How many times has the Bush Administration gone into flaming fuchsia alert because leaks to the media are enabling the terrorists? I know I’m stricken with the fainting vapors at the very thought. First the NYT has a big leak about data mining that appear to clear Abu of lying to Congress (though as Glenn Greenwald points out, it most certainly does not). Now it looks like the DoJ may have tipped off Ted Stevens before his house was raided by the FBI.

What’s striking is this tidbit in today’s WaPo:
Stevens said in a statement that his attorneys were advised of the impending search yesterday morning.
I spent nearly 9 years as a federal prosecutor. I’m not aware of a single instance when any prosecutor or agent told anyone outside the Justice Department that a search warrant was going to be executed later in the day. Telling outsiders — especially lawyers for the person whose property will be searched — defeats one of the principal purposes of a search warrant: SURPRISE to ensure the integrity of the evidence field.
Let’s recall what Dubya said about the NYT reporters who reported on the existence of the NSA wiretaps:
Yesterday, the existence of this secret program was revealed in media reports after being improperly provided to news organizations. As a result, our enemies have learned information they should not have.
And the unauthorized disclosure of this effort damages our national security and puts our citizens at risk. Revealing classified information is illegal, alerts our enemies and endangers our country.
Considering the screeching terror and global annihilation we all face at the hands of the swarthy hoard, I’m sure this kind of leak could mean the end of democracy as we know it. No doubt Commander Codpiece and the Gang that Couldn’t Shoot Straight will be all over it like a cheap suit in the rain.

Maybe things are different in the w. Va. AG’s office, but under DOJ prodedures the only time you would inform somebody in advance about a search warrant was if you had already set up an impound of the thing/premises to be searched.
One time we had a case where we were going to search 25 garbage transfer stations simultaneously. Because the warrant application was much langer than a Harry Potter book and took a long time for the judge to read, and becasue we then had to get 25 copies delivered at diverse locations around NYC, it took all night to accomplish an application that was first broughht to the judge around midday.
We had agents at every location all night long ( I personally sat on a loaction with an FBI agent and nearly lost a toe to frostbite in the process)waiting for the warrant to be delivered. We impounded, that is to say barred the gate and excluded anyone from entering the premises, until the warrant arrived and we could do our search.
That may have been what happened here. But the quote Jane has is the norm. The whole reason for a warratn rather than a subpeona is surprise so they cannot destroy or hide hte evidence. Otherwise you just use a subpeona

Here in the Northern District of California former federal district court judge Robert Aguilar (a Democrat who often frustrated prosecutors) was prosecuted for allegedly tipping off a potential defendant that he was being investigated. Judge Aguilar was forced to resign.
The USA who conducted the prosecution was Joseph Russianello, currently slated to be reappointed as USA for California’s Northern District.
Jane, you must be mistaken, I’m sure Rep Jefferson was given at least a days warning before his house and congressional office were searched. Don’t you think?

IIRC there was substantial delay betweenthe time the agents showed up with the warrant and when they actually searched the office.
The only reason there was not an armed confrontation was becasue the Sgt. at Arms and the agents agreed to impound Jefferson’s office until the dispute about immunity for his office space could be worked out.

May be apples and oranges. It may be that they are planning to obtain the records via subpeona.
Also, sometimes you have to get a warrant for physical search, to do forenisc tests.
For example, if I want to take a DNA swap of you cheek and you won’t consent, I have to make a warrant appliacton to search, because of the invasion of your privacy.
So, if what the FBI was after was literally THE HOUSE as opposed to records kept inside of the house, then they would need a warrant if Stevens would not consent to the search–though he is an idiot for not coonsenting if given the chance.
If the evidence they are seeking is literally in the very components of the house, there is little to worry about in terms of destruction of evidence. Unless he burns the house down.
Wouldn’t Gonzo at least hold on until the recess?

Can someone explain how it “shores up” a regime to drain its treasury? Both Taxpayers for Common and Sense and Citizens for Responsibility and Ethics today asked Republican leaders to request that Stevens at least temporarily step down until the investigation was resolved.
“It is imperative that no member under federal investigation be involved in the oversight or appropriations of any agency involved in investigating that member,” said Melanie Sloan, executive director of Citizens for Responsibility and Ethics in Washington. “Sen. Former Sen. Fred Thompson, R-Tenn., appears to have flip flopped on his pledge to sign federal legislation replacing all federal taxes with a 23 percent sales tax, according to an unedited FairTax.org video reviewed by ABC News.
“He has not taken this pledge,” Thompson spokesperson Linda Rozett told ABC News.
The Thompson camp’s denial appears to be contradicted, however, by an unedited FairTax.org video in which Thompson is asked, “Senator, if the House and Senate pass the ‘Fair Tax’ bill do you feel right now that you would sign it?”
Thompson replies to the question by saying, “Yeah, absolutely.”

I am going to go out on a limb here, because I don’t really know what changes are proposed for Calif. But:
The electoral college is enshrined in the Constitution, and it will never be changed, for the reasons that ammendments to the constitution are difficult. However, some political scientists figured out a way to make that irrelevant. Here’s how:
They drafted model legislation which said that the state would give its electoral votes to which ever candidate won the popular vote. Furthermore, the legislation by its terms only takes effect if the states representing a majority of electoral votes pass similar legislation.
The idea of legislation that only takes effect if other states pass the same legislation is not as unusual as you may think.
