Where the defense attorneys at the Padilla trial likely scored some points was with their cross examination of the prosecution’s expert witness, Rohan Gunaratna.
He responded to a question about whom he had worked for in the past with a variation on the classic — I-could-tell-you-but-then -I’d- have -to-kill-you response. He was obtusely mysterious (or mysteriously obtuse) when questioned about his claim to have interviewed purported terrorists for his 2002 book “Inside al-Qaida.”
“In some interviews I worked for government. I do not wish to name these countries, I would be breaching some confidentiality and agreements I signed with governments,” he said. Judge Cooke would not permit a defense lawyer to ask if any of the purported terrorists Gunaratna had interviewed had also been tortured.
So it all boiled down to “I’m a United States Government expert witness. Trust me.”
Gunaratna is being paid $300 an hour for this kind of courtroom testimony, up to a maximum of $53,700.00. Not too shabby.
In 2001 Gunaratna was quoted as saying:
The Americans lack a deep understanding of how to fight terrorism because unlike the European states the experience of America in the fight against terrorism is very limited.
He’s wrong.
Terrorism has played a historic role in United States policy. In some ways you might say America wrote the book on violence and terrorism beginning with the deliberate and well planned terrorist-genocidal dealings with Native Americans. As H. Rap Brown has noted “Violence is as American as cherry pie.” Using violence and terrorism to overthrow regimes the United States doesn’t like is also as American as cherry pie: Chile, Indonesia, Haiti, Dominican Republic, Grenada, Panama, Guatemala and, this, my personal favorite from 1893, Hawaii.
I had been told that Gunaratna was quite the Pentagon/Justice Department favorite but I wasn’t buying his testimony. I sent him three e-mails requesting clarification about what he testified to and what he had written. I wanted FDLers to have fresh information. He responded with variations on “I may be done by Tues we can talk about the trial then. Kind regards, Rohan.”

The prosecution’s star witness in the Jose Padilla trial on terrorism support charges apologized Tuesday after being admonished by the judge for speaking to CNN about the bomb investigation in Britain.
“I’m not pleased,” said U.S. District Judge Marcia Cooke. She has expressed repeated concerns that jurors could be swayed by news accounts of terrorism related events around the world, which have occurred throughout the eight weeks of testimony.
“It is very difficult, or could be very difficult, if one of our jurors were to see you,” Cooke told the expert, Rohan Gunaratna, before jurors arrived in court. “I cannot force you not to speak. I would strongly urge you not to.”
Gunaratna apologized and said he would not do it again while still a witness in the trial of Padilla and co defendants Adham Amin Hassoun and Kifah Wael Jayyousi.
“I will not speak to any media on my specialty until I finish my testimony,” said Gunaratna, an al Qaida expert and head of the Singapore based International Center for Political Violence and Terrorism Research.

Lew, is the defense barred from asking Gunaratna, how much he is being paid by the Govt. for his testimony? Just a thought! One bone of contention, it was 1898, not 1893, that Queen Lilioukalani was summarily put under ‘Palace Arrest’, depriving Hawaii it’s sovereignty!!!
I don’t do this kind of work, but I’m a bit surprised that the court would allow an “expert witness” to testify and then be able to dodge questions on cross about the basis for his alleged expertise. If he’s going to testify then it all comes out or if he can’t let it out then he shouldn’t be allowed to opine from the witness stand.
I just do civil law so I’ve never faced this issue – Christy? LHP? Anybody?

He’s like every other consultant-expert I’ve known — except for one. And I write about her Friday night as a contrast to Gunaratna. I haven’t pushed yet because it just came out — but I think there’s an interesting question the defense raised which Judge Cooke, in her wisdom, threw the blocks to. But how many of these so-called terrorists had been tortured? We know for sure Padilla was. We have all those folks in Guantanamo and the dozen other little Guantanmos parked around dictatorship nations.
Hey, I think it would be a real find to find someone in that bunch of interviewees who wasn’t tortured.

The initial take over was in 1893 at the end of a Republican administration. They had to wait for a Democrat’s term to end before they could complete the process.
I will quibble with calling it terrorism, though. It was a takeover, but almost bloodless. Just the threat of superior military power.
I’d also quibble with Grenada. Kinzer’s book (Overthrow, an excellent read) is the only decent account I’ve read. But it paints it as more or less a rescue, even if we did screw it up pretty badly.
But those are quibbles. Excellent post.

According to Barbara Tuchman, part of the reason for the Tea Party was that the merchants had (illegally) acquired a large amount of tea from the Dutch, and didn’t want their investment to go to waste. So the encouraged dumping the Brit tea before it ever passed customs (and had to be paid for).

My wife and I this morning engaged in a rip roaring argument about exactly what terrorism. I contend that it is the use of violence by a nongovernmental force or the covert use of violence to achieve nondemocratic ends. The people who kill abortion doctors are terrorists. Covert violence by the United States to achieve a specific end is, I think, terrorism. Just as lynching horse thieves because there were no courtrooms within 200 miles, is terrorism.
I do use a very wide definition.

In other words, don’t mind me judge if I just piss all over your “government owns you” ruby red slippers. The point is not to speak to the media about a related subject until after the jury finishes deliberations. Period. It does not matter when the “testimony is finished.”
If the Judge truly believes that this jerk-off’s concocted horsehit on the evening news may be prejudicial to the defense, then the gov’t has a choice. They can voluntarily pay him and he can agree to silence outside of the court, or the gov’t must withdraw him and let the judge strike the testimony.
But that’s not what happens.
Instead, the guy gives a “I’ll be quiet for another day or so while I’m on the witness stand and then go back to corrupting the jury.”
It’s a good thing the prosecution is getting plenty of help from the Judge (who is not allowing the constitutionally required bare minimum cross examination of the witness about his “prior interrogations”). The prosecution’s witnesses are corrupt and the case against Padilla is virtually non-existent. Hopefully with this Judge’s help (and she obviously doesn’t mind having her slippers pissed on by the government team) the prosecution can sway the jury.
Judge to defense: — You’re not allowed to cross exam the government witness on his credibility.
Judge to prosecution: — I “strongly urge” the witness not to prejudice the defendant, but if he must, I won’t do anything.

Tom Hartman was saying on Air America this morning that the Boston Tea Party was the result of mega corporations trying to wipe out the smaller shippers. The King had given the East India Company complete tax freedom, while the smaller shippers were still taxed. He compared it to the robber barons of the late 1800’s and again the early 1900’s, resulting in the great depression. Today, according to Tom, is the third time this has been tried in the history of America.

Well, we here in New England grew no exportable crops (except pine trees for masts, or catching cod) and were damn fine boat builders and sailors. During the time that England “controlled” all trade, we largely made our living smuggling between the South and the Caribbean. On July 4, 1776, we declared (officially) our independence from England. They could have agreed and removed all of their military, but they decided to fight. (Lots of raw material-trees-not available in England or other colonies.) After the Revolutionary War, the Constitutional Convention took place in Philadelphia. It was scheduled for May 14, 1787, but people were late, and it took place on May 25th instead. Benjamin Franklin arrived in a Chinese sedan chair carried by inmates because he was old by then. On Sept. 17th, 39 of 42 delegates signed. There was still no bill of rights. The colonies needed to approve of the constitution, and that took beyond July 4, but it was still celebrated in Philadelphia on that date with great fanfare. Floats!!!
According to Eric Margolis who writes for the Toronto Sun (a despicable right wing rag but E.M. is very knowledgeable) the ‘taliban’ are actually the ‘Pashtun’ tribe(s) totalling some 30 million people straddling the Afghani/Paki.border. Margolis recalls seeing them walk hours and hours barefoot in winter to deliver a hundred pound load of ammo they carried on their back, turn around and go home.

for heart, an excellent book is Dr. Dean Ornish’s Reversing Heart Disease. well worth having a look at and a good read. he’s a hero of mine for the research he did and the publicizing of it. what area do you live in? maybe could recommend someone to see re. heart and liver. would probably involve a fresh look at what you eat.

FWIW, OT comments are part of what makes FDL so interesting. Like someone said to me, there are always at least 4 or 5 parallel conversations going on. Enforcement of “no OT” only happens during Book Salon, Blue America posts, and others as stated. I think it’s great to be respectful of people like Lew Koch who are reporting on serious issues, and only have a few posts a week. But, in deep EPU land, I don’t see that as a problem. Just my opinion.
Well thanks I just feel a fish out of water, on this day among others. I spent my working life keeping others from ending up as I have. I guess one major injury in 25 years is not bad, the hell of it is that injury was to me.

If one cannot concur with the self apathy of those individuals that are forever debating the unforseen then how is one to divocificate? One must not even try. To do so would be folly.
So prosecution has to get paid witnesses. Splendid. As far as I can tell the shabby ass prosecution ain’t got *nothing* to do with the accused. The judge should just throw out the government’s case. It’s shoddy and shabby. And it stinks. It’s a travesty and it offends this citizen who has just seen much better legal footwork thrown out and trodden on by a president and his minions.
At least Lew and Rachel, you should have enough opportunity to study some Graham Green-esque characters to right a masterpiece. Particularly the fellow with the mustache.
