SEC. 13. Recall is the power of the electors to remove an elective
officer.

So any officer that’s elected to their position. Which would make them eligible. I would not be in favor of this (I was not in favor of Davis’ recall as much as I detested the man), but yes theoretically such a recall could be initiated. There are some variations in the rules about how many signatures are required to be collected depending on the office, but otherwise the procedure’s the same.

I think you completely ignore the next Article of the State Constitution.

ARTICLE 2 VOTING, INITIATIVE AND REFERENDUM, AND RECALL

SEC. 14. (a) Recall of a STATE officer is initiated by delivering to the Secretary of State a petition alleging reason for recall.Sufficiency of reason is not reviewable. Proponents have 160 days tofile signed petitions.
(b) A petition to recall a statewide officer must be signed by electors … Signatures to recall Senators, members of the Assembly, members of the Board of Equalization, and judges of courts of appeal and trial courts must equal in number 20 percent of the last vote for the office.”

The reference to Senators is to the STATE SENATE…not Congressional Senators. After all the following reference is to the Assembly, and there is no mention of the House of Representatives.

“SEC. 18. A state officer who is not recalled shall be reimbursed by the State for the officer’s recall election expenses legally and personally incurred.”

“SEC. 19. The Legislature shall provide for recall of local
officers. This section does not affect counties and cities whose
charters provide for recall.”

Thus the California State Constitution DOES NOT have any role in authorizating the recall of Federal Officers…only those that serve at the State and Local level. In addition there is NO procedures enunciated for initiating the process.

Don’t get distracted searching for this as a solution to the issues with Pelosi or Feinstein. It isn’t there!

The second act which evidently will begin in Jan.2009 is already being scripted and cast for.

A hint: Democracy in Iraq proves untenable (that is to say not to Americans liking for lack of control it presents) and a new Iraqi strongman has been mounted. Iran attack really fucked things up in ME and Americans are now getting push back from China and EU. Americans are now in full ME disfavor for not being able to knock Iran over as advertized. Pulling in Israeli troops,armor and air force assets has really backfired for Americans amongst ME Muslim world.

Israels unilateral decision to fully take all of West Bank and integrate into Greater Israel has set off a ME firestorm of unrest and anger.

All Palestinian Arabs being forced to leave and go into Jordan,Syria,Lebanon or Egypt.

Israel is now viewed fully in Arab world as a pariah and outside of international law.

Israel fully declares itself defiant of any attempt to force it to backdown.

The Americans throw full support behind Israel.

The Americans are forced to pull back from Persian Gulf as they are now seen as the real enemy of Muslim world throughout the Gulf and in Saudi Arabia. Egypt breaks off relations with the Americans as does Turkey and Indonesia. Malaysia and Pakistan break all formal contacts with Americans as well.

With three American supercarriers now sunk and four more knocked out beyond repair the myth of American naval/air supremacy has been demolished. Iran is being armed and rearmed via Russian and Chinese channels. Americans can do little about this as they are fully tied down defending Israel as that is only remaining open access point into ME for the Americans.

Sending in three small tactical atomic weapons on two military high value targets raised ME uproar against Americans and Israelis.

Tehran has been nearly leveled. World cultures and heritage preservation groups all in full condemnation of American/Israeli ME reckless air war conduct and destruction.

Refugee populations in ME now unchartable and becoming very real threat to all ME countries.

United Nations has held five votes to stop the Americans and Israelis from further ME war and fighting. Americans have not agreed to any UN moves which restrict full,open ended American or Israeli ME military conduct or actions.

Americans are paying $16 per half gallon of gas and $19 per half gallon of diesel. Limited to one third tank per auto or light truck per week with permit. No permit. No fuel.Fuel tax revenue flows have collapsed. Airline travel? Restricted to extreme need/VIP only. Heavy land haul fully governed by available fuel supply and economic tradeoffs.ME war taxes and rationing systems now fully in place after the early Bush/Cheney reality denials are taken down. There is now an American military draft in place. It is very unpopular as going to ME is seen as likely one way trip alive.

Americans now not allowed/welcomed in many countries around the planet.

Americans seen as warmongers/warcriminals.

I call his office and make suggestions and offer support for a strong position. I feel like the most I get is a cotton candy response. All air.

And, if the Repubs don’t deal, then they’re gonna be in serious do do come election day. The public will not take kindly to lost opportunities or sheer stupidity.

Reid is doing the prudent reasonable thing to offer. It’s up to the few smart Repubs to accept.

… This country has become very strange.

There is actually a possibility it has been “very strange” for a very long time and that it is only now that we’re transitioning to a “normal” time and just now seeing the strangeness, like moving from the shadows into light and noticing how odd the shadows look.

Maybe evil can only be seen in contrast to good and not when experienced by itself.
