Well, who says the Bush Administration doesn't give two shits about civil rights? Today the House passed legislation to give women, gays, and lesbians equal protection under the law against attacks and violent threats based on gender and sexual orientation. Such legislation, to my thinking, is inherently American and clearly falls in line with our nation's purported respect for the rights of all individuals and all that noise we like to make about treating every citizen as equal under the law.
The White House's response?
The White House views the expanded hate crimes bill as, “unnecessary and constitutionally questionable. If H.R. 1592 were presented to the President, his senior advisors would recommend that he veto the bill.” The reason given for vetoing this bill is, “State and local criminal laws already provide criminal penalties for the violence addressed by the new Federal crime defined in section 7 of H.R. 1592, and many of these laws carry stricter penalties (including mandatory minimums and the death penalty) than the proposed language in H.R. 1592….. There has been no persuasive demonstration of any need to federalize such a potentially large range of violent crime enforcement, and doing so is inconsistent with the proper allocation of criminal enforcement responsibilities between the different levels of government.”
Translation, please?
While the White House is dressing up its potential veto in legal terms, the political reality is that they don’t want to go against the socially conservative base of the GOP. In essence, social conservatives are couching their objections in a free speech argument, but what they really want is for homosexuals to be treated as sub humans who have no rights.

Dobson, founder of Focus on the Family, warned that the true intent of the bill was “to muzzle people of faith who dare to express their moral and biblical concerns about homosexuality.'' Basically, what the White House is saying is, "The Preznint is going to veto this bill because it infringes on the rights of anti-gay bigots to spew their propaganda and say screamingly ignorant, hypocritical bullshit."
So, just in case any of you were wondering, the White House does care about your civil rights, but only if you are using those civil rights to deny other people their basic civil rights and equal status as American citizens.

Sometimes it is very, very hard for me not to wish extreme violence upon the people on the Other Side. As a gay, American theropod, all I want is the assurance that I have full rights as an American. Civil rights are NOT "special rights". As it is, I am expected to pay full taxes and abide by the laws, even though I am a second-class citizen under Repugnican rule. Isn't that taxation without representation? Didn't we make a big stink about that at some point in the nation's history?
But this is another area where the 'Publicans have boundary issues. They can't figure out that religion needs to stay in church and out of schools, governments, science labs, public health, and the courts. I have patiently tried to explain to them that if they'll just keep their religion out of my bedroom, I won't have sex in their churches, but since they can't keep to their side of the bargain, it looks like I'm going to have to hunt up some pretty man and go get nasty in somebody's vestibule this Sunday.

Civil Rights Are Not ‘Special Rights’!
That pretty much sums it up, TRex. How hard is it to figure that out?
A few years ago, I was in a band that did some dates in Topeka, Kansas. We were treated to the sweet, sweet Christian love and charity that is Fred Phelps & Co. Now, this was not Slayer or NWA or the Indigo Girls – it was a children’s music band – the poems of Robert Louis Stevenson, set to Celtic music. We were invited because it was Stevenson’s birthday or some such. That’s going to threaten the moral fabric of society, now isn’t it?
This was in 2000, I think, because I remember seeing oceans of W signs and I longed to be back in the Land of Fruits and Nuts again. But we were booked at a college in Topeka, and as we drove up the driveway past the pristine, manicured lawns of the campus, we saw the signs. You know what they say. I was shocked beyond belief. I don’t think he had much national exposure at that point, so I had no idea what was going on, or how they knew our drummer was gay.
Topeka is a lovely, old-fashioned town with many charming Victorian and Craftsman homes (reasonably priced), but to me it has become an ugly place. I feel sorry for the non-wackaloon denizens of that town, that they have to be host to a fetid, foul and stinking chancre like the Westboro Baptist Church.
And my new name for Dobson’s group? “F*ck Us In The Family”.

I’m a good Catholic (well, not really but I am a believer). What I don’t get is why nobody calls them on this bible/ten comandments bulls**t. Steve Colbert did. And a week or so ago Bill Maher was going at it with Smerconish (I think) about the comandments. NOBODY can possibly believe they should be treated as some sort of law and posted everywhere. Yet only the comedians can confront our leaders? Someone should (as Colbert did) ask these guys to name them. And when they get to the one about the Sabbath, remind them that it said that ‘your slaves’ should have a day of rest also. So you can have slaves, just don’t ask them to work on the Sabbath.

I just read HR 1592. Its basis appears to me to be the Commerce Clause, since people and materials in such crimes often cross state lines. It allows grants of $100,000 approved by the DOJ to help non-federal jurisdictions, personnel, and other aid. And it permits the federal government to pursue a case if local authorities do not and lays out the penalties for conviction under the statute.
The invocation of the Commerce Clause does not seem particularly unusual to me. It is a pretty standard way to assert federal jurisdiction, because almost everything in the country is covered by it.

Sorry, I completely disagree. Hate-crime laws don’t grant equal protection (which everyone should have). They grant EXTRA-equal protection under the law and if, in fact, such a thing is not unconstitutional then it should be. Not that the Constitution means much anymore.
Criminals should be prosecuted for the crimes they commit, and whatever the reason they committed their crimes shouldn’t enter into the equation. If a prosecutor wants to argue for a harsher sentence because a crime was committed out of base bigotry, I have no problem with that. But to codify that if I *think* one thing while committing a crime then it’s bad, but if I think something *else* then it’s worse… I don’t see any value in that.

In which case, are you advocating that crimes should be punished irrespective of their motives? If society cannot allow it’s values to guide how violent criminal behavior should be sanctioned, then we have a system of laws as coldly irrelevant as the Canaanite form of fundamentalism preached in Leviticus. I think that our society is saying that crimes motivated by bigotry and hatred are WORSE than crimes motivated by, say, mere greed or psychosis, and this valuation comes from our values. This is something that the constitution allows, unless of course, you’re a Scaliaite strict constructionist of framers’ intent.
I somehow get the feeling that if the Repubs make the election about “the gays”, they will again win in ‘08.
Those Rep. nominees all seem likely to use gay bashing to win the vote.

This is a tough call, legally and morally. Of course a person’s mental state can matter when they commit a crime: it can affect the degree of culpability. If someone fires a gun into a crowd, it could matter whether they intended to or not (perhaps thinking the gun was unloaded). The other worrisome issue is the federalization of criminal law, which traditionally was left primarily to the states.
The White House’s motives are totally bogus, of course, for the reasons others have mentioned. But the answers to the policy questions aren’t obvious. It seems to me that the animus of the defendant could be considered an aggravating factor in imposing a sentence, along with the additional pain suffered by the victim, but it’s hard for me to accept a hate crime as a separate federal offense.

By federal law, shooting a federal marshall is treated differently than shooting a 7-11 clerk. Society (by enacting this law) is trying to say that killing someone who is trying to enforce the laws deserves more punishment, as a sign of respect for the rule of law itself.
By enacting a hate crimes law, society would be trying to say the same thing. Beating and/or killing is bad enough, but if you do it because you believe someone else is less than fully human, and less deserving of civil rights, you will pay an even greater penalty — because we as a nation are all about equal rights.
By vetoing this legislation, Bush would be doing just what the title of this post says: standing on civil rights.

The reality is that “hate crimes” are actually acts of violence (against persons or property) committed with the intent to threaten and intimidate some group or individual. The purpose is to put/keep them in their place or to drive them out. Since these acts of violence are in themselves crimes, you have two crimes committed, the act of violence and the attempted intimidation.

Both kids had school projects, and my son is going on a 2 day trip and needed me to buy and pack provisions since he is the only vegetarian on the trip and ALL of the restaurant stops on the trip sound like places where it would be difficult to get any vegetarian food. The rationale behind a hate crimes law is to prevent intimidation of others…and to halt the proliferation of threats by those that might hide behind a popular prejudice to justify their attack.
It’s just like an anti-lynching law. The mere fact that opinion might be antagonistic towards an unpopular minority does not justify violence against them.
I’m not gay, but I have been assaulted by anti-homosexual violence. It took a great deal of effort for me to tell the cops that the attackers used these epithets, and didn’t try to rob me. Their attitude changed immensely when I mentioned this…suddenly they were a lot less interested in capturing the attackers.
This was 15 years ago…but it makes one wonder. I think that if there was an express hate crime law the police might have to take attacks associated with verbal assault just as seriously as if someone said “Next time we’ll kill you and your children”.
When they use a particular group threat they are essentially making a similar sort of threat. This is the same sort of threat like voter intimidation, or a bomb threat, or a terrorist threat against a group.
It is not “free speech”, especially when accompanied by an actual assault.

Actually, according the WaPo, they’ve identified about a thousand. At present, there are roughly ten names that they’re considering releasing; one of the criteria for name-release is the hypocrisy involved by the individual. I think that’s why the USAID guy got named.
So I think there’ll be additional name releases to come. And supposedly … um, ?Brian Williams? was really pissed when he learned that they were only going to release two names; he thought they’d be naming more tomorrow and he’s really annoyed that they’re not.

It sort of changed my life in that respect. I’ve since stood up in two assault cases where I’ve seen incidents where people are being assaulted where the attackers are using racial or homophobic expletives against others. People have to realize that these same bully-boys would do this to them if given the chance.
I’m reminded of Pastor Martin Niemollers admonition when I see the Republican’s stance on things like this.
