OK for Cranky and Fern, I went and checked the office copy of the Federal Employees Almanac and everyone in the Executive Branch below the VP is considered covered by the OPM regulations.
The Department of Justice is part of the Executive Branch. So OPM regs cover how/when they can be fired.
The Judicial Branch (Federal courts) have different rules for their employees. Only in the Legislative Branch (Senate/House) do you find employees that can be fired “at will.”

The issue with Scott Jennings and the other non-.gov people is that we’ve yet to see any email *originating* from a non-.gov address, other than when quoted in a reply. It hasn’t been dumped at all. We got a printout of a Google Mail forward yesterday, but we’ve not seen emails ‘From:’ Scott Jennings (or any non-.gov mailers) disclosed to Congress.

Actually it could mean one of two things:
One – there is no paper trail, in which case they’re in a heap of hurt for breaking that particular law – there MUST be documentation giving grounds for firing.
Two – there is documentation, but it does not give ANY grounds for firing. This is where those performance plans would be helpful.
Something no one has pointed out is that the fired attorneys have the right to appeal to the Merit Systems Protection Board for a hearing as to the grounds for firing, and DOJ would have to produce the documents that justified the terminations.

But the thing is that these people are not “Federal Employees” as in career civil servants. That almanac – as well as the rules and regs themselves – apply to career civil servants. These attorneys are political appointees and are not subject to the civil service requirements. At least that’s my understanding. (30 year Fed here.)
Nevertheless, it is beyond my comprehension that there would be no documentation requirements even if they can be fired without cause (which they can, as we know).

One negative review in 2005, but didn’t cause him to be put on list in 2006, yet he ended up on list.

Ah…selective awareness is a beautiful thing.
If they are considered “civil servants” they cannot be summarily dismissed, they do not serve “at the pleasure of the president.” Neither Reagan, nor Clinton nor Bush could have fired the whole lot of them at one time.
This is why one of the senators was asking Sampson earlier if he knew of any pressure from anyone for career jobs. A career job is safe. A political appointment is not. It’s obvious why someone in a “pleasure of the president” position would want to convert to a career employee.
I don’t know how to prove this but tomorrow I’ll see what I can find. But it’s logical. And it’s something I’ve heard and witnessed with every administration going back to Reagan.
I don’t mean to “fight” with you because you and I are both on the same side in these hearings, but I am certain that political employees are not provided the protections that civil servants are. Your friend at the DOJ needs to research “political appointees” specifically.
