June 2004, Senator Durbin speech:

Let’s take one example: sleep deprivation. In Ashcraft v. Tennessee, a 1944 case, …….Justice Hugo Black wrote:

It has been known since 1500 at least that deprivation of sleep is the most effective torture .

Just so Durbin remebers he considers sleep deprivation a form of torture he wants to use on Republicans.

I thought good liberals opposed torture and agressive acts against an opponent.

Now were condoing denyiny Senators their sleep, isn;t that called sleep deprivation and opposed by Dick Durbin as a tactic of Nazis?

Are we really going to hold our Republican opponents in the Senate without due process? What happened to habeas corpus?

If Bush did this to the guys in GITMO, Christy would lose a lung from screaming at Bush for being so mean to decent folk.

But, apparently, we now believe coersion and just a little bit of torture is OK. So is it OK now for Bush to deny prisoners sleep? is it OK for him to play on-going rap music like having to listen to a Bob Byrd speech.

Will we be allowing family visits since our prisoners aren’t allowed to leave?

Just saying…

Why does CNN and MSNBC insist on calling fillibuster a “marathon debate”? They refuse to call it what it is. What I would give to hear one anchor bring up the Civil Rights Act fillibuster.

In this case it’s because it makes Republicans sound like statesmen, not obstructionists. Josh Marshall has been so confounded by the suppression of the word “filibuster” he’s been urging readers to send examples from the national press.

JEP at #161:

Oh, give me a break with the “Loose Lips Sink Ships”! Loose screws sink them, too. We’re discussing articles in major magazines, not trafficking in satellite pictures. You’d really hate William Arkin.

And what, by the way, is a “screaming liberal”? “Liberals” are by nature in the moderate range of the political spectrum unless, of course, you’re a Republican propagandist.

Intelvet: sorry to disagree with you, but at this point, if george bush is insane enough to try to work up an attack on Iran, the first line of defense against extending the atrocity of Iraq into Iran, will be the knowledge that he’s planning on doing it.

And if he succeeds, a lot more americans, and a lot more Iraqis will die, as will Iranians.

Thankfully, our military is starting to speak out against the lunacy. Admiral Fallon is quoted as saying, as he rejected a third carrier in the gulf:

“Some of us are trying to put the crazies back in their box.”

WE need to know that that’s happening. And we need to know if the preparations for an attack on Iran are moving forward, in order to respond to it, and exercise our right as citizens to try to preclude it.

Again; I’m sorry, but as we know, push is coming to shove. We have them on the run and part of it, is keeping track of what they’re doing, including how they are using our military in their desperate attempt to escape the blame for what they’ve already created.

And when it comes to keeping track, FDL, despite my occasionally mixing it up with some of the mods here, does a great job of that.

As an ex-marine vet, I say to any and all, keep those posts coming. There’s too much at stake to pull punches.

LOL. During his Sunday stoll through the Baghdad market a few months ago, McCain said Zarkawi would follow us to the US if we pulled out of Iraq. I’m not kidding. I remember citing this on a thread.

That is because they probably invented him in the first place. They can’t keep their story straight. Some reporters went to Zarqawi’s home town in Jordon, and no one knew who he was out of a very small population, but they did know he was a “legend”. I always thought the pictures of him looked photoshopped.

actually zarqawi was Sonny Bono after he kissed the tree….

From LIEberman: He’s basically saying he doesn’t know what to do, but he mentions Republican efforts and not one mention of Chris Dodd, who is a co-sponsor. What an SOB.

Thank you for contacting me to express your views regarding the Habeas Corpus Restoration Act of 2007 (S. 185), which was introduced by Senator Arlen Specter (R-PA). I appreciate your views on this serious matter, and I welcome the opportunity to respond.

As you may know, the U.S. Supreme Court ruled in Hamdan v. Rumsfeld that military commissions that had been set up by executive order were in violation of the Geneva Conventions and the U.S. Uniform Code of Military Justice. By establishing tribunals unilaterally and without authorization by Congress, the Bush Administration had exceeded its legal authority; and the Supreme Court, in what I thought was an excellent decision, ruled that no one in this country is above the law, including the President in a time of war.

With my support, the Senate Armed Services Committee approved a measure aimed at fulfilling the requirements set forth in the Hamdan decision, and which included such provisions as ones that would allow suspects to see evidence against them and bar evidence obtained through torture or coercion. In addition to seeking to follow the Supreme Court’s ruling, I feel that the United States must stand on higher ground by following the rule of law and human rights standards under the guidelines of the Geneva Conventions.

Later in the 109th Congress, I voted for the Military Commissions Act of 2006 (S. 3930) because it provided a process that I believe responds to the Supreme Court’s Hamdan decision. The bill set clear military tribunal guidelines to try enemy combatants against the United States charged with violating the laws of war. S. 3930 did not alter our responsibilities under the Geneva Conventions, thanks to the negotiations led by Senator John McCain (R-AZ) and others. Also, during the debate over S. 3930, I voted for an amendment introduced by Senator Specter that, among other things, would have allowed habeas corpus protections to aliens detained by the United States, outside of the United States, and who were determined to be enemy combatants or awaiting such a determination. The Specter amendment, unfortunately, did not pass.

S. 185 would amend the federal habeas corpus limitations imposed by the recently enacted Military Commissions Act and the Detainee Treatment Act. In so doing, the bill affords aliens detained by the United States within its territorial jurisdiction, including those detained at the Guantanamo Bay Naval Base, the right to challenge their detention and military commission trial procedures by an application for writ of habeas corpus. S. 185 is currently pending consideration by the Senate Judiciary Committee. Please be assured that I will continue to keep in mind the views which you shared as this bill moves through the legislative process. To keep track of future actions on this legislation, you can go to the “Bill Tracking” service at http://lieberman.senate.gov/issues/resources;.
