Having watched Judge Walton get seriously angry during sentencing at young African American men he accused of living in self-imposed chains, I have to say I'd be really surprised if he let rich, privileged Scooter Libby completely escape a future in an orange jumpsuit. John Dean sounds about right:
How long a sentence is Judge Walton likely to impose? On May 25, Special Counsel Patrick Fitzgerald filed the Government's Sentencing Memorandum asking Judge Walton to sentence Libby in the range of "30 to 37 months." Criminal defense attorneys with whom I have spoken expect that Judge Walton will choose a sentence of roughly 30 months (two-and-a-half years), and to give Libby at most a couple of days to get his affairs in order before surrendering to the Federal Bureau of Prisons.
No doubt, the Bush White House has been making similar calculations. Thus, they are approaching a moment of truth. There are only three real insiders here: Bush, Cheney and Libby. However, it appears that the outsiders have looked at the situation, and acted to try to improve it. And as long as they are outsiders, they can do so without criminal exposure.
Dean goes on to point out that if Libby were acting simply on his own behalf, a pardon wouldn't be a problem. But since Fitzgerald has already said that a "cloud" still hovers over Shooter, and should he be lobbying for a pardon, it would potentially further a conspiracy to obstruct justice. Not that I imagine anyone involved cares much at this moment in time, but it could have implications on down the line.
But perhaps the most interesting part of the Dean article has to do with recently announced Presidential candidate Fred Thompson, who has been publicly defending Libby:
Nonetheless, based on his two-plus years as an Assistant U.S. Attorney, Thompson informed the audience, "In no other prosecutor's office in the country would a case like this one have been brought." Apparently, other prosecutors tolerate perjury and obstruction of justice. In addition, later in his speech, Thompson explained, "I have called for a pardon for Scooter Libby. When you rectify an injustice using the provisions of the law, just as when you reverse an erroneous court decision, you are not disregarding the rule of law, you are enforcing and protecting it."
The Libby defense fund was certainly not short on cash. Was Thompson paid for his Libby lobbying efforts? Since Mark Corallo was formerly the defense fund's spokesman and is now Thompson's press secretary, he's certainly in a position to know. Let's hope somebody asks.

Update: Josh Marshall says Thompson was not being paid to defend Scooter. He's evidently trying to ride in on a white horse and tie himself to as many BushCo. scandals as possible. Shrewd.

With all due respect to Jeralyn and her expert analysis on this yesterday at TalkLeft, I do so very much hope that John Dean is correct.
I am beginning to dislike Freddy more and more. Is Thompson the ‘annointed’ one, the Bush dynasty’s choice to succeed their little boy? And then perhaps Jeb in ‘12. This Bush family was born to rule you know.
I think John Dean has it right. His book Worse than Watergate came out long before most Americans woke up to the fear mongering and incompetence of Chimpy and Shooter.
Conservatives without Conscience is a great read too. Really nails the difference between the Cheney Bush cabal as compared to Goldwater conservatives.
Are we starting a pool? I say 3o months, remanded immediately to the pokey. I’m split on the pardon issue. Have to think about it a little more…

In many of these unfolding GOP criminal conspiracies, the only unifying element beyond the criminality itself is the disdain so many show toward the possibility there may be jail at the end of the line. The Repukes being rolled up one by one in Alaska are beginning to feel some pressure, though.
I agree with Dean, but I DO hope that Scooter’s team gets a Sunday evening call reminding him to bring his toothbrush.

It is my strong belief that Mr. John Dean be granted a pardon by the next Democratic president. No Republican would ever do it. This man, Dean, has paid his dues.

What time does the sentencing begin? Is that known yet? I am figuring there will be some serious nitpicking going on in chambers amongst lawyers before the public part begins.
I think a pardon is highly unlikely. I can just seen Waxman and Leahy rubbing their hands together in glee — subpoenas at the ready.
Because –IF– Libby were to accept a pardon, that means he admits he is guilty. Best of all, he can’t plead the Fifth, and must testify truthfully to Congress.
Should he commit perjury, he could and would be prosecuted for the same…

Fitzgerald, a career prosecutor who tends to avoid the cameras, disagrees.
Thompson is preparing to seek the presidency as the standard bearer of the wing of the Republican Party that turns a blind eye to official misconduct.
Fitzgerald is preparing to return to his work as one of the nation’s most trusted enforcers of the rule of law.
Here is a real contest for Americans to decide. They can choose between two tickets: Thompson/Libby versus Fitzgerald/Rule of Law.

Thompson was admitted to the State Bar of Tennessee in 1967 and worked as an assistant U.S. attorney from 1969 to 1972. He was the campaign manager for Republican U.S. Senator Howard Baker’s successful re-election campaign in 1972, which led to a close personal friendship with Baker. He later served as co-chief counsel to the Senate Watergate Committee in its investigation of the Watergate scandal, (1973–1974).
He was responsible for Baker asking one of the questions that is said to have led directly to the downfall of President Richard Nixon—”What did the President know, and when did he know it?” Also, Thompson’s voice has become immortalized in recordings of the Watergate proceedings, with him asking the key question, “Mr. Butterfield, are you aware of the installation of any listening devices in the Oval Office of the President?”[7]
Peterr, I also caught the “received any cash” and thought it a dodge. Plane rides, Comstock & Carallo’s time, introductions (recall that Fred attended the funders’ party at the Carville/Matalin home), favorable mentions on “Tucker,” polling in early primary and caucus states…. Lotsa ways to underwrite a fella’s quest for the White House without “receiving any cash.”
I do like Josh’s frame, though — Fred’s tying himself to as many BushCo scandals as he can, with the Griffin flirtation. To doubly enrage the base, perhaps Mrs. Thompson can be a wetnurse for little SammieDave Cheney.
When Walton “makes public” the letters received regarding Libby’s sentence, does anyone know how that will be done? Would it be immediately available online via the court, or will hard copies be handed out that someone (WaPo/NYT/etc) will scan and put up on their sites later?

It’s an odd family. With the exception of Maureen (now deceased) all of the children seem to have gone through times of being on the outs with Mom & Dad. I remember during the 80s, Michael went public with the fact that Nancy and Ronnie had never met his youngest (who was a toddler at the time). Or something like that. They are emails supposedly sent accidently to a GW43 site (org instead of com or something like that) which happened to be owned by a friend of Palast’s. They contained long lists of caging targets. So, it would seem that Palast gave them to the BBC–who he does work for–and Conyers got them there.
To be honest, I am not entirely comfortable with Palast’s tale, since he could’ve, by now, published the entire lot. He says there are 500, but he has only printed excerpts from a few. Odd, that.

I read John Dean’s opinion on a regular basis, he knows the issues from the inside out.
What I still do not get is why people like Thompson, Toensing, Woodward, Miller, Novak, and others refuse to get how serious this is. Outing an undercover (noc) agent whose job it was to follow the path and sales of WMD’s into Iraq, Iran (I am sure Valerie had many other critical jobs that we will never know about.)
Why do these people refuse to admit how serious this was/is? Undermining National Security by outing someone (Plame) who was looking for just what the Bush administration was after…WMD’s. What is with these people what are their agenda’s? Do they support underminig National Security? Very disturbing!
Wonder what Fred Thompson has pushed for in other criminal cases, like for people robbing a corner service station? Thompson needs to get out on the street more the American people are pissed…we want to witness justice.
Let’s hope and pray that Judge Walton sends a clear message to the Bush administration, Cheney, Libby etc, that he means business. Let’s hope that Walton sends a clear message that as Fitz pointed out that “truth is the engine of our judicial system”. Americans are hanging on by a thread to this concept.

Rove’s people (apparently Tim Griffin, included) sent 500 e-mails to the wrong e-mail address (georgebush.org) which was a satire website signed owned by a friend of Palast’s. These e-mails involved caging lists. Palast has been talking for a while about how he had these e-mails and he has now turned them over to John Conyers.
I thought it was an incredible story but apparently it’s true – supposedly there’s a pic of Palast and Conyers looking at a caging list on Palast’s website, but I can’t get into the website – it might be flooded right now b/c Randi was telling everyone about it.

Palast didth protest a bit too much earlier this week, when a diarist on DKos asked some pointed but (I thought) reasonable questions about the mysterious emails. Palast’s self-aggrandizing style raises red flags for me. Trust but verify…and raise the eyebrows ever higher when Palast goes postal on someone who asks him to verify, as he did this week.

Which is something I have wondered. Copyright law says that the text belongs to the writer, so in effect that means that if you send me a letter, I cannot publish it without your permission. But Palast has never discussed this. Which makes me wonder about other issues of legal liability–which then begs the question, how was it that he was able to publish the excerpts he has published. And why hasn’t he written more about what is in the emails, which it seems he could do.

IANAL either, but I have a good friend who specializes in copyright law, and she tells me that the copyright belongs to the author, no matter what, and may not be reproduced without the author’s permission.
WRT letters and emails. They “hard copy” belongs to the receiver. They can show it to anyone they like, but they can’t publish without permission. They can however, write about what they read. If that makes sense.

Michael Reagan’s op-eds are published on occasion in my local paper and they are absolutely awful.
You can’t get through one fourth of one without seeing his blatant lies. By the time you get to the end, they are too numerous to be counted.
His writing is like something you might see from a highschool freshman who can spell but who has flunked his history and civics classes. Who knows, maybe the spelling thing is because he has an editor.
All he does is spout radical rightwing rhetoric so ridiculous that it leaves you thinking what the h????.
Personally, I think he is trying to out conservative, out republican, and out wingnut his daddy. Instead he just looks like a fool.
Bush the Father got away with pardoning several principals in the Iran-Contra scandal, and the effect was to shut down the Walsh investigation (the pardon recipients no longer had any motive to cooperate). So I’m afraid that claims that a Libby pardon will obstruct justice, while correct, don’t really matter much. If Bush wants to do it, nothing will stop him.

first penny – Greg Palast is getting rather tiresome.

It’s time for Greg Pallast to put up or shut up. Show us the emails. Jason Leopold lost all his credibility during the Libby treason incident claiming that sealed indictements were about to be served to K. Rove and we saw how reliable that was.

One big difference here though: the Congressional investigations are just getting started. They had been completed by the time of daddy’s pardons just before he walked out the door.
Pardon of LIbby WOULD pretty much derail the current criminal investigation, just as it did with Walsh’s investigations of iran/Contra. But a pardon of Libby would put him square in Henry Waxman’s sites for the House Oversight committee. He would HAVE to talk and no fifth amendment rights on a crime where he’s been convicted and accepted the pardon. I would call it a good foundation for impeachment of Cheney were such a thing to occur.

Palast has done some good work, but one gets the distinct feeling that he has come to learn to love the spotlight. I saw him at a book signing on the Upper West Side (just happened to be browsing when he turned up and stayed around, thinking it would be interesting). That was like a month ago. At it, he said that he was going to see Waxman (not Conyers) in a couple of days to give or show him the emails. But he was definitely loving having an audience, and hearing himself talk. Didn’t leave enough time for more than 2-3 questions.
On the whole, entertaining but not impressive.

Possible scenario: Libby is pardoned. Democrats at first threaten to investigate. Much sound and fury. Then, “for the good of the country”, it’s dropped.
20 years later, Libby shows up again in a Republican White House as a senior advisor. Elliot Abrams is also on the staff there.

My penny wasn’t to negate all that Palast does. His work in Ohio was and is important. And maybe part of his cloying coyness re the release of the 500 emails erroneously sent to his buddy is based on possible copyright issues, but his Guy Noir schtick is right out of “The Onion.”
His account of events which I was part of during the Exxon Valdez cleanup in his book _The Best Democracy Money Can Buy_ is so riddled with errors and intentional distortions that I’m surprised I trust the guy on anything.

What’s the difference between then and now? I’ve heard it said that if Libby is pardoned, then he is in effect pleading guilty, and can no longer refuse to testify on the matters at hand. And if he testifies, and lies, he can be prosecuted for perjury.

Palast also has more cred as a news source than either FDL or DailyKos, according to NewsTrust, based on a sample of 30 (Palast) and 45 (DailyKos & FireDogLake) reviews. NewsTrust has a much wider reader base (more than 1,000 reviews of AP) that tends liberal in orientation.

He did not lose “all” credibility. Maybe he lost cred with YOU, because you focused all your judgement on this one case, and ignoring all the other good reporting that he’s done.
I respect his work, as does Marc Ash, the editor of TruthOut, which has more cred as a news source than FDL does (see my post on NewsTrust, with links). Jason has paid his dues, and he is a far better source than most of what I hear on CNN or other MSM. What’s the old expression– cutting of your nose to spite your face? Ah, yes, here it is.

Sorry to be a pain in the ass but ….
I first came to FDL during the Libby trial and I asked if someone had a timeline. Somebody graciously referred me to a good site (with diagrams and circles and everything.) And I stupidly didn’t save it or print it out.
So I’m asking again: Anybody know where I can get a timeline of events in this case? I ask because FOXNews has one somewhere at its website. I’m not Plameoloist that many of you are, but it struck me that the FOX timeline was missing a few things.
More I think about this, the more I believe that Libby will go to jail now.

The court will usually make a statement about what he has reviewed, what has been submitted, what he has chosen not to take into consideration, what, if anything, he has accorded extra weight….. that kind of stuff.
Each side gets to make an oral presentation of their position.
Sometimes, other witnesses are allowed to speack, for example victims, sometimes memebers of the defendant’s family.
lasty, the judge will explain how he did his guidlelines calculation what mitgating or agrravating factors he took inot account, etc.
He will then impose sentence and read off a bunch of statutory language about minimun surcharges and fees (don’t even pay attetnion to that).
Therafter expect Team Libby to make an application to contiue bail pending appeal
This is where the fun begins to pay ver close atttention when that starts.
That should be where the lawyers will get their exercise.
Iassume walton will give Libby a couple days to get his last minute affairs in order unless htere has been a prior communication with the court indicating that he will not need the time.
They will usually pick a surrender date, adn a surrender location for Libby to report to. When he has reported for his induction into prison, his bail will be released.
There may be some other motions relateing to conditions of incarceration such as remand to a halfway house or a motion for house arrest
I expect the latter, That too may provide some jazzy lawyer’s arguemnts. In fact I wish I could be there for that one.
Poor Scooter wants to call his very fancy home “prison”–I would expect some fireworks here as well

Aw don’t be hard on her. She thinks like a defense lawyer. Probabaly becasue she is a defense lawyer. So for her the prosecuotrial glass is always half empty.
It’s a point of view thing. I rather liked hearing her take, it broke up the echo chamber effect and she pointed out things that escaped my attention because, suffering from my point of view-itis, all I could see where the flaws in the defense case.

But, the article leaves me with a question that I feel needs an answer. If Thompson is giving speeches in which lies are being told about the facts in the Libby trial, isn’t there anything that can be done to call him down? Is this not some sort of crime? Is Fitzpatrick being libeled?
Something is seriously wrong if he can get away with this.
