Andrew Cohen of the WaPo’s Bench Conference Blog made some excellent points yesterday about the burgeoning mess that is the Gonzales DOJ, and it is well worth repeating:
Were these problems and confrontations avoidable? Absolutely.A strong and independent attorney general never would have let such partisanship seep into the Justice Department from the White House; never would have given creative defense attorneys another argument to make in court against the government. (And the fact that some of these arguments will never succeed is beside the point; that federal prosecutors now have to defend themselves and their political motives drains time and energy and resources away from legitimate business.)
Nor would a competent head of the Justice Department have allowed the scandal to mushroom into what it has become today. By failing to give complete and candid answers to the Congress, the attorney general and several of his former colleagues all but guaranteed the looming battle over executive privilege. Someone, after all, came up with and approved and coordinated the compilation of that list of U.S. attorneys who were to be professionally whacked — and the fact that we still don’t know the full story about that is not the fault of Democrats, or the media or anyone other than those in the administration who know the truth but who refuse to tell it. They are the ones who have picked the subpoena fight to come.
And at the bottom of it all — or at the top of it all, depending upon your view — is the president of the United States. His failure to fire his buddy Gonzales, and his failure to demand (sincerely and not just for the cameras) that all of his subordinates cooperate with the investigation, has brought us to this unhappy place, where smart lawyers don’t want to work at the Justice Department, current prosecutors have to defend their political persuasions in court, and the judicial system has to now gear up for a constitutional showdown that long ago could have been avoided. All of this is the price all of us are paying for one man’s blind loyalty to another.
Yet another George Bush failure that we all get to clean up for a long, long time. Friendship over country. Great. Just great.
And beyond that, as Charlie Savage reports this morning in the Boston Globe:
Federal officials have disobeyed at least six new laws that President Bush challenged in his signing statements, a government study disclosed yesterday. The report provides the first evidence that the government may have acted on claims by Bush that he can set aside laws under his executive powers.In a report to Congress, the non partisan Government Accountability Office studied a small sample of the bill provisions that Bush has signed into law but also challenged with signing statements. The GAO found that agencies disobeyed six such laws, while enforcing 10 others as written even though Bush had challenged them.
House Judiciary Committee chairman John Conyers , Democrat of Michigan, said yesterday that the GAO’s findings demonstrated a need for a more “extensive review” of how the government has followed up on hundreds of other laws challenged by Bush.
“The administration is thumbing its nose at the law,” said Conyers, one of the lawmakers who commissioned the GAO study….
Bush’s signing statements have drawn fire because he has used them to challenge more than 1,100 sections of bills — more than all previous presidents combined. The sample the GAO studied represents a small portion of the laws Bush has targeted, but its report concluded that sometimes the government has gone on to disobey those laws.

Morning all. Thought a little levity would do us all some good this morning.
Until Gonzo is removed, you can rest assured that Bush and Cheney will be under no pressure to do anything they don’t feel like doing. With Gonzo still in power, you can go to sleep at night knowing that Bush and Cheney can commit any crime they want and know that no one will investigate it. While Gonzo is still head of the DOJ, you can face each day knowing that the law only applies to some of us, that subpoenaes are for little people, that evidence can be destroyed by the click of a few buttons, etc.

I hate to be rude, but seriously, how stupid are you people?
A ’strong and independent’ AG would never have even been nominated. When is everyone going to figure out that Bush doesn’t want competent people around him? All he’s interested in – all he’s ever been interested in – is being surrounded by people who keep telling him he’s the Golden Child. That’s it. Everything else is discarded or ignored, be they facts or people.
Here’s my suggestion in honor of Scooter Libby.

The post notes, rightly and with a tone of “this was wrong to do”, that Bushie and Gonzo picked this fight, viz.:
The point everyone needs to remember is this: all the handwringing about how a government interested in efficent, honest operation would not have done the things Bush and his crew did, is irrelevant. Bush, Cheney and the Republicans are coming at government from a very different angle: they are not interested in efficient, honest operation of government. Their only interests are in the expansion and perpetuation of Republican power, and the destruction of any potential challenges to that power.
Seen from that point of view (or point of philospohical origin – take your pick), what Bush, Cheney, Gonzales, Rove and all the rest did was not only perfectly rational, it was predictable, foreseeable and, indeed, the most efficient means to accomplish those ends.
That they discarded the ideas of truth-telling was, to them, irrelevant. They were and are interested only in aggrandizing their own power, and that of their Republican successors. Truth-telling gets in the way of that objective.
That they discarded the ideas and traditions of impartiality was, to them, a positive attribute of their policies. In a world where Republicans are “good” and opposition to Republicans is “evil” to be resisted and destroyed, being partial – selectively prosecuting Democratic officeholders at a rate of what, 17 to 1, or deliberately overlooking or burying Republican misdeeds (where are all those Senate Indian Affairs documents about Abramoff, anyway?) – is a sign that the person being partial is a loyal member of the Party.
That they are picking this fight is a sign that they think, having had a number of years to pack the relevant courts, they can win it. And, in winning it, both cement their power for decades to come and hide their criminality as well.

I would like to recommend a Dance radio station, C89.5, which can be accessed over the internets at http://www.c895worldwide.com/web. It’s owned by the Seattle School District and operated by students of Nathan Hale High School, and supported primarily by listeners, for the last 30 years.
The station has a few specialty programs in the schedule, but most of the time it’s just dance, dance, dance, uninterrupted by commercials. Unfortunately, I’m afraid they won’t be playing any Celia Cruz until she appears in a mashup.

Bush will never fire Gonzales. We now know that his very appointment of Gonzales as Attorney General was an enormous act of chutspah and a gigantic “*# you to Ashcroft, the rule of law and to the American people.
Remember, Gonzales had got sent on that hightly improper visit to Ashcroft’s hospital room on March 10, 2004, to request that Ashcroft reconsider the reauthorization of the secret surveillance program. Ashcroft refused to reauthorize the program and indicated that the acting Attorney General Comey was the person to whom Gonzales and Card should direct their request. If Bush did not send Gonzeles to that hospital room, he certainly knew that he went. As many as 30 Department of Justice senior staff were prepared to resign immediately, protesting both the underhanded effort to go around acting A.G. Comey to get the program re-authorized, and also in protest of the Bush Administration’s effort to continue the warrantless search program without change. And Bush knew it.
So who does Bush appoint to replace Ashcroft when he resigns in Nov 2004? Gonzales. It is crystal clear from that appointment, just how far Bush is willing to go.

In an otherwise worthy piece, this is beyond naive. At the root of this is Bush’s blind loyalty to no one but himself. In this game of pig-in-the-blanket, Gonzales is the blanket and Junior is the pig. The second Gonzales is out of office, the gently covering blanket is whisked away, and the pig is revealed. The DoJ begins to function as something other than an all-purpose disposall unit down which the Administration’s many crimes can be stuffed, shredded, and forgotten.
Bush needs AGAG, desperately, for his own and Karl Rove’s protection. No one could, and no one confirmable would, keep the airlocks closed tight on the stench of all that elephant dung in 21st century America’s very own Augean Stables.

But what he is saying is that it is the job of reporters to keep things like Libby leaking information about covert operatives under wraps–that when Libby used illegal methods to undermine Joe Wilson’s attempts to correct the public record on the state of Iraq’s nuclear program, and the inaccuracy of the president’s claims about Niger–that all Libby was doing was the “dark acts” of politics. Cohen is saying that a journalist’s job is to ASSIST in the coverup of government lies.

I wish I could remember the name of the person who commented (perhaps he/she is on here) who wrote that the Dems really need to just call things as they are and start handling Bush like an alcoholic dad who has trashed everything he touches and now the adults are coming in to fix things. WASHINGTON (CNN) — Lawyers for convicted former White House aide Lewis “Scooter” Libby will ask a federal appeals court Tuesday to allow him to stay free while they contest the sentence of two and a half years, a defense source told CNN.
After U.S. District Judge Reggie Walton last week denied the defense request to allow him to stay free, Libby’s lawyers promised to quickly appeal.
His attorneys argue there are several key legal issues which they believe they have a good chance of winning on appeal, including whether Special Counsel Patrick Fitzgerald had the constitutional authority to conduct his probe. Fitzgerald, the U.S. attorney in Chicago, was appointed in December 2003 to investigate whether a law was broken in connection with the leaking of the identity of covert CIA operative Valerie Plame.
They also argue it was improper for Walton not to allow a memory expert to testify during Libby’s trial. (Posted 10:10 a.m.)

This has nothing to do with competency or incompetency. It has to do with advancing an agenda. These people only appear “incompetent” because they are being judged by standards no longer in vogue. People who think independently and have loyalties to country that would supersede buddies are useless to advancing the agenda at this point; even Ashcroft wasn’t enough for them!
At this point, we are well on the road of fascism (a.k.a. Corporatism), moving into empire and eventually a failed state. The end will be a brutal feudalism with 21st century technology for the few who can afford it (guess who that will be) or sustain it (China?). Until people, especially the politicians that confirm these craven wormtongues, catch on to this, we will always be snookered.
It’s time to start talking impeachment at the highest levels. This administration and failure by so many to perceive a much more insidious agenda under the guise of incompetency will destroy us all. They have gotten almost everything they wanted so far and it is not over by a long shot!

gonzales isn’t some unfortunate mistake that slipped through the screening process. gonzales was installed as head of DOJ by bush and the republican congress specifically because of his partisan hackery; because he would faithfully execute the plan to use the DOJ not for fighting crime, but as a weapon against political opponents, and for retaining and growing cult of republicanism infestation of the government. That gonzales has been imminently successful at his mission is exactly why he is still in charge of DOJ.

This is the first time in American history that we should have “twofer” and hold the impeachment hearings for both Bush and Cheney simultaneously. It’ll make history. And it’ll get both of their lying, scummy asses out of OUR White House at the same time.
To put it simply, if our nation’s founders had wanted a “unitary executive,” then they’d have switched positions of Article II and Article I at the beginning of the U.S. Constitution.
The Republican Party, once the party of Lincoln, has now become a party of traitors, subverting and sabotaging everything that our nation holds dear, in a blatant, almost Communist-like grab for power and a dreamed-of quest for perpetual Republican one-party-rule.
