Sen. Chris Dodd gave a great statement on the floor of the Senate this morning. You can watch video here on his Senate website. I asked for a written copy of the remarks, because there wasn’t a transcript available, and am reprinting them here with permission because I’ve had several e-mails asking for this. Here you go:
Mr. President, for six years, this President has demonstrated time and time again that he doesn’t respect the role of Congress nor does he respect the rule of law.
Every six years as United States Senators we take the oath office to uphold the Constitution. Our colleagues on the House side take that oath every two years. That is important.
For six years this President has used scare tactics to prevent the Congress from reining in his abuse of authority. A case and point is the current direction this body appears to be headed as we prepare to reform and extend the Foreign Intelligence Surveillance Act.
Many of the unprecedented rollbacks to the rule of law by this Administration have been made in the name of national security.
The Bush Administration has relentlessly focused our nation’s resources and manpower on a war of choice in Iraq. That ill conceived war has broken our military, squandered resources and emboldened our enemies.
The President’s wholesale disregard of the rule of law has compounded the damage done in Iraq and has made our nation less secure and as a direct consequence of these acts, we are less secure, more vulnerable and more isolated in the world.
Consider the scandal at Abu Ghraib – where Iraqi prisoners were subjected to inhumane and humiliating acts by U.S. personnel charged with guarding them.
Consider Guantanamo Bay. Rather than helping to protect the nation, the prisons at Guantanamo Bay have instead become the very symbol for our weakened moral standing in the world.
Consider the secret prisons run by the CIA and the practice of extraordinary rendition that allows them to evade U.S. law regarding torture.
Consider the shameful actions of our outgoing Attorney General who politicized prosecutions – who was more committed to serving the President who appointed him than the laws he had sworn to uphold.
And consider, of course, the Military Commissions Act – a law that allows evidence obtained through torture to be admitted into evidence.
It denies individuals the right to counsel.
It denies them the right to invoke the Geneva Conventions.
And it denies them the single most important and effective safeguard of liberty man has known – the right of habeas corpus, permitting prisoners to be brought before a court to determine whether their detainment is lawful.
Warrantless wiretapping, torture – the list goes on.
Each of these policies share two things in common.
First, they have weakened our ability to prosecute the global war on terrorism – if for no other reason than they have made it harder, if not impossible, to build the international support and cooperation we need to fight it.
And second, each has only been possible because Congress has not been able to stop this President’s unprecedented expansion of executive power, although some in this body have tried.
Whether or not these policies were explicitly authorized is beside the point. In every instance, Congress has been unable to hold this Administration to account for violating the rule of law and our Constitution. In each instance, Republicans in the Congress have prevented this body from telling this Administration that “a state of war is not a blank check.”
And those aren’t my words, Mr. President – those are the words of Supreme Court Justice Sandra Day O’Connor who was nominated by Ronald Reagan.
And today, it appears that we are prepared to consider the proposed renewal of the Foreign Intelligence Surveillance Act – a law that in whatever form it eventually takes will almost certainly permit the Bush Administration to broadly eavesdrop on American citizens.
Legislation, as currently drafted, that would grant retroactive immunity to telecommunications companies that helped this Administration violate the civil liberties of Americans and the law of this country.
Mr. President while it may be true that the proposed legislation is an improvement on existing law, it remains fundamentally flawed because it fails to protect the privacy rights of Americans or hold the Executive or the private sector accountable if they choose to ignore the law.
That is why I will not stand on the floor of the United States Senate and be silent about the direction we are headed.
It is time to say “no more.”
No more trampling our Constitution.
No more excusing those who violate the rule of law.
These are our principles.
They have been around at least since the Magna Carta.
They are enduring.
What they are not is temporary. And what we do not do in a time where our country is at risk is abandon them.
My father was Executive Trial Counsel at the Nuremberg trials of Nazi war criminals during 1945 and 1946.
What America accomplished at those historic trials wasn’t a foregone conclusion. It took courage – when Stalin and even a leader as great and noble as Winston Churchill wanted to simply execute the Nazi leaders, we didn’t back down from our belief that these men—as terrible as they were—ought to have a trial.
We did not give in to vengeance.
As then, the issue before us today is the same.
Does America stand for all that is still right with our world? Or do we retreat in fear?
Do we stand for justice that secures America? Or do we act out of vengeance that weakens us?
Mr. President, I am well aware that this issue is seen as political. I believe that Democrats were elected to strengthen the nation – elected to restore our standing in the world.
I believe we were elected to ensure that this nation adheres to the rule of law and to stop this Administration’s assault on the Constitution.
But the rule of law is not the provenance of any one political party – but of every American who has been safer because of it.
Mr. President, I know this bill hasn’t even been reported out of the Judiciary Committee yet.
But I am here today because if I have learned anything in my 26 years in this body—particularly during the last 7 years—it is that if you wait until the end to voice your concerns, you will have waited too long. That is why I have written to the Majority Leader informing him that I will object to any effort to bring this legislation to the Senate floor for consideration.
I hope that Senator Leahy is able to remove this language – he is a dear friend and I know his respect for the rule of law runs deep.
But if he cannot, I am prepared to filibuster this bill.
President Bush is right about one thing: this debate is about security. But not in the way he imagines.
He believes we have to give up certain rights to be safe.
I believe the choice between moral authority and security is a false choice.
I believe it is precisely when you stand up and protect your rights that you become stronger, not weaker.
The damage that was done to our country on 9/11 was stunning. It changed the world forever.
But when you start diminishing our rights as a people, you compound that tragedy. You cannot protect America in the long run if you fail to protect our Constitution. It is that simple.
Mr. President, history will likely judge this President harshly for his war of choice and for fighting it with a disregard for our most cherished principles.
But history is about tomorrow. We must act today to stand up for the Constitution and the rule of law.
Mr. President, this is the moment. At long last, let us rise to it.
Stand up for the Constitution and the rule of law. Here are a few ideas on how you can do so…today.

Senator Dodd had a date with destiny and he has not been found wanting. If he prevails, truly prevails, and this isn’t simply a symbolic gesture he will become president.
This is the kind of leadership that we need in dealing with the wh. It is really sad that there is not much of a stir in the country and the MSM will not be much help. reid will prove once again that the rethugs actually won both houses in 2006.
Even if the Congress had been shown these “secret” documents, those that saw them were unable to say or do anything. It was a neat “out;” able to see them which covers the wh making this know to the Congress, but unable to do because they were “state secrets.” A foolproof way to break the law.

I have to say I’ve been disappointed that Edwards has had such a low profile the past few weeks. Sure, he’s not in the Senate, so he doesn’t have the same platform as Dodd or Obama or Clinton. But he must know we want to hear from him on these issues (retroactive telecom immunity and others). I got a fundraising e-mail from Edwards/Joe Trippi right after Dodd announced his hold on the Fisa fix, and it contained nothing about FISA, nothing about policy at all – just a request for money.

We don’t get many victories or often even the truth. That’s why it is so heartening to hear someone like Senator Dodd stand up for those values and principles that have been and should be at the core of who we are as Americans.

Hey, good idea! Hugh’s List and a copy of the constitution!
Dodd got my attention way back with the “restore Habeas Corpus” thing. I’d never really thought about him previously, because of his association with Don Imus. But then I looked into his actual policies, and I said to myself, “This is all but a laundry list of my priorities.” I could want a little stronger support for healthcare and gay rights, but mostly, less want there than with other Democrats. The fact that he’s been doing this and continues to do this, again and again, have not only wiped out my reticence, but made me into an enthusiastic supporter.
Yes, it is sad that this needs to be said; that this needs to be the attitude of a crusader and not the basic assumption of every Senator and Representative, regardless of party. But that’s the way it is… and I’m glad someone’s holding the banner aloft.

I have been an unflinching Edwards supporter. But this speech moved me a little. I still support Edwards. But as I said: Dodd has now moved me. A little. We’ll see. Plus: I like the fact that he was in the Peace Corps. He speaks fluent Spanish (as distinct from you-know-who). And his father was a top judge at Nuremberg. All plusses in my book. We’ll see.

Yes, of course it can happen. Around this time last presidential cycle, Howard Dean was anointed as the inevitable winner. Of course, that didn’t turn out so well, but at least it tells you that that the conventional wisdom is not so wise.
I like what Dodd is doing. Forget D and R for a minute, and you’ve essentially got three factions in this country: vocally pro-constitution, vocally anti-constitution, and people who will sell out whichever way will bring in the money and votes. If Dodd takes up the mantle of leading the pro-constitution faction, as he seems to be doing, then many Americans might find themselves punching out the chad next to his name when they’re in the voting booth. Ultimately, that’s what matters, and the rivers of ink spilled in support of “mainstream” candidates don’t.
I’m not going to bet on this outcome, but it’s certainly not impossible.

I do not understand in any sort of logical way Mrs. Pelosi’s penchant for “fraternizing with the enemy” – yes, as Speaker, she has to talk to him and discuss things; she has to make her case and so on. But I think her having any sort of social contact with him – cozy little lunches and so on is a major mistake.

I’m beginning to wonder how much of Hillary’s “support” is somewhat manufactured by pollsters who are highly experienced at getting away with skewing data in favor of their clients.

It really speaks volumes about Edwards’ character, judgment and priorities that he isn’t out in front rallying his supporters around this issue. Dodd needs all the help he can get from high-profile democrats, whether they’re in the Senate or not.

Those are fine points, but the problem is that Edwards isn’t properly focused on the critical FISA fight that is going on right in front of him, right now. It shows incredibly poor judgment on Edwards’ part.
Edwards needs to address FISA and rally his supporters to support Dodd’s efforts. And he needs to do it soon.

It makes me uncomfortable to see all the references to the Intel Committee and Leahy/Spectre being provided with “documents” without any idea of what they are acutally getting.
Does anyone know:
1. Are they getting the firewall requirements set in place by Lamberth and Kollar-Kotelly?
2. Are they getting information on objections raised by Qwest to participation?
3. Are they getting the FISA court “orders” that were put in place in January?
4. Are they getting the “ruling” that supposedly took place in the early spring and presumably (although no one with credibility has spelled this out) is the basis for saying that the FISA court is requiring identified,targeted caller foreign powers/agent of foreign powers calls to other foreign powers/agent of foreign powers to have a warrant, if those calls are handled through a US based switching station?
5. Are they getting a copy of the FISA court rulings/holdings after the May “emergency” application (that DOJ waited days to make) when the 72 hour period was up?
6. Are they getting a copy of all the information that was provided to Judge Taylor before she made her ruling on the facts?
Are they even acknowledging that they can not, via statute, override the Fourth Amendment, which one Judge has already ruled, on the facts, was violated by parts of “teh program” (Taylor) and which another Judge has stated, on the facts, no reasonable lawyer could have found supportable (Walker)?
It all seems rushed, inaccurate, lame, incomplete and none of it seems to take into account the SPECIFIC and RECENT statements by both Judge Lamberth and by Baker – who used to handle all the FISA applications – that this kind of wholesale slaughter of law and oversight isn’t needed to have workable surveillance.
We really are coming full circle back to Judge Keith’s point – Are we a nation of laws or of men?
If you grant massive pardons of the wealthy and powerful for untold felonies, without even requiring apologies or confessions, the answer is pretty clear isn’t it? Not just a nation of men, but a nation of loyal Bushies, irrespective of the labels they try to affix.
Unapologetic kidnap and torture for the Arars, el-Masris, Errachidis, etc. who never broke any laws or took up arms against the US; equally unapologetic pardons and financial payoffs to corporate insiders who commit reams of felonies.
Actually, Judge Keith will have to revise his posit. It becomes, Are we a nation of laws, or of repellant and repugnant, intervebrate and depraved purveyors of power. Men don’t torture – they have to first become something less than a man to do that. And so we become a country, not of laws, and not even of men, but of evil.
John Edwards has spoken about this issue on several occasions, as well as the best way to end Bush’s failure in Iraq
but Congress is a “Private members Club and choose to ignore JE, who is an outsider.
Therefore he’s doing what he does best … campaigning directly to the people.
Chris Dodd is great on this issue, but he fails on other issues … which I’m sure are better left for another thread.
Right now, please keep telling your friends to call their Congresscritters and do so yourselves.
There has to be a far greater outcry and sustained outrage to see this through.

A little while ago I emailed the Edwards campaign to ask whether they had any paid staff positions available on the ground here in Nevada, that I’d gotten laid off in March, and would rather work for a viable and acceptable Dem candidate for a while than take another corporate quant job right now. I pointed out that I’ve lived here for 15 years and have been an active local citizen with numerous media contacts.
I asked specifically that they not hit me up for money right now, given our family circumstances (my wife just got RIF’d too).
Never heard anything regard my request, but I do now get daily email contribution pitches from them.

Edwards isn’t in the Senate or the House. He needs to let the person who can lead the charge lead it without sucking the limelight. I think he knows that.
Dodd should get the chance here to take the spotlight he has earned without Edwards nipping in and shifting the focus from the Senate.
The dance card right now leads with Dodd and Obama and Clinton are going to have to step up to the plate. They “have” in the sense of mouthing words, but neither seems very enthusiastic so far and neither seems to be exercising or wielding any actual power in the Sentate or with Reid.

the point we need to make is two fold;
“we do not need privacy protection to hide that which we are ashamed, we need ot to hide that which we are proud.”

Perhaps. But I’m on his email list, and I’ll I’ve gotten are appeals for money. He should be using the Internet more effectively to get around the media blackouts, IMO.
I’m just hoping it doesn’t have to do with his wife, but I must say I’m not impressed overall. Most of his emails are about money, and not so much about where he stands on things. Dodd, whose email list I somehow got on waaay back when, has been much more about the issues.

One more thing on a slightly different topic: I understand that there may be a filibuster in Congress on whether to extend or change the current laws in place on the issue of NSA wiretapping US citizens as part of the “war on terror.” The administration claims that it needs enhanced abilities to do to this because the laws as currently written are archaic and permission to do wiretaps on targets of interest take too much time in this dangerous world in which we are living. I can tell you that as part of my responsibilities at the CIA, we did indeed sometimes have to ask the Foreign Intelligence Surveillance Act (FISA) court for permission to surveil a target. We needed to provide a reason why it was imperative to national security. We almost always received a prompt and positive response from the court to our request. So I believe that the administration’s request to expand these powers with the rationale given that the present laws are too clumsy and slow is wrong and demonstrates another attempt at accruing power in the Executive Branch at the expense of our civil liberties.
Interesting thing about MSM not picking up on Dodd:
MSM typically reports what’s already happened: retroactive. Instead of trying to influence debate by being proactive and investigative. Thomas Jefferson defined the primary function of the media as disseminating ideas and issues out there for the citizenry for the purpose of debate.

This is the way to run for president IMHO. I’m not about to pick a candidate at this point, but he’s putting the contest where it needs to be, at the WH doorstep.
Hillary just wants to be loved. Barak and JohnE are in some sort of pissing contest and Dodd’s making them all look, well like they’re part of congress.

But that is precisely what Edward’s should be saying. He seems pretty insulated from taking stands on what is happening in Congress RIGHT NOW! These are precisely the points where he should be telling his supporters to go out and try to inflence things…to prevent the further loss of our Constutional protections or improving things for Americans.
Sure Congress can ignore HIM. But they can’t easily ignore their Constituents that represent a needed pool of voters.
It’s almost as if Edwards wants some of these reactionary Bills and appointments to succeed. Rather than have his supporters get Hillary and Obama to act, it’s almost like he is wanting them to vote with the Republicans. That would alienate those voters from Barack and Clinton. So perhaps that’s why he isn’t out “working” these issues.
Excellent speech! But not as good as George McGovern’s “this chamber reeks of blood” speech in 1970.
I haven’t switched to Dodd from Edwards. Let’s see how Doddio does when the going gets really tough and he has to get out there and filibuster with half the country jeering at him and foaming at the mouth.
So every congressman took an oath to uphold the constitution? I guess it’s okay not to do that if you take the oath with your fingers crossed (on both hands, of course).

i can only hope that there are more people like dodd who understand what’s at stake here and have the courage to speak up.
There’s quite a bit of Dodd vs Edwards going on in these comments, but the truth of the matter is, any Democrat we could put into office (as well as Ron Paul, if he gets the opportunity) will turn the direction of this nation around. I cried, literally tears down my face crying, when Bush won in 2004. I look forward to crying in 2008, but hopefully because our country will become one that I’m proud of again.
It’s a scary thought that I’m afraid to even hit this “Submit Comment” button because I’ve expressed dismay with the Bush Administration. What kind of world are we living in?

Edwards isn’t in the senate and probably is VERY focused on winning over the voters of early election states. Still, it wouldn’t hurt if he put out a statement, so people know how he feels about the FISA debate and Bush’s spying.
I have no idea why we haven’t heard anything and don’t follow his campaign events daily. Perhaps he’s been sick or something. Dunno.
