Attorneys for Cheney and the other officials said any conversations they had about Plame with each other and reporters were part of their normal job duties because they were discussing foreign policy and engaging in an appropriate "policy dispute." Cheney's attorney went farther, arguing that Cheney is legally akin to the president because of his unique government role, and has absolute immunity from any lawsuit.
"So you're arguing there is nothing — absolutely nothing – these officials could have said to reporters that would have been beyond the scope of their employment [whether it was] true or false?," U.S. District Judge John D. Bates asked.
"That's true, your honor. Mr. Wilson was criticizing government policy," said Jeffrey S. Bucholtz, Deputy Assistant Attorney General for the Justice Department's civil division. "These officials were responding to that criticism."
Erwin Chemerinsky, a Duke University law professor who represents Wilson and Plame, said the leak was no typical policy debate. President Bush himself said that revealing Plame's identity could be illegal conduct and a firing offense, he told Bates.
So Shooter thinks he's above the law. Color me flabbergasted.

P.S. I have hope for this judge, whatever his reputation may be. If he has any conscience at all, he knows that the Wilsons have a real valid point to make. As far as I know, she has no way to make a living as a veteran WMD – hunter, only because Cheney and minions took it ALL away from her.
We need to put this unitary executive theory to a vote at SCOTUS. US v. Nixon was the endgame of Watergate. US v. Bush and Cheney will either nip our budding fascism, or sound the starting gun. And I do mean “gun.”

I’m disgusted with the Democrats’ lameness on the war, and lobbying reform, and Rahm’s Top Secret Trade Deal, but we don’t have any other viable options. methodist, the non-vicious branch. as i’m an agnostic/functional atheist, i don’t like to emphasize it. OTOH, if you actually get into some of the text of the raw biblical documents (not the ham-handed translations most people use) there is some truly amazing stuff in there, technological anachronisms. my favorite sermon of my dad (he didn’t have a congregation but would fill in at various local churches if a pastor got sick on short notice) was “the eight days of evolution”. this was back in the late 1980’s just before he retired but even then we could smell the stench of creationism wafting on the wind around raygun. he laid down the truth that day; anyone trying to use genesis to support creationism was lying through their teeth. I gotta go see if i can find that in his papers it might be worth posting somewhere…

got it in one. my dad didn’t actually teach at the seminary, he taught at North Texas State because my mom already was tenure track there when they met (music dept, piano) (i think they called it the Teachers Normal College or something then). so he pretty much stayed out of seminary/church politics, but enough leaked through that when i had to make my own religious decision, i said, “no thanks”.

First, the Repubs won’t dare let Bush be convicted. That would let his replacement be an automatic nominee for ‘08 and they’d lose big time.
Second, it would disgrace them (Senate Rs) all and within their party they’d be crushed.
No, they have to tough it out and hang onto the shreds of their party and it’s gonna be ugly for them.
Dems could Impeach perhaps, but never get the conviction, so it’s wasted effort which would make them look ridiculous to the public.
Dems should just crush the entire Repub party with Bush standing on-deck as the ship goes down with him saying, “I’m in charge here.”
So, to that end, kicking Abu Gonzales out on his keister is a great step in the right direction. He’s been disgraced already, so the Impeachment is a natural follow-through. It would also help us restore some real Law and Order to this administration.
If we have to go down the list and replace each and every one of Bush’s people, one by one, then it’s worth it. Tenet is gone. Wolfowitz is gone. Rumsfeld is sorta gone and Gonzales could be next and then who knows after that. Boiled Rice anyone?

It’s not really news. Soldiers and some in the public knew about this when they were first being sent over there and took their own Dragon armor.
The military eventually told them if they kept using the Dragon armor and were killed they’d lose their death benefit (insurance).
In short, somebody is probably getting kickbacks for guaranteeing the worse armor is used (and people die for it).

My reading of the Constitution says that the VP breaks ties in the Senate and replaces the president if he’s no longer able to serve.
So the only other power the guy has is what the president delegates to him. In this, he’s like anybody else who works for the president. And nothing more.
Maybe there’s some additional body of law I’m not seeing here, but it seems to me that with an additional 50 cents to buy a pitcher at a yard sale, Shooter could find a nice place for that warm spit this argument is worth.
