The Department of Justice is part of the Executive Branch. So OPM regs cover how/when they can be fired.

The Judicial Branch (Federal courts) have different rules for their employees. Only in the Legislative Branch (Senate/House) do you find employees that can be fired “at will.”

The issue with Scott Jennings and the other non-.gov people is that we’ve yet to see any email *originating* from a non-.gov address, other than when quoted in a reply. It hasn’t been dumped at all. We got a printout of a Google Mail forward yesterday, but we’ve not seen emails ‘From:’ Scott Jennings (or any non-.gov mailers) disclosed to Congress.

The Department of Justice is part of the Executive Branch. So OPM regs cover how/when they can be fired.

Actually it could mean one of two things:

One – there is no paper trail, in which case they’re in a heap of hurt for breaking that particular law – there MUST be documentation giving grounds for firing.

Two – there is documentation, but it does not give ANY grounds for firing. This is where those performance plans would be helpful.

Something no one has pointed out is that the fired attorneys have the right to appeal to the Merit Systems Protection Board for a hearing as to the grounds for firing, and DOJ would have to produce the documents that justified the terminations.

If they are considered “civil servants” they cannot be summarily dismissed, they do not serve “at the pleasure of the president.” Neither Reagan, nor Clinton nor Bush could have fired the whole lot of them at one time.

This is why one of the senators was asking Sampson earlier if he knew of any pressure from anyone for career jobs. A career job is safe. A political appointment is not. It’s obvious why someone in a “pleasure of the president” position would want to convert to a career employee.

I don’t know how to prove this but tomorrow I’ll see what I can find. But it’s logical. And it’s something I’ve heard and witnessed with every administration going back to Reagan.

Sampson is just a punk. They should tell him to just get the hell out of the Senate chamber. It’s time to demand that Abu be brought to account for this charade.

It is unbelievable that there is so little accountability; that lists of names just appear out of nowhere and disappear into Sampson’s memory hole; the lists are not vetted with anyone at DOJ, that the AG signed off on lists that he had nothing to do with compiling or discussing, that the AG turned over the position of Chief of Staff to a punk like Sampson. This is unbelievable. Makes FEMA look like a model of managerial efficiency. Unbelievable.
