We fully recognize that the Constitution provides that commutation decisions are a matter of presidential prerogative and we do not comment on the exercise of that prerogative.
- We comment only on the statement in which the President termed the sentence imposed by the judge as “excessive.” The sentence in this case was imposed pursuant to the laws governing sentencings which occur every day throughout this country. In this case, an experienced federal judge considered extensive argument from the parties and then imposed a sentence consistent with the applicable laws. It is fundamental to the rule of law that all citizens stand before the bar of justice as equals. That principle guided the judge during both the trial and the sentencing.
- Although the President’s decision eliminates Mr. Libby’s sentence of imprisonment, Mr. Libby remains convicted by a jury of serious felonies, and we will continue to seek to preserve those convictions through the appeals process.
As Marcy points out, the idea that the President who is currently pushing to restore minimum sentencing guidelines would give a happy hootie about an “excessive” sentence for Scooter Libby or anyone else is laughable. (He is, after all, the man who openly mocked Karla Faye Tucker before putting her to death.) By commuting Libby’s sentence rather than pardoning him, Bush insures that Scooter will remain silent and be able to invoke the fifth before before Congress and not risk being cited for contempt. This president’s contempt for the rule of law is thorough and complete.
Fitzgerald is an honest prosecutor who worked like a dog for this conviction and got mocked by pissy members of the beltway entitlement set for his efforts. Now his work gets swept away by the chief crook seeking to obstruct justice. I’m gonna guess he’s righteously pissed. I know I am.

and I’ve reconsidered my reconsideration. I do think Walton should resign in protest. While the next judge might well be worse, I think it would be worth one judge for the impact and importance of the act.
I’m trying to digest this news, just received on coming out of teaching. One of my Saudi students just asked me to explain the word “politics” and I was trying to keep my temper under control. When I was back in the States, I was told that things are turning around. I don’t think they will turn around without a fight to the death.

He could be re-nominated by the next Democratic President. I don’t see the Repubs voting against a Republican judge, nominated by Democrats, who was originally appointed by GWB. I think that he should resign; it would be a monumental statement and an incredibly patriotic thing to do.
Suppose we had put an impeachment investigation on the table weeks ago. Would the President have paid a heavier price for today? Would he have hestitated? If he had gone ahead, wouldn’t we be in better shape tonight, knowing that this would help move the country along?

Well, NARAL just called asking for money at exactly the wrong moment. I managed to (politely) get some of my anger at what happened today out of my system by explaining all about Joementum to the very nice man who called (I told him all about “short ride” to explain exactly why I was no longer donating to NARAL). He kept saying “wait a minute – what did Lieberman say? And the national office supported him?!” And by the end of the call he thanked me profusely for all of the information. I don’t think he’ll be working with them again.
PW—The punishment part of the trial is over- the punishment will stand as the judge declared- except for the prison term that just got erased. The Law license issue is a state matter. It will be done according to Virginia procedures. If Libby wins on appeal, of course, then he would certainly retain his law license.
Please, divine grace, let the next President appoint Fitz as Attorney General.

No it’s not. Right now Scooter is still a convicted felon. He is still under a sentence of 2 years probation and a fine of $250,000.
Libby is appealling his conviction. PatFitz is saying that he will not lay down and play dead for the appeal.
I will be in Christy’s area tomorrow afternoon and I am going to see if I can round up a couple of old friends to drive to DC and stand in front of the People’s House and protest this mockery of justice. Since I’ll be flying tomorrow I will be hopeful that someone with more wherewithal than me organizes something more meaningful and I will gladly join in.

y’know, I love to see that as a good thing…….but I don’t. I see it as a ludicrously futile gesture. Like in Bush Cassidy and the Sundance Kid, when they are totall screwed and surrounded, and one of them says something like, there’s gotta be some way out of this…..and the other says, “Well, they could surrender to us, but I wouldn’t count on that.”
Bush just welded himself to Libby. He’s basically confirmed that it’s a crime family, not an administration.
Fitz has to be blowing steam out his neck. I think I can hear Walton screaming from over here, too. Bush has pissed upon the justice department and the judiciary from a very great height, only it’s no longer a metaphor. Libby hasn’t even had his appeal start. This goes against all sorts of codified commutation procedure.
Quite a change from when he said that he was going to spare no effort to get to the bottom of the Plame outing, and whoever bore responsibility would be turned out of the administration.
If it had been Clinton doing this, Buchanan’s americans would have been out in the streets with their pitchforks and torches, looking for a little rough justice.
I thought Bush would wait until after the election for the pardon. Maybe he was giving Putin an object lesson in how real democracy practice justice.
But this is up there with the wisdom of Solomon. Apparently, Libby can still claim the 5th for other court proceedings, so Bush can stay insulated. Expect an ‘attaboy’ from the WSJ in about 10 seconds.
So, now the task is to weld this act to every last republican running for office. Any questions remaining about the impact of elections?
Oh, yeah, we’ll also have to put down the palace coup when they decide to pull a Reichstag, expand the war to Iraq, or decide that just because any democrat that can fog a mirror will sweep the election, they just don’t feel like leaving the White House. The mask has slipped and Bush just signaled that he’s happy to fight a ground war, retreating right up to the last bunker, surrender’s not an option. He’s been concerned about his legacy – I hadn’t thought that he intends to outdo Nero.

The governor who never saw a death sentence he didn’t like. Drug offenders? He threw away the key, this despite his own dubious history of substance abuse.
The Constitution he has kicked around for six years. Habeas corpus, torture, kangaroo courts, illegal wiretapping, and illegal wars, he never hesitated from any of these. So Libby the meticulous lawyer, Libby the national security expert outs a covert agent, knowing it is against the law, knowing that it damages national security, but it’s OK because Libby is a Republican and as we are all coming to learn Republicans are not like the rest of us. If any of us had done what Libby did, we would already be in jail. Bush, Cheney, and Republicans everywhere would be calling us traitors and demanding the harshest punishment possible. But Libby is a Republican so he gets the best defense that money can buy courtesy of his rich protectors. He gets a get of jail card from Bush or at least the sock puppet version of Bush that Cheney uses. He gets a future of wingnut welfare. And he gets to act the victim, the martyr, for the country, for the cause.
I would love to hear Pelosi say that impeachment is back on the table. It is the only way we are going to stop them from trashing our country, our values, our Constitution, and our laws.
That’s not worth Fitz’s time. Anyone could do that. He must walk away from this, or this just fades.

The issuance of a statement would appear to be discretionary — he could’ve stayed mum. While hated and publicly maligned by the Scooter Defense Forces, he hadn’t bent the rules to persecute Scooter — he’d played it straight, by-the-book. He might not have ever gotten a plum Republican assignment in future, but he probably wouldn’t have been actively harassed for the rest of his life.
Now, that’s not the case. He just painted a big bullseye on his back, and we all know a certain gun-wielding fellow with a bit of a vindictive streak…

I think that the Washington people have ALWAYS had a different point of view on the Libby thing. They thought that Libby was doin what foot soldiers on both sides have always done- taken bullets for the boss- and that he shouldn’t end up in jail for it- cause any of THEM would have done it too had they been in that situation.
People outside DEECEE think that’s total raving bullshit.
It took Jeb Stuart Magruder 30 years to admit that Nixon ordered the Watergate break-in of Democrat party headquarters. I hope it does not take that long to get confirmation Mr. George W. Bush’s criminal actions while in office. I have always thought that Bush is a co-conspirator in the outing of Plame and those who were indirectly outed.
Ultimately, I think this will do more good than seeing Libby in orange. It should solidfy the 30 percent or so of the indepentent or undecidied voting population which currently thinks ill of Bush et al. Provided the 30 percent who are Democrats, don’t split over a divisive primary and stay home or vote for a spoiler, that should mean a Democratic victory in 2008.
There isn’t enough lipstick in the whole world to change the face of this odious move.

Fortunately, he should not be back in a law firm or in govt. His convictions stand; they relate to lying and obstructing justice, so his bar admissions should be revoked or suspended. For the same reason, no rational govt would allow him a security clearance.
Doesn’t mean the AEI and speaking fees won’t keep him in the millions he intended to become accustomed to after his govt service. No doubt, he’ll also pick up substantial consulting fees for helping Big Dick and Shrub write their memoirs. (Though even that should be restricted, since much of the material will be still be classified before publication.) But he should no longer be able to practice law or advise govts.

I was able to see Pat and his team in action almost every day of the trial as they worked to provide justice. They and Judge Walton were truly impressive. Their belief in the law was clear and shining. Bush has exposed himself, and most Americans are sickened by his arrogance.
I was going to quote Pat in a comment, so even though Jane beat me to it, here it is again—

I served in the U.S. Air Force Security Service years ago, top-secret clearance, reporting to DIRNSA (Director, NSA), and saw a whole lot of top-secret materials while serving overseas during the Vietnam War.
If I’d disclosed the identity of a covert CIA agent, blowing her cover and her front-company cover, leading to the outing of a whole slew of other covert CIA agents and their contacts (besides endangering their families), I’d have either been shot by a firing squad or would still be serving time in Leavenworth.
But Scooter skates, after participating in a major national security breach, causing irreparable damage to our country.
He lied and obstructed justice to hide the criminal conspiracy that originated in the inner, corrupt bowels of the White House, attempting to cover for his criminal co-conspirators, like Dick Cheney, Karl Rove, George W. Bush, David Addington, Ari Fleischer, and a whole lot of other Republicans in the White House who participated in this criminal act.
Of course, Bush will pardon Scooter after the November 2008 elections, along with a whole lot of rotten Republican officials in his administration. These will preemptive pardons, kind of like the corrupt Kentucky Republican governor did several years ago.
And this will be the ultimate Bush legacy…getting his name into the Guinness Book of Records for having pardoned more people than any previous president, serving as a testament to how much corruption there actually is in the Bush mal-administration.

Firedoglake should go after Tucker Carlson until he publicly admits on air that his father, Ambassador Richard Carlson, is an active member of the Scooter Libby Defense Fund who will in effect be writing the check to pay off the $250,000 fine for Scooter Libby. In the interest of public disclosure and fairness in reporting, Tucker should come clean as to the real reason Tucker said this is all “Bullshit” to David Shuster after he clearly and plainly explained why Scooter Libby was convicted of several felonies and deserved to serve his jail sentence. I watched the segment again at MSNBC.com and was apalled at the way Tucker reacted to Shuster’s straightforward reporting. Tucker should be held to account why he is expessing his apologistic views for Scooter Libby and reveal his family ties to this case that has certainly influenced his views on air.

Bush’s sneering contempt for, and refusal to honor, his own sworn oath to “faithfully execute” his office in accordance with the Constitution – especially when, as here, his fellow lawbreakers threaten to turn state’s evidence against him – was flagrantly revealed today as a direct result of the resounding victory for the government delivered by a unanimous Appeals Panel at mid-day. A Circuit Court ruling that reflects the excellent work of Judge Walton and his staff, and the content-loaded motion response delivered under the duress of a very short timeline by the government. That hard-won ruling, denying Libby’s attempts to assert that an independent DOJ prosecutor is somehow unConstitutional and therefore a ‘close’ question on appeal, stands untarnished by the subsequent abuse of power delivered by the occupant of the Executive Office of the President. The members of the government’s prosecution team have done their job, done it very, very well, and should continue to stand tall in principled opposition to our corrupt Executive Branch leadership.
The ball is absolutely now in the court of our Legislative Branch of government. Independence Day would be a damn good day for our legislators to finally declare and reclaim their independence from the unAmerican, out of control Executive Branch leadership, and to announce that they will now act accordingly by at long last asserting the full measure of the Legislative Branch’s inherent Constitutional powers to check and rein in the now-unrestrained men of bad faith who remain in charge of the Executive Branch and the Armed Forces of this nation.
I haven’t even read all the comments. I’m too disheartened. But I will say that Fitz is the hero in this. He stood tall for the law. We might think it’s a wash, but if nothing else matters, history will prove Cheney evil. And shrub his subservient lapdog. Let’s not let the history books lie, okay?
What bothers me most in this is the idea promoted in the “president’s” statement that Scooter’s reputation is so much more precious than ours that damage to it is punishment enough for him. What about the reputation of every “nobody” who has been imprisoned for lesser crimes? Slap in the face, y’all. To all of us.

Scooter Libby is a true hero.
He understood that his superiors, Bush and Cheney, are thoroughly unprincipled and unscrupulous men, and he was willing to cast aside his own principles and values and go to whatever lengths necessary to stop in its tracks any investigation that could have uncovered their misdeeds.
That he was caught in his lies and obstruction is a minor failing. His true intent was protecting his dark masters.

Isn’t the point that Bush by using the term “excessive” means that Libby did not deserve ANY time in the slammer and therefore Bush’s syntax bears some scrutiny. If one day of slammer time for Libby is excessive as held by Bush then under what basis would the Judge have reached that conclusion under the fed sentencing guidelines. What I suggest is that the wiser heads on this site now analyze how the Judge could have given zero slammer time under the sentencing guidelines.
What Bush actually stated was that slammer time for Libby was “inappropriate” not “excessive”.
