Emptywheel arrived in CT today. In much the same way that George Bush received cosmically appropriate gifts from the heavens when congress gave him a blank check to fund his pet war, we got home to find that Fitzgerald had released his sentencing memo in the Libby case (PDF).
Favorite part so far:
III. Response to Certain Arguments in Mitigation
In this case, as is his right, Mr. Libby maintains that despite his conviction, he is totally innocent. He has expressed no remorse, no acceptance of responsibility, and no recognition that there is anything he should have done differently – either with respect to his false statements and testimony, or his role in providing reporters with classified information about Ms. Wilson’s affiliation with the CIA.
Instead, on Mr. Libby’s behalf his supporters have submitted to the probation office and the Court a variety of arguments challenging the propriety of his prosecution. These arguments for leniency paint Mr. Libby as the victim of an improper, unnecessary, and politically motivated investigation, an unfair indictment, and a wrongful conviction. These arguments mirror comments made by the defense’s public relations team and posted on the defense website, www.scooterlibby.com, before, during and after the trial. The submission of these arguments on Mr. Libby’s behalf is well known to Mr. Libby and his attorneys, and while they have not to date explicitly embraced these arguments, neither have they disavowed them. The government submits that these arguments are completely at odds with the kind of contrition that normally is a pre-condition to leniency.
It's pretty hard to make the argument that Barbara Comstock — who worked for the Libby defense fund and was there in court every day actively pitching those stories to journalists both inside and outside the courtroom — could be construed in any way as being separate and distinct from either Libby or his defense team. Contrition does not seem to be their strong suit.
Paging Reggie Walton…Fitz probably can't be that direct about Monica Goodling's personal Svengali Barbara Comstock and her three inch roots but I can.

Update: Jefress responds — he doesn't want to release the letters written in support of Libby, whose authors could no doubt side gig in the Chamber of Horrors at Madame Tussaud’s:
Given the extraordinary media scrutiny here, if any case presents the real possibililty that these letters, once released, would be published on the internet and their authors discussed, even mocked, by bloggers, it is this case.
I'm kinda hurt here. Why does he think we'd treat people like Richard Perle, James Wolsey and Mel Sembler with anything less than the respect and dignity that their service to this country so richly deserves? Maybe it was my shoes.
(BTW, Libby is being sentenced next week on the 5th and Marcy and I both plan to be there.)

Is this the ONLY pre-sentence filing that Team Libby put in?
Where is the part where they refure PatFit’z arguements or make arguements of their own about the appropriate sentencing range for Libby?
Unless Libby makes a deal, which I don’t see happening, this case has been like the mountain that gave birth to a mouse. No underlying crime, and the bigger fish have all gotten away. Let’s not forget that CREW, who I esteem far above Fitzgerald, asked the Congress to investigate the Rove e-mail trail in relation to the CIA Leak. As far as I know, Congress has not pursued this, and at the time, Fitzgerald, through his spokesman, basically stone-walled. You may think you got “Fitzmas”, but you really got a lump of coal.

My question too. This document only deals with the letters, and their release, and the Gotti cites in support of their argument.
I wonder, though, if they aren’t also worried about the release of the other letters that’ve come in to Judge Walton — you know, our “lock Irve up and throw away the key” letters.

Now we know that part of Libby’s arrogance came from his knowledge that they were dismantling the justice dept.
After Watergate there was the conventional wisdom that the nation couldn’t bear the thought of a former President being tried and ultimately sentenced to prison. Given the crimes of this administration one can hope that what is called for is a national catharsis by the sentencing of major Republican players to long prison terms. Get them off the streets for once and for all.

Well, I’m batting 100% so far . . . so I might as well put in a prediction on Libby. 18 months, with bail pending appeal.
This site has done a wonderful job covering the Plame scandal — and a horrible job promoting the skills of Fitzgerald.
As I have said a million times, Fitz sucks. He is a horrible prosecutor. Capable of only going after the smallest fish, and never, never, never, going after the criminals themselves.
He has done this time and again in Illinois, only going after the little guys, the low hanging fruit (like Ryan) but never the criminal leaders (Daley will never go down).
I really, really, really, wish this site would call it like it is: Fitz is a loyal Republican who has worked overtime to protect this administration and has been rewarded with what looks like a long career as a Republican operative.

The US prosecutors’ sentencing letter has been made public. The sentencing letters for the defense are basically witnesses and testimonials to argue for a lighter sentence for Libby. The letters need to be made public. New information may come to light in these. If charges are made in the letters, it would be helpful to anyone cited so that they could respond before sentencing. I’d like to see names, positions, relationship, and reasons/opinion shown (with writers’ personal contact info. redacted.)

This is off topic. I’m actually worried about our pres.(truly). Yesterday, I thought he would be gleeful at his victory. But he wasn’t. Then today I saw a clip and he seemed very down-hearted to me. No smirk, no swagger. I think it’s finally dawning on him that the spin is no longer working. Rove actually had him believing that he could create the reality and as long as he kept reminding us about 9/11, we would believe it. Now, he seems to know that everything is coming unraveled. This scares me. Cheney is ready to bomb Iran and our only hope is that someone is strong enough to stop him. I think our pres. is about to hand over even more power to Darth. He just looked like he was ready to call it quits.

Have known him for decades and actually rather like him but when he screws up he really screws up. Our district folk adore him at least on this side of Monterey Bay. Sam Farr replaced him in congress and is a serious progressive though considerably more self effacing he is a great improvement and early on signed to Murtha’s attempts to stop the Bush madness. Panetta is incapable of making any decisions of import in a timely fashion even now as the O’Reilly invites continue as does the Emanuel worship. Big Bill Clinton mentions Panetta once in his mammoth memoir.

The Republicans in Congress were gonna block everything he (Clinton) asked for, so he gave in. Instead he got Republicans in his government: Cohen at Defense, (maybe) Tenet at CIA, Gerger down the hall, Dick Morris on weekends, Hillary and probably some others I’m not thinking of now.
Is it any wonder his presidency looked like Republican-lite?
I don’t blame Bill so much. I think he’s great for a Southern Conservative Dem. But, it sure would’ve been nice to have had more Dems running the show.

Scooter Libby’s punishment shouldn’t be spending three years at a minimum security prison.
Instead, he should be designated an “enemy combatant” (since he did help our enemies by outing the identity of a covert CIA agent) and he should be extraordinary renditioned to a secret CIA detention facility somewhere overseas, where he can experience justice as administered by former Brewster Jennings employees (Valerie Plame’s former CIA co-workers).
Think about it. Who would be better able to determine what punishment Scooter Libby (or any of his Bush administration co-conspirators) should receive, especially since the outing of Valerie Plame, and the disclosure of Brewster Jennings as a CIA front company, endangered not only their own lives, but the lives of members of their families?
And since the disclosure of Brewster Jennings as a CIA front company also endangered any overseas contacts that covert NOC CIA agents had established and nurtured over many years, then the survivors of any of these foreign contacts killed after this disclosure occurred should be given a crack at Scooter Libby, too, as well as a crack at any of his co-conspirators complicit in the outing of Valerie Plame’s top secret identity.
At the very least, Scooter Libby should spend his three years behind bars at one of these overseas secret rendition spots under the watchful eyes of CIA agents harmed by Libby’s blatant disregard for their safety as well as our national security.
I wager that Fred Hiatt is one of those letter writers asking for leniency. I think we can guess a lot of the writers: Cheney, Bush, Addington, Rice, Victoria Toensing etc..
An I Think Bush is the reason why the judge is reluctant to release those letters.
My prediction based on Judge Walton’s admonishments during the trial: three years. In the electric chair.
The matter is so very simple:
Fitz was supposed to officially (since everyone knows) find out and punish the lickers.
Did he do it? Did he do it? Nope.
When he didn’t touch Rove, everyone said “wow, this is high strategy!”, and after all these years of waiting he has only been able to find out that libby lied. Big deal!
All this is ridicolous.
It would be interesting to know what the Wilsons think of this whole business.
I would LOVE to see bush pardon Libby.

I remember the Libby team requesting the public to send letters to the Judge in support of Libby and they said, I am going to paraphrase here, “if you are an attorney let the Judge know that”. It might have also included other occupations, but I specifically remember the request for lawyers to write to the Walton in support of Libby and tell him you are a lawyer. I remember thinking, they want the attys to influence the judge, is that legal?

Can someone please explain how Libby can admit a wrongdoing at this point when he has appeals pending?
Also, I can’t see anybody, let alone Libby, confessing guilt or being contrite when his whole case was an adamant innocence. I suppose he could say I’m sorry people were hurt because of my failed memory and great workload. But that won’t satisfy most people here.
It would take a great man to fess up to such crimes. I’m afraid Libby doesn’t fit the bill here nor would most of us who are out to see him punished to the maximum degree.
