildly popular “uniter”, he was propelled into office via an act of treasonous.
The Reagan assassination attempt was done by the son of a close bush family friend — while Ronald ran as an aggressive, “reform” type in 1980, he became a passive “hands-off” delegate after the assassination attempt. Coincidence — Nancy Reagan could not stand the Bushes.

Neil Bush was a major player in the Savings and Loan scandal — cost us billions. He told congress that he received million dollar loans that were “forgiven” and that this “happens all the time.” Does anyone else think this makes chimpy’s Social Security con more reprehensible?

Bush Sr. pardoned all of the Iran/Contra co-conspirators. Many of these same folks have played active roles in enabling treasonous acts of George W Bush.
Bush Sr. was having breakfast with Bakr bin Laden, brother of Osama, the morning of 9/11, at a Carlyle Group shareholders meeting.
The Bush administration was specifically warned about planes being used as weapons and that “Bin Ladin Determined to Attack US” yet they claimed “who could have known?”
The Bush administration was specifically warned about the need to rebuild NOLA levees and was specifically warned about Hurricane Katrina, yet they claimed “who could have known?”
Iraq, a war that Bush I refused to continue fighting in after Desert Storm, was allowed to progress into what is now being more widely accepted as “the gates of hell” and a civil war. This after the American public was told “we would be greeted as liberators” and “mission accomplished. The oil industry, however, is making record profits that are astonishingly high and the military-industrial complex is making BILLIONS in profits – much of the federal money they receive (hundreds of billions) cannot be accounted for. Outrageous billings for services and supplies are the order of the day – but billions are just “disappearing” into the war machine’s deep pockets.
George W. Bush becomes the first President of the United States to proclaim that torture is official U.S. Policy. Of course, torture was part of the government’s attempt to destabilize sovereign governments under Iran/Contra. Those programs were illicit and kept “off the book” and out of the press. George W. proclaims this is now official U.S. Policy.
George W. Bush declares the constitution is just a “God Damn piece of paper” and declares that he is above the law. He signs bills with statements that he will not follow the laws he is signing. He also signs into law a budget bill that was not passed by both senate and house.
As President Bush embarks on a new effort to shore up public support for the war in Iraq, an uncle of the commander in chief is collecting $2.7 million in cash and stock from the recent sale of a company that profited from the war.
Is it possible that the Bush family has connections to some of the most disturbing events in the past 100 years?
I humbly present this for discussion only, not as fact – “Gemstone” files style, seeking to promote dialog. Much of this would never be verifiable if true – run these topics through your favorite “search engine,” see what you find, decide for your self, and share your ideas.

Via “legal fiction,” a corporation is also a “person,” and could consequently be “pardoned” for offenses not yet even charged, no? Just like the case law has settled the question of the President’s power to pardon actual persons for offenses not yet charged (Gerald Ford precedent).

Well -apparently- they were not using it for checking communications between al Qaeda as they coordinated their multi-pronged attack on 9/11. Otherwise they would have known about it and been able to stop it.

For those who looked at the CLinton video (or saw it live–yes, I mean you, RevDeb), it is the central trope for her campaign. Can she both hold the DLC contributors and continue to be a credible candidate for actual primary voters.
The trepidation with which she approaches these “tough vote” is remarkable.
I’ve also been reading about Obama’s problems with homophobia in the black Christian community (and more largely, (RIP, Steve Gilliard, from whom I learned about this) among black males in general). He’s in a similar bind–he doesn’t want to alienate anybody, but has to alienate somebody and may end up alienating everybody.
Now if we can just get the newspapers to notice that Dodd is raising a newsworthy issue. Coverage in today’s NYT of Dodd was limited to a commercial of his about a haircut in a barbershop.

I watched an Obama speech on C-SPAN tonight. It was filmed Tuesday in Boston.
He was speaking with a decidedly Southern accent. What’s up with that? I thought they were all saying John Edwards was the phony in this race — but Edwards has been using his Southern accent for a very long time. Now, if we can just get some film of Clinton, Obama and Edwards all talkin’ Southern…
I still say, if all they have against Edwards is his haircut, his big house and stuff like that, then they must not object to ANY of his policies.
