Dear Jane, Let’s all take a vow not to be shocked for one month. At first, it will hurt like heck. Some of us may not be able to endure it. But as time goes on, it will get easier and easier and, by the end of the month a few of us may have kicked being shocked altogether. Don’t you think it’s at least worth a try? Yrs, Handel Glassberg, President, The Playdo Institute

JH’s suppositions seem correct. Libby will never serve a day in jail (remain free on bond pending appeal) and will be pardoned during the appellate process. The pardon is simply a matter of timing as to when the pardon will least interfere with the goings on of the Bush administration.

I say Fitz is an over-rated wus, and he will not take a position of go to jail NOW.

As I stated in Wilson? Yeah! Fitz? Feh!:

“Next time you hear someone sing the praises of Fitz, the special prosecutor remember he didn’t get the guys who ruined the career of the patriotic Mrs. Wilson, and he let the guilty guys wriggle off the hook.”

In Relevant Conduct and Scooter’s Sentence I offer my analysis to the effect that Scooter is looking at substantially more than Fitzgerald is asking for. Please check it out.

A little taste of how the Neocon Royalty pamper their Superior Intellects when ‘on location’ in NYC [Duck Liver Mousse on Water Crackers anyone?]:

The Club contains 60 bedrooms for members and guests, a variety of meeting rooms for business and social functions, and one of the most extensive club reference and lending libraries in New York City. The Union League is also home to a distinguished art collection and an art gallery with rotating exhibits. The fitness center features all the amenities of a first class sports club, including international squash courts.

The Club Today

The Union League is a social club providing its members and guests with a quiet sanctuary and relief from the hustle of the city. The dining rooms reflect a subdued elegance with a chef and wine cellar that compare favorably with any in the city or, members can drop by the grill for a light lunch or supper. Members gather cordially for social events, theatre evenings, wine tastings or just to meet friends for a convivial drink at the bar. An active speaker program includes Public Affairs forums which have hosted outstanding speakers on current events since the 1880’s as well as library events with notable authors.

Hugh, thank you so much for your learned opinion.

Your willingness to share your professional skills (and billable hours :) with the Lake is a very generous gift.

Hope I’m not presumptious to puruse this question, but do Germany (or other nations) assert jurisdiction over extra-national human rights crimes?

I’m curious about mapping other nations’ jurisdictional assertions against overseas US military/NSA/spook assets.

If my query is off the mark, please feel free to ignore.

kirk murphy @ 176

Hugh, would this also apply to prosecutions in Germany and Belgium (or other nations) which - IIRC - allow prosecution in their national courts for war crimes/human rights crimes comitted anywhere on the planet?

It’s complicated. I was wrong to say that US citizens could not be tried before the ICC. It is just extremely unlikely. US nationals could come before the ICC at least in theory if they committed crimes in a country which is a signatory to the ICC. This has never happened and is unlikely to happen for two reasons.

The principal way the US has gotten around the ICC is by article 98 or bilateral agreements which stipulate that US nationals will not be referred to the ICC. The US has about 100 such agreements. Some, however, are restricted to US military personnel only and many are with non-signatory countries.

The second way the US has addressed this problem is through a different kind of diplomatic pressure. Because the political costs of such a prosecution vis a vis the US would be extremely high, countries such as Germany defer prosecutions to our legal system which will, in fact, choose not to make them.

Belgium, for its part, can assert universal jurisdiction but that is different from actually practising it. The principle is very controversial and so it is easier to squelch such prosecutions than face an angry US.
