Ah, irony. Not only does it look like the Regent University grads and Bush flunkies did a horseshit job of redacting today's doc dump, but one of the nicest chunks of damning evidence against Alberto Gonzales is one that never got redacted.
Check this out, courtesy of a fellow over at DailyKos:
Smoking gun? ( 20+ / 0-)
This was not even redacted. Batch 5 p 14. 2/12/07 From Monica:This is the chart that the AG requested. It shows detail for each fired USA and each proposed replacement. Information Abu said UNDER OATH that he did not have, and was not involved with. His testimony should be interesting…
Yeah, it should be.
I can't wait.
———-
UPDATE: The Bad News — if only I'd looked at The Damned Date, I would have seen that this memo was dated AFTER Abu's testimony. Arrrgh! The Good News — there's other, much better evidence that has Kyle Sampson crafting at least one chart for Gonzo BEFORE he testified.

So long sucka.
45 minutes to go. I picked Friday the 13th at 4:45. I’m holding my breath.
I have just one more thing to add:
(nelson muntz)
HA-HA!
(/nelson muntz)
Are these all from doj or did Monica fork em over along with her immunity deal?
Who do you think will replace him?
And GOOD RIDDANCE Abu….ya loser!
Digby had a post about how people are not doubled over with laughter at the prospects of Gonzales having stopped everything, everything and taken to 5 hour cramming sessions for his upcoming testimony.
We are paying a man that much money to cram for testimony about a matter he had little to do with?
That is funny.
-GSD
Well, if I were Monica, no matter how brass balled, I’d have been ducking and weaving too, knowing God-zalez was a big fat liar and was going to get to be toast!

This is all from today’s doc dump. And the section that nails AGAG wasn’t even redacted.
Phoenix Woman rises!
I am thinking that there may be something to Friday the 13th being a lucky day after all……
Every little straw like Imus, the e-mail disappearance and Monica G. is undermining the Bush White House.
April is also the cruelst month
Cramming his foot in his mouth.
Put me down for Next Monday as Gonzo’s Last Goodbye.
And I’ll give even odds that he has an ‘accident’ before he can spill anything.

GSD @ 7
Yup. It’s also funny how people who tell the truth, plain and unadorned, don’t need to cram in the first place.
Oh, ow.
Hey, PW, did you like all the people signing Issa’s hissy fit letter about the lack of illegal immigration prosecutions, in October 2005? And one of the co-signers was Duke Cunningham–only a month before he had to resign? And Doolittle?
Isn’t the timing of their concern interesting?
It’s in sec. 7. Page 18, I think.

The calls are coming from inside the house!
Remind me again about the dates. Did the firings occur before this e-mail? And when did he make the “I don’t know anything” statements? I thought at one point that the DoJ was trying to make up reasons to justify the firings long after the fact, and it would have made sense for Gonzales to ask for a list of the reasons that were being made up, so he’d have something to say. But if this occurred before, then it looks pretty smokey.
The rating is now 25 .
I’ve been looking in on the stuff at TPM from time to time. I think the commenters are ready to start throwing canned veggies in response to the canned official answers.
CNN attacking Margaret Chiara for the staff bonus thingy in the documents. One should note, that there is no clear reference who wrote the note, “Hey Rachel” or when it was written, that was quoted on CNN. There follows a memo from Chiara explaining that she realized that some people didn’t get awarded that particular year, but maybe next year, if their work was outstanding.
Did someone at DOJ pull the trigger on purpose for leaving that little tidbit unredacted?
If so,
THANKS!
LJ/Aquaria,
there’s yet another connection btw all those pukes on that hissy fit letter -
all of them rec’d $$ from and lobbied for the Bajagua project (San Diego/Mexico), you know, the vendor nobody wanted . . .until Cheney met with them twice
Why didn’t DOJ redact the damning stuff as they had before? Intentional nails?
just a clarification –
there is a strong possibility that the “redacted but readable” documents aren’t redacted, but highlighted.
It wasn’t a bird, it was a homicide pigeon.
Time to crack down on this threat too.

IANCHS (or AL), but I’ll reply anyway. :-)
One of the small silver linings of consolation about seeing Darrell Issa blow off a few million of his own money to pay for Gray Davis’ recall was knowing that he’d done it so that he could run for governor — only to be shoved aside by Pete Wilson’s boys, who ran Arnold hoping that the Terminator would be an obedient little T-800 unit. They thought wrong, and Ahnuld’s now putting as much daylight as he can between Wilson (and Bush) and himself.
I will give Issa this: He’s at least willing to defend Pelosi against Bush’s bullcrap attacks RE: Middle East trips.
On CNN just now, Wolf asked Andrea Koppel if there was anything interesting in the DOJ document dump today. She said there is one interesting thing. She proceeds to quote from the letter a staffer wrote about Chiara’s cruel management style. Then, Andrea concludes, this document bolsters DOJ’s contention that at least Chiara was fired for performance reasons.
Excuse me, I have to go throw up.
Not just Gonzales, but Sampson made some statements about the AG’s involvement, also under oath, that do not really jive with this either.
Monica seems to be less willing, what with emails in her name, to lie under oath to Congress. Popcorn time.
If jayt is around (or any other hoosier who will appreciate the time references) I put up an appreciation piece for Mike Pence up at kos

Scarecrow: Looks like it was 1/9/2006
Update: Looks like the “memo” was from that date.
Ruh roh, Houston, Abu has a problem.
To me, this document drop, seems like damage control for the previously dumped docs. They’ve had plenty of time to mess with the documents to present them the way they want to.
Also, there is a section where they are watching Issa on C-Span questioning a border control guy, and the DOJ is getting all pissed at the border control guy for answering truthfully, instead of sticking to their coached answers.
Implosions tend to happen quickly.
Next week’s gonna rock.
p.lukasiak @ 26
Yeah, some people were considering that; the one thing making folks think it was indeed redaction is the neatness of it: the squared-off blocks, etc. The guess is that it was done by hand with black pen — red marker would have guaranteed it wasn’t legible, but not many people know this.
Was Andrea Koppell in on the Whitehouse pundit/pressure presser?
These nitwits need to be spoon fed everything.
There won’t be a story until Josh Marshall digests and explains everything so that MSMonkies can follow along.

but look at the date. this is way after he testified. And this is from the older dump as well. this isn’t new. in fact, it would actually show that he didn’t know when he testified. This is the doj trying to justify the firings after the shit hit the fan…
this was present in doc dump number two. They’re sendig the sme stuff again.
This idiot Tasia or whatever the name is has the “Clinton FIRED all the USAs when he took office” as a talking point for the 3/6 briefing of Abu. Or maybe Moschella? They make this kinda difficult to follow. Lots of duplication here.
Interesting too that over 40 USAs (presumably First and Asst) have left their posts for various reasons over the previous 5 years. Is that a normal rate of turnover for DOJ?

Subject: US Attorney Hearing: DRAFT Talking Points
>
>
Dan/Cathie -
In preparation for tomorrow’s hearing where six of the dismissed US Attorneys will be testifying, we have drafted some talking points that we were going to insert into Will Moschella’s testimony (the DOJ witness) that get out the message that although we stand by the decision to remove these folks the process by which they were informed was not optimal. Right now the coverage will be dominated by how qualified these folks were and their theories for their dismissals. We are trying to muddy the coverage up a bit by trying to put the focus on the process in which they were told - I suspect we are going to get to the point where DOJ has to say this anyway. First, it is true. Second, we are having morale problems with our other US Attorneys who understand the decision but think that these folks were not treated well in the process. I think from an internal management perspective it needs to be said. We are also discussing internally if we can/should release more information about why these folks were let go if we can address the privacy act aspects. I think it cuts both ways – it does prolong the story in a sense because I suspect that the US Attorneys will just go away at some point when they feel they have vindicated their reputations. On the other hand, I don’ t know if the Senate Dems will let this go until it is all out in the open. Let me know your thoughts.
Thanks.

So that was the excuse they came up with after she was fired and they were under pressure?
A couple of commenters have asked the question about the relationship between the date shown in the document (2/12/07) and the date of Gonzales’ testimony that he did not get involved in the details (which one of those commenters – - Robin as quoted below) indicated was prior to this document. If the testimony preceded the document, the document proves nothing since it could easily be explained as Gonzales simply trying to get to the bottom of the story after the fact.

Subject: on another note
Mike Elston from the DAG’s office called me today. The call was amiable enough, but
clearly s p m d by the Sunday Post article. The essence of his message was that they feel like they are taking unnecessary flak to avoid trashing each of us specifically or further, but if they feel like any of us intend to continue to off- quotes to the press, or organize behind the scenes congressional pressure, then they would feel forced to somehow pull -their gloves off and offer public criticisms to defend their actions more fully. I can’t offer any specific quotes, but that was clearly the message. I was tempted to challenge him and say something movie-Iike such as “are you threatening ME???”, but instead I kind of shrugged it off and said I didn’t sense that anyone was intending to perpetuate this. He mentioned my quote on Sunday and I didn’t apologize for it, told him it was true and that everyone involved should agree with the truth of my statement, and pointed out to him that I stopped short of calling them liars and merely said that IF they were doing as alleged they should retract. I also made it a point to tell him that all of us have turned down multiple invitations to testify. He reacted quite a bit to the idea of anyone voluntarily testifying and it seemed clear that they would see that as a major escalation of the conflict meriting some kind of unspecified form of retaliation. .
I don’t personally see this as any big deal and it sounded like the threat of retaliation amounts to a threat that they would make their recent behind doors senate presentation public. I didn’t tell him that I had heard about the details in that presentation and found it to be a pretty weak threat since everyone that heard it apparently thought it was weak.
I don’t want to stir you up conflict or overstate the threatening undercurrent in the call, but the message was clearly there and you should be aware before you speak to the press again if you choose to do that. I don’t feel like I am betraying him by reporting this to you because I think that is probably what he wanted me to do. Of course, I would appreciate maximum opsec regarding this e-mail and ask that you not forward it or let others read it.

Y’know, all that “cramming” and “prepping” that Abu G is doing has the potential to really bite him in the ass, when he faces questioning by a competent prosecutor. Subject: NM USATTY – urgent issue
Importance: High
I just received a telephone call from Steve Bell, Sen Domenici’s CoS, who urgently reported the following:
1. Outgoing USATTY David Iglesias holding a press conference at 11:30 Eastern this morning.
2. He is allegedly going to say that he was contacted by two Members of Congress last Fall regarding the investigation into the courthouse construction corruption case. Information on this is in the following article: http://www.abqtrib.com/news/20…..-investig/
[page break]
3. He is allegedly going to say that the Members urged him to deliver indictments before November’s election. He will further say that one of the Members, frustrated with his answer, hung up on him in anger.
4. He is allegedly going to link these phone calls with the current news – saying that he believes this ultimately led to his being asked to resign by DOJ.
Bell said Domenici’s idea is not to respond, and hopefully make this a one day story. They have already been contacted by McClatchey. Unfortunately, I do no think that they can make an allegation such as this go away so easily. They have not confirmed to the reporter they were one of the Memebrs.
I am available to discuss further – clearly, once this happens in Albuquerque the reporters will be asking DoJ and the White House

Retention only lasts a short while after you *cram*. If they postpone Abu’s hearing by even a day he’ll forget everything he’s been stuffing in his brain, including how to tie his shoes.
They’ll have to wire him up for his testimony, it’s the only way.

You got that right! I don’t see how he escapes a perjury rap now, unless he’s going to rely upon the old “memory like a seive” defense.
“Yes, I admit now that I may have seen the chart and had a discussion about firing all the attorneys for political reasons, but I have no present recollection at this time. . .”
The Old Water-gate defense revisited!
This should be an interesting few months as Gonzo twists in the wind and Rove tries to explain what happened to all those incriminating e-mails, and Congress demands an indictment for lying to Congress!
“And there was much rejoicing!”

Total trivia, but Maine was originally part of Massachusetts. It wasn’t Maine until 1820. It came in as the 23rd state.
LS @ 22
I almost guarantee the unnamed emailer was Phillip Green, an AUSA in her office who had been appointed (but has never been approved) to serve as USA for IL SD. There was a OPR investigation into him, and I think BushCo blames Chiara for leaking news of that (though I don’t think she did).
In other words, it very likely was Gonzales’ spy within Chiara’s office trying to get revenge. No doubt she handled hte meeting very poorly (uh, and Abu G is going to use that as a reason to fire someone???). But I also think the email is just Green trying to get back at her.
perris @ 149
I’m with p. lukasiak here (and he does have some experience with, ahem, documents, you must admit). That stuff was just printed with gray highlighting behind it, and came out legibility-challenged. It’s also substantially the same text as another document in the same file. If it had been a real flubbed reaction, you would have been able to read something like: just spoke to potus after his session with Jeff G, he was obviously still worked up, coz he was saying “f*** the constitution!”

So you have an outgoing director of public affairs, and an incoming director who was a deputy press person, but there’s a big computer glitch and the news release doesn’t make it out?
Then from the recent Frontline on the Press/Gov, there was this exchange

[Former Public Affairs Director] Mr. [Mark] Corallo and others we’ve talked to say there’s now a green light in the Justice Department for these subpoenas that hasn’t existed before.
[Scolinos]Mr. Corallo is no longer at the Justice Department, so I think he’s not aware of all the facts surrounding these cases. …

For too long, Israel has been taking land from which Palestinians have been evicted, and detestation is spreading around the world. In Ireland, photos of Israeli bulldozers are placed beside those of landlords’ battering rams. Even a former U.S. president has recognized hafrada (”separation” in Hebrew) as apartheid. Disgust has reached such a level that even highly conservative institutions that normally try to avoid politics are driven to express concern.

The email from Sampson to Meiers about the purgees/replacements that TPM has up is from 1/9/2006.
It’s really tough to say that Sampson acted on his own with this, but I suppose a case could be made. Still, something this big… If Abu wasn’t the least aware of it, if he left this all in the hands of subordinates, he’s incompetent or lazy. Or both.

Kyle Sampson testified under oath (after the AG testified saying he was not involved) that the AG knew prior to the firing. There was a meeting on 11/27/06 in the AG’s office about the pending firings that occurred on 12/7/06. So, what occurred after the firings and during and after the testimony appears to be damage control or get your story straight info. Perhaps the implication is that the “story” was fixed to fit the “story”.

An article I posted a while back from Indian Country Today (which should be easy to find with Google) indicated Chiara got kudos from the tribes for working well with them to deal with problems like domestic violence, which are frequently neglected because jurisdiction is unclear between local law enforcement, tribal law enforcement, and the US Attorney. If there were Abramoff-style “help” going on, I don’t think it would generate that kind of press.

Thank you LS, Audrey and Urban Pirate. Based on the fact that AG’s testimony preceded the date of the document posted by Christy, that document is not anything close to being a smoking gun – - in fact as someone suggested earlier AG could point to it and say, “See, I was scrambling to find out about the purge process which was being run by Kyle Sampson, and about which I knew very little.

But, look at the phrasing. It’s to comply with Abu’s request for the chart. Therefore, it’s reasonable to assume that the chart itself predated the testimony (otherwise, why would Abu take an interest in it?), and second, that Abu was aware of the chart’s existence–otherwise, he wouldn’t have known of it.
Other documents dumped, now or previously, will show the actual date of the chart, which likely has its origins in early 2006.
Thank you LS, Audrey and Urban Pirate. Since the document posted on Firedog to start this follows the AG testimony thay he knew nothing, the document is nothing like a smoking gun. In fact, AG could point to it as proof that he knew nothing, his staff was trying to bring him up to speed after his testimony.
Too bad.

Robert P. Ewing,
Sampson testified that he had met with AG numerous occasions about the purge. Therefore he knew. He “signed” off on it, and the WH cleared it – it was his job. If he hadn’t, the USAs would still be employed. Sampson had no power to fire them.

It is just a plausible that AG was told about the chart (even if the chart itself predates his testimony) after his testimony, and then asked for it because it became clear that there were going to be subsequent Congressional hearings.

This chart, or this version of it, does not predate Gonzales’ 1/18/07 testimony before the Senate Judiciary Committee.
In fact, while undated, this chart was definitely created after 1/18/07. On the second page of the chart, in the notes regarding John McKay (WDWA), in the third column, giving information about potential replacements, it says:
Rep. Reichert has recommended
potential candidates; interviews
were held 2/9/07.
If that note is to be believed, that means the earliest this chart could have been created was Feb. 9 or 10, 2007.
Robert P. Ewing, Robin, LS, Audrey, and Urban Pirate are right, this IS NOT a smoking gun.
We do know that there WAS another, similar chart or list, created by Kyle Sampson on or before 1/09/2006: TPMMuckracker

Gonzales repeated the same claims, that he was not informed of these decisions and the reasons for the resignation, choice of those to be fired etc., in his press conference on March 13, 2007, which was well after this memo.
“Yes, it became quite clear that under Gonzales, the department placed no more than secondary value on the standards that I and my office had valued so heavily for the preceding 25 years — accuracy, integrity, responsibility, and quality of decision-making being chief among them. Had I stayed as director of OIP, I might have been working for a Monica Goodling protg by now.”
