Go here or here for a stream of Goodling's testimony.
Please keep extraneous comments to a minimum to lighten the load on the servers.
Wow, that was fun. Rep Davis was basically asking Goodling about all the inconsistencies in AG's testimony. Her lawyer interrupted, asking for AG's testimony. Then Dan Lundgren pulled some parliamentary procedure. The committee voted to table that, but there was no clerk to record the vote. So now we have the vote, 17-8, Lundgren's motion fails.
Clerk corrects: 17-9.
Davis (AL): Ms. Goodling, when did you first become aware that AG made public statements that were inaccurate.
MG I saw the Press conference.
Davis: Did you communicate to AG that you thought his testimony wasn't right. Did you read accounts of testimony. Did you think inaccurate.
MG Some of it is muddled.
Davis: Did you communicate to McNulty that AG's statements were not accurate.
MG That was toward the end of my time. I spoke to AG on Thursday or Friday of my last full week in the dept.
Davis: Was there anything that made you uncomfortable.
MG I could not longer work. He proceeded to stay, Let me tell you what I can remember, he laid out for me his recollection of the process of replacement of USAs. He laid out a little bit of it, he asked if I had any reaction to his iteration. I remember thinking that this was something that we all had to talk about. I didn't think it was appropriate.
Guttierez (IL): Yield to Davis.
Davis: Please finish regarding conversation with AG.
MG: There was more, but I'm having trouble remembering it.
Davis You said part of the conversation was in appropriate.
MG Unconfortable.
MG I did not know if it was appropriate for both of us to be discussing our recollections.
Davis: Why inappropriate.
MG I knew we'd have to talk about our recollections. I think in all fairness, he was just talking to someone on his staff.
Davis: Did you tell AG that his statements were not fully accurate?
MG No
MG I feel like after he had the press conference, people had already raised questions.
Davis Do you think AG appreciated that he made statements that were not accurate.
MG No. He clarified the remarks from his press conference. I think he's apologized for that.
Davis: Did AG discuss circumstances around termination.
MG A little bit, he said he thought everyone on list was peformance related reason. He thought DAG testified about Cummins, he said that he thought that was wrong. He really thought Cummins was on list for performance reason. There was more to the discussion. He laid out what he remembered then asked if I had any reaction to it.
Davis You said AG asked if he had any reaction. Did you think AG was trying to shape recollection.
MG No. I just did not know if that was a conversation we should be having. To the extent that any of your questions were about testimony, I thought they were press conferences.
Davis do you think it's important that AG give accurate responses to Congress. Would you come abck to correct testimony.
Wasserman-Schutlz: One minute to Davis.
Davis You've said that if you discovered there was something incomplete you'd come back and correct it.
MG I'm going to need to consult with counsel. I was saying that if, when I go back to review the transcript Id' want to consult.
Davis Did McNulty go back and make any attempt to correct record?
MG I don't know of any.
Davis Did he go back and correct statements in closed briefings.
MG I remember hearing Dept was going to work on questions.
W-S: Two more minutes to Davis.
Davis: You have been AUSA for a period of time. Did you prosecute cases?
MG THey all pleaded out, but I did some work.
Davis: Are you familiar with rules that govern DOJ
MG Some of them
DAvis would it be appropriate for a Senator to consult about a particular case.
MG I don't know of the rules in this area.
Davis Do you think it'd be appropriate for a Senator to call to make inquiries about info only known to the USA office. And a member of Congress.
MG I'm not an expert.
DAvis Do you know of any instance for a politician to call USA to prosecute anyone. If the person didn't have evidence, that would be inappropriate.
MG If they didn't have evidence.
Davis Was there a phone call regarding prosecution of particular cases.
MG I've seen press accounts. I don't know if the call happened. I can't address hypothetical. It raises questions.
Davis During your briefing session, did the Domeici call to Iglesias come up.
MG I don't think that
[The answer is yes, btw, it came out in the most recent Document Dump]
MG I don't remember when it was discussed in DAG's office.
Ellison (MN) Did you know Thomas Heffelfinger. Any conversations about problems with his performance.
MG Concerns that he spent too much time on NAIS.
Ellison: Was there concerns about whether or not he was allowing NA tribe memebrs to use tribal IDs to vote. Did anything about tribaal IDs come up.
MG I don't remember.
Ellison Did you receive communication from SOS Kipmeyer
Ellison did you interview Joan [didn't catch the name] Do you recall she had a solid resume, had been practicing law for 15-16 years. She didn't get the job did she?
MG I did hear she was liberal.
Ellison Was that a factor in decision to bypass her.
MG It was a factor.
Ellison You hired Paulose. 4 AUSAs have quit because she's so inadequate.
MG They didn't resign,
Ellison They quit their leadership position, is that right. And went back to line positions. You know Paulose personally. She described you as a friend. How much time has gone by since you spoke to her.
MG MArch 07. Maybe the first week of March.
Ellison did you ask Jones-Humes about religious affiliation, party affiliation, Federalist Society? You bypassed a chief of civil and hired someone who had no experience right
[Another fight breaking out--Lundgren is trying to allow MG to filibuster]
Ellison: Did Rachel Paulose's political affiliation play a role. Did her religious affiliation play a role. Federalist Society? Never tried a case with a jury have a factor?
MG She had significant experience? As I recall Rachel's experience was some civil and criminal, we did include the fact that she might be a candidate for Presidential nomination.
Short recess will return for a second round of questioning.
I'll start a new thread when we get back.

Davis is doing the JOB on her. He is focused. She doesn’t know much about USA’s.
AZ Matt @ 2
But she knows enough to hire and fire them?
Marcy!
So Wasserman Schultz left herself two minutes?
Well, things have certainly gotten interesting now. Seems we have Abu G and Sen Domenici in a bit of bother…
Doesn’t she have any records to consult about anything?
this is a terrible thing that she has no policy knowledge on the Attorney/senator information
Wasn’t Monica earlier described as a competent DOJ employee? She doesn’t know much about law.
And now, we’re onto Palouse…
AZ Matt @ 2
Yes: strong and direct is the way to go with her.
Conyers and some of the others have a casual way of questioning – it doesn’t seem to work well with her. Davis is the way to go.
Davis: When you brief McNulty did Dominici call come up?
MG: I don’t know. Don’t know the date of the call. I did address the call but I don’t know when
Davis’ DeeCee office: (202) 225-2665
Its nice to see most of the Dems yielding their time to Davis!!! Go Davis!!!
She’s rattled.
Slap the cuffs on her she lieing
pwrlght @ 8
She politically “competent” :)
Thanks Teddy.
big bob @ 15
I don’t care about her – I want the big fish.
Blub @ 16
Remember where she got her training.
This is maddening
she stated that she saw a list and sugested two names to be added
why won’t anyone ask her
WHAT SPECIFIC CRITERIA DID YOU USE TO DECIDE TO ADD THOSE TWO NAMES?
and no one has asked her about the spreadsheet with the federalist and political activity columns
From Christy’s post before this began this morning:
There’s a buffer agency to handle any questions from congresscritters so that the USAs don’t communicate with them and give the impression of impropriety. OLA? Well, that was true until about Nov 8, 2004.
Completely ignore the attempt to interrupt the questioning Keith.
GO GO GO
Don’t these Rethugs get it yet?? They have lost their AG under the bus and a couple of NM politicians.
My office just had a client convicted of witness tampering for doing what Gonzales did.
They thought the MN USA spent too much time on the Indian subcommittee. Getting a little to close to the trillion plus in stolen tribal royalties?
EPU’d from prior thread:
What is Davis’ background? He is on fire!!! Other HJC members [some, at least] should watch & take notes.
Davis deserves lots of happy happy calls from firepups.
Tribal IDs? That’s a new one. And interesting. Native American disenfranchisement, anyone?
I’m finally feeling like I didn’t waste my afternoon listening this. Getting interesting now.
Ellison is sure bringing an important issue on tribal ID’s to vote. Plenty of discrimination in that area.
Helen @ 11
if she does not know, but dont know the date of call, which is it, the call from dominici or the date of the call?
Liberal, not Dem, HMMMM!!! Gotcha!!!
it’s mind boggling that this little twit had so much power over people whose briefcase she’s unfit and unqualified to carry.
Thank you thank you for the liveblogging!
Desperately trying to catch up.
I wonder how Abu feels about that Bowie knife she just planted in his back?
“I didn’t hear she was a Democrat, I heard she was a liberal.”
Priceless.
She just admitted that politics played a role in a USA hiring, yes? Am I right?
1oldlady @ 29
This is where the missing docs would come in handy.
Goodling: “I don’t know if I knew she was a Democrat. I knew she was a liberal.”
My god.
(facepalm)
Federalist Society! yea
I feel like I’m reading reading a liveblog of Lance Armstrong going for a Stage win.
!
Oh boy. The Christianists must hate this. A Muslim getting tough with their nice little Christian girl.
Davis: this is what a prepared congressman looks like. He did a fantastic job and it was so good to see the other Dems yield. This really is the time when the beans have started to be spilled…
The whole Democrat/liberal comment is just mindboggling.
Mutant Poodle @ 18
My meanning was a little jail time would refresh her memory only
Gonzo and the new mexico senetor were both trying to obstuct jutice..
anne @ 34
Amen to that!!! AGAG and her are sooo screwed!!!
Finally, the Dems have someone speaking who’s done this before. Geez. It’s late afternoon.
Lundgren beating up on Ellison.
Chair Lee sez MG can finish her answer.
these GOPIf$%ers are pissing me off man
tommy yum @ 32
It was. One of my students complained on an evaluation of me “He’s an open liberal, and what especially bothers me is that he’s proud of it.”
Goodling says liberal like it’s a dirty word.
i love the advisors behind both of them!
Tire her down…let the GOP make a bluster…and then send in the dogs…..
woof woof woof woof
Finally, asked about the Federalist Society.
I like this chair, she’s awake!
Lundgren sure is grizzled.
EPU’d from prior thread:
dmg @ 298
The questioning is establishing that Domenici and Wilson asked to have Iglesias removed. Someone correct me if I’m wrong, but doesn’t this also show obstruction of justice?
Muzzy @ 38
Saw him clinch the overall at nasty stage in Nante in ‘03. This is a lot like that that.
You know what? Screw this. Throw the lot of them in jail for contempt of Congress and let ‘em stew. They’ll start talking.
egregious @ 50
missed it, what was said
Where the hell is Conyers? His questioning has been less than stellar but he’s better at chairing the committee.
Ed*ard Teller @ 46
Wear that “L” proudly, my man!!!
pseudonymous in nc @ 26
Hehe. Who knows, maybe we’ll get real lucky and there’s an Abramoff angle here.
Unbelievable.
Recess and there will be a second round of questions.
1oldlady @ 54
whether it was a factor in the hiring
recess for vote
How about a recap someone? I missed the fireworks—on the road.
grape_crush @ 62
a House floor vote?
Ed*ard Teller @ 47
I’m proud of it too, ET…nice to see you.
CTuttle @ 42
USAs are political hires. But you have to step back and look at what got Paulose pole-vaulted up the ranks.
Dover Bitch @ 50
Grizzled and grasping and guilty of obstruction of justice. God it is so embarrassing – we suffered him as AG here in the once golden state.
Ellison did a good job but Lundgren saved her ass. Frustrating but that is how it goes. Giving Davis 12-13 minutes really made Gonzo look very bad. Ellison and Davis were prepared.
Fish Bone @ 56
Meds then a nap?
Hot Damn! See, this is why we need new blood in Congress and the White House. The stale names of Clinton, Gore, Kerry, Biden, etc. have got to go! These two guys are incredible. Finally some life to the DemocratIC Party! YeeHaaww!
Nice job of coaching, Gonzo.
What he did would qualify as (a) coaching a witness and (b) obstruction of justice in any court I can think of.
CTuttle @ 43
They’re screwed, but not over that. Appointing a US Attorney is one of the few positions in which the President / DoJ is permitted to take political affiliation into account.
Politics are a part of hiring USAs. It’s the Asst USA’s and staff positions that aren’t supposed to be political.
Cheese and rice!
I finally get to cspan just in time for a recess!
Sampson: I don’t know, ask Gonzalez
Gonzalez: I don’t know, ask Sampson
Goodling: I don’t know, ask Jesus.
Rove: Fuck you.
Bush: Great job, guys.
gonna be a second round of questions – yippee!!
edit – it’ll be a lot easier for the D’s to pile on more questions than it will for the R’s to stonewall and tell Monica how adoreable she is.
During the recess, cspan 3 is rerunning Davis’ amazing questioning.
Replay of fireworks on C-Span 3 now.
Thanks EW.
Artur Davis was good. It was also good top see other Dems cede their time to him as he was making hay.
Earlier she says politics didn’t play a role in USA firings….but now she admits it did in the case of the Palouse seat.
This also contradicts (again, see Wagner) that she had no role in the hiring/firing and the list.
De-lurkin’ furing recess. Big-time thanks to the big-pups at FDL that do the heavy lifing here.
Also, way back upthread was Cong. Davis’ number. I called and extended my congrats and gratitude for his questioning. Urge others to extend support also.
Back to lurkin’ for today.
Bad question- Monica didn’t need to ask if Rachael was a member of the Federalist Society ’cause she already knew. Otherwise, great job in the questioning.
Liberal Liberal Liberal Liberal
Bwaaahahahahahahahahahahah!!!!!!!!!!!!!!
called daves office to thank him and started to cry with joy
kdh22 @ 69
j/k. Probably to the House floor or another committee.
newspaperbrat @ 67
Any chance of booting him out in 08?
tommy yum @ 67
It was the sneer in her voice when she said “liberal” which made the cake.
RevDeb @ 65
Recap? Here’s your stinkin’ recap – She accussed Abu of lying to Congress and of trying to steer her testimony.
Tom Steele @ 74
Nutshell sighting!
RevDeb @ 65
They’re replaying the “fireworks” on C-SPAN 3.
Davis was outstanding. Davis for AG in a new Democratic administration.
I’m not following the bases for the lawyers’ objections? Are they just trying to run out the clock? If so, can’t the committee force her to come back for more questioning?
Brisingamen @ 53
at the time i wrote that, all davis had done was ask wouldn’t this behavior be considerd worng, or a crime, or whatever. he seemed to be asking an opinion from little ms. twit. he wasn’t, to my hearing, getting any concession from her that these things did in fact occur.
So when is Davis forming his Presidential Exploratory Committee? I want to be the first to donate (of course, gotta make sure he’s not a Blue Bog I guess…)
Helen @ 88
In a nutzshell, so to speak. Helen you slay me!
I’m just listening but I would have loved to have seen Goodling’s face each time Davis was granted more time to continue his questioning of her.
Thus far we have Goodling’s admission that she broke the law in questioning applicants about party affiliations.
We have her statement that Gonzales lied.
We have her statement that Gonzales tried to harmonize his story with hers.
And then we have all of her own inconsistencies today re her varying roles as gofer and dragonlady.
Here comes the spin on MSM to throw Monica under the bus….she’s young..young…young…was their “adult supervision” going on – Michael Isikoff
Liberal Liberal Liberal
O M G!!! finally!! now its on y’alll and cspan is showing hi-lites mmmmmm
meep! @ 91
No clock, as such. If the majority wants another round, they can just say so.
geez, she’s not an expert. She’s incompetent, that she sure is
scribe @ 90
It is not unreasonable that a Republican Adminstration dislike liberals.
again and again he stabbed her with the sword of Allah!
Cspan 3 now rerunning the very beginning of the hearings starting with Conyers’ opening statement.
kdh22 @ 65
Yuppers.
MB Williams is probably the go-to person on this subject, but the NAIS issue is interesting, not least because you have Chiara in MI, and Native American prosecutors passed over on the southern border.
I wouldn’t be surprised if keeping Native Americans from voting was part of Unka Karl’s grand scheme.
Did your conversation with the AG make you “UNCOMFORTABLE”…
Yes.
Ay Caramba!!
There’s meant to be a HJC immigration subcommittee meeting at 5:30, which means the second round is going to be abbreviated. We’ll see if the GOPpers hang around to run out the clock and run interference. But Goodling won’t want Davis up again, especially if he gets yielded mucho time.
Issa is a bastard.
Hugh @ 96
Nice summation, Hugh!!!
Folks, please keep comments brief and hold the one-liners for after the liveblogging. It’s tough enough to transcribe testimony in real time without having to open up a new thread all the time because the comments start piling up on the server load. Thanks. (On behalf of Marcy’s fingers, please use restraint where possible.)
She parked a Greyhound on his ass!
He saw the list of atty’s and lied through his teeth to the committee.
Hows that No Confidence thing workin’ for ya now Abu?
BWAAAHAAAHAAA
I loved Ellison not taking any sh*t from the Repukes trying to interrupt. Just flat out ignored them first and then basically told them to STFU! goD, what a breath of fresh air.
TeddySanFran @ 12
i just called davis’ office – they were gratified to hear my praise. i told them what was being said here in the fdl thread… the person who answered the phone had recently become aware of the site & would pass on the good word to the congressman.
CSpan 3 is replaying the money quotes during the committee recess.pseudonymous in nc @ 103
And what about Abramnoff? Saw his name come up earlier in this thread. His he still being deposed or in the pokey? So many crooks so little time to keep track.
“Did the Attorney General ever try to get into your pants?” “Did that make you uncomfortable?”
Christy Hardin Smith @ 112
OK, since IANAL, what is your take on the Goodling/Gonzo meet? Does that rise to Obstruction, or just inappropriate ickiness?
AZ Matt @ 28
Agree, but notice MG wouldnt’ commit that that was the basis of it. So it may well be some of the other issues, such as not wanting to have an NA-friendly in charge of relationship with the tribes.
Taking time from work to check in- Damn, looks like there’s finally some meat on this turkey of a hearing…
Go, Davis, wake ‘em up but good! 2nd round of ?s to come. Well, alright. Thanks for the live blogging, EW, & CHS earlier. Will read every bit of it when I get home.
Dan Lundgren was a half descent AG for Ca. When he left, and now in DC, he’s become a total tool.
Hugh @ 97
LS @ 105
Was he stroking her long blonde locks and himself at the same time? That kinda ‘uncomfortable’. ]
Sorry, couldn’t resist.
OT, but closely related: David Iglesias to Abu Bin Gonzo: “Pony Up, You Lyin’ Little Shitewhistle
well mebbe he didn’t use EXACTLY those terms…
These “hearings” (to satisfy the dem base) are becoming a vehicle that displays the corruption of our country. Nothing will happen, everyone will have immunity or get pardoned. The dem’s are scared of bush (wiretaps and pictures) so there will be no real challange and dweebs like Gonzo will continue to chuckle and play the game.
pseudonymous in nc @ 107
Attenuation of the Native American vote is routinely practiced in states with high Native American populations, especially when the GOP control the politics of those states. The most important of these to Republicans in the past six years have been AZ, NM, MT and MI.
did dan blow a gasket or WHAT!!! LMAO!!!
Davis’ DeeCee office: (202) 225-2665
called to congratulate as well.
Okay, now I know what I will be doing most of next year.
We are moving to a new home in the next county. After all those hours I worked to oust Pombo from CA-11, we will now be living just over the county line in . . . wait for it . . CA-03.
Home of Dan Lungren.
Ewwww.
Hugh @ 101
But mind you, Hugh, no law was broken.
Now get back to indicting Jefferson, why dno’t you? (Not that I mind, mind you, Jefferson’s just as corrupt as they are…)
emptywheel @ 119
This is not a NA friendly administration. The whole Cobell case shows that. Interior has sure tried to screw the Tribes. The Tribes know who Abramoff’s buddies are.
bonkers @ 94
Just so you know, Mr. Artur Davis voted
o For the Military Commissions Act
o For the Bankruptcy bill (technically known as “Bankruptcy Abuse Prevention and Consumer Protection Act”)
o Against Net Neutrality (technically the “Markey of Massachusetts Amendment” to the “Communications, Opportunity, Promotion, and Enhancement Act of 2006″), and
o For Federal Government intervention in the Terry Schiavo case (technically known as “For the Relief of the Parents of Theresa Marie Schiavo”)
[Mod: The Schiavo info is wrong, see b&s correction at 1:31 ]
gonzo lied to congress … Now what will the senate with Republican do ,, that line that no crime has been found was throw out the window ,MONICA gave up gonzo .He’s was suborning perjury as clinton did with betty currie .Impeachable
sjvalleygal @ 132
Glad this little show could serve as an inspiration.
Mutant at 115 — I need more context, actually, to be sure exactly what did or did not occur there — but given the fact that an investigation had already begun in Congress at that point (if I understand where it was on the timeline — her testimony was a little iffy on that point), it could certainly be construed as trying to influence her testimony by synchronizing their testimony. Which is a big no no. And can result in a charge of obstruction — it’s why the Libby letter to Judy about “aspens turning at their roots” raised so many hackles, for one.
Ed*ard Teller @ 127
Strangely enough, AZ, NM, and MI had their attorneys fired by the DoJ. I’m sure it’s just a coincidence.
What happened in MT, not enough Indians to matter or did the USA cave?
hayduke @ 109
Today’s Republicans are all bastards and bullies. They have to be beaten into the ground until the crawl back under the rocks from which they came. Each and everyone is more loyal to their Party and an ideology than they are to the people. They are all anti-democratic and ultimately anti-American. After Watergate and Iran-Contra they should have been driven into the sea but were allowed to linger on life support until they crafted their alliance with the radical fundamentalists. They are subverting the Constitution and deserve no quarter.
Linda @ 122
Lundgren was run out of office in California because he was, and forever will be a fucking repuke tool.
Ed*ard Teller @ 126
And the Dakotas. Remember when Tim Johnson beat Thune in 2002? There was all sorts of BS over voter fraud on reservations. And it was SD that prompted the move to strip courts of the right to appoint interim US Attorneys.

Ripping off Native American resources is almost certainly involved as well, so don’t forget to include Cheney, Abramoff, and the mysterious Energy Task Force as well…
To correct, I don’t think artur Davis voted for the Schiavo intervention
emptywheel @ 128
Ah yes, the famous IOKIYAR exception.
Yes, the vote suppression amongst native Americans contributed to Tom Daschle’s defeat. Indeed, one thing that has become clearer in thei whole epsiode is that KR’s “get out the vote” is more like “suppress the vote”.
Ed*ard Teller @ 126
egregious @ 136
The USA is Bill Mercer, better known as interim associate AG.
i.e. he’s an absentee landlord.
Leahy’s comments
“It is deeply troubling that the crisis of leadership at the Department allowed the White House to wield undue political influence over key law enforcement decisions and policies. It is unacceptable that a senior Justice Department official was allowed to screen career employees for political loyalty, and it confirms our worst fears about the unprecedented and improper reach of politics into the Department’s professional ranks.
“As Congress continues its oversight to pull back the curtain on the politicization of the Justice Department, it is abundantly clear that we must do all we can to get to the truth behind this matter and the role White House played in it.”
Question.
Who actually would draw up potential charges in regards to Abu obstructing, this committee or another body?
Y’know, the folks at Davis’ office seem really really happy today — guess they’re getting a lot of positive feedback ::grin::
I hope KO leads with Monica’s damaging

in defense of Ms. Goodling, might I say that:
1. she hasn’t cried yet,
2. ummmm,
that’s about it.
Monica :”some USATs had less prosecutorial experience than Rachel Poulose who had 3-4 years! She was Repubican was a factor in her hiring. Does that tell you the level of inexperience and competence of AGs across the country? Monica is providing rich insight into the DOJ under GWB.

WHOA! Thanks for that. Nevermind then. Go get Gonzo at least!
This woman’s testimony is so riddled with contradictions and lies they should handcuff her away right now. Of course, she has immunity! so that won’t happen.
The Republican party has become a danger to this country. It is dismantling it peice by peice, from a democracy to a christian theocracy. That is clear from this hearing. You were only considered for a job if you were a christian republican.
And they are being allowed to destroy it by the Dems.

Estimates range from a mere 200 billion, to a plausible trillion, to as much as 7 trillion with interest as to how much has been stolen from tribal royalties.
Probably no one would break the law to prevent that information from coming out, tho, right?
Hey, while we’re on break. Did I misidentify Sheila Jackson Lee as Maxine Waters sitting in for Conyers? I think I did–and if I did I’d like to go fix it

Sorry, I don’t know the answer to. Are you doing a regular piece for the Guardian each week?

Well, this is important because it might help pry loose the 750,000 emails that McCain is sitting on from his committee’s investigation of Abramoff’s abuse of the tribes. Thar’s gold in them thar hills! (I betcha).

ew at 159 — I think it was Sheila Jackson Lee. (She is wearing a yellow suit today, if that helps, and Rep. Waters is in white.)

That’s my problem–I;ve been looking at the screen, though I think by voice it was Lee.
Gonzo only pawn in game of life. (video link)
I was annoyed at all her “I don’t know, I’m not an expert” remarks, until I realized…that’s all getting her incompetency on the record. She was in way over her head, and AG gave her the authority to do quite a lot.
I hope they yield Davis some more time. He is a former AUSA. From Wikepedia:
“..Davis was born in Montgomery, Alabama, and was raised by his mother and grandmother. He graduated magna cum laude from Harvard University in 1990 and cum laude from Harvard Law School before returning to Alabama.”

EW, yes, it was Jackson Lee sitting in for Conyers.

I think you did.
When you get a hostile witness like Monica you better know how to question them. And, Davis does the job. More. More. Dems, take a lesson here and know your subject. Thank you, Davis.

It was definitely Lee. Waters hair was “down” and straightened, Lee’s is pulled back.
The way she hissed that dirty word “liberal” makes me think she wasn’t paying attention at God’s Own Law School; Jesus was a liberal.
emptywheel @ 152
Josh Marshall did a lot of reporting on SD in 2002. Here’s one post from the archives, but you can dig out plenty more of the shenanigans.
In short, Thune accused Johnson of personal involvement in voter fraud on reservations.
rep lee is sitting in for conyers – i called rep davis’s office to salute him tho i live in nj
ET@153, That 9% Native Hawaiian is not really accurate, as blood quantum is not factored in, a conservative estimate factoring in blood quantum would put the number higher, say, 30-35%!!! *g*
Jackson Lee was definitely the person in the power chair the last time Lungren interrupted for a ruling when Ellison wasn’t allowing Goodling to fully answer the question, if that helps, so I’d guess she’d been subbing all along. (And I only got to see because we had a commercial break in cartoons — The Peanut is home and C-Span is not a hit today.)

I was delighted to see Wasserman et al yield time to Davis, but for fuck’s sake, couldn’t they game this kind of tag-teaming beforehand instead of waiting until one of ‘em gets hot on a line of questioning?

I can’t believe she said “her role in selecting US attorneys for replacement” this is absolutely ridiculous. This child being given this amount of power is the story of this, the worst administration in the history of this country.
Tom Steele @ 183
Only the dirty fucking hippies believe that. Every *good* Christian knows that Jesus was a conservative who hated taxes, gays, women, minorities, Jews, and the poor, and loved nothing more than war and a good strong military.
egregious @ 136
Don’t forget, the Montana USAtty is never in the state, because he’s been dual-hatted by Gonzo on some DoJ admin type job (I forget which). This has gotten so bad that (a) the Chief Judge of the D. Mont. has issued a public chewing out and (b) Tester is one of the sponsors of the repeal of that other section of the so-called Patriot Act which permits USAttys to not reside in the district where they’re appointed to.
In other words, the Montana situation was well in hand for the Rethugs, so they didn’t need to fire him.
brownandserve @ 143
Mr. Davis is a Congressman from Alabama…you think maybe he was voting the way his constituents in his district asked him to?
That’s a big difference from going to DC and totally disregarding what your district is calling for like most of these politicians do.
I called the offices of Davis, Ellison, and Wasserman-Schultz to thank them and encourage them to continue to act as prosecutors. The office staff was very thrilled to hear the praise.
I also called John Hall, my rep, to tell him to vote NO on the supplemental tomorrow.

Honestly, she comes across as much more knowledgable than either Sampson or Abu. I’m not impressed with the girl, but she is acqutting herself much better than her resume would have suggested to me. IMHO, the bar is damned low, considering the other DOJ officials who testified before her. And also, she seems much more capable than the Rep tools who keep jumping to her defense and iterating that there’s nothing to see here folks, move along….
JGabriel @ 203
Jesus especially liked the death penalty. Liked it so much he, um, tried it out himself…

You forgot McNulty. One of the good things here is that the circular firing squad at the top of DOJ is now complete: Gonzales, his deputy McNulty, Sampson, and Goodling. They’ve implicated each other in perjury.

i think congresswoman Jackson Lee did an honorable job holding things together w/ firmness & not caving during the most contentious part of the hearing. i just gave a shout out to her at her dc office (202) 225-3816.
the person who answered the phone said she would really appreciate hearing this. we need to praise these people when they do well!

Re where is the chairman…if you noticed both the chair and the ranking left….that was planned so that they would not be involved in the squabble that had to happen…the GOP had to be allowed to cry but those two did not have to be there. Not a new thing to do that…and you know in advance that it won’t go anywhere when they are both missing…just a procedure to let the minority cry and say they tried.
Isn’t all this coaching of the witless taking a long time?

BTW, Davis is co-sponsor, along with Adam Schiff, of a congressional resolution calling for a no-confidence vote on Gonzales. Also, according to his web site, Davis had a 98% conviction rate as an AUSA. No wonder his questioning was so sharp.
Sarik @ 220
This is a vote recess. Not for conferring with counsel.
The Rs got f**ked on the vote on the motion to table because they didn’t have everybody there. Hahahahah! That little ploy of not showing up to make a statement kinda backfired on ‘em. Davis was able to continue his attack. Chalk that one up to Jackson-Lee.

They would have lost anyway. The Pubs don’t have a majority in the HJC any more than they have one in Congress.
Under House rules, can one yield time to a less senior member? Davis did so well in the Gonzales questioning, I was hoping he’d be in from early on today, but only less senior members have yielded to him in the first round.
do you reckon someone will ask Tony Snow if Signor Gonzo still has the president’s “confidence” now that little miss Jesus groupie has said he lied to Congress?

I’ve seen this before as well — allows the chair and ranking member to stay collegial, while allowing the political kabuki to be shoveled out for the folks who want to buy it. Wouldn’t be surprised, especially given that it was Lungren — he and Cannon and Issa appear to be the designated blowhards in this particular committee for the dog and pony politics shows.
JGabriel @ 234
More than likely, but the Reps come and go to take care of other business in other committees, mtgs with constituents, lobbyists, etc. So there could have been a time when there wasn’t alot of Dems in their committee chairs. But I think the fact that the Rs have done this on several occasions, meaning not participating to give the impression that it’s ‘no big deal’, ‘nothing of import here’ that the Ds have told their Reps ‘be there unless you have to vote’. I experienced that in the state legislature committee mtgs/hrgs.
so Davis did a great job, but 90% of this has been a puke-inducing snoozefest.

may i point out that there is no dishonor in being a criminal defense attorney either? I know that you’re only 15, but when one takes a look at what this admin has done to the rights of individuals, which very well might not be undone any time soon, you could even be looking at a growth market.
But above all, follow your conscience.
emptywheel @ 261
Lordy. Can’t they do something to officially keep Congress is session and just rotate back to their districts?
AZ Matt @ 257
Oh sh*t. Recess appointment? Been there, done that
Paul Kiel just posted a statement by Sen. Leahy at TPMMuck:
“It is curious that yet another senior Justice Department official claims to have limited involvement in compiling the list that led to the firings of several well-performing federal prosecutors. What we have heard today seems to reinforce the mounting evidence that the White House was pulling the strings on this project to target certain prosecutors in different parts of the country.
Arthur Davis appears to have gotten Goodling to impeach Gonzales for suborning (trying to “frame” her recollection on a matter in which they would both be witnesses) and for “misspeaking” (aka perjury) to Congress.I guess the Harvard Law grad (Davis) whipped the Regent’s grad (Goodling) in this exchange despite the pro-Regent exhortations of Randy Forbes.
Mr. Peabody @ 244
We’re getting what we could reasonably expect – Monica violates every expectation the public could have of a DOJ employee; Monica gives Sampson, McNulty, Moschella a hearty shove; Monica reluctantly exposes Abu as a shiftless wanker & criminal & fool. Not bad.
emptywheel @ 261

JGabriel @ 274
Well. not to scare anybody, but there have been some reports that some WH people believe that recess appointments aren’t restricted to actual recesses, and that the president can make them if he feels a position needs go be filled by Congress can’t or won’t fill them.
CNN just did a piece on YKos and the presidential candidates who will be there for a Presidential forum – Edwards, Richardson, Obama – were all I caught. They followed with a tease bit on Monica’s testimony without any substance thus far.

Constitutional Conflicts between Congress and the President, Louis Fisher…..this theory holds about as much water as their unitary executive theory. Some of the recess appointments made by many presidents have been counter to accepted practice. A recess appointment is just that; even this Supreme Court would not uphold a recess appointment when Congress is not recessed.
OK, outfit question. Goodling is wearing a black suit. Is she wearing pants or a skirt? (snark!)
Dan Lundgren was a half descent AG for Ca. When he left, and now in DC, he’s become a total tool.
Besides inability to spell, this statement is so far out there to be in orbit.
Lundgren has always been, and will continue to be a repuke tool, and a very crappy attorney. While AG, he continued to provide legal cover for state agencies when they committed crimes. Instead of prosecuting for their crimes, he and his agency provided outlandish defense.
Example: Cal State University wasted tens of millions of dollars over many years on projects that were funded in violation of state law and University procedures. When taken to court, AG defended state on grounds that the state agency AG was representing in court was not really a state agency. Incredible, but it prevailed. Another example was the DMV fiasco – only one of many such examples of state agency stupidity.
