I fear I am comming down with the funk. Those germ factories in velcro sneakers that live in my house have infected me with some dastardly virus. On the up side, I now have a distinct Lauren Bacall tone to my voice today. Sadly, that also means it will likely be a raspy wisper tomorrow.

Not sure if this is your style or not, but these have worked very well for my better half and I.

I’ve got 4 kids under 11 all in school and have not been been ill for over two years, until this week when I got complacent and didn’t take the Immune Blasts, and got a cold. One of those male ego moments, “Nah…I don’t get sick anymore.” Sho nuff…ended the streak that lasted through literally 20-30 various colds to go through the household.

I just take 2-3/day for a few days when one or more of the kids brings home a bug. I never take over the counter stuff anymore like I used to when I got sick several times a year. There is a transition period to get off the drugs, but I really think it’s worth it once your immune system gets strong on its own.

We can get them at just about any natural food store now. Drink insane amounts of water also. Hang in there!

When I was watching TPM’s highlight reel of last night’s Dem debate, I really found the affect of Hillary’s laughter strange, when she was confronted about having voted for Lieberman-Kyl amendment, which Gravel pointed out was a step towards declaring war on Iran. I think it means somebody is not giving her very good advice. She has this sort of forced laugh that turns into a cackle if it’s prolonged enough, and I detect the forced nature of the laugh. It just doesn’t sound all that natural to me, and she sometimes picks inappropriate times to laugh. Somebody should tell her to laugh more sparingly and to choose more appropriately when to laugh, like only when something is funny.

I would still like to see a Burns-style docu on the whole war-from Japan in ‘37, to the Eastern front, Dunkirk, Battle of Britain, Stalingrad, Rommel, July 20th…there’s so much being left out of this one… a holistic historical document is what I’d like to see, all respect to Mr. Burns, and the vets whose stories he does tell.

It is true that he placed a hold on the bill following its passage through the Homeland Security and Governmental Affairs Committee in June, but has since worked out his minor concern with the office of Sen. Joseph Lieberman at which time he lifted his hold.

With Coburn out of the running, the mystery of who was attempting to block public access to Presidential records continued. But now, the Sunlight Foundation has revealed that the senatorial hand behind the secret hold is Sen. Jim Bunning (R-KY):

Senator Jim Bunning (R-KY) now has an objection to moving forward with HR 1255, the Presidential Records Act Amendments of 2007. The bill would overturn an outrageous Executive Order that would keep presidential records hidden from public view indefinitely. […]

Now, whether or not he has had the hold all along, Senator Bunning has been forced to take responsibility for the objection. That makes us happy.

Tell Bunning to let the bill come to a vote here or call his office at 202-224-4343.

But voter-passed (in CA) initiatives – even if Amendments to the State Constitution – deprive the CA State Legislature of the powers set forth in Article II, Section 1, Clause 2.

The (dumped) CA state initiative sought to arrogate to CA voters a power reserved by the Federal Constitution for the State Legislature.

TOW, no family members here who served in WW II, and consequently I don’t know enough about it. Grandpa served in WW I, and my dad was in the AF between Korea and the Nam. WW II has always interested me though.

Probably the single most important event in recent history. The echoes of WW2 surround us every day, whether considering chaos in the MidEast, trouble in Korea, or even just a jet plane flying over…it surrounds us everyday. I truly believe it is impossible to understand the geopolitical state of the world today without a working knowledge of WW2.

Seems the GOP effort to pre-steal a chunk of California’s electoral votes is kaput. So says this LA Times blog. The outfit behind the scheme is “virtually dead with the resignation of key supporters, internal disputes and a lack of funds.”

Met Mommybrain, who btw says’s Hi to Suzanne. She’s still back at the Peach Cafe cleaning up the mess we Dems made.
Met a lot of really nice folks tonight.
And, the man-cub went with us. His idea. He was impressed and learned quite a bit tonight, I think.

My brother and I kept trying to kill each other until we were 14 and figured out that we could work as a brilliant, two-part, parent-fooling team of coordinated lying. It was a major revelation that allowed us to get away with MURDER.

I fought with my younger brother more often than with the rest of humanity combined– mainly because he did not show proper deference to me, his elder brother. This lack of deference may have been due to the fact that we were almost exactly the same size at the time. {sigh} Life is so unfair! (*g*)

How does a state initiative trump the Federal Constitution, whatever Cali State’s rights may be?

The following diary isn’t the article I’ve been looking for, but it seems to speak to this issue (stridency of article not intended towards you, CT… :)

If you have time to shed any light on this, I’d be grateful. I don’t seem to understand something basic here, but I would sure like to be able to…

This initiative could be stopped before the ballot is printed. It doesn’t require protests. it doesn’t require canvassing. It doesn’t require phone banking or a mail campaign or fundraising.

All that it requires is a lawyer who understands the difference between constitutional and statutory law to file a motion in federal court for an injunction.

For those of you who doubt me, take the time to read the California constitution. Particularly Article 2. I’ve heard the argument that “Initiatives are considered products of the legislature,” and it won’t stand up in court for a number of reasons.

First, the purpose of the initiative process is statutory. The CA constitution does not confer a constitutional purpose to the initiative process. In fact, constitutional law initiatives are PROHIBITED by CA’s constitution. Initiatives can’t change the California constitution, and they can’t amend the US Constitution.

Second, the US constitution would have to be amended in order to be able to use an initiative process to decide the apportionment of presidential electors, because the US constitution specifically delegates the authority to decide the method of apportionment to the state legislature. As I’ve already said, the CA Constitution DOES NOT confer the federal or state constitutional powers of the legislature to the initiative process, NOR CAN THE LEGISLATURE DO THAT under the CA constitution. The initiative process is a STATUTORY process. Statutory, as in CA statutes. As in, laws passed under the CA constitution. Not federal constitutional laws. Not state constitutional laws. STATUTORY.

Third, the state legislature HAS ALREADY DECIDED the method of apportionment, and because the US constitution specifically delegates that authority to the state legislature, the initiative process can’t be used to change that decision. Not without amending the US constitution. Does the US constitution state that state legislatures or popular initiatives shall decide the method of apportioning presidential electors? It does not. And it won’t. Unless the US constitution is amended.

Fourth, the initiative process can’t be the SUBSTITUTE for amending the US constitution, without amending the US constitution to allow THAT.

Now, I know that the “conventional wisdom” being spun is that the initiative process creates law that is considered a “product of the legislature,” but consider whether that is a sound argument to allow changes to the US constitution by a statutory process.

My language skills are far from fluent, but I think that the death projection I heard was only for the street protest (the one Burmese state media is reporting only 7 fatilities for). If there were other massacres and this was part of a general bloody crackdown, inside monestaries and stuff, the actual death toll may be horribly higher.
