Fact Free Fred Hiatt is at it again. The man has never meet a Bush Administration crony op-ed he wouldn't run, no matter how factually challenged or inaccurate it may be. Mercifully, Glenn Greenwald has already parsed the dreck on the op-ed page of the WaPo today so I don't have to:
Many of these statements are highly misleading, as they strongly imply that FISA has not been amended since it was first enacted 30 years ago. But several of the statements — such as: "the law has not been changed to reflect technological advancements" — are just flat-out lies.
In the wake of the 9/11 attacks, the Bush administration demanded a whole slew of changes to FISA which expanded the President's eavesdropping powers and which the administration claimed were necessary in order to bring FISA into the 21st Century by allowing surveillance of modern communication methods. Congress, needless to say, complied in full, and in October of 2001 — contrary to McConnell's misleading Op-Ed — it enacted, and the President signed, sweeping "modernizing" changes to FISA….
That FISA was substantially expanded in October of 2001 — at the administration's request — is one of the central (and often overlooked) facts illustrating how severe is the corruption and dishonesty which lies (still) at the heart of the NSA lawbreaking scandal.
The same President who demanded changes to FISA in light of the terrorist threat, who received all the changes he demanded, and who then assured the nation he had all the surveillance tools he needed under the law, then proceeded — the very same month — to eavesdrop on Americans in violation of that law. Then, once caught, he sought to excuse his lawbreaking by claiming that the law (which his own administration re-wrote and heralded as sufficient) was somehow inadequate.
In light of McConnell's Op-Ed today, it is also critical to recall that the administration had multiple opportunities since those post-9/11 changes to expand the scope of FISA, and it was the administration which refused those changes on the ground that they were unnecessary. In 2002, multiple Senators sought to make it easier to obtain FISA warrants, and the Bush administration opposed those changes, insisting that it already had sufficient eavesdropping powers. And all throughout last year, Senators such as Diane Feinstein and Arlen Specter proposed endless FISA amendments to expand the scope of government eavesdropping (in response to claims that FISA was too narrow), and the Bush administration was completely uninterested in all of them.
The administration is not, and never has been, interested in expanding the scope of FISA in order to enable them to obtain warrants more easily or accommodate "new technology." Their overriding goal has been, and plainly continues to be, the total elimination of meaningful oversight with regard to how the government eavesdrops on Americans. That goal of theirs was accomplished for many years by simply breaking the law which requires oversight, and now — having been caught — they seek to accomplish the same goal under the guise of wanting "updates" to the "rotary phone era" law.
It is probably too much to ask that Fred Hiatt would demand factual accuracy from a Bush Administration crony, but it isn't too much to ask that the WaPo's ombudsperson call him to task for failing to do so in the printed pages of the newspaper. Since it is her job and all. I am certain that Ms. Howell would appreciate you politely calling this inaccuracy to her attention in a briefly worded missive. (And I do mean politely worded, please.)
Since Glenn has already done the fact-checking for her (and please do feel free to include a link to him), it ought to be a quick correction note and a tsk tsk for Fact Free Fred for failing to catch the multiple errors in the op-ed prior to publication or at least noting them somewhere for readers on the printed page of the newspaper. Something like this can really tarnish the sterling reputation of a newspaper's op-ed pages. *cough* I'll be waiting to see if she does her job — but you'll have to pardon me if I don't hold my breath.

Polite queries, concerns and corrections will not change the minds of the publishers, editors, pundits and celebrity news readers as to the error of their ways. Only when they fear real consequences, economic or otherwise, will these purveyors of indoctrination and propaganda realize they have made a serious miscalculation in their support of the radical right. The fear of God has to be put in them before there is any change in the MSM. The radical right wing didn’t take over the MSM with velvet gloves when they started their subversion of the 4th Estate over 30 years ago.

rw — It’s not my golf bag, alas, but if I am reading the caption correctly on the photo link, the course is somewhere in Dublin. You can bet that if we were there, Mr. ReddHedd would be checking out the links. Unfortunately, good shots for me are few and far between. But Mr. ReddHedd is quite good when he’s having an on day, so perhaps one day in the future…ya never know.
For over six years people have pointed out the factual errors, outright lies, misdirection and shallow meaningless coverage in the MSM. They have written letters, made telephone calls, sent emails, contacted their representatives, marched in the streets and signed petitions in an attempt to express polite, respectful concern. What has been the result? A MSM that is so corrupted and compromised by power and priviledge that they are unable to change course to reassert the the honest role of the 4th Estate in political life of the nation. Thankfully, more and more people able to think for themselves are cancelling their subscriptions to the NYT, WaPo, Time, Newsweek and turning off the network news and the Sunday talk show bubble heads. The sooner the MSM is relegated to the trash can of history the sooner the country can be reclaimed by the people.

Bluetoe at 29 — I thought about mentioning a subscription cancellation, but so few folks that I know even bother having one to the WaPo these days that it would be a not-so-substantial effort, I should think. It’s sad, really, when you think of the stories that used to be dug into and broken in the WaPo and the NYTimes and other press outlets how little of it is allowed to break through these days. All the more so because I know that many of these outlets still have excellent journalists on their staffs — but they have been relegated to non-story infotainment reporting and steno duty. Beyond irritating, and something that no doubt has some of the greats of the past spinning in anger.

There are so many good writers on the left side of the aisle and they do a tremendous job of debunking the crap that ends up in the national newspapers, but I am wondering…
Has Jane, Christy, Glenn, and the other fabulous writers in the lefty blog arena tried to get their own op-eds into the national papers? Have they tried and gotten shut out of the process, or have they not tried at all? It would be rather nice to get a wedge put into place on the op-ed pages to counter the usual crap that gets published.

Reading Greenwald (and being in a dark deep subcategory of newsconsumer), I have to say that I had no idea about the October 2001 revisions of FISA. Following this (warrantless wiretapping) and the various other threads (USAs, Plamegate, etc.) for awhile now, I wonder how many Pups and others knew that FISA had been thoroughly revised?
I don’t think somebody like McConnell makes an honest mistake here, but the October revisions are definitely not part of the mainstream–or, I don’t think, naive blogstream like me–understanding of the sequence of events in the NSA story. For instance, were the revisions mentioned in the Frontline documentary last week?

I’ve said this here b4, but…..as frustrated as I am with the WaPoop, I still maintain my subscription. It IS the hometown paper, and I am old enough so that I still like a printed product in my front yard every morning. Plus, there are good features….columnnists like Eugene Robinson, Harold Meyerson, Marc Fischer (local stuff), and sometimes Milbank; lots of info about local events; occasionally good Sunday magazine features…..and, of course, COMICS.
I think it also should be pointed out that the Post, even as it currently exists, is not ENTIRELY a propaganda mouthpiece. There are still a few hard working reporters who break important stories….some have been quoted here, for instance.
That said……I f******g HATE Fred Hiatt, Krauthammer, Will, Novak, and the entire rest of that ghoulish tribe. Many’s the morning poor mr oddmommy has awoken to one of my blood-boiling rants about their latest fetid drivel.

But my point is that I don’t think a lot of people know about these revisions. Obviously there’s some general knowledge about the Patriot Act changing things.
And I use as an example the Frontline domestic spying documentary, that played on the night of Comey’s testimony. Maybe somebody else can remember it more specifically, but my sense is that it shows Frank Church and the post-Watergate creation of FISA, and then moves to 9/11 and the legitimate international espionage challenges, but then jumps to 03 and 04 the discovery of warrantless wiretapping. I’m almost positive there was no discussion of what Greenwald is talking about today, how in FISA was revised in October 01. Now, Hedrick Smith and Frontline were making a documentary and they left it out, so I have a clear sense that it’s not general knowledge.
McConnell is completely disingenuous–I’m not trying in any way to say that he isn’t. But I think that Greenwald bringing this up in his response, and getting this item out there as the Comey testimony and Gonzo’s teetering collapse shine the light on this crucial issue (where Greenwald has been leading the way, starting with a great shout out the day before Comey’s stirring narrative), is pretty important stuff.

Remember the days immediately after 9/11? We were giving BushCo in general, and Condi Rice in particular, a ton of grief for failing to “connect the dots.” Remember that?
Unfortunately, BushCo decided that the answer to that criticism was to collect more dots. And Rove & Cheney decided to use their improved authorizations as cover for collecting certain kinds of dots that interested them.

I think you’re on to why this op ed is out there. There were two very strong editorials by Hiatt last week on Comey’s testimony, so I’m sure the WH asked for an opportunity to respond — and this is what they got: a dishonest diversion with no acknowledgement of Comey’s testimony, let alone any discussion of the fact that there was a program that the AG, DAG, and FBI director were willing to resign over before the current(later?) version. So instead of responding to the concerns about what they were doing before, and what they’re doing now, this op ed is designed to divert us into thinking about the statute instead, as though that’s the problem.
At the moment both sides seem to like the Gonzo wars.
Bush likes em cause it keeps the focus off HIM- the REAL criminal- and the dems like it cause it’s like shootin fish in a barrel and the pleasure goes on and on like Lil Abner’s Endless Hot Dog–while yer eatin at one end- they’re still makin it at the other.

I’m not sure the WH is happy about this. Both the WaPo and NYT editorial pages have both emphasized the point that the real problem is Bush, and that Gonzales is just his loyal consiliere (my term, but they’ve essential said the same thing.) This is no longer about Gonzales memory or bureaucratic skills; they’re now focused on the subversion of the Justice Department by the WH. Even the Republicans know that.

In light of last wk’s testimony, it’d be interesting to read a transcript of Comey’s address. Here’s the remarks synopsis from link above:

I gotta disagree…..I think that Bush’s continuing to stick up for Gonzo at this point is making his own pathetic buffoonery more obvious every day.
Here’s what I want from our next president and Congress. An end to the occupation of Iraq. No more unprovoked wars by the U.S. government anywhere. And a comprehensive top to bottom new Middle East policy. Starting with a fair and just settlement of the Israeli-Palestinian conflict.
Over the course of 200-plus years, the Constitution has needed amendment how many times for the benefit of changing technology?

Froomkin sets up a new category “FISA Watch” and picks up Greenwald’s takedown of McConnell. He asks, “so why would McConnell engage in such blatant dishonesty?” or something like that, then quotes Greenwald’s conclusion: the goal has always been zero oversight of domestic spying.
Nice complement to the WaPo/Hiatt discussions in this thread, and Froomkin calling up Greenwald is moving faster than Lederman parsing Kmiec, with “blatant (Wapo editorial page) dishonesty” thrown in for good measure.
Time to bring back those discussions of “isn’t there some responsibility for editorials to have a factual basis?”

Oh, I did not mean to discourage your excellent missive! I was just managing expectations, and repeating Howell’s own boundaries as she’s stated them over time. I’m sure emails and letters (especially from people not yet identified as “liberal bloggers” or “readers prompted by liberal bloggers”) make her wonder, late at nite as her well-coifed head hits the pillow, where her ombudsing ethics went.
Bush says Gonzo “testified in front of Congress”. Somehow I don’t consider saying “I don’t recall” over and over as testifying.

Christy — emptywheel had a post in which she speculated about why McConnell is seeking revisions to FISA — one of the things they’re seeking is retroactive immunity for the telecoms for allowing their customers to be spied on — and there would have been a period after the Wednesday Night Ambush in which the original program was no longer authorized by the Attorney General, something the telecoms were relying on as a legal shield. This suggests that updating for new technology is just a smoke screen, as Glenn conclude.

I think that there were also FISA revisions in the early-1990’s after the FBI used FISA to declare Aldrich Ames a “foreign agent”. Certainly there was an expansion to include “physical searches” in the FISA Act in 1995.

I believe that the term used in the FISA Law is “electronic communication” and “electronic interception”. There is no issue with the ability of FISA to apply to email AND OTHER DIGITAL TRANSMISSIONS. It’s just silly. Where the Bush administration apparently has problems is with their wanting to undertake widespread “fishing expeditions” on billions of communications of those not involved with terrorists in order to find a few words of phrases that might be related to terrorism.
These programs are blatantly illegal, and of course would never receive warrants from a FISA court.
When McConnel suggests that technology has outrun FISA he isn’t talking about the technology used by terrorists, he’s talking about the governments ability to spy on massive amounts of people, both citizens and non-citizens alike. FISA is a roadblock in the ability of these government spies to snoop on our daily affairs. McConnel wants to rescind the 4th Amendment.
I think everyday the Washington Piss provides editorial space for the liars from the Bush Administration. I guess being a newspaper is hard work and it is easier to be the official organ of the Bush Administration. The transformation from Post to Piss is complete; the only further hope that Hiatt has is to work for Murdoch. Maybe he can but the Washington Piss and join it to its New York sister paper.
