It's sentencing day today for I. Lewis Libby. Today, Judge Reggie Walton will sentence Libby based on his conviction on multiple felony counts after a trial and conviction before a jury of his peers.
Elizabeth de la Vega has a great article on what is truly the heart of this case.
If the memorandum filed by defense attorneys in anticipation of former top White House adviser I. Lewis "Scooter" Libby's June 5th sentencing is any indication, it appears that Libby—one of the highest White House officials ever convicted of a felony—has learned precisely nothing from his trial and conviction on charges of false statements, obstruction of justice and perjury.
Libby's lawyers admit—because they have to—that their client, a man with three decades of executive-level federal government service, disseminated classified information about the status of CIA Agent Valerie Plame Wilson in response to public criticism of the Bush administration by her husband, former ambassador Joseph Wilson. They nevertheless insist that this, at best, reckless (and, far more likely, intentional) act is not only not illegal, but not even wrong.
Unfortunately for Libby, this in-your-face position also has a certain shoot-yourself-in-the-foot quality. Libby is arguing for a probationary sentence, which is considerably more lenient than that called for by the Sentencing Guidelines. (See lesson one below.) An essential factor every judge must consider in deciding whether to depart from the guidelines to impose such a light sentence is whether it would sufficiently deter others from similar misconduct.
Having aggressively argued that there was neither crime, nor misconduct, how do Libby's lawyers then address the issue of deterrence? They argue that Libby has experienced a "very public fall from grace" and that this "dire consequence" alone would be enough to "warn the public—and high ranking government officials in particular—that it is important to take FBI and grand jury investigations very seriously." This is an exquisite expression of the entitlement and arrogance that spawned the administration's smear campaign against Joseph Wilson in the first place. It could only be more pointedly evocative of utter contempt for the rule of law if it were followed by a sneer emoticon. (emphasis mine)
Judges do not tend to appreciate a hair-splitting attempt to pretend to have remorse while, at the same time, pretend not to have done anything for which to be remorseful. That "having your cake and eating it, too" approach can be important for preserving grounds for appeal, but the failure to own up to your own conduct is never a plus when it comes to sentencing. At least not with any federal judge I've ever known — and, as Matt Appuzo of the AP reported earlier this week, Judge Walton is known as a tough on crime kinda guy. Most federal judges are, frankly, so to be known as tough with a sentence on the federal bench really means something — let's be honest.
And I keep going back in my mind to something that Patrick Fitzgerald said on the steps of the courthouse after the jury returned their verdict in this case:
Any lie under oath is serious. We cannot tolerate perjury. The truth is what drives our judicial system. If someone tells a lie under oath, it is every prosecutor's duty to pursue that case. It is obviously a serious matter when a high level official does that under a national security investigation — it should never be tolerated.
…No one is above the law, no one gets less protection under the law. And we do not talk about someone who is not in the legal system in the case at bar. All we'll say is that Mr. Libby by lying and obstructing justice harmed the process.
Libby is an attorney, an officer of the court, and he has represented clients in white collar crime cases. In other words, he ought to have known better.
The thing is, though, you can never, ever predict what will happen in a criminal matter. Not with a jury and not with sentencing. The jury came back with a multiple felony count verdict. Today we find out what Judge Walton will do with the sentencing considerations. Some things are fairly standard, though: both sides will argue their points with the judge; Libby's lawyers will be able to present some testimony in an attempt to mitigate Libby's abject failure to show any sign of remorse that he broke the law. Or that he has fully owned up to all of his conduct in the matter. And Judge Walton will ask I. Lewis Libby to rise and hear his sentence.
Today we find out the answer to at least one question: will he or won't he do time? Emptywheel and Jane will be at the courthouse — there should be liveblogging capability from the media room, and we are planning on using it, as well as having reporting from the courtroom itself as breaks and proceedings permit. The sentencing hearing is set to begin at 9:30 am ET. Stay tuned, and we'll all find out together what comes next…

From what I have heard all along, grounds for appeal are really thin. Were they strong, I might agree with you, but I would hope that Judge Reggie tells him to get his affairs in order and get ready.

Today feels like one of those momentous days in history that help define the morals and values of the United States. Today we either confirm or deny that there is a dual layered legal system in the US. Do we have a system where the poor get the book thrown at them and the rich walk away with their hand slapped or is the legal system applied evenly as possible to all. Film at 11.

i confess to being more interested in what the lawyers will say today (fitz!), than in what sentence libby gets (so long as it is some real jail time). maybe it’s because i’m still wishing for the whole truth to be publicly revealed.
I wonder how many CIA agents decided to keep quiet about the false WMD story put out by the Bush administration after they saw what happened to Valerie? If Scooter gets a pardon or no real time then no CIA agent will likly EVER dare cross Bush. After all who wants to get banned from their industry and have to look for a new line of work. The Judge should take that into account when he sentences Scooter.
It a beautiful day for a sentencing.
Do we know who the witnesses will be? A tearful spouse? Are surprises possible? Will Tucker’s dad testify? Toensing?
Although it is just as important, the sentencing does not have quite the drama as did the verdict.
Right now I cannot sense which direction Judge Walton is leaning. I am doubly curious to see how each side presents its case. And IANAL!!

We have decided, well … (picks up The Very Heavy Book and throws it at Scooter, hitting him right in the head).

Walton: The court sentences Mr. Libby to 3 years and one month in prison, with no chance of parole. Court adjourned.

George at 37 — No, if the grounds for appeal are deemed to be quite thin, they often remand you immediately to jail and you appeal from there. It is very, very common to be remanded immediately, especially in cases where a violent crime conviction has been obtained (felony with firearm, that sort of thing). What is different with Libby is that this is not a violent crime offense, but an affront to the judicial system by a high-ranking public official who was also an officer of the court as an attorney. He may be allowed a few days to get his affairs in order, but I look for a remand if he is given jail time in his sentence. Judges don’t tend to look very favorably on lawyers who try to end-run the judicial process or who lie under oath.
dakine at 45 — WY state law requires that the governor follow that procedure. So pretty much any governor of any party in that state would be required to do just that.

Well this old lawyer wroked his schedule to be free until this afternoon, in order to see what happens. I think we both know tho, that despite whatever sentence is handed down, the determination of whether he does any time at all will be made when Walton rules as to whether he remains free pending appeal.
As to Jefferson, well that’s quite the indictment, altho it was kind of interesting to hear the give and take at the press conference yesterday regarding whether, even with the details set out as completely as they were, we should put any faith in the independence of the US Attorney bringing the charges. What a fine legacy Gonzales hs left us. Unfortunately, he has also left us with this conundrum, as reported in WaPo:

The FBI gave him the bills, but did not trace the remainer? Certainly they use marked bills for stings. Can the Treasury be called in to Committee?

Can the Senate and House please review the Frist financial transactions? They have authoirty to search/review their own.
The only thing keeping Frist from being searched for trade violations was using Congressional privelege. The notion that discovery was not beyond the actions he did in his office probably prevented that, when the Reps controlled Congress.

Mr.Murder — Yes, Frist ought to have been investigated to the fullest extent possible if there was any indication of wrongdoing. But that does not, nor should it, excuse alleged bribery and other matters in which Jefferson is said to have been involved. You don’t let one person off for breaking the law because you missed on someone else. Whatever allegations of politicization may be going on at the DOJ — and there are a lot of questions — lawbreaking needs to be punished. Period.

My bet- the same one who did evidence in going after the former Arkansas Sec. of State for voting software fraud. He did a kickback payment to sell items being moved out of Dallas Texas(Seqouia voting tech) and got it moved to Arkansas. The man turned state’s evidence and then was promoted to run ES&S.
Just have a feeling he might have stopped in the neighborhood… or the people from the(then) pending Gas lease case in Southern Arkansas.

It doesn’t help Scoots in my view that the right wing noise machine has been poo-pooing his conviction all along. Fred Thompson has been absolutely appalling in this regard and if he enters the race it should be an issue.
My money says Walton throws the book at Scoots not just for lying, but for being the Cheney firewall. Deterrence here is sorely needed, not just against perjury, but against the notion that Omerta leads to personal profit after the fact. Scoots will have a good long time to dream about his wingnut welfare “job” that awaits him upon release.
I am also betting on remand.

The idea of a double standard in place, and his being essentially entrapped through the the feds, and his office having undergone a search when First used the same for a shield to trade illegally, it goes back to the idea of politicizing enforcement.
This guy got ninety grand, but his fridge could not load a pallet of bills on it. I hear the Baghdad embassy freezer can handle nine billion worth of pallets. Or Mr.Ledeen’s Swiss bank account.

Trying to get that “fair and balanced” talking point out there? ie- “Sure, Libby lied” says the Repug Think Tank Crazy, “but the Democrats are just as corrupt. Look at this Jefferson thing.”

I had a similar idea. One can always seek a sentence reduction from jail. Since Irving (I just love using his real name) never was subjected to the coersive power of criminal contempt for refusing to testify (a la Judy Miller) this sentence could substitute for that type of contempt effort. Something like, “I will sentence you to 33 months, but will entertain a motion for reduction in sentence if you waive your remaining fifth amendment rights and speak to this nice fellow in the ill-fitting suit to your right.”

I sure hope Libby brought his toothbrush, as they say. The more time he spends in stir, deprived of full freedoms, even if it’s a ClubFed golf resort, the more likely he is to sing in the upward direction.

Having served on the jury, it’s nice for me to see this come to a close. I doubt this will be the last we hear of the case, with the defense attempting to run out appeals, but for now, it appears the defendant will do some time.
A criminal defense lawyer I know thinks Libby will receive from 24 to 30 months, and will be able to self-report, instead of being taken in to custody right away.

Marcy and I were listening to Meek on the way in (he’s here today). He mentioned something about how he knew Fred Thompson was supporting Libby in the context of the letters and I couldn’t tell if he meant that Thompson wrote one or not. Didn’t get a chance to ask him before he ran upsairs.

Badwater at 121 — Not for show — the judge will have an idea going in on what his sentence is likely to be, but defense counsel is given an opportunity to pitch their client’s case — and to put him on the stand to express remorse and/or acceptance of responsibility. But you never know exactly what will or will not happen — it’s based generally on their appeal strategy layered against a play for a more lenient sentence from a downward departure standpoint in the sentencing guidelines. Should be interesting, allthe way through, today.

Another interesting aspect of this case will be the letters that come from Judge Walton’s office. As you know, there was a concerted campaign for friends of Libby to attest to his character. It wasn’t obvious up front that those letters would ever become public.
Here we are on the cusp of sentencing, and Judge Walton has said he would release them. I think that’s only fair, given that they may have had an influence on his sentencing – either upward or downward. We may see some redactions, but hopefully not of the sender’s names.

I hope someone from the MSM will ask Mrs. Carville for a her prediction of the sentence. She’s Deadeye’s rep, a tail gunner and just wants to snipe at whatever Judge Walton hands down. Anything to “lock her into a story,” might disrupt her timing a little.
The problem with her is, she doesn’t care what anyone asks her, she just spews out her talking points.

Why would Scooter get — if sentenced to time behind bars — time to get his affairs in order? It’s not like it’s a surprise that this could happen today. Shouldn’t he come to court prepared to sleep somewhere new tonight?
So what would happen if Libby started singing after the sentencing? Even though I believe he was an integral part of outing Plame and should be held accountable, I do feel bad for his kids and wife.

I agree. The timing of the charges may be suspect, and there are probably people out there who have done worse, but the charges sound substantive and believable to me. In fact, given some of the places he does business, it would be pretty much a miracle if he was not involved in corruption. Nigeria, for example, is notorious.

They really do believe they have some bully authority above the courts and the legal system. They are a law unto themselves, the royal citizens of Cheneyland make their own rules, on the fly, and only use the laws on the books to persecute and disempower political opponents.
Scooter won’t spend a day in prison.
Even if he’s sentenced to three years, his legal team will file an appeal and drag it out until the inevitable day Lord Bush pardons him on his way out the Oval Office door.

If his sentence overlaps Bush’s final 6 months in office, he might get a truncated term via a pardon, but my guess is that he’s cell-bound for now.
Considering what immigration has done to the Bushies and their fractured base, I also doubt King George intends to offer any pardons until he’s much closer to his glorious departure day, the more he loses his base, the bigger the body of impeachment supporters.
W WILL NOT go down in history with a big Clintonesque impeachment asterisk beside his name. Libby’s going to hang out to dry just long enough for Bush to be assured he won’t get impeached.
