If I may jump into the medical research on dogs question:

I love dogs and I work with surgeons. There are times when research must be done on mammals before it is done on humans.

The heart surgeries that we do on children in St. Petersburg are only possible because of earlier surgeries on dogs in particular.

However, using dogs to demonstrate surgical staples and then killing them is totally unnecessary, contributes NOTHING to medical research, and is just sick, sick, sick.

And I think it is true that Guiliani is a pathologically twisted f**k who might very well outdo Bush.

That’s my impression of him. When he was mayor, I was too busy working & being a single mom to pay attention to politics. But viscerally I always hated him (& I didn’t hate almost anybody until W became prez), but was never able to articulate why. Now that we are learning about him more thoroughly, as the national spotlight falls on him, the reasons for my intuition become more apparent.

I can relate to the experience of not really hating anybody b4 the likes of Bush et al. and Rudy came around.

I never before experienced the kind of emotional/physical response to politics that I do now. The sight of Dick Cheney’s sneering mug on television makes me ill. I had an apoplectic fit when a couple of George Allen zombies dared to post their yard signs in front of my son’s school last fall. (no, it wasn’t a polling place….it was back to school night….and I, er, persuaded them to remove the signs).

I HATE these people. They are evil. They are liars, thieves and murderers.

Nobody caring much about global warming?

Here is a short summary of Massachusetts v. EPA, decided today by the U.S. Supreme Court. The summary is provided by a lawyer working on global warming and then edited by me. (These are not quotes from the Court’s opinion.) (I am also working on presenting this case to my law stuents today.)

1. 5-4 decision. The usual suspects. Justice Kennedy, the swing vote these days, joined the liberals on this one.

2. Court holds that Massachusetts has standing because as a quasi-sovereign Massachusetts has special status under the doctrine of parens patriae. Also (1) the injuries from global warming are concrete harms that are actual and imminent, (2) greenhouse gases contribute to global warming and therefore there is a causal nexus between EPA’s refusal to regulate and the harms from global warming; (3) it is enough that the remedy here would slow or reduce global warming – there is no need to establish that the case would reverse global warming.

3. Carbon dioxide and other greenhouse gases are “air pollutants” within the meaning of the Clean Air Act and thus EPA does have authority to regulate them under the statute.

4. As for mileage standards on motor vehicles, a job Congress gave to the Department of Transportation, DOT can do its job at the same time that EPA is doing its job. They are not inconsistent and not a reason for EPA to refuse to regulate automobile carbon dioxide pollutants.

5. The Clean Air Act says that EPA is to use its “judgment” in deciding what harms public health or welfare, but: “the use of the word “judgment” is not a roving license to ignore the statutory text” (quote from the Court).

And here is a bit more concerning our President and EPA’s argument that to combat global warming might interfere with the President’s foreign policy. Note: These are quotes from the Court’s opinion:

“EPA has refused to comply with [the law’s] clear statutory command. Instead, it has offered a laundry list of reasons not to regulate. For example, EPA said . . . that regulating greenhouse gases might impair the President’s ability to negotiate with “key developing nations” to reduce emissions and that curtailing motor-vehicle emissions would reflect “an inefficient, piecemeal approach to address the climate change issue.”

“Although we have neither the expertise nor the authority to evaluate these policy judgments, it is evident they have nothing to do with whether greenhouse gas emissions contribute to climate change. Still less do they amount to a reasoned justification for declining to form a scientific judgment. In particular, while the President has broad authority in foreign affairs, that authority does not extend to the refusal to execute domestic laws.”

And then there is this:

“Nor can EPA avoid its statutory obligation by noting the uncertainty surrounding various features of climate change and concluding that it would therefore be better not to regulate at this time. If the scientific uncertainty is so profound that it precludes EPA from making a reasoned judgment as to whether greenhouse gases contribute to global warming, EPA must say so.”

That is because Congress stated in the Clean Air Act of 1970 that if something is a pollutant that endangers public health or welfare it must be regulated.

The Court, in the end, does not say that the Bush Administration’s EPA must regulate greenhouse gas emissions from automobiles, but it has to have a good reason for refusing to do so — one that it did not present so far. In the words of the Court:

“In short, EPA has offered no reasoned explanation for its refusal to decide whether greenhouse gases cause or contribute to climate change. Its action was therefore “arbitrary, capricious, . . .”

If the Bush-era EPA wants to say now, after the case comes back to it, that greenhouse gases do not contribute to global warming and therefore do not endanger us, or that there are speficic policy reasons for letting us cook in Hell (my words), “EPA must ground its reasons for action or inaction in the statute.”

In short, the decision goes back to EPA and control for the rest of us goes forward to Congress.

I’m reminded of an old comedy movie (I can’t remember the name), where all of the scoundrels end up at the airport, and the confused motorcycle cop gets so frustrated, he yells out that everybody is under arrest at the airport. I thinking that every “tool” organization used by this administration should be identified and have all their e-mails subpoened to see how this spiderweb has really been woven. I know…not realistic, but I can dream…

I’m no great fan of Rudy, but could we at least try not to engage in “gotcha” politics? Unless she had a direct hand in the torture and killing of these dogs, I don’t see how this is germaine to the discussion of Rudy’s fitness for office.

I’m quite sure your outrage at the mistreatment of animals is real. However, we’re talking about something that happened in the late 70’s, which, if you’re old enough to recall, was not exactly a high-water mark for animal testing.
This woman was acting as a sales rep for that company, and nothing I’ve seen so far indicates that she even knew about the testing or condoned it.

If you want to make an issue of it, be my guest, but in the pantheon of real issues facing Giuliani, this is probably the least of his worries.

I tend to agree with Tom, not to make excuses for her behavior, but because I think Giuliani has many more personally relevant stories that need (un)covering.

As for the timeline, 30 years ago may seem out-of-bounds regarding a current spouse who wasn’t a spouse then, but considering the things we know about GWB’s childhoodlum interest in blowing up frogs, the college “hazing” with coathangers as brands… all well more than 30 years ago, and still they seem so relevant today.

This story, though, really makes me NOT want someone like the 3rd Mrs. Giuliani having any input into health care issues. Even 30 years ago, you’d think a nurse would have had issues with performing that kind of work. What was wrong with actual nursing?

I’ve always despised the eager whores who sacrifice animals to demonstrate surgical products and bring home six failure salaries.
You have no direct knowledge of my emotions.
My outrage is real. As is PETA’s.
And Rudy’s candidacy is in asystole.
Because of this real issue.

I’m quite sure your outrage at the mistreatment of animals is real. However, we’re talking about something that happened in the late 70’s, which, if you’re old enough to recall, was not exactly a high-water mark for animal testing.
This woman was acting as a sales rep for that company, and nothing I’ve seen so far indicates that she even knew about the testing or condoned it.

If you want to make an issue of it, be my guest, but in the pantheon of real issues facing Giuliani, this is probably the least of his worries.

Here a nationally known blog front pages Rudy’s little problem with Cruella the Puppy Stapler, and Behold! new arrivals show up at the Lake to tell us this isn’t important. And then they muddle the facts in the way that favors Rudy. And then they tell us Rudy doesn’t care.

Like I said, knock yourself out if you want to be outraged about something that happened thirty years ago before she even met Giuliani.

My entire point is that we shouldn’t be hypocritical about digging into spouses’ backgrounds in an effort to discredit a political candidate unless there is some kind of direct connection (re: Hadasah Liberman’s ties to big pharma). We all threw a fit when the GOP started flinging shit about Hillary when (and even before) she was First Lady, so to turn around and do the same, out of simple spite, lowers us to their level.

We can’t complain about the depths to which the political process has sunk if we’re not willing to take the high road ourselves.
