One of the most essential skills of a good manager is the ability to delegate responsibilities. For a busy Attorney General like Alberto Gonzales, there simply aren't enough hours in the day to be unaware of all the important stuff you need to be unaware of. That's why a talented deputy like Paul McNulty is so invaluable:
In a closed-door interview with congressional investigators last week, Deputy Attorney General Paul McNulty said the [Daniel Bogden] firing weighs on him heavily, according to an aide familiar with the transcript of McNulty's comments. McNulty said he succeeded in sparing another U.S. attorney whose identity has not been revealed….
McNulty told investigators he did not see the list [of U.S. attorneys to be fired] until October, two months before the attorneys were fired….
McNulty asked during the interview last week to speak to the whole Bogden affair. McNulty told investigators he had hoped for some explanation for Bogden's inclusion on the list because he saw no apparent reason to fire him.
He said he was told that Justice wanted to bring in someone with more energy for Nevada, a fast-growing district.
He "was told that Justice wanted to bring in someone with more energy?" Well, we know that Alberto Gonzales didn't know anything about why Bogden was fired. And Kyle Sampson, the keeper of the list, claims not to know why Bogden made the list either. So who, in this equation, is "Justice?" Who was calling the shots? It certainly wasn't McNulty.
Yes, apparently the Bogden firing just materialized spontaneously out of the DoJ's time-space continuum, and the #2 guy in charge was helpless before its two-mere-months-in-the-future inevitability. After all, the USA firing list was completely set in stone by then, with no chance for additions or deletions allowed, especially not by someone as low on the totem pole as McNulty. (Of course, this begs the question of just which totem pole we're talking about.) Or maybe McNulty was waiting for his phone to ring so he could leap into bold, decisive action, just like another great, patriotic American.
This kind of weird-but-convenient passivity and incuriosity in the face of inexplicable decisions and dodgy information has become downright epidemic in Washington over the last six years, in both the government and the media. Why, it's almost as if asking questions has become bad for business, or bad for your career, or maybe just bad form. (On the other hand, maybe there's a good reason to look the other way…)
The good news is, the Democratics are finally able to start asking the gonzocracy the tough questions no Republican would ask. The even better news is, the Republicans don't seem to be very good at answering them. They must be out of practice.

Tests show that the I-880 connector ramp suffered repairable damage when the I-580 ramp fell on it in the tanker crash and fire. It will not have to be torn down, but is expected to be reopened in seven to ten days.
I-580, on the other hand, is looking like months before it will be back in service.

The March towards Martial Law October 26, George W Bush quietly authorized a provision revising the Insurrection Act (10 U.S.C.331 -335), which places limits on the President’s ability to deploy troops inside the United States. Senator Patrick Leahy (D-Vermont) has warned that this action suggests the president is preparing to declare federal martial law. The Insurrection Act and the Posse Comitatus Act (18 U.S.C.1385), have set strict prohibitions on military involvement in domestic law enforcement. Bush is seeking to undo those prohibitions.

This gives Goodling an absolute pass at testimony before Congress. She can claim, in spite of immunity, that her 5th Amendment rights by way of IG and OPR trump everything. Interesting.
Are the IG and OPR finally doing a proper job of investigating? Maybe. Or, maybe not.
I’d subpoena the folks in OPR and IG down to the Senate. Put them under oath. Ask them all sorts of questions about why they’ve just now announced opening an investigation into Ms. Goodling.

Congress should pass a Bring Home the Troops appropriation bill, not an Iraq War appropriation bill
Instead of sending Bush any form of Iraq War appropriation bill, Congress should send him a nice fat “Bring Home the Troops” appropriation bill. Give him no money at all for the war, and as much money as is needed to protect the troops and get them out of there.

Tester calls on Montana US Attorney to Resign (WaPo)
Sen. Jon Tester (D-Mont.) called yesterday on a top Justice Department official to resign his U.S. attorney’s post after revelations that he worked to alter federal law so that he and a handful of other senior aides could escape residency requirements that governed their assignments as federal prosecutors.
Since 2005, William W. Mercer has served as acting associate attorney general at Justice Department headquarters in Washington as well as being the U.S. attorney in Montana, where he spends just three days a month. That has drawn the anger of a Montana federal judge who contends that Mercer is violating a federal law that requires him to live in Montana.
The Washington Post reported yesterday that on the same day in November 2005 that Attorney General Alberto R. Gonzales assured the judge that Mercer was in compliance with federal law, Mercer asked Senate aides for new legislation that would allow him and a few others to escape it.

I hear ya. I like to overstate the importance of this sliver of the story because I was in college at UMt when Mercer was and he doesn’t seem to have changed a bit (except he has lost the little moustache and 70s “wings” in his hair) and Tester was born in the town where I went to high school.

Here’s an IANAL question:
If Goodling broke the law in setting up illegal hiring parameters for new DOJ employees, do those who weren’t interviewed or were rejected after interview have grounds to sue, either individually or collectively? And if that happens, do those hired under the illegal parameters warrant some sort of review beyond their performance on the job since their hire?

In the editing box, left click to get a blinking cursor (at the point for the link) You will need URL cut and pasted say in a text editor program. Left click on “LINK”-up comes box asking for URL which you can “paste” it in. Click OK, then another dialog box asks for text for the link like “LINKY” for example. Again Click OK (or what ever-click cancel if there is a mistake.)
But FDL automatically turns a URL string into a link-for example just enter “http://….com”. Like this

One has to wonder why it was deemed essential that members of the Korean National Police and Sweden’s Rikspolisstyrelen needed to participate in the mass-arrests of thousands of US citizens. Is there, perhaps, some NATO-like quid-pro-quo that obligates US troops to respond to mass-arrest situations inside these countries should the need arise? Could Falcons I, II, and III be dress rehearsals for something bigger? There is, after all the disturbing $385 million federal contract that KBR recently received to build “detention centers” to “support the rapid development of new programs.”

There are four weeks until this trial starts.What a way to cast clouds over the upcoming A*P*C/Rosen espionage trial coming up on June 4th. That is if the trial is not delayed for the 5th time, or dismissed which the Israeli lobby has been pushing for.
Four weeks for a cloud to be cast over the trial. Taking out McNulty would be one big cloud.
