Last night, after Larry Craig announced he was “reconsidering” his resignation and the audio tape to his lawyer weirdly surfaced, a commenter at TPM made this trenchant observation:
If Sen. Larry Craig reconsiders and steps all over Gen. Petraeus’ week of surge, Bill Kristol’s head will explode. That Penatagon media war room they set up will be useless in the face of this cable TV zoo.
John Amato and I were sitting around here at the super secret Crooks & Liars batcave last night when we read this and started giggling like schoolgirls because it was so true. And predictably, this morning we were watching The Today Show and after only a few fleeting moments of the German terror alert, the subject was once again…Larry Craig.
Right now Bush is trying to hold the Republicans behind the surge, because gawd forbid they succumb to pressure in an election year and embarass him by putting some kind of limit on his abililty to fill body bags. Hence surrogates like Ari Fleischer are dispatched to produce ads shaming Republicans into supporting Bush’s pet war, and the number one target (dollar-wise) was Arlen Specter’s back yard — to the tune of nearly a million and a half dollars.
This article that Julia found from 2005 on Bush’s relationship to Larry Craig was illuminating for a lot of reasons:
Bush is also angry with Craig, a conservative who joined with Democrats in a filibuster to defeat permanent renewal of the Patriot Act. As a meeting recently, Bush referred to Craig as “a goddamned traitor” and told the National Republican Senatorial Committee to start recruiting someone to run against the Idaho Senator in 2008.
Such anger against those who dare oppose him is typical for a President who all too often launches into obscene tirades when his policies are questioned. Bush, on many occasions, has called political opponents “traitors” and, in private, refers to Senate Judiciary Chairman Arlen Specter as a “lily-livered bastard.”
Bush’s petulant, childish bullying tactics may have reached around and bit him in the ass this time. In the wake of the all-out effort to relenetlessly push him off the stage, Larry now seems defiant — emboldened by the support of, yes, Arlen Specter, who just may not be so happy about those ads running in his back yard and everything they symbolize. General Petraeus’ carefully choreographed 9/11 report on teh most awesome surge, aided and abetted by a phalanx of compromised and credulous pundits, PR spinners, think tank personel and other assorted wankers may go down in a blaze of Larry Craig’s bathroom stall glory.
Call it “the revenge of the lily-livered bastard.”
UPDATE: TPM Election Central reports that Mitch McConnell still has a place in his heart (and the Senate) for Senator Craig should he be exonerated of the charges against him. You have to wonder what Craig might have on ol’ Mitch that would be incentive enough to bring him back into the fold, don’t you?

I don’t see this as some sort of deliberate move to distract people’s attention, since the attention it will get is all bad for republicans (unless they watch Fox News, where I bet Craig’s name will soon be followed with a hyphen and a capital D). My guess is that Larry Craig is mightily ticked off at what he believed were his friends in the Senate, pissed at the White House, and is gunning for revenge.
And yes, he absolutely has to have something on McConnell. This is hugely embarrassing for him.

I have practiced criminal law for twenty years in multiple jurisdictions. I have seen thousands of plea agreement forms. I have never seen any that had as defective an advisement to the defendant as to rights regarding counsel. Never. Appellate courts everywhere I have practiced have been consistent in holding that a defendant must be specifically advised of his rights to counsel for the proceeding and that there must be crystal clear record of the defendant having waived them. That is because the right to counsel is a Constitutionally protected right. Because the plea form from Hennepin County used in Craig’s case does not have a full enumeration of the defendant’s rights; there is no clear evidence that the defendant knowingly waived them. In every jurisdiction I have practiced in (which does not include Minnesota, but there is no reason that should be different) this plea form would be found to be defective on it’s face by an appellate court.
Now, the burden is indeed on Craig here. If I were a judge and this matter was put in front of me, based upon the defective form, I would have to set the matter for an evidentiary hearing to determine the defendant’s (Craig’s) state of knowledge and mind when he entered the plea. My personal opinion is that Craig consulted an attorney, maybe more than one, before entering this plea; they just were not attorneys of record in the court case. What the decision would be would depend on the sworn record from there; but the defective plea form really does militate in his favor. Again, here is a link to the actual document. The fully stated enumeration of the specific components of the Constitutional right to counsel should have been delineated in paragraph 9 with the other Constitutional rights that are being waived.

I question whether he really wants out as opposed to just saying he wants out. I said exactly that the second he started making noise about getting out of the plea. And therein lies the ironic beauty here; he likely CAN get out, whats he going to do? I will say this, if I were the Hennepin County prosecutor, I would make a fair wager that I could could convict Craig on a solicitation variation of lewd and lascivious conduct and probably another Minnesota statute (can’t remember the number or name; may actually have been a subdivision of the disorderly conduct section) tha clearly contemplated included conduct of peeping violations. If am Craig I do not want to try this junk; it will get very messy and embarrassing for him even if he does win. There is one other good possibility for Craig, and if I am Craig’s lawyer, this is where I am heading very fast and very quietly. The Hennepin County Court has a pre-trial diversion program that could be offered. I would be talking very quietly to the head county attorney, or his chief deputy, about what a useless mess for both sides this is if it gets reset on a trial docket; big time and resource costs, dog and pony show interrupting other court activity etc. Talk him into stipulating to set aside the plea and entering into the pre-trial diversion program; which is typically a 8 or 16 hour class costing about a $150, an agreement that you will not commit any other offenses for a year and you are done.

bmaz – don’t you think you’re maybe discounting too easily the anger and resentment of both the County prosecutor and the judge involved? IOW, having engaged in what they thought to be a good-faith negotiation (and yes, I think it *was* negotiated) with Craig, that they’ll take at all kindly to Craig now coming back, reneging on his agreement, and then asking for a diversion program in return for his screwing them over?
(and the Minn DOC statute does encompass “obscene” conduct. so that might well be what you’re think of there).
And won’t the diversion agreement, even if he can sell it, still entail a stipulation to the facts as alleged? They do here.

jayt – As to factual basis, some do, some don’t I have no idea what it is in that specific court; but since it is not regulated by the court, but rather by the prosecutor, it could be to an amorphous disturbing the peace anyway as long as the prosecutor was cool with it. As to the anger and resentment on the part of the authorities, that is a very salient point. I almost wonder if they didn’t have some of that to begin with and that is why he didn’t do diversion to start with. More likely, I think that may not be the case and the mail in plea bit was all arranged because it had the least “noise quotient”. In short, I got no idea where that part of it stands. Apparently Craig has also retained Tom Kelly, a Minneapolis attorney that is very well respected by several people in NACDL that I know. We will know pretty fast if this is the course; so we shall see. It may not work, but I sure as hell would be trying it if I represented Craig.

Craig may have an ace up his sleeve re Mitch McConnell’s abbreviated military service, back in the 1960’s. Remember, there was no “Don’t ask, Don’t tell” policy back then…
I’ve been thinking that, given Craig’s reconsideration, it might be time to see if playing with the Lindbergh Terminal map might lead to anything of interest.
Craig was likely flying NW (Northwest) #1276 from Boise to MSP (since the incident happened a little after noon and he had to catch his plane) which landed at 11:44 am and connecting to DC on NW 672 which departs at 1:05 pm.
If some enterprising individual (with press credentials?) could find out which were the arrival/departure gates for these flights (they’re daily with dedicated gates at least they used to be when I was flying this route a few years back) and the location of the restroom in question, this map [pdf file] would indicate whether or not Craig went out of his way, during the limited time he had between flights, to use the restroom

The most damning statement in the police report of the airport incident with Craig is the fact that Craid DID NOT FLUSH THE TOILET WHEN HE LEFT THE STALL!! I just hope that the policeman in the other stall had the good sense to take a peek at Craig’s toilet. If it had not been used, then what the hell was Craig doing in the stall all that time if he wasn’t trying to pick up the man in the stall next to his? Seems to me if that toilet was not used, that is clear evidence that Craig was looking for some action with another man and all the toe tapping, foot touching, and hand swipes were all attempts to find a partner. I don’t know how he can explain the unused toilet any other way!
