In case you’re confused as to what exactly happened in that airport bathroom between Senator Larry Craig (R-ID) and that undercover cop, just click here — thanks to CBS13 TV in Sacramento — and all will be revealed. (The hand in the still shot belongs to the guy playing the role of Larry Craig.)
Love,
PW
UPDATE: As Glenn Greenwald pointed out, when BlogActive’s Mike Rogers first broke the news of Craig’s penchant for (illegal) airport sex back in October of last year, the Republicans were unanimous in their support of Craig and condemnation of Rogers.
And let’s not forget that they’re lockstep-solid behind Diaper David Vitter, even though he solicited hookers and Craig apparently has not.
The ONLY reasons they’re attacking Craig right now are: 1) He pled guilty (and that can’t be taken back — not in this case) and thus he’s been nailed dead to rights, 2) they don’t want this to hang around like the Mark Foley or Duke Cunningham cases (not to mention Tom DeLay or Bob Ney), and 3) since Idaho’s a Republican state with a Republican governor, they figure that if they can shame Craig into retiring ASAP, they can appoint another GOPer to replace him in time for the general election for that seat next year.
And it looks as if the campaign to force out Craig is working: He’s been forced to “temporarily” give up his committee seats, including his position as the ranking Republican on the Senate Veterans committee. I suspect that he’s going to be gone by, oh, Friday afternoon or thereabouts.

Wuv’s ya, too…!!!
So… what is new with the fascist party?
What’s with the sandals-no socks with a suit? Nice look.
I luv that The Beard had to interrupt his regularly scheduled Situation Room irregular breathing to report on just how much sex is going on in men’s public restrooms. Couldn’t’a happened to a nicer guy.
And mothers of America, I ask you, would you want your son to go into a public restroom if you knew a Rethuglican Senator was inside?
So, are we calling the affair Toiletgate then?
Larry Craig, R-Udaho?
OT – Everyone should check this out:

Feingold does it again!!
Gore/Feingold ‘08
PW,
I don’t care about sexual orientation.
Guy meeting guy in bathroom.
I don’t care,
MSM gets off.
The one thing I’d worry about Larry Craig, though, is his vulnerability to being blackmailed.
Prairie Sunshine @ 9
He’s “The Beard” now? And not Leslie(I don’t know how he got the nickname Leslie to begin with)?
Joe Klein’s conscience @ 12
OUTstanding!!
Jonathan @ 13
How do we know if he wasn’t already being blackmailed all these years? His sexual tastes have been grist for the political mill for a long time.

Oh, stop snickering.
airportcat@15
feingold is my wished for candidate but he wont get into the race sob sob sob…..
Jonathan @ 13
The real issue here is simple hypocrisy, not the morality of the senator’s acts. He’s a culture warrior who publicly advocates that those of his own closet sexual orientation be hunted down and subjected to Kristallnacht.
This being said, I am impressed that his fellow rethugs took all of two days to strip him of his leadership positions and seniority, while our party allows our own traitors to keep all of their power and honors intact. If being a hypocrite and party traitor gets you sidelined, then Lieberman, Landrieu, etc, etc should’ve been booted out of our company a long time ago. As usual, the rethugs are showing discipline, albeit in the service of their evil, bigoted, hateful vision, while we’re still showing our fear. It’s frustrating.
Twain @ 19
lol, yeah, good to see :D

Likewise, Gore! *sob* *sob* :-(
KO will be doing his own re-enactment.
And Harry Shearer was great, speaking from NO. Someone draft him for the Senate.
Senator Potato Head, it’s a vast wasteland out there…
hope you find enough truck stops.
Feingold really is terrific. Good brain, great heart. Wish there were more like him.
They’re going nuts here in Yankee stadium. I hear Paul McCartney’s here.
Did you know Rudy Giuliani spent more time in Yankee Stadium than the Yankees did? S’true.
well.. speaking of the war that we are in. What is the bet course to take with the NSA?
I was thinking of encrypting large data sources to waste the enemies time and money.

Jonathan @ 13
Oh, dear, Jonathan’s baiting me again. (wink)
Let’s see: Ever have sex in a bathroom? Ever have kids walk in on you?
If Craig wasn’t such a self-hating doofus, he could have found safer ways to stay in the closet and lie to his family as well as to the gay-bashing people who got him elected. But unprotected encounters in airport restrooms? Over a period of decades? Hello?!?!? The miracle is that he wasn’t nailed before this (though he may well have managed to have scared off other cops in the past, as he tried to frighten away the Minneapolis cop by flashing his Senate ID card and saying “what d’ya think about THAT?”). (I was going to say that the other miracle is that he apparently hasn’t given his wife an STD, or anything that can be passed on to the kids, but that’s between him and his family.)
But of course nothing I say or do will convince you that this is worthwhile and that we should all be deathly, boringly serious at all times. So I’ll stop here and let you have the last word or eight.
jane hamsher @ 28
Heh, so’s Billy Crystal! Hmmm… I thought he was a Mets fan…???

Sure would be nice if Mr. Progressive Feingold could actually find the cojones to consider impeaching someone. Now that would impress me. The rest is hollow rhetoric until the Constitution is honored by exercising the precise mechanism it contains and contemplates for times like we find ourselves in.

Did everyone contact MSNBC and tell them to fire Tucker…….?
Eureka Springs @ 38
so, craig might actually run for re erection

and I believe he went to yankee stadium with drag queen guilani,, I know he offered to push in his stool
uggg…it’s been a long day, sorry for those but I had to do it
If the CBS crew was going to reenact the scene, they should have read the report correctly. Craig was not sitting to the officer’s right, but to his left. According to the officer, Craig had to reach across his own body to “stroke” the underside of the stall divider.
If the CBS crew had the setup correct, the one announcer would have realized that it was strange for Craig to stroke the divider in his left hand. It would have been interesting to see him describe/speculate just what Craig was doing/stroking with his right hand…
bmaz @ 45
Feingold is a Senator. He can not impeach anyone. Impeachment happens in the House of Representatives.
As remarked earlier,
the story is when he Craig attempted to intimidate the officer with his Senatorial credentials.
Picking up guys in public restrooms is, well, tacky at best, and undoubtably hypocritical. But honestly, I don’t care.
Attempting to use your position to intimidate law enforcement.
A clear ethical violation, if not criminal.

According to some of the Idaho sites I read, Craig got married after the first rumors that he was gay. Somewhere someone said the kids are hers from a 1st marriage, but don’t know if that’s true. Idaho Statesman, I think, asked him in interview if marriage was merely one of convenience. So, maybe there was not so much danger of the STD.
(disclaimer) only if all of the above is accurate, of course.
kirk murphy @ 52
Or babelfish project gutenberg texts… then ftp them to somewhere central asianish. ‘course when they finally put you on trial for your life, they’ll probably allege that you used code to incite terror. Avoid the word “zucchini” if possible

GordonM @ 25
At least it is educational for the rest of us here who wouldn’t have a clue if somebody appeared to hit on us in the public bathroom pit stop….
I’m all for enlightenment….
it’s on right now…..
Sangermon@50 Feingold is a Senator. He can not impeach anyone. Impeachment happens in the House of Representatives.
Well, actually I am quite aware of what office Mr. Feingold occupies. But when a powerful progressive voice like Feingold goes out of his way to dismiss impeachment and affirmatively try to discourage it; that is pretty significant. As a Senator, Feingold took an oath to the Constitution; he is currently failing that oath. That is just a fact. I very much like and admire Feingold; that is why I am so upset and disappointed with him.
Just imagine if Craig was a black senator. Because of his intimidation attempt, the officer would have no recourse but to remedy the situation by giving Craig $20 to blow him.
Sen Craig has certainly provided me a window into a world that I never knew existed, but then, I’m not a Republic.
I don’t know about the intimidation bit. You could just as easily interpret his “What do you think about that?” comment when he flashed his congressional ID, as an ironical admission that he was just caught and likely in big doodoo.. as in “OK.. bet you had no idea what you just reeled in..” I mean, at that point, he was nailed. There was no way, short of bribery, he could conceal his ID at that point.
tw3k @ 35 — Ooooh! Thanks for that. Howie reminds us of Rick Renzi, another GOP scumbag who’s about to go the Duke Cunningham/Bob Ney/Tom DeLay route.

Jonathan @ 13
Those are Rove’s/Cheney’s favorites senators. Look how quickly Vitter announced that the surge was a success.
Hi PW!
I’m sorry, but the left’s interest in the Craig story is kind of gross. I’m always happy when a Republican screws up, but gay guys messing around in a restroom is NOT a big deal. There is a reason why some gay men have historically had to resort to picking each other up in restrooms. And there is no reason to think that Craig was not going to be discreet (nor is there any reason to think his conduct respresented a threat to a kid who might have overheard him). This is a totally minor story w/ a creepy homophobic bent.
Phoenix Woman @ 64
gah, that guy ain’t human :(
Badwater @ 62
I remember reading about the T-room trade in college, but I guess I never really believed that kind of thing is a normal occurrance. But then I don’t hang around men’s rooms either.
PW,
I look at it as an intelligence officer (which I was in Viet Nam).
Is Larry Craig vulnerable? Does he know something I want to know? Can I offer him something he wants that will cause him to tell me stuff I want to know?
Hi tw3k!

dharmamarx @ 68
Say what? TRex wrote about it last night, too.
Sure. For thirty years, the GOP connives with moralizing faux preachers, using gay rights and reproductive freedom in their cynical effort to take power long enough for the megacorps to loot us.
Funny you’ve missed the consequences – here in SF, we haven’t. We get LGBT kids and young adults from all over the country, kicked out of their homes ’cause their credulous TV addled parents actually believed the phony preachers in the GOP hate machine.
Yeah, nothing to see here, just move along.
Nothing to see if you choose to keep your eyes closed.
dharmamarx @ 68

And he used to be my congress critter, before I moved to Hawaii. I tried to help the Democrat running against him in 2004, but his congressional district is one of the largest in the country, and is full of redneck conservatives, as well as Indians and ranchers and lots of land and sand. I don’t know what y’all are so excited about. If you read the whole story he seems to be saying that he isn’t yet convinced on impeachment.

much harder but the hague would work just fine for me.
PW,
I love your posts.

dharmamarx @ 98
Larry Craig is a sad repressed gay man who is so dead inside that he must make everything dead around him.
Just a matter o’ time!
Good riddance, hypocrite.
tw3k @ 99
Now you’re talkin’!
I’ve learned a lot here today. I didn’t get the part where the police officer put his foot under the partition and into Craig’s space until I saw the video. I have no patience for hypocrisy, but that looks like entrapment to me.
yellowsnapdragon @ 81
It’s also pretty much illegal to have sex in public, no matter who you are or what your sexual orientation.
Yes, KO said he’d have a re-enactment on his show, and in theory, it should be on right about now.
However, I wouldn’t know. I turn off his program after the Worst Person in the World segment.
I usually find his “#1″ story to be celebrity-driven and utterly nauseating.
bobschacht @ 93
Mazie, expressly told me she was very interested in Impeachment Proceedings, particularly Cheney!!! *g*
Michael Harold @ 104
KO reading the police report and the cop states that his foot stayed within his stall area but that Craig moved his foot into the cop’s stall area.
sangemon @ 103
Impeachment would simply deliver Shrub to the Hague, in a lovely orange Jump-Suit!!!
KO with the straight flush!
dharmamarx @ 98
uh…I’m all for having fun in the woods…. But….
getting caught for public sex acts get you on the sex offender registry…..
Moral of the story: In a crowded public place, if someone offers you a choice between publicly accepting their genitals or publicly accepting a bag of pot, in California the bag of pot is less of a bust.
Second moral: select picnic baskets large enough for the ultralight 2 person.
Or just leave the basket and take the tent and munchies – and a friend.
Be prepared!
No I haven’t missed the consequences of this. Craig and the rest of the Republicans are small, nasty little people. But why am I supposed to be disgusted w/ the guy for trying to get off in a restroom? That’s it’s hypocritical? EVERYTHING the Republicans do is hypocritical. The Republican party does not give a rats ass about homosexuality; the sole reason for the existence of the party is to make rich people richer. And since they refuse to admit this, everything they do is hypocritical.
kirk murphy @ 84
Well I for one thought that Diaper David Vitter would poop out but he really managed to keep his sh*t together and remains unchanged in spite of everything.
Go Big Papi!
(sorry folks)
Steve-AR @ 90
I didn’t see this but read the transcript. Is it possible that Abrams was egging him on knowing he was bulls***ing. And then was laughing at HIM rather than at the story. I know guys that do this to people that they know bulls**t shamelessly.
dakine01 @ 105
yeah but doing “it” next the Fine Art Museum is great :)
OMG, Dan Abrams just pointed out that R’s have had double the number of sex scandals as the D’s.

Hugh @ 113
I’m surprised he didn’t receive a ‘Bobbitt’ trim, yet, when a Dem Gov. does the appointing it OKIYAR …!!!
dharmamarx @ 98
No, it’s worse than a bag of pot. Private consensual behavior is one thing, but adult consensual sex in a public place is not private, and the public has an interest in not being exposed to it without consent. I am a libertarian when it comes to sex, and I have absolutely no problem with consensual sexual behavior of any kind, but there is definately a strong argument that people should have the option to be “free from” as well as “free to”.
OT (refers to an earlier thread)
NYT has an article up about the Foster execution.
http://www.nytimes.com/2007/08…..te.html?hp
Interesting: his father takes some responsibility for the path his son took, saying he was in jail at the time, had taken his son with him to buy heroin when the boy was small, etc. He says if he had been called to testify he believes his son would not have got the death penalty. And he may well be right about that. Don’t recall who Foster’s trial lawyer was; he has one of the best for the appeal, but the execution date is tomorrow.
As I said below, my feelings are too mixed on this particular case; I generally oppose the death penalty but occasionally, there’s a crime that makes me think it’s appropriate…
dakine01 @ 114
Shaka, Bra!!! 8-)
I can’t believe I’m watching this. Serious People on my teevee are discussing political sex. How weird.
What I still want to know is, how did Roll Call get the tip about Craig on the very day Gonzo resigned? Someone from Roll Call is on this show, so maybe Abrams will get around to asking that question.
tejanarusa @ 122
yeah, that just a shame all around. Even worse that it all just boils down to politics.
perris @ 74
I really like his quote at the end:
“I understand the politics of impeachment,” Conyers said. “But we have something going on now that we’ve never had before.”
Absolutely right on! I’m glad to see that someone in the Democratic leadership realizes that!!!

I think his bravado statement about assaulting a gay man is overcompensation for his fears about his own masculinity…

TheOtherWA @ 130
well… their is “reason!”
juslin @ 119
Actually, to me it’s that (a) the story is actually being reported and (b) Repubs are jumping on him. Which means that the media and some Repubs are running scared and no longer willing to just ignore and bluster. Heck, within one day we heard “Clinton did it too”. That usually takes at least a month.
as far as craig, why isn’t anyone asking about the charges of peeking?
that is to me a far worse crime then what they are discussing
he plead guilty to peeking
nobody is discussing this
why?
newspaperbrat @ 133
You’re such a dear, sigh, I agree with the Nobel Prize, but, alas, no further…!!! ;-)
Well, the moms on here discussing the idea seemed to think sending off their young son to an airport restroom where two guys were having it off was a problem.
Even in SF, I’m not finding Larry’s choice of play space to be winning any sympathy.
You may not grasp this, but most people get all squicky about sex acts in front of children – or where children can readily observe.
Amazingly enough, the practice is a felony sex crime in many states. Should this trouble you, perhaps lobbying your statehouse on the issue may bring relief.
Do keep us posted on the campaign; the media should be memorable.
Can’t wait to hear about the campaign supporters, too…from a safe distance.
And the ad campaign…

quick search;
Why does the public have an “interest in not being exposed” to consensual sex? I missed how my well being was in any way threatened by witnessing two (or twenty) people screwing. But, if you like, I’ll change my comparison: it’s as bad as getting caught speeding. (People sometimes die from that.) Furthermore, it’s unclear to me that a closed bathroom stall really qualifies as “public.” Lots of things happen in closed restroom stalls that do not happen on, say, public sidewalks (I hope). That we have cops sitting around in restrooms sniffing out homo sex seems pretty creepy to me.

perris @ 142
I missed something. Where was he caught peeping?
Badwater @ 86
yep.. and also why we need to stay on top of it, despite its sordid nature. Under Rove & Co, the current rethug leadership has built a disciplined and highly effective party mechanism based on fear, greed and outright bigotry… if Craig’s discomfort helps us highlight that, and the need for change if we are to reclaim our country, then something good might come out of all this.
They made this country into a place where it’s WRONG to be difference, and where our diversity has gone from a perceived national asset into the perceived source of all of our problems. That’s unacceptable, and it’s a path we have to get off of now… if we have to out every last Larry Craig to do that, then so be it. Heck, in my opinion, this is every bit as important as Iraq, domestic spying, torture and shrubco’s financial corruption.
Anybody know how Bo Diddley’s doin’?

What gives this story real legs in my tiny opinion, and negates the “Clinton did it too” garbage is simple. Clinton did not repeatedly and consistently attempt to use his political power to criminalize oral sex. He never tried to deny others the right to enjoy oral sex in private, never attempted to refuse parental rights to those who enjoyed oral sex….etc etc. Craig did these things towards gays, over the long term, consistently. It’s the hypocrisy, stupid!
Elliott @ 174
So did I…!!!
wangdangdoodle @ 173
that’s painful!
Wow, I’ve seen so many people on teevee today that look just like Larry Craig.
solai @ 149
It’s a question of judgment, isn’t it. These rumors have been swirling around for a long while, and you know Romney had to have heard them. And if he hadn’t, he chose to have a senator on his team who was voting in such a homophobic way. Either way, really poor judgment.
Elliott @ 179
Oh yeah. I could tell my favorite I.T. guy wanted to strangle me!
wangdangdoodle @ 174
omg!!!
Shadowstalker @ 176
The clip of Craig’s eyes lighting up and practically licking his lips as he calls Clinton a “nasty, bad, naughty boy” is truly… something.
Perhaps this is old news, but Toles on Craig is great.

A-men…
kirk murphy @ 166
No, no dumping going on in that mens room
Shadowstalker @ 177
Seems to me that there are two levels of hypocrisy here, in that the repugs dealt with Craig in a different way than Vitter.
LoudounLib @ 183
No shit. I was able to restore, though, without having to ask I.T. to dredge it up from where-ever…

Yep. And it is also illegal to go to a prostitute anywhere but Nevada and NO and DC ain’t too awfully close to Nevada.
And isn’t it Richardson’s campaign that cut a guy loose who had worked at a brothel? Of course, he’ll catch a ration of sh*t just for having hired the guy in the first place.
repug news network is working overtime to see how many ways they can avoid covering one of their fave senators
Posting here ’cause I surely hope this latest [!?!brightshinything?!?] will mostly disappear from the airwaves shortly, except for ushering the latest dishonored senatorial-seat-holder O.U.T. asap, and we can return the nation’s concentration to restoring basic human rights, Katrina’s lingering and languishing problems still desperately needing attention, the disaster some well-known folks in this country helped cause in Iraq,…
Forgive me if this already covered…
The estimably variegated Gairy Bower on Tweety tonight, bringing all his assumed glory to bare on the hounding of poor, hapless sacrificial lamb, Larry Craig:
“It’s not that Christians don’t sin. It’s that Christians are forgiven for their
sins.”
Where does one begin? Why does he still get airtime? Ask Tweety & MSNBC.
dakine01 @ 199
NO = New Orleans? I did not know that prostitution was legal in NO.
Louis le Chat gets a cameo appearance in Ready-Made Magazine.
punaise – Did you catch Karina Gore’s quote the other day that her pappy likely won’t seek the presidency? Don’t have the actual quote handy but it gave me renewed hope he will accept a draft.
Our work has just begun. Keep the faith at least until a week after he returns with his Nobel Peace prize.
Did you catch the New Yorker story on freshly minted French President Nicolas Sarkozy’s American visit with Shrub -8/27 issue?
hey, it’s Valley Girl!
Valley Girl @ 201
Yes, NO = New Orleans and prostitution is not legal there or DC and those are the two places Vitter is supposed to have (and pretty much admitted) breaking the law. The only places in the US where it is legal is some of the counties in Nevada (and Vegas is NOT one of the legal counties).

kirk murphy @ 209
they were godless heathens Kirk, can’t be forgiving the unbelievers.
Loo Hoo. @ 181
My point Solai and LooHoo from last night about Craig – this whole thing shows someone whose judgement and decision-making process is so poor that I certainly would not want Craig – OR Romney to represent me. Romney is an opportunist and I certainly hope the voters are getting a good view of someone who found it really easy to be pro-choice in MA when he was governor but “found Jesus on the courthouse steps” on abortion and stemcells when we decided to run for president. Sorry, Mitt – it just won’t fly. And throwing your buddy under the bus when he got into a tangle – well, that is really just standard MO for the GOP – I think it’s in Rove’s handbook.
Adie @ 207
Maybe I just need a magnifying glass?
newspaperbrat @ 203
didn’t see the quote, but I’ll hang in there for Gore with your encouragement.
Missed the Sarkozy article (subsription lapsed) but I’ll find it online. I wish I could get someone to airbrush out my paunch! (big scandal in France – Sarko’s buddy, the publisher of Paris Match, airbrushed out his love-handles in a vacation picture.)

Beer break, potty run, ciggie…
WaPo:
Saying that former Massachusetts Governor MItt Romney went out of his way to “distance” himself from Sen. Larry Craig yesterday would be a understatement. Romney called his former Idaho campaign chairman’s behavior “disgusting,” leaving little doubt about his feelings on the Idaho Senator’s guilty plea on lewd conduct charges stemming from an incident in a men’s room in the Minneapolis airport. But it isn’t the only endorsement a 2008 candidate has run away from this year.
In June, after South Carolina Treasurer Thomas Ravenel was indicted on federal cocaine charges, Rudy Giuliani’s campaign quickly announced its state chairman in South Carolina would be stepping down. And in July, Bob Allen, a Florida state representative who was serving as the co-chairman of McCain’s Florida campaign, resigned from that post after being charged with soliciting an undercover male police officer for sex in a public bathroom.

The Republicans are finally not playing the party line to protect their own. And on such a burning issue as . . . a harmless misdemeanor involving sex.
http://rawstory.com//news/2007….._0829.html
Yes there is hypocrisy involved. But really. This the thing Republicans choose to jump ship on their own on??? What about the war. They still huddle around the Fox Republican leadership on the war, torture, secret spying and so many other issues that cost American LIVES, hundreds of billions of taxpayer dollars, and our values and civil liberties. Where are their priorities? Why are they turning on this guy? Because Craig didn’t turn to them before blowing up this scandal. In other words, he screwed me so I’m screwing him. That’s how the Fox Republicans think. It’s all about them. Not about the good of America. So sad. So darn sad.

lol good Q!
i watched Craig’s press video on C&L yesterday, where he says hs’s going to ask his counsel to advise him on what to do. Here’s some free advice: quit going to airports to give bl*w j*bs in public restrooms. Just do like Jeff Gannon and the rest of the Republican pervs, and go do it at the White House.

Backwards. They’re turning on him because of those other things. Remember how long it took the Foley thing to play out? Remember Hastert going to the mat (*cough*) for him? And that involved minors. This is the first time they haven’t tried to paper over the crack (*cough cough*) and pretend everything is just fine. Stock up on popcorn. They’ll be ripping each others hairpieces off soon enough.
Heh, and the other one passing unnoticed – WH guys pranked Rove’s car. These are the guys that completely manufactured the tale of how the Clintonistas trashed the WH. They just did more to their own than Clinton’s crew ever did to them.

Press Bias
While the Press has created a huge furor over Idaho Republican, Rep. Craig’s brush with the law in an airport, there has been another unlawful incident that has been completely ignored by the National Media. Democratic Rep. Filner just last week was charged for his run-in with a baggage clerk, also at an airport. The significance of this is that
although Republican Rep. Craig’s charge was simply a misdemeanor Disorderly Conduct, Democratic Rep. Filner was charged with Assault and Battery. The severity of these charges are as follows:
Disorderly Conduct
Almost every state has a disorderly conduct law that makes it a crime to be drunk in public, to “disturb the peace”, or to loiter in certain areas. Many types of obnoxious or unruly conduct may fit the definition of disorderly conduct, as such statutes are often used as “catch-all” crimes. Police may use a disorderly conduct charge to keep the peace when a person is behaving in a disruptive manner, but presents no serious public danger.
Assault Basics
Assault is an intentional attempt or threat to inflict injury upon a person, coupled with an apparent, present ability to cause the harm, which creates a reasonable apprehension of bodily harm or offensive contact in another. Assault does not require actual touching or bodily harm to the victim. Assault and battery are sometimes used interchangeably, but battery is an unjustified harmful or offensive touching of another. Battery also differs from assault in that it does not require the victim to be in apprehension of harm.
Assault developed in common law, meaning it developed through usage, custom, and judicial decisions rather than from legislative enactment. Modern-day assault statutes closely reflect the ancient common-law definition. An assault is both a crime and a tort. Therefore, an assailant may face both criminal and civil liability. A criminal assault conviction may result in a fine, imprisonment, or both. In a civil assault case, the victim may be entitled to monetary damages from the assailant.
Battery Basics
Simple criminal battery is most often prosecuted as a misdemeanor. Repeat offenses or the specific nature of the offense may warrant more severe treatment. For example, in some states, a second or third offense against the same individual is a felony. In cases of domestic violence, many states do not permit battery charges to be dropped against the defendant, even at the request of the victim, because of the potential for repeat or escalated harm.
Aggravated battery is a simple battery with an additional element of an aggravating factor. This is most often the addition of a weapon (whether use was real or merely threatened), and is almost always a felony offense. Other aggravated batteries include those committed against protected persons (children, the elderly or disabled, or governmental agents); those in which the victim suffers serious injury; or those occurring in a public transit vehicle or station, or school zone, or other protected place. These are all aggravating factors that will enhance simple misdemeanor batteries to the level of felonies.
While Republican Rep. Craig’s misdemeanor Disorderly conduct is receiving demands for his ouster, Democratic Rep. Filner’s assault and battery charges are getting no attention whatsoever, and are being swept under the rug. With the fact that the Battery on the Airline attendant occured in a public transit station, the battery charge should be considered a felony Aggravated battery.
So, the question is, why is such scrutiny and attention being placed on the Republican misdemeanor while Filner’s two charges, 1) assault and 2) battery, which should be considered a felony is being given no news coverage at all? Is the media being biased here? I think definitely so!

Uh, JD
Sorry to put a pin in the spin bubble, but I reach out with my finger and touch a peace officer, I may be charged with Assault and Battery.
And I’ve ssen the charge used in that way for very limited contact between citizens and law enforcement officers – and those who merely argued with officers.
Tain’t saying any form of unwanted contact is OK (it’s not), but the purported point of your comment is laughable.
But I’m quite willing to believe it is the best the wingers have.
Can’t wait to see what gets served up when McConnell steps out for her star turn…
Valley Girl @ 230
dakine01 @ 108
And Craig never claimed that the cop but HIS foot into HIS stall…he attributed HIS putting his foot under the partition and touching the officers foot to his “wide stance”. He also said that it may have “appeared” he reached down under the partition because he was “picking up a piece of paper”.
BTW There was a gay pickup website that had a posting about the Minneapolis-St. Paul Airport “sting” in and around the time that Craig was busted. It asserted that the cops were “entrapping” victims by “tapping their feet” and putting their feet UNDER the partition.
I’m wondering if this post was submitted by someone who hoped to IMPLY that the cops entrapped him. It would be interesting to see if any email from Senator Larry Craig has been sent to that site about that time frame!
Eureka Springs @ 172
The police officer was able to see “the blue color of his eyes”…kind a reminds me of that old Bunker Hill adage.
Jonathan @ 71
But, it might not be information you want. It might be his cooperation and silence.
Loo Hoo. @ 249
I may be misreading Conyers when he talks about the ‘politics of impeachment’, but personally I don’t think it’s about politics to gain power. I think it’s good government which will naturally, in these times, gain us political power.
Think of it as power flowing to the party which is earning it with hard work, just like a corporation (or industry) which earns money through hard work.
I still like Keith Olbermann’s dragnet version of what happened.
