Mr. Kelner's briefing raised particular concems about Karl Rove, who according to press reports used his RNC accountfor 95%o of his communications. According to Mr. Kelner, although the hold started in August 2004, the RNC does not have any e-mails prior to 2005 for Mr. Rove. Mr. Kelner did not give any explanation for the e-mails missing from Mr. Rove's account, but he did acknowledge that one possible explanation is that Mr. Rove personally deleted his e-mails from the RNC server.
Mr. Kelner also explained that starting in 2005, the RNC began to treat Mr. Rove's emails in a special fashion. At some point in 2005, the RNC commenced an automatic archive policy for Mr. Rove, but not for any other White House officials. According to Mr. Kelner, this archive policy removed Mr. Rove's ability to personally delete his e-mails from the RNC server. Mr. Kelner did not provide many details about why this special policy was adopted for Mr. Rove. But he did indicate that one factor was the presence of investigative or discovery requests or other legal concerns. It was unclear from Mr. Kelner's briefing whether the special archiving policy for Mr. Rove was consistently in effect after 2005. (emphasis mine)
Oh, frabtacular day. And may I just say for the record that if Mr. Rove knew that his e-mails were to be preserved due to a pending criminal investigation and deleted them anyway in an effort to keep them from being viewed in discovery under a valid request from, say, a certain tall special prosecutor whose name might be Fitzgerald…well, that could be construed in a whole lot of places as obstruction of justice.
Oh, and did I mention that there are reports that Monica Goodling is cutting an immunity deal with one or both Judiciary Committees to spill all?
You just can't find loyal minions willing to break the law and take the fall for you like you used to, can you, Karl? How does that make Scooter feel, I wonder?

Someone back a thread or so, I think it was emptywheel, suggested James Comey to step up after Gonzalez is pushed out. I think I agree. Comey did the right thing in the face of some very serious threats and he thinks fast on his feet…effectively. The next president is free to nominate his own AG, and I hope Patrick Fitzgerald is given serious consideration for that. Honestly, I believe that both are exceptional men.
Karl Rove going down worries me, though. That leaves George W. Bush alone with Dick Cheney.

God, this makes me sick. I was captive in my car (on a long drive to see my dad who was dying in a VA hospital) when the Iraq war started. I will never forget the sound of bombs exploding and Rumsfeld’s voice describing the “shock and awe” experience. He was orgasmic. I felt so ill, dizzy, disoriented. I knew the guy was an evil f*ck. I wonder if he was a regular too.
There is just no end to the perversion of these freaks.

I guess I just expected and IANAL, that once he convicted Libby, as I was sure he was going to, he would move on to the next phase and indicting the next set of criminals.
You can’t tell me I am the only person surprised that he said barring further developments or however he worded it, that the investigation was inactive.

I am guessing that Conyer’s committee has finally turned up some pretty compelling evidence, which will make it very much worth her while to cooperate fully with Congress. And quite self-destructive if she doesn’t.
She is still young–she has time to get through this, and get on with her life. Likely everyone in her “personal” circle is telling her this.
I for one, am dying to hear her explain where on earth she came up with the notion of administering loyalty oaths. Was it really her idea, and if it wasn’t, whose was it.
And I would also love to hear her talk about who emailed her via the RNC servers (did she have one of those accounts???) and under what circumstances and why!
First, Rove deletes emails he’s not supposed to. Then, they change the law so that he’s definitely not supposed to delete emails, but he deletes them anyway. Then, they back them up, because he won’t stop, and he still deletes his emails.
He’s out of control.

No respectable place allows a worker to direcly delete (the backup copy) of an email. It sounds like even a crap place like the RNC had an archive policy of some sort for at least Rove in place.
This should mean that he can hit delete so he does not have 2 million emails on his PC, or viewed when he connects to the server – but they damn sure are on the server.
Add to that the fact that you know the SS, CIA, FBI, or NSA have these emails (tax payers are paying for these freakin emails).
I am sure this has been pointed out above, gonna try and read this thread in full now. Once I saw this issue – well this is what its all about aint it. Commit crimes galore for years and hide the evidence, very easy when the cowering cowards are in control of Congress – not such a good plan when there is actual oversight.
If Monica Goodling rats out and gets immunity would that also remove her from any danger of losing her Juris Pharisee degree from Regent? Would she then be an un-indicted co-conspirator subject to sanction by the bar?

Because it’s late and i’m stupid with fatigue. I knew that Fitz was apolitical, it just slipped my alleged and frequently absent mind…(altho his was a political appointment, was it not, or have my neurons atrophied again..?)
Actually, Fitzgerald has no stated political affiliation and has zealously pursued sleazeballs on both sides of the aisle. People get the mistaken impression that he’s a Republican because he was sponsored by a Republican senator who was looking for a tough, honest prosecutor.
The reason Fitz has a vocal fan base around these parts, IMHO, is that he is a competent and honest civil servant faithfully executing his duties and they’re pretty damned thin on the ground these days. It’s a pretty sad commentary on our times when Our Hero is an ordinary Joe doing his job. Or maybe it’s actually a nice thing that our hero is a guy doing his job quietly and professionally. There are worse things to admire. One of them is a President we didn’t elect twice.

This ilk of Goopers is the most brash, arrogant, stop-at-nothing group I have ever seen.
I just don’t think we have seen them begin to fight. When they do, I have yet to see a Dem with the juevos to stand the fire and brimstone they will throw out.
And, since their strategy is to “run out the clock” time is not on the side of “poetic justice.”
I believe the beginning of the end is when some powerful Repugs turn on them. Who is that going to be? I just don’t see any of them having a modicum of conscience and they could rationalize forking their own grandmother for “the cause.”

Thank you for clearing that up for me. Fortunately I have not observed the demon using his blackberry in bed. That makes me feel really really queezy. blergh. But he does seem to be utterly intoxicated with his power. He can’t get enough of himself. I can’t wait ’til that perpetual smirk is wiped from his pitiful face.

Fitz is adored beacause he did his job under the yoke of a Republican coupe and still got someone convicted. He did not get more because the admin is a bunch of lying treason snakes.
When whatever investigations fall out I would bet that a decent portion will be built on the work he has done. If not then he will still remain the one that discovered the crooks had been dipped in by their heel (thus have a weak spot… can you smell the festering?). Again he did this when folks around him were getting calls and towing the line or getting “fired”.
For that and the fact that his press confs show he has master command of data, timeline, and relevence… and all in his head, no notes needed. Compare that to Abu Gonzo who looks like a lying two year old when talking about stuff he has supposed to have/have not done.
I guess its just because the guy is a hard-working hero.
I’d love to see Abu flip. Bet he could tell some tales….

I will guess zero…and there is going to be plenty of opportunity. Kinda funny considering how many of them they hired.
As a senior fed who has run programs and also large procurements, the onus is on the individual to follow rules and regs about proper use of gov’t equipment and maintaining the security of gov’t information. You just can’t use a non gov’t account for conducting gov’t business and of course this applies broadly, not just to officials with security clearances. “I forgot” or “we not clear about the rules” does not cut it. EVERYONE has to take a refresher course each year on computer security and it covers email and the handling of controlled data. These briefings are 3rd party prepared materials viewed on-line with some course and test (it’s been privatized), they are not briefings or memo’s issued by local managers. It is not uncommon for the gov’t to assert that by default all information is by default not for public (and thus international) dissemination and is sensitive, therefore, paperwork is necessary to share information – be it conversation, presentation or written. I’m not referring to declassifying information, just asserting the info isn’t sensitive. All Computers systems need to have security policies and procedures. Also, information about people, job performance and etc is controlled data. It clearly falls under these rules and regs that are discussed in the annual computer security training. So sending email on a GOP server is considered public dissemination and if it involves public officials, it’s controlled data and needs to be secured.
If Monica gets a deal and then because of that deal nobody ends up going to jail (think a rerun of Iran Contra) then the Dems will have been played again. This is all a little to convient for me despite being a minor player she goes to the press screaming she won’t testify. After the press asked who are you? She claimed congress was out to get her and she was going to invoke the 5th. She seems like a creature created to attract the media and over eager Dems. She is setting up a sucker play. This move is to orchestrated to be hers alone and to awkwardly set up to have been thought up by a woman. Hmm? Orchestrated and Awkward!this play was called in by a Republican Man.

Fitz did his job, he got a conviction of Libby for lying and obstruction in the leaking of a covert agent. Libby is/was pretty high up on the food chain. That’s a start. He hinted he had more but that it’s now up to congressional oversight to keep it going and are they ever. Albeit slowly, but they’re being very methodical and leaving nothing to chance. Trust me, I’m just as impatient as the next person, but they have to do it correctly.

It’s ok – it may also be a gender thingy – I would love Fitz even if he was that rare breed of a so-called “good” Republican. Everyday is Fitzmas day and when the Dems take back the WH I pray that Al and/or Nancy appoint him AG -we need a brilliant man to clean up the rat’s nest that is Gonzo’s legacy. ;~)

Happily, Rove’s emails STILL exist regardless of his deleting them. They cannot really be deleted…unless the RNC itself provided Rove with access and resources required to truly eliminate the emails. Simply deleting emails does not eliminate them. Data recovery services should have no problems recovering anything he deleted.
The only way this would not be the case is if Rove wiped the emails: deleted them and then overwrote the affected harddrive sectors hundreds of times with noise data. The only way he could do this is with official RNC sanction and help. This isn’t something a mere user can do.
So, either the emails will be recovered or the RNC is complicit in a crime.
It actually takes more than simply ROVE eliminating his emails, of course. Anyone and everyone else that received the deleted emails or sent them to Rove STILL has them available…unless they took part in what becomes a criminal conspiracy.

Would it be possible for someone to do a summary of the many good suggestions on this blog? I’m thinking there are alot of good ideas and or advice in this story about how to get the emails, where to search, who to go to, who might have them. Some times people say, I think … is reading this. Well, if Fitz, Waxman or Leahy, KO, were, could that help them? As much as I love this place, I don’t have time to read every article and all the messages but a recap of some of the main points, ideas, suggestions from the messages at the end would be great. Maybe not every story but some of them? Then for those that don’t have time, they could read the story and the message board sumary. What do you think? I hope I am not out of line.

AND…if you look at the numbers of casualties of US forces there has been not only an INCREASE…but that increase is not from IED’s…it’s from automatic weapons fire. These attacks are no longer coming from furtive bombers but from miltiamen doing what Sadr has called upon them to undertake. I wouldn’t be surprised if some of these deaths are the result of Iraqi “friendly fire”,

This is absolutely true! Given their assertions, and their claim that the emails are “lost” when they should still be on the hard-drive, the WH should be compelled to turn them over for examination. There should be stored or overwritten (and readable) copies on the hard-drive unless the drive has been SCRUBBED…which would, of course, destroy ALL the emails. That would imply a criminal act…or at the very least utter negligence or a quite complex sort. This requires a series of acts that goes far beyond stepping on a treadlepedal on a dictaphone!
And the fact that he didn’t report this “accident” that would have lost all his emails (and functioned perfectly well without them) suggests that something else is amiss.
I wonder if any of his subsequent SENT emails actually preserve emails that date to prior tio his (ahem) Rosemary Woods moment. This really smells like a cadaver in a trunk on a hot Sacramento summer day!
Rove would not only have to have totally scrubbed/wiped his inbox of emails, but his sent email files. Not only that, the people that he sent those emails to, or received them from, would ALSO have to do the same thing. Rove wasn’t simply sending and receiving emails to himself (and even if he were, it is likely that the emails traversed intermediate snmp servers.

And now innocent Ms. Monica “I’m A Top Justice Department Official Taking My Prophylactic 5th Amendment” Goodling is back in the spotlight. Looks like she will be lucky enough so that Congress will grant her immunity. She must be so relieved now that she can tell the truth without any possible harm whatsoever coming to her (right!). All she has to do is tell the truth. If she lies of course, she’s going right to jail with Scooter. But of course she wouldn’t lie now. Would she? I mean these Republicans don’t lie, right? And she comes from such an honest department called Justice. Either the Attorney General Gonzales himself or Goodling’s immediate superior Sampson (or more likely both) lied right through their teeth in smearing those good prosecutors who they fired because they wouldn’t witchhunt Democrats. They’re such an honest nice bunch.
Oh the storm is brewing. The clouds are gathering for you. The Republicans who are sending our boys to die to enforce the Rule of Law in Iraq may just find the Rule of Law actually applies to them at home. They may just find there are some consequences for them for getting caught breaking the law . . .

There’s no percentage in cutting a deal with Monica Goodling. She’s a “true believer”. No matter what, she’s not going to give Congress anything. She’ll take her immunity and leave them holding a bag of sawdust.
I must also add, I’m not so much in a hurry for Gonzo to go – my money’s on Orrin Hatch as the chimp’s nominee for AG, g_d help us. From their perspective, he’s perfect – the Senate couldn’t possibly not confirm him.

Agreed. Wtf would she go for that deal now unless they had something else to pressure her with?
I’m not sure whether anyone has made this point, but it is worth noting that Rove’s computer/computers (some of them, anyway) were paid for by the federal government, and are still owned by the government. Would it not be a crime to destroy government property by destroying hard drives? Seems so to me. The GAO could certainly investigate this easily enough.

I keep wondering how closely Fitzgerald is following the Judiciary Committee’s investigations, and especially the missing emails. Might he reactivate his grand jury and put his FBI agents back to work?
Another thought. Might not the Judiciary Committee staffers be interested in talking to Fitz to see what he knows about deleted emails?
