Please, act today. Stand up for the Constitution and the rule of law. Sign the petition to Harry Reid and ask him to take a stand on FISA. Let’s get to work:
Push for a couple of things on FISA: (1) no retroactive immunity for telecom companies or wayward presidential administrations and (2) no “basket” or “umbrella” warrants — make them spell out surveillance targets specifically and expressly in individualized warrants as they have been doing since the inception of FISA. Via looseheadprop:
The Constitution REQUIRES, doesn’t suggest – requires, that warrants be issued only upon probable cause. Countless Supreme and lower court decisions have repeated the logically obvious notion that each warrant application is fact specific to its particular case.
Ergo, you cannot possibly have blanket or so called “basket” warrants issued without a case by case determination of the existance of probable cause…
What exactly is the Bush Administration hiding with this desperate need not to spell things out individually? These are American citizens being surveilled, the least the Bush Administration can do is be honest about why they are surveilling them. Why? Because that is, and has always been, the law. It is time we stood up to “the Cheney element” in the United States Senate and beyond. No blank checks — not for this President or any other. This is the United States, and we do not have a king. It’s time we started acting like patriots instead of subjects.

I still think Pelosi and Reid were among the first “surveilled” and that’s why they are folding so easily. I can’t think of any other explanation of why they would be so willing to sacrifice America as we knew it.

The rule of law is still-born in the Bush administration, which was inaugurated in 2000 by SCOTUS when it ruled in Gore v Bush.

I just talked to a staffer at Cardin’s (SJC) office and thanked him for opposing immunity. Staffer acknowledged Cardin’s position on immunity. Asked that they “hold the line” on this issue.

Sure I’ll call like I do all the time. However, the joke is on us. The members of the Senate have either been compromised or are functioning under the control of personal fear. They will not stand up for anything that theatens their well being- REELECTION.
Until the reporters and the columnists start to act in within the constitutional frame work that is their responsibility to uphold, this country will continue to be givem the pablum of fear that is driving this country into the ground.

They can’t make individual warrants because they are vacuuming up information about everyone from every possible source. Phone calls from matching voice prints. Faxes. Emails. Text messages. Internet searches. They’ve already admitted to opening first class mail and doing black bag warrantless searches of physical property. Am I leaving anything out?
Use for political gain, or sell to the highest bidder. It’s power, either way.

The thing that I would want to know, is that of all of the people surveilled to date, are any of them journalists or other media representatives, bloggers, elected representatives from opposition parties or their employees, political volunteers, PR and media firms working for opposition groups, political activists, etc.

Person of Interest….I have long held (but never seen discussed) the fact that we now have a designation “Person of Interest” – a lowering of the bar for “probable cause” and “suspect”.
So I’m not surprised to see the same lowering of the bar requiring a warrant.
If you’re a person of interest, your goose is cooked these days. So why not wiretap everyone if we just THINK they might be suspicious (thought police)!

It’s true that the laws that are about to be legislated that affect our privacy rights invite abuse by overzealous Presidential appointees. Many of this President’s appointees have shown a proclivity for bending or breaking laws that are already extant.
I see no reason to cut any slack to any legislator that votes to enable the Federal government to invade our most confidential communications, while not trusting us to know that they’re doing it, or even acknowledge that our Congressional representatives, with the proper security clearances, have a right to know what they’re doing and who they’re doing it to.
I would consider any legislator with ties to the communications industry, either as a campaign donor, or prior relationship as an employee, or major investor, that votes for retroactive and blind immunity has violated a responsibility to avoid any conflict of interest. Someone who is demonstrably beholden to an industry should be held accountable for their vote. There will most certainly be an appearance of impropriety in voting either for or against the party to whom you are beholden.
I believe that our Congressional Representatives have a fiduciary relationship with us, their constituents, and that should be first and foremost in their minds. I think they should easily see that they should not touch the whole idea of retroactive immunity to telecoms with a ten foot pole!
Rawstory also reporting that Russia (Putin) may well have thrown a big, wet blanket on Bush/Cheney fantasies of attacking Iran. Raw Story, by way of Asia Times reports that Putin and the Supreme Leader (NOT Ahmadenijad, the REAL power in Iran) have gotten together and may be coming to agreement such that an attack on Iran is an attack on Russia.
I have long hoped that Putin (or China) would step in and totally queer any ability by BushCo to start yet another war. Either country is fully capable of doing it and now it looks like Putin may be doing it.

They are ALL culprits. But really, the Dem leaders Need to stand and rep their constituents, even if they “don’t have the numbers”. The system will correct at the next cycle. If they are waiting for better numbers, their people will see them not doing what they were elected to do and they will not GET better numbers. They need to get the numbers needed to reverse all this stuff before it becomes a part of New America (and I used the word “knew” because the America of Now is not the America of 1999).
