BREAKING: Get out yer popcorn. Karl Rove and Scott Jennings just got added as witnesses to the Senate Judiciary Committee hearing scheduled for next Thursday at 10 am ET. (H/T to reader Helen for the spot.)
Jon Mandle at Crooked Timber has an interesting set of choices for the next administration regarding the illegal NSA domestic spying program(s), in all its phases and guises:
Assume a new Democratic President is inaugurated on January 20, 2009. Focusing on the illegal wire-tap program(s) (as opposed to the other cover-ups), which of the following is most likely:
a. the illegal wire-tap program(s) will be dismantled and all evidence of them destroyed by the time the new administration takes office;
b. they will still be up and running, and the new administration will quietly continue them;
c. the new administration will quietly stop them;
d. the new administration will say that they are stopping them, but actually continue them;
e. the new administration will make a big show about stopping them (and actually do so);
f. the new administration will make a big show about stopping them and move to prosecute members of the previous administration for violating the law.I can’t believe a. is a viable option, so how would a Democratic administration handle such an illegal inheritance? Is there a significant difference among the candidates? (Maybe I should have made a you-tube video asking this.)
In case anyone is wondering, I’m a big fan of option (f), should the evidence and facts point to criminal behavior. And I would absolutely love to know what each and every Presidential candidate thinks about this issue — and how the rule of law should be balanced against national security interests. Because that balancing test for the Bush Administration has come out in favor of abject terror and Big Brotherism every time over Constitutional liberty interests. And the fact that it has led to more Pizza Hut sales than actual prosecutions is a sign of its real world value versus using it as a means of propagandizing fear to the masses until it became a political liability upon exposure.
The wholesale disregard of the rule of law, the end-run of the FISA laws, the flipping of the finger at Congressional and Judicial safeguards and oversight…every last bit of illegal behavior on this should be exposed. Because John Poindexter and his obsession with spying on us all should never again pop up in another administration.
If ever a civil liberties sucking vampire of a free-for-all, unaccountable program needed a stake through its illegal heart, it is this one. And that is a message that every Democratic candidate needs to hear from each and every one of us. Loud and clear.
Here’s a message for you, political candidates who kowtow to party and special interests: Put your nation first.

President Bush could have on his desk as early as today a $40 billion homeland security bill, already passed the Senate late Thursday and expected to clear the House today.
The Senate-approved package, which contains many of the security suggestions made by the 9/11 Commission, would direct more federal funding to so-called high-risk states and cities as well as require more stringent screening of air and sea cargo.
“I believe this bill will greatly enhance the security of the American people, protecting them from natural disaster and also, God forbid, from terrorist attack,” said Sen. Joseph Lieberman (I-CT), one of the bill’s chief authors.

Michael Moore was on Jay Leno last night, and he said this. It had just occurred, and he was sort of chagrined because he hadn’t had a chance to tell his family yet.
I think that the Dem winner in ‘09, perhaps armed with supermajorities in both houses, should commit to a 30-day plan to unwind, reverse or otherwise repudiate virtually all shrubco legistion, executive orders and signing statements, going back to 2000… all directives, deregulations, faith-based privatizations, No Child Left Behind, tax cuts for the rich, all constitutional subversion laws, etc etc.. everything goes.

I strongly favour option ‘f’, too, but am tempted towards an option ‘g’, in which the new government goes over the information to see to what extent Congressmen were being targetted, and release that information to the targetees. It might bring home the enormity of the project. Perhaps some prominent MSM people could also be informed of their being ‘watched’.
I think the chances of an ‘f’ solution are improving. The more dirt that comes out on this administration, and that sticks in the brains of the public, the lower Bush’s polls go, the more easy it will be to put the programme out as a stealth assault on democracy, which of course it was and is. I also think bringing John Yoo before a committee to expound on his theory of government would be a salutory experience for all concerned. Light is the best disinfectant.

Drivers? Driving cars is a generally stupid thing. The oil co’s and rubber co’s tore out the cable cars and fight public transportation at every turn in order to sell gasoline.
The very idea of independent motoring is foolhardy. It takes years of experience (and some accidents) to learn to be a good driver. Add alcohol or drugs and the potential for disaster is increased exponentially. There should be rails on the roads. We enjoy driving b/c we are accustomed to it.
Mass transit could be so vastly improved that it would meet all our private needs.
We have been conned (by auto mfgers, insurance co’s, oil co’s, tire co’s and government) into believing that driving automobiles is a part of our non-negotiable American lifestyle. Cars with bad drivers are very dangerous. No one is a bad driver, though.

he may have taken some license here.. I helped someone out who got entangled in an OFAC investigation a few years, as a result of human rights advocacy activities. OFAC is part of the Treasury Dept and would, I think, pretty clearly have jurisdiction over any Cuban “trading with the enemy” issue, at this stage in an investigation.

I will be attending YKos via SecondLife as I cannot attend in person. I do have a host of questions related to these issues of secrecy vs freedom. I list them below with hope that some of you that DO attend, or have the opportunity to attend one of the open forum debates, will ask ALL the candidates a few of them. They are:
Do you believe that it is legitimate use of the classification system to hide illegal, unethical, or embarrassing activities by the government? Will you pledge, right now, to the American people to run the most open and non-secretive Administration in modern American history? Would you be supportive of a blanket, moving window of declassification that declassifies ALL government documents and activities that are 20 years old or older? Would you be supportive of legislation strictly limiting what can be classified and for how long – limiting classification to current intelligence methods and sources as well as military operations and capabilities? Would you support a federal Open Meetings law similar to that enjoyed by many states that prevents the People’s government from holding secret meetings involving matters of public policy? If these laws are good enough for the states, do you not agree that a similar law is good enough for the PEOPLE’S federal government too? Would you support legislation strictly outlining what can and cannot be claimed under the rubric of “executive privilege”? Can you defend why ANY policy meeting should be secret from the American people since any and all policies that are ultimately decided upon DIRECTLY impacts the lives of the American people?
I’m in favor of alternative “g”:
After all, all those alternatives are based upon the precedent of the current administration’s own conduct.

The Moore subpoena further demonstrates the absolute ham-handedness of Bushco. They subpoena Moore, while concurrently ignoring subpoenas from congress. The potential for Moore to turn the tables on them and gain free publicity is enormously advantageous to Moore. Way more upside potential for Moore than for Bushco. Way more downside for Bushco than for Moore. Yet, they are so freaking ham-handed, they cannot resist using their hams.

Ok, I do tend to get worried. The reason that I do worry about such things is that as an easily identifiable GLBT person I would be one of the first to suffer. He seems to be more of the willfully ignorant and incurious sort, than the ideologically driven sort, which he seems to think I’m accusing him of being in this and in other cases. The parents of a U.S. soldier who killed himself after returning home from military duty in Iraq have sued the U.S. government for negligence. Joyce and Kevin Lucey say their son Jeffrey hanged himself after the U.S. military ignored his depression. In late May 2004, Jeffrey was involuntarily committed to a military veteran’s hospital after he ignored his family’s pleas to seek help. The hospital discharged him after a few days. He killed himself three weeks later. His father came home to find his son had hung himself with a hose in the cellar of their house. The dog tags of two Iraqi prisoners he said he was forced to shoot unarmed, lay on his bed. The Lucey suit follows another case in which two veterans’ rights groups say the Department of Veterans Affairs delayed and denied veterans help for disabilities such as post-traumatic stress disorder.

I am very worried that unless there is action from this congress to begin the process of accountability the next administration, whoever will lead it, will not roll back the prerogatives this bunch of crooks has take for themselves. This is why it is so imperative that that we have impeachment hearings. Even if they die in the Senate, they will be a shot across the bow of the next runaway ship of state.

Moore adressed this last pm. (Not Tillman, per se.) When he announced that proceeds from the screening on 8/11 would go to provide health care to the 9-11 rescuers, there was the predictable applause. But he waived it off, and said, words to the effect, “let’s not lose sight of the real issue here. The Bush administration is going to investigate me. I mean, DON’T THEY HAVE MORE IMPORTANT THINGS TO DO???”

I look back to the group of individuals who were never held accountable after Iran Contra, and see the damage they are causing today. That is why this is my number one factor when I choose which Democratic candidate to support: whichever of them will be the most likely to seek accountability from this group of lawless radicals. I know it will be far easier to avoid the accusations of seeking retribution by just burying the past and moving forward, but this just doesn’t cut it after all the abuses of power we have seen. A lack of action against them constitutes tacit approval in my opinion. Unequivocal support for the rule of law is needed now, and whichever candidate steps forward on this will probably get my vote.

Not implausible. There was a great piece in NYRB a few months back about RFK’s private efforts to investigate the assassination of his brother. We had what Mort Sahl (per a Wolcott feature on him this month) called a “bureau of assassinations”; we could certainly have an extragovernmental surveillance apparatus.

The question that should be posed to each and every presidential candidate is what is their own personal definition of ‘unitary executive’ and will they or won’t they embrace such a philosophy when they assume the office… all of the NSA wiretapping, disregard for the Geneva Conventions, extraordinary renditions, detainee torture, stripping habeaus corpus from enemy combatants, deleting thousands upon thousand of emails pertaining to official business, muzzling the EPA & surgeon general, the USA scandal, outing Valeria Plame, ETC… ALL OF THESE ISSUES COME BACK TO THE IDEA OF UNITARY EXECUTIVE AND HOW THE CURRENT ADMINISTRATION VIEWS THAT PHILOSOPHY AND HAS PUT IT INTO ACTION… why isn’t the MSM asking that question?

He also may have been shot by other weapons in the arm and vest. This would indicate that … more than one person was firing at him.”
The previous investigations under Army regulation 15-6, which establishes procedures for such inquiries, concluded that a trio of young Rangers was following the initial fire of their squad leader, Sgt. Greg Baker, as the soldiers were trained to do. But none of those official inquiries identified who squeezed the trigger on the fatal shots.
Baden, though, suspects that enough ballistics evidence remained for the Army to have pinpointed the shooter, even though key evidence such as Tillman’s uniform and body armor was destroyed within three days of his death. Baden also said X-rays could have been used to identify the path the bullets took through Tillman’s head, but the results were not included in the autopsy report. And neither was mention of a hole in Tillman’s leg discovered by a soldier who helped carry the body down the hillside.

Impeachment Logic
Have we had enough? Is there anything left for this president to do to his people and their government? He’s only one man who can be checked. Bush has been afforded too much. I actually had to check myself yesterday as I entertained the idea justice was not in the best interest of the American people. The idea was it would be a defocus to begin a process of impeachment, and by the time we initiated impeachment proceedings, it would be time to vote Bush out of office.
As more and more unfolding possible wrong doing percent with increasing questionable actions from this administration, it is clear this president feels “he’s on the way out, so what the hell, what can the Congress do.” Finally, Bush and Congress, the Democrats, agree on something, and if I were in Bush’s shoes, I would be in this agreement 100%.
Law enforcement officers don’t stop arresting criminals one hour before they get off. They just don’t let crimes go for the other shift to handle them; and, nether should the Congress and the Senate allow Bush’s very high crimes and misdemeanors go because he’s going to be voted out soon. Could that be why Bush continues to build on his impeachable actions?
Claims of Al Qaeda in Iraq and this administration’s stonewalling associated with Pat Tillman’s murder are both impeachable offensives. Al Qaeda in Iraq claims are impeachable because it seeks to misinform the American people for the right to kill more Iraqis. You see, the only way Bush can calm the violence in Iraq is address the civil conflict. If he can make one side Al Qaeda, especially the Al Qaeda that flew plains into the Twin Towers, they can eliminate one side with no outrage for excessive killing. Most Americans want revenge for 9/11 so no one will mind if they thought they were killing Al Qaeda. That’s why Bush and his un-straight up General Petraeus know with certainly the surge will work: They plan to create a modern day killing field complete with genocidal killings of their crated Al Qaeda in Iraq.
The Pat Tillman incident is obviously impeachable and I think still holds many unknown possible outages impeachable actions.
The point is clear. When crimes are committed, they must be addressed. No one should have the feeling they are untouchable. If I were in Bush’s shoes, I would be licking my chops and committing every questionable political action in my favor because after all: I would be on my way out. Justice must be swift to set an example, and not used only when it is expedient to do so. Bush should be made to look behind his shoulder because he fears the steps of justice on his tail. We must impeach Bush, and if we run out of time, put his butt in jail.

However, I believe the issue is even bigger than that. The white house has nearly replaced a democracy with a dictatorship. Unless they are stopped, another 18 months may be enough to enable them to accomplish their goal. Little bushie has finally accomplished something! His grandpa must be very proud of him.
