I’ve spent the day trying to sort out what’s going on with the FISA bill. We’re operating in a political context of many liars, fraudsters, poseurs and kabuki artists, a DC fog machine of secrecy and deception. But there is something happening, a nascent bit of movement, that carries with it the germ of promise. . . maybe.
Last week, Bush Dog Lead Dog and House Majority Leader Steny Hoyer was all set to announce a total FISA sellout bill to make the imperial executive spying powers already granted to this president on a temporary basis permanent. But the progressive caucus in the House threatened revolt, and found they had power to force a bill that sucks in the context of any reasonable absolute standard of constitutional muster, but which, in the current perverted political environment, does not totally suck on all fronts, and it mandates sunlight provisions that could set the table for future reforms, should they be enacted. Still, it needs to be fixed, and we need to apply pressure, right now, to make that happen.
Here’s what’s of note: the progressive caucus has not been known for throwing its weight around or for its ability to overcome egos and petty squabbles sufficient to wield unified power. If they can do this on a consistent basis, we will have an ally inside the House that can exercise real leverage. We would have some group with whom to build, in addition to any Blue America candidates we can get elected. That’s the goal of our whole Blue America effort.
When negotiating (or changing the direction of politics), the initial stages of offer and counteroffer set the potential bargaining zone that might exist. The first offer tends to anchor the conversation, and since Republicans and Bush Dogs have been controlling the agenda, the next counteroffer from the Bush Dog leadership pretty much capitulates completely, every time. They won’t fight the longstanding right wing drift of politics, they’ll only drift with it while lying to the voters in order to expand their own personal fiefdoms.
The revised bill that came as a result of the progressive caucus made some effort to generate a counteroffer, a new anchor, that does in fact try to reopen the bargaining zone and national conversation toward a more rational, and constitutionally sound, spectrum.
The big push right now, until tonight, is to call members of the Progressive Caucus and ask them to stand up against the umbrella warrants written into the current bill and hold out instead for individualized ones FOR AMERICAN CITIZENS ONLY, before any surveillance can proceed. When you’re surrounded by all the fraudsters, poseurs and liars, the only thing you can do is stick to your own principled agenda and find people with whom you can ally and build power, for the long term, and fight like hell for every inch of ground in the immediate term.
Let’s hope the progressive caucus gains a taste for coming together to make shit happen.

since they can do a search in anticipation of a warrant, they have a period of time before they need to apply..I think it is only a few days though

On an issue with respect to this FISA re-write, I hope folks know that what the US Government means by the word “target” and what is actually taking place, are in fact 2 totally different things.
In a roundabout of comments and responses to comments over at Glenn Greenwald’s place today, I raised this very issue:
All of us need to understand this very simple fact: There are no individual targets!
If the US Government had specific individuals to target, then that is exactly what they would do. And they have had that power since the birth of this country.
The logical and mandatory inference to the current FISA re-write shenanigans by the US Government is because they don’t know who to target!
And the final logical and mandatory inference we all must understand is: Everyone is a target!
How about the FDL Caucus? Let’s start getting some Firepups in Congress, kick a few asses, take a few names and “Rescue the Republic”.
I’ll toss in $25 to help get it started…

I can’t run for office in the near term (because of my job) but I ran for state legislator in 2006. I’d certainly be happy to share what little I managed to learn about the whole process if anyone has a serious inclination to run.
I would strongly encourage anyone with serious progressive (liberal) convictions to do just that. But be prepared to put in the time to do it right. Time is the key, especially since I think it’s safe to assume no FDL candidate would be rolling in the special interest money.

And that is how the descent into fascism will continue even if we make big gains in the ‘08 elections (which is hardly a foregone conclusion with the Dem’s penchant for shooting themselves in the foot as frequently as possible).
I’m afraid this is even less likely than impeaching Bush and Cheney, but I think we need to mount a serious effort at impeaching some of the clearly partisan members of our Supreme Court. I really hate the precedent it would set, but I truly feel we are experiencing a time of national emergency.

Bingo. Unless there is a blanket “no warrant required” clause in the bill, the program remains illegal. The Repubs are pushing for the change, because they have been, and still are, operating illegally. The problem is they have created a “story” to change people’s perception of reality in order to manipulate them into feeling guilty about protecting “the Homeland”…it is the same old “story”, and it is not “reality” based. They are datamining, and they are operating illegally and afraid of getting held accountable, that is what they are afraid of, even more than terrorism itself. The Dems have been afraid of being “perceived” as weak on terror. No, no, no…if they pass laws that create immunity for illegal activities by this Administration, they are weak on up-holding the law. That is the real danger. It is nothing more than an exercise of a bunch of twisted, convoluted “confusionspeech”, created by those that are breaking the current laws, that have framed this whole voyage into non-reality.
And as for you Hillary Clinton, I want a comittment from you to seek peace in the Middle East and to not attack Iran. Should you become president.

Um, so what? Just because Bush vetos a bill doesn’t mean the Dems suddenly have to give him whatever he wants.

Repeal the 4th AmendmentBill sunsets in February.The Democrats need to get over their imagined fear of being called “terrorist coddlers”, manage their own best message of “The rule of Law first! We are saving the US and its Constitution” and the Repugs will be overwhelmed at the 08 polls.
With the FISA re-write, the Democrats need only to sitdown, cross their arms and STFU.

Maybe she’s under the influence of the DLC in the same way Edwards was when he was a senator. After he got free of Shrum he became a great voice for all Americans. Maybe she needs to break free too.
There’s an election RIGHT NOW in Ohio’s Fifth District. Not next fall, but next month, November 9th is the primary. Robin Weirauch doesn’t have a real primary challenge, which is a good thing. But come next month the GOP will settle on a candidate and Robin will be running in this normally red district against a Club for Growth candidate (They’ve pured a ton of cash into the race) and that election is right around the corner, December 11th.
