Since it’s late on a holiday weekend, I thought we could treat this as kind of an open thread. So very much news happened this past week (was it only last Monday that AGAG resigned? Seemed like months ago).
So, I’m gonna pour a glass of merlot and join the late late night soiree conversation. There’s also some very nice Vermont cheddar if anybody’s hungry.

Wine and cheese are funny. I remember when my sister and I travelled in France. We found out we could not find a bad bottle of wine, even when we started trying to find such a thing, popping into the most disreputable looking stores, etc. Never did suceed.
So we figured, cheese would be the same, right? The first two were winners — some kind of brie for one, and a lovely nutty firm one for the other. The third tasted like it was scraped off the inside of old shoes. We were much more careful with cheese after that. But the wine never failed…

When I was pregnant with #1 son, in the summer of ‘91 we were living in the oh-so-aptly-named Sunland (north of the San Fernando Valley) and we had temps of 117, IIRC. We also had no AC. I was very glad I did not have access to a firearm at that particular time. It cooled off about a week before my son was born, but by then I was an insane harpy.

Holy crap. If they have those facts locked up, that shouldn’t be an issue one would hope. This is one guy that I wish was in the Texas criminal justice system. Never thought I would have occasion to say that….
Perhaps that says something about wishing death for people that harm or kill one of our own. I have struggled with this, thinking about what I would want if someone killed one of my daughters…
Oh, I was not necessarily indicating I wanted this guy dead. Texas is real good at getting them tried fast and locked up for good too. I am not particularly in favor of the death penalty. Not totally on moral grounds, although that is part of it, but more on economic and certainty grounds. Due to the way, ahem, cops often do their jobs, and a lot of other factors, there are very, very few cases that I think have the requisite certainty to even consider the death penalty, even if I was fully on board with it morally. Secondly, although I don’t know the relative figures today, but for a very long time it was pretty much a lot cheaper, in terms of overall cost cost involved, to incarcerate the average capital convict than to go through all the necessary appeals and other steps required to get him to the death chamber and finished off. So it was not worth it morally or economically. Where those relative economic stats are today, I don’t know though.

Planned federal ozone standard could affect millions here

Early next year the federal government is expected to set a groundbreaking ozone standard that could dramatically affect millions of North Texas residents every day.
But if you want to tell the federal government how you feel about the proposal, which could force regional leaders to take drastic steps to slash pollution, you’re going to have to hop on a plane or spend most of the day in the car.
That’s because the only public hearing in Texas is scheduled for Wednesday in Houston.
Environmental groups are urging Dallas-Fort Worth residents to do the next best thing — write and tell the Environmental Protection Agency that it needs to strengthen the ozone standard to better protect public health. Ozone is a lung irritant that at high enough concentrations can trigger asthma attacks and aggravate the conditions of those suffering from other respiratory ailments.
“The current standard is just way outside what any scientist would recommend for a standard that protects public health,” said Matthew Tejada, an advocate with Texas Public Interest Research Group in Austin. “The EPA really needs to hear from people who say that ozone is affecting the quality of my life, my health and the health of my children and my community.”

State selling pristine mountain range in Big Bend

AUSTIN — Over the objections of some conservationists, a pristine mountain range adjacent to the Big Bend National Park has been put up for sale by the Texas General Land Office.
The land offer comes after other controversial proposed sales of state-owned wilderness areas to private interests, including last years proposed General Land Office sale of 400 acres at Eagle Mountain Lake in Fort Worth, and the 2005 proposed Texas Parks and Wildlife Department sale of 46,300 acres at Big Bend Ranch State Park.
Those properties ended up staying in government hands after public outcry: The Eagle Mountain Lake property went to the Tarrant Water District and the Big Bend tract remained in the state parks inventory. The latest transaction, however, continues on course.
At issue is 9,269 acres containing the Christmas Mountains, which is next to the northwest corner of Big Bend National Park. The property was donated to the state in 1991 by the Virginia-based Conservation Fund and the Pennsylvania-based Richard King Mellon Foundation under the condition that it remain protected from commercial development.
To benefit school fund
It is not part of the parks system inventory, but rather is held for the Permanent School Fund, which finances public education, according to information from the General Land Office.
The agency put the property up for auction last month and closed bids last week, Land Office spokesman Jim Suydam said. He said that the agency is not equipped to act as a steward for the land and that various encumbrances placed on it will prevent commercial development.

I once saw her do a gig in a small venue where the total audience was maybe 20-30 people, and I actually got to talk with her between sets! I told her that her guitar wasn’t high enough in the mix, and she laughed and said that I wasn’t missing much.

I want to EPU a comment from the last post, about the circumstances of Deborah Yang’s departure as USA for the Central District of California. There seems to be a belief (supported by what evidence, I have no idea) that there was some kind of grand plot to derail the Lewis investigation, and that Gibson Dunn’s big-dollar offer to Yang was an overt act in furtherance of the conspiracy.
I have a number of friends who are current or former AUSAs in that office. I also know some people at Gibson Dunn. Based on everything I’ve heard (and based in part on what I know from first-hand experience about how the revolving door between government and the private sector works for lawyers), I think the more benign view of the story is more likely to be correct. Consider the following:
1. Gibson Dunn was very late to the party in terms of ramping up its capabilities in white-collar defense and special investigations.
2. Gibson Dunn also has a very bad history in terms of ethnic and gender diversity. It is still a white boys’ club, to a greater extent than almost any national law firm. It hurts their ability to recruit, and it hurts their ability to retain good associate even more.
3. Given (1) and (2), Deborah Yang was an absolute must-get hire for Gibson Dunn. She could have asked for and gotten an NBA All-Star compensation package. I’m sure that Ken Doran and the rest of the leadership of Gibson Dunn consider the money they spent on Deborah Yang to be a huge bargain, and a fantastic investment.
4. USAs rarely, if ever, have a case load. It’s an administrative position. If you look at who actually tried all of the successful political corruption cases developed in NDIll during Fitz’s tenure as USA, I suspect you will find that while his name was on the papers, the actual work was done by AUSAs.
5. Every lawyer who has ever left a government agency for the private sector has left behind open cases. It’s inherent in the process. When I left the office of chief counsel of the IRS, I left behind approximately 10 pending Tax Court cases and a variety of other matters. They all got reassigned, and nothing fell through the cracks.
6. Government lawyers take the rules about avoiding post-employment conflicts of interest quite seriously, as violations are felonies.
All of which is by way of saying that if anyone has real evidence of problems surrounding Yang’s departure, I’m willing to look at it objectively. So far, as near as I can tell, no one has come up with any.

The NRA has decided to offer all active-duty troops a complimentary year’s membership. The $35 per is not exactly monumental, but the NRA could gain thousands of lifelong members out of this dandy bit of PR. And while the fact that the latest issue of American Rifleman may be at a soldier’s doorstep his first day home from combat isn’t ideal, I think the NRA is on to something fundamental.
Troops should get free memberships everywhere, to gyms, museums, rotary clubs, Costco. They should get to the head of the line at movie theaters, the DMV, for Southwest flights; we should be yielding to our troops at every turn (not to mention ensuring they get proper medical care, and jobs). Instead, we likely treat them like any other strangers; we honk at them for cutting us off, hustle in front of them at the grocery store, and generally ignore the sacrifices, and adjustments, these men and women are making.

This is very thought-provoking, and may be right on, but I would offer the following as counterpoints: Why did Yang choose this particular time to leave? Even though the USA may not try the cases personally, would the USA not have enormous influence over setting priorities for the office? Doesn’t the entire US Attorney scandal suggest that it is critically important who occupies the position of USA, especially where there are political battles to fight with a corrupt Justice Dept.? What about that piece that came out recently (forgot which blog) that said that the Lewis case wasn’t happening because there were insufficient funds in the Justice Dept. budget? Can’t we afford to go after corrupt congressman? What is Yang’s replacement doing to advance the cause of justice? I admit that the foregoing does not suggest that Debra Yang herself is corrupt, but it leaves open the distinct possibility that the system has been corrupted. IMHO.

That’s what makes all this talk about Iran being a strategic threat to the world just more horseshit. We’ve only heard about Shahab-6 (and that from the Washington Times), and there have been no field tests I’m aware of. Beyond that, the Shahab-6 is expected, if ever delivered, to have a range of about 5500km, possibly capable of reaching southern Europe, not the U.S.
No time for hysteria. This is nothing more than bluster. Typical for Iran, but not anything resembling an accurate assessment of their capabilities.

Absolutely, on both counts. That’s why so many former government lawyers are so freaked out by the USA scandal.
It happens. I posted a comment on the last thread about a similar experience that a friend and former IRS colleague of mine had. It sort of goes without saying that it’s difficult to fully fund DOJ, IRS, SEC, OSHA, etc. when we’re pissing away billions of dollars a month in Iraq.
I can’t speak to specifics, and I’ve never met the guy, but he is a very highly regarded career prosecutor. CDCal is in good hands, at least for now.

Ooooh – a B-3! Lucky you. The Mister would not happen to be on a Hammond list, would he? I have a Hammond A-102 (with matching 251 Leslie) in my studio that was in an old lady’s living room for 40 years before I got it, and an M-103 and 2 pianos (one baby grand, one spinet) in the living room.
I play at Cozy’s in Sherman Oaks from time to time – I’m not gigging as much as usual because the lead singer in my all-girl blues band just had a double mastectomy (don’t get me started on health care!) but I play various gigs here and there. I used to play BB Kings regularly but it’s gone sharply downhill in the last couple of years.
Tomorrow night my husband and I are going to go jam at Cozy for the Blues Jam with our kids, who play drums and sax – it’s the last night before school starts, and we’ve had them down there every Monday this summer to get their chops together, so if any Pups in the area are around the Valley tomorrow night, we’d love to see you at Cozy’s!

The only thing the Iranians really have is personnel and some outdated tanks. They can’t use them against the U.S. except by crossing borders.
What most people in this country don’t realize is that Iran simply isn’t a big threat. I don’t think any of the region’s nations want to get into a war with them, which would turn into a long war of attrition.
Why is it that the U.S. invaded Iraq? Because sanctions, inspections, the last Gulf War and the Iran-Iraq war destroyed their capability to fight back. Why is it suddenly impossible that the same is the case with Iran? I don’t think they’ve come close to fully recovering from the Iran-Iraq war.
The U.S. will want to bomb the shit out of them, first and foremost, because they have no real air defenses. All they really have is people, and some temporary means of fighting a land war in their own neighborhood. That’s why nobody is talking about an invasion.
The Iranians will sit there and take it, and then devise non-traditional ways of getting back at the U.S. Iraq will come apart at the seams, and, contrary to their own previous policy and animosities, they’ll start shipping arms and some money to the Taliban.
In fact, I think there will be little likelihood that they’ll be able to inflict much damage. Most of what the U.S. will expend will be cruise missiles, and other stand-off weapons. Iran won’t even be able to get close to the attackers. (Sure, there will be some bombing excursions deep into the country–there are DFCs to be won and generalships to be ensured.)
What I’m suggesting, and most of the rest of the world knows, is that it will be like one of Cheney’s ground quail shoots. And it will be done for no other reason than the silly and wholly ridiculous notion that all that destruction will cause the fall of the Iranian government, whereas quite the opposite will happen. It will be like 1979 again.

{sigh} I once knew a teen queen of pretty similar talent and beauty– but she was already married and had 3 kids. That marriage eventually broke up, and after several intermediate marriages she eventually settled in with a shiftless banjo player I knew. I moved away, so lost track of them, but I’m pretty sure that they played local clubs over the years. Emmylou didn’t have a kid until her career was on its way, and then she only had one for a good long while.

Remember, they are receiving billions of dollars for social services in alcohol and drug counseling, elder services, abstinence training, general counseling (mental illness may be viewed as influence by demons or worse), prison outreach and much much more.
Take the time to understand that people with virtually no education or training are being paid billions to administer services to those who may need medical help, psychological or psychiatric help, social workers, nutritionists and more.

Actually, I agree with everything you said, but was unwilling to say it myself b/c I have no first hand knowledge (or even quality second hand knowledge) of what goes on in htat particular office.
Further, USA’s usually DON’T try cases tehmselves b/c it is considered too risky to the reputation of the office and b/c USA’s are usually not personal themselve “trial Guys”, They are usually politcal guys.
PatFitz in NDIL is an exception to both those rules and is a more ahnds on than the norm. He actually argue pre-trial bail applications in the Conrad Vlack case.
For him, I think going into court is a temptation that takes him away from all the dreary papaerwork. *g*
