It is shaping up to be quite an interesting morning. It seems that Kyle Sampson's testimony has been leaked out everywhere in advance of the Senate Judiciary committee meeting — which screams political stage management to me, and it says that Mr. Sampson, Mr. Rove, Sen. Hatch and others have been talking about how to manage the political fall-out. Both the WaPo and the NYTimes have bits and pieces up this morning, but it is this bit from the NYTimes that caught my eye:
“The distinction between ‘political’ and ‘performance related’ reasons for removing a United States attorney is, in my view, largely artificial,” Mr. Sampson plans to say, according to his statement.
The statement says a failure to execute the priorities of the Justice Department or “work constructively with other governmental constituencies in the district” amounts to a political and a performance problem, eliminating the distinction.
“To my knowledge,” the statement adds, none of the prosecutors were removed to affect a specific case for partisan advantage.
Mr. Sampson is to explain that he prepared a list of prosecutors to remove with input from the White House and senior department officials. It is unclear how much he knows about all the motives for the removals, because a Justice Department official like him would typically have little access to internal White House deliberations.
On Wednesday, Justice Department officials acknowledged that they provided incorrect information to Congress in a letter on Feb. 23 drafted by Mr. Sampson and approved by the White House counsel. The letter said that “the department is not aware” of the president’s adviser Karl Rove “playing any role” in the decision to appoint his former deputy, J. Timothy Griffin, as interim United States attorney in Arkansas.
The letter was written weeks after Mr. Sampson wrote in other messages that Mr. Griffin’s appointment was “important to Harriet, Karl, etc.,” referring to Mr. Rove and Harriet E. Miers, the White House counsel at the time.
The messages describe an aide to Mr. Rove, J. Scott Jennings, holding conference calls with Justice Department officials about how to have Mr. Griffin installed despite Senate opposition.
And so we come back to the question of the Miers and Rove testimony. And the new GOP meme of "this is all just a witch hunt," which was trotted out with abandon in the sophomoric and rude antics of Rep. Mica during yesterday's GSA hearing. Josh hits the nail on the head this morning:
This is all about the investigation and what it may or may not uncover. But Sampson's claim and conceit is not so much that he and his crew are innocent of the charge but that the charge doesn't even really exist, that it's all just a misunderstanding or a witch-hunt. What he did is fine, he says. The problem is just the "confusion, misunderstanding and embarrassment" caused by how the thing was handled.So, have your eyes out for Sampson's word play and games. This investigation is about whether Sampson and his crew corrupted the justice system by purging US Attorneys who wouldn't use their prosecutorial powers to help the Republican party.
In the end, as with everything else that Karl Rove ever touches, it is always about "the math." Mr. Sampson's testimony is scheduled to begin at 10 am ET — so buckle up. It could be a bumpy ride this morning.

What’s amazing to me is that federal prosecutors need witnesses to testify to prove their cases, yet the justice dept. officials won’t testify to congress.
They want average citizens to do their part (as witnesses) so the justice system will work. Yet the justice department employees won’t do their part. When it’s a bit uncomfortable for them, they take the fifth before they are even asked a question.
What kind of example is that?
Difficult not to be cynical.
Which Kyle? Kyle Sampson? Kyle “Dusty” Foggo?

shocker at 5 — Let’s be precise here: the political appointees at Justice and the White House, appointed by the Bush Administration, are raising a ruckus about testifying. Career DoJ employees are required, by administrative regs, to seek an okay from the AG prior to testifying and, again, the political employees at Justice are saying no to such requests. (That is, for example, what is holding up Fitzgerald’s sharing any information about the Libby trial findings with Waxman’s committee until the questions asked by them are rephrased. Ahem.)

3 tbsp high heat oil
1/3 cup popcorn
1 or 2 tbsp organic sweet (unsalted) butter
sea salt
heat oil in a deep-sided, heavy-bottomed pan over medium heat. add popcorn and cover. shake pan frequently. when popping decreases, take off heat. when popping has stopped, add cold butter and stir constantly. add a few sprinkles of salt and serve!

I just tuned in to see the vote to block spinach from the bill that has no spinach. Loved Harry Reid’s point to DeMint before the vote: “This seems like something that is just wasting precious time. If the Senator from South Carolina wants to waste 15 minutes of the taxpayer’s time, I suppose it is his prerogative”. (paraphrased)
Oh lord, Biden is speaking… I wonder why the Senate isn’t in order? I do think what he’s speaking about is important. I just wish he could be brief.

CHS at 11 – Okay. I think I get it. So it is the political appointees who are obstructing justice?
Seems like it makes it hard for an honest, non-partisan (if their is one), prosecutor to make the case that people should testify as part of their duty as an American.
Still difficult not to be cynical.
It is about more than that. They fired a handful. What about the 85 or so they didn’t fire? Isn’t the clear implication that those 85 did use their powers to help the Republican party? People are focusing excessively on the firings. Even if they hadn’t fired anyone, this would still one of the largest corruption scandals in US history. The firings just let us find out about it.
So there are, what, 93 prosecutors? And 6 or 8 of them had some integrity? That sounds like about the right ratio for Republicans.

I love the fact that CSPAN3 is titling this “Kyle Sampson, former Chief of Staff to Alberto Gonzales” testifying regarding “US Attorney Firings”.
I guess the delay in starting this hearing is that the Senate (on CSPAN 2) is voting on Biden’s thing to add money to the bill for additional armor for the troops. That vote is almost over, so I’d imagine this hearing will begin in about 10 minutes at most.
(That means I have time to make a cappuccino… and of course, one for Christy as well.)

After watching the forgetful wicked witch of the GSA lie her toosh off yesterday, I was ready for an Oz event, and the weather did not disappoint.
I’ll be blogging this around a lot more as the weeks progress, but “the blogs” should concentrate on finding all the dirt that’s already “out there” in Inhofe, Issa and Davis, they all need a good swift-boating.
These investigations not only give us an insight into the mis-deeds of the Bushites, it gives us a clear picture of who in Congress is willing to conspire to help hide their lies, defend their criminals, and attack their accusers.
There ought to be a law against our cngresspeople acting opnely on behalf of these rogues, every time Davis or Mica or Issa opened their moths yeasteday, they joined in on the ongoing conspiracy to defraud and mislead the American voters.
If there is any way to determine that these lawmakers were involved in any way in the process of coaching these witnesses, or asking patent, Rovish questions to provide cover for their crimes, they should be held accountable as co-conspirators.

We know that Sampson will spin this as “politics as usual”; Repubs on the committee will call the hearings “a witch hunt”. They will attempt to spin the debate their way. I see a real possibility that they could succeed. Can the Dems counteract the “spin” and put these slimeballs in their proper place, or are they all gonna imitate Schumer and cower in a corner when challenged? I really have my doubts.
Leahy is just so justifiably disgusted with the rape of our judicial system.
Leahy is not a happy camper. Kyle will be wanting his mother before this is over.

What’s interesting is that from Sampson’s prepared remarks, it’s clear that Leahy and Sampson have different opinions of what’s proper versus improper. Sampson asserts politics is fine. It’ll be interesting to see the extent he pursues making that point.

CNN pipeline also has the hearing, with good audio quality. It has a free two week trial period, so if you cancel by then it doesn’t cost you anything.
I signed up last week when one of the hearings I wanted to see didn’t seem to be on elsewhere.
Note: It is one of those things that you have to remeber to cancel as the trial period ends.

you’re so funny! I try to justify the inordinate amount of time I spend on the web by taking my laptop out and putting it on the bookrest on the stationary bike. Works pretty good if all you are doing is surfing and reading, but hard to write very well.
