I have no brief for Irving Libby, but I have never understood why this “process” isn’t considered double jeopardy and held grossly unconstitutional. It is clearly unjust to require a person to prove his innocence (yes, I know what the book says; the fact is the defendent is pretty much required to prove innocence in 99.5% of criminal cases) and then double-penalize him for making the (constitutinally-protected) attempt.

Libby is at a disadvantage for the presentencing report, however, because he was convicted rather than pleading guilty. The sentencing guidelines provide leniency for those who accept responsibility for their crimes and cooperate, but since Libby continues to contest his conviction, he will very likely struggle to show remorse about crimes he still contends he didn’t commit.

The unavoidable rock and hard place for any defendant planning an appeal. The best Libby can possibly do at sentnecing is “I’m really sorry all this happened, but it wasn’t my fault/intent.” That’s all he can possibly say with an appeal in the works.

The real question, imho, is whether he stays free on bond until the completion of the appellate process.

My bet is that he stays out.

How soon before these folks begin to ‘disappear’ from the streets? :grin:

OT but… Profuse apologies to those who have responded to my comments in previous threads but got nothing back from me! These threads fill up faster than I can read them and by the time I go back to answer, the thread is closed and people have moved on. I enjoy the comments here very much however, even as a lurker. In time I’ll get to know you all.

Apologies also to Cassie for appropriating her name. I used to be a member of Truthout’s forum until they closed it down last fall and Cassandra is the name I used.
