Well, well, well. Look who was on the list for potential firing as a US Attorney: (H/T to Peterr for sending me the link on this)
The latest revelations came amid reports that the White House has already launched a search for Gonzales's replacement and that support for the attorney general among Republicans in Congress is fading fast. One GOP strategist with close ties to the White House said last night that it is likely Gonzales will leave and that White House counsel Fred F. Fielding already has potential replacements in mind.
White House press secretary Tony Snow offered tepid support for Gonzales, saying President Bush still has full confidence in his longtime friend and ally. "We hope he stays," Snow said.
The March 2005 chart ranking Fitzgerald and other prosecutors was drawn up by Gonzales aide D. Kyle Sampson and sent to then-White House counsel Harriet Miers. The reference to Fitzgerald is in a portion of the memo that Justice has refused to turn over to Congress, officials told The Washington Post, speaking on the condition of anonymity because Fitzgerald's ranking has not been made public.…
Mary Jo White, who supervised Fitzgerald when she served as the U.S. attorney in Manhattan and who has criticized the firings, said ranking him as a middling prosecutor "lacks total credibility across the board."
"He is probably the best prosecutor in the nation — certainly one of them," said White, who worked in the Clinton and Bush administrations. "It casts total doubt on the whole process. It's kind of the icing on the cake."
Fitzgerald has been widely recognized for his pursuit of criminal cases against al-Qaeda's terrorist network before the Sept. 11, 2001, attacks, and he drew up the official U.S. indictment against Osama bin Laden. He was named as special counsel in the CIA leak case in December 2003 by then-Attorney General John D. Ashcroft, who had recused himself.
Fitzgerald also won the Attorney General's Award for Distinguished Service in 2002 under Ashcroft. (emphasis mine)
Do the words Saturday Night Massacre under cover of other firings have meaning for anyone else? And why the refusal to turn this portion of the memo over to Congress? Because the placement of Patrick Fitzgerald on that list — a man who has secured a conviction for Osama Bin Laden, among many, many others, show it to be the ludicrous political hack job that it was in firing these USAs? Because, Rove and company would not have had any reason to want Fitzgerald out of the way back in 2005, now would they? Jeebus, these people never, ever learn, do they?
There were over 3,000 pages of e-mails dumped late yesterday, and The Muck has readers sifting through them as I type. I know that a number of our readers were also talking about reading through them yesterday, so feel free to leave information on what you've been finding in the comments below as well. There is so much information out there, that it will take a collective effort to dig through it all — any help on this is much appreciated.
It seems AG Gonzales is not so happy with his deputy, McNulty, according to this from The Muck, and this from the NYTimes – apparently being honest with Congress that the USA in Arkansas had been fired to clear the way for Rove's crony selection was frowned upon by the AG. (Shocking, I know.) When you add in the increased tension from potential voluntary Sampson testimony, the DoJ is becoming quite the Peyton Place and, vis a vis the White House political operations (read: Rove and his minions), the tension is mounting.
Via the Nitpicker, I find this gem:
Republican officials operating at the behest of the White House have begun seeking a possible successor to Attorney General Alberto Gonzales, whose support among GOP lawmakers on Capitol Hill has collapsed, according to party sources familiar with the discussions.
[snip]
"We have a crisis where there doesn't need to be one, and now Democrats have an issue where they can open up the subpoena floodgates," said an exasperated Republican aide. "Once these investigations start, there always ends up being a lot of messy collateral damage." (Emphasis Nitpicker's)
Interesting, no? Especially when you peek back at this quote from yesterday's LATimes:
"This is one more chapter in the defense of Karl Rove," said one leading GOP figure who insisted on anonymity because he was speaking ill of the president's most powerful aide. "This isn't accountability, it's damage control, and it's protection for Karl."
You would think after a while, that the Republicans about town in DC would get tired of their party being used as the Rove's dirty laundromat, but maybe that's just me and my scruples talking.
I do like that "collateral damage" phrasing though. It has a certain air of much more dirt to come out, doesn't it? Although, as TPM catches in the NYDailyNews, "some top White House officials" are saying not so fast to the exit for Gonzales. (And that would be which WH officials, exactly? Let's contemplate who wants Rove and/or the DoJ to squirm a little more at the moment, shall we? Or the fact that every time this White House says someone is doing an excellent job, they mysteriously turn in their resignation within 72 hours.)
Spent some time yesterday evening coming up with some alternate AG names to vet, in no particular order: Ted Olson, Francis Fragos Townsend, Michael Chertoff, Miguel Estrada, Lawrence Silberman. I have no idea whether President Bush is going to ask Gonzales to step down or not — but I think the responsible thing to do is to start the vetting process now just in case. I have by no means come up with a comprehensive listing of possibilities — and none of these folks particularly makes me tap dance with glee, although some are much better than others as possibilities. And then there is this alternate list from the WSJ. It includes a number of names that I'm almost positive wouldn't make the short list for George Bush, Dick Cheney and Karl Rove in a bazillion years.
So, what do you think, observers of the Beltway machinations? There are a lot of new e-mails to sift through — but, in the meantime, Rove is still sittin' purty in the catbird seat, with the rest of the media contemplating a replacement for Gonzales. Diversionary tactics, anyone?

Good morning!
Oops. I decided I’m not a fascist troll after all. Sorry for the duelling handles.
Good mooorrrrning, Lakers.
From the WaPo:
“U.S. Attorney Patrick J. Fitzgerald was ranked among prosecutors who had “not distinguished themselves” on a Justice Department chart sent to the White House in March 2005, when he was in the midst of leading the CIA leak investigation that resulted in the perjury conviction of a vice presidential aide, administration officials said yesterday.”
I love that the blogosphere is combing the document dump. It’s like a… an… army of davids… or something like that…he he…
Mornin’ puppies!
Anyone else think Lieberman has become a vital lacky in the Wurlitzer?
He sure seems to appear a lot with his ‘I might switch’ schtick a lot these days. I’ll bet it’s eating him alive that no one gives a rat’s ass anymore save for the MSM…
It’s now beginning to look like the appointment of Ed Meese to the Iraq Study Group was just the first step in his “tanned, rested & ready” transformation.
And, lest we forget, Sandra Day O’Conner’s out there without a job.
Balrog at 7 — You know, I think the last thing the GOP wants is for him to switch — then they would lose their “bi-partisan support” lynchpin. Plus, then they’d be responsible for the Senate going nowhere because the control is so evenly split at the moment, no matter who is in charge, they can’t move things forward much at all. They want the responsibility for that to land on Dems — not themselves. I don’t think they would take Lieberman if he wanted to switch.

Bahaha. First time I [quickly & erroneously] read your comment, I thought it said “army of devils.” [Projecting to what “Great Minds in the WH” must be thinking.

Agreed, which is why I wish someone would call his bluff. He’d melt like a prawn on a hot sidewalk.
I’m hungry for documents this morning.
Christy Hardin Smith @

Which means he is in a perfect position to milk the GOP for money. He won’t change parties as long as his campaign coffers are stocked by the GOP.
And he won’t change parties as long as the Dems continue to stroke his obscene ego. Ugh.
Just put this on the last thread, but in case it’s important, I’ll put it here also:
——————————————————
Cujo359 @ 232
In the 2-8 I’m looking at, pages 20-26 are resumes. ???
There’s a letter from Sen. Feinstein complaining about low numbers of convictions for immigration crimes, followed by something about a dispute over who should be the temporary USA in South Dakota, a short list of who needs to be replaced (no explanations). Pages 10-48 are all resumes.
——————————————————
This may not mean a thing, but if this document was just released last night, why would Karl Rove be talking about Feinstein’s letter last Thursday when he spoke at Troy University???
When I saw this clip (link below), it seemed suspicious to me. You know…one of those things they all latch onto as a talking point, but leaves out the main crux of the story in order to say, “Even Democrats did it!! See! See!”
Does it make sense that Rove would have advance knowledge of this??

…which is why he keeps threatening. But he also knows that, given the electoral landscape, he’s about 20 months from being irrelevant, and getting what will amount to a 4 year time-out before his disintegrating career – following his reputation a little too late – comes to an inglorious end.
Will be fascinating to learn what’s in the “dump”… and what’s not. Wonder how much commingling there will be of dot govs and dot rnc-types?
“Quotes” Meacham on Imus this morning pontificating about the predicate for war, etc. A man who preaches faith but lacks faith in his own ability to frame an argument so he must toss out the quotes of others.
Joe Who?
Balrog @

Ugh! I can’t wait to see HIM get his cummuppance…
bonkers at 14 — It does if the WH has had people in the political shop looking all of thsi over for the last week before they turned over the documents. Remember, the thing that Rove and his minions do best is oppo research. And the thing that they use the Worlitzer for is to magnify the smallest of details into something that it is not, in order to deflect from themselves. I’m certain there are a number of bits that will come out over the course of the next few days inserted into the docudump for just that reason. And I’m hoping that more of the things that were NOT included — like the Fitzgerald information — will start spilling out as well. THAT is the stuff that will be really instructive.
christy this is one enjoyable post, couldn’t stop reading it!
I’m gonna say something that will raise some ears;
if Rove really is a genious then teh fitster gets the nod
no kidding
that will distance Bush from abu torture and his decisions here, make people think Bush had nothing to do with gonzales firing…it will be a stroke of genious
it will also be throwing cheney under the bus if he does it by indicating the verdict and prosecution were correct
fitz would have to recuse himself from further investigation or prosecution regarding plame to boot
is rove this smart?
nope, he’s a moron
I’m just sayin
Mutant Poodle @ 15
I laugh to think of him changing his positions on everything should the Dem Senate majority widen in ‘08.
‘No one wanted the troops home more than I. I’m a huge fan of cut and run. George Bush is a poopy-butt. Wahhh. Wahhh.’
Please God let it be so.
oh, the irony!
fitz “did not distinguish
himself” according to the
ideologues inside operation smear,
yet he was able to convict an very
popular ex-govenor in illinois, and
convict the vice-president’s faith-
ful hand-servant, on mostly muddled
journalist testimony. . .
he is very likely the most able pro-
secutor in the nation, at the moment.
the irony is “both joyful, and truimphant. . .”
I’m firmly in the “screw Joe” camp. The Dems will increase their presence in the Senate in ‘08 with or without him, so I say call his bluff.
Tom @ 22
I think the new senator gets named by a republican…not sure though
Ted Olson? Bush’s lawyer, who got him appointed in 2000? THAT Ted Olson? Are they serious? Michael “Katrina” Chertoff? Oy. If these are the front runners, you have to wonder about the people who didn’t make the cut.
Something occurred to me overnight in reading all the stuff about the USA firings. In biz mgmt, one thing high power CEOs recommend is that you fire the bottom 10% every year. Now maybe it is a coincidence that the number of fired USAs happens to equal approximately 10%…and it is fairly clear what criteria they used to determine what constitutes the “bottom”, but maybe this is our MBA preznit trying to be one. Naaaah, he was never much good as a bidness manager either, was he?
Watch them nominate Harriet “best President ever” Miers.
Last night my 90 year old aunt called Bush an as**ole. It was too funny. I’ve never heard her use that word, and I’ve never heard her curse. She’s such a sweet lady. After she blurted it out, she covered her mouth, was kinda embarrassed, and apologized. I could see it made her feel a little better, I just chuckled, and said you should here what I call him.
While sitting in her kitchen, the radio was on. It’s always on in the kitchen, and always will be. There was some local right winger talk host on, and the guest was saying how the Democrats have played right into the Republicans hands in reference to USA firings. He went on to say that they changed the conversation from Iraq, and this was going to help the Republicans.
I thought to myself, what’s next. That there is nothing wrong, and the Democrats are playing politics. And that’s what came out of the host’s mouth, along with a scoff at the hearings that are going to be held.
They need somebody who will shred evidence for them. The list has got to be short.
Is Fred Thompson a lawyer, or does he only play one on teevee?
This scandal is turning into the Grand Unification Theory of Bush Administration Evil, isn’t it? All we need now is to find out that Karl Rove had the FBI wiretap Democrats running for office and we can put a cherry on this little Shit Sundae…
Tom @ 22
I’m sorry to keep pointing this out, but we did that already. Last year. He got kicked to the curb in the Democratic primary. He’s not a Democrat anymore. Every time he threatens to “switch” parties, the correct Democratic response should be: “What does the Connecticut for Lieberman Party think about this?”
These people are the coldest, most callous bunch of motherpuckers, need their asses kicked to the curb.

i’m very happy that investigations are making headway – that is a very good thing….
but there is something more important going on…. especially for iraqis and the families of those americans in iraq (or under threat of being sent).
today is the first day of the fifth year of our war & occupation against the people of iraq… with no sign that there will be an end at any point this year.
indeed, speaker pelosi is supporting a bill that will continue funding the occupation for another 18 months – until 2 months before the 2008 elections. i’d like to think that it’s only the republicans who would play politics with a war (see the 2002 elections) – but it doesn’t look like that is the case.
and those who could make the attempt to hold feet to the fire (like moveon) are mostly either silent, or in active support of the 18 months of continued funding.
somedays, like today, i despair….
Why do Republicans hate national security so much?
I’m not reading the dumped e-mails myself, just the reposts, but the really interesting thing I’ve noticed so far is that these are all “.gov” e-mails. Wasn’t there a big uproar over people using non-official e-mail accounts? Those are the messages I’d really like to see.
I have a question: In light of the CREW complaint about White House staffers using non-White House/government e-mail addresses to circumvent the archiving requirements of the Presidential Records Act, and given that we now know that RNC and Bush 2004 e-mail addresses were used, I wonder if Patrick Fitzgerald received everything he asked for with his request for information regarding the Plame outing. That is, did the White House respond to his request by limiting the search for e-mail to those saved in the White House archives? Color me curious.
chun yang @ 33

And John Dean kicked his ass from here to Charing Cross. It was lovely. Thompson, as Minority (GOP) Counsel — essentially acting as Nixon’s defense attorney — tried to make a few digs at Dean’s credibility, and Dean, in that quiet, elegant way of his, not only parried Thompson’s assault but alluded to Thompson’s various ethical failings in such a manner that Thompson — Mister Ruff-n-Tuff Prosecutor Man — backed down right quick.

Well, this is pretty much EXACTLY like the saturday night massacre…except for technology differences. When will a fire light under the american people to call for the ouster of this president and all his cronies. So clearly, Bush and Cheney BOTH need to leave office. Did Nixon have many people supporting him through his “leaving process.” I know Pat Buchanon was on board for Nixon, but back then, there was no fox pee news. (otherwise known as yellow journalism). So my concern is that there are still people out there that support this crooked administration.
I can’t remember the “atmosphere” because I was just a kid and my parents hated Nixon before he was in trouble. So, those of you who do remember, was there an active faction of supporters for Nixon??? Is today different, and why?? And what can we do about it??
Christie at 38 – Well, a big zhu ni sheng ri kuai le to her!(I have to use what I learn in Chinese class somewhere – It just means happy birthday!)
Do I have a nice boy I can introduce her to – I explained the Libby trial to my son and he wants to see a bunch of people in jail! He has been calling for Bush to go to jail since the age of five. It is lucky we live in progressive Chapel Hill, because he can barely SPEAK to his Texas relatives!

Top U.S. Official at Unesco Resigns Before Audit’s Release
PARIS, March 19 — The highest-ranking American official at the United Nations Educational, Scientific and Cultural Organization has resigned, just days before an official audit made public on Monday reported that he had violated Unesco’s rules by granting seven contracts to an American consulting firm without an open bidding procedure.
The official, Peter Smith, had served for 21 months as assistant director general for education at Unesco’s Paris headquarters. He said in a resignation letter dated March 12 that he was resigning because of a “threat against my life, the inadequate support and follow-up to that threat, and a negative climate in the workplace.”
[snip]
Mr. Smith, 61, a former president of California State University, Monterey Bay, who represented Vermont in the House of Representatives as a Republican in 1989 and 1990, has reportedly left France and could not be reached for comment.
[my bold]
The movement should start this morning – here and now – the only Republican candidate for attorney general that the American people will accept is Patrick Fitzgerald. Period – end of story. Gonzo goes – Fitz steps up – that’s the only way to restore confidence in the DOJ. If Bush cares at all about the confidence of the American people, he’ll nominate Fitz … if Bush has nothing to hide, he’ll nominate Fitz … If the firings weren’t just a cover-up for killing investigations, he’ll nominate Fitz ….. (your talking/pressure point here)
BTW – Fitz, of course, reluctantly takes the job, but with some conditions about his independence and access.
Patrick Fitzgerald as AG is the only way for Bush and the Republickers to restore the confidence of the American people…Patrick Fitzgerald as AG is the only way for Bush and the Republickers to restore the confidence of the American people…Patrick Fitzgerald as AG is the only way for Bush and the Republickers to restore the confidence of the American people…Patrick Fitzgerald as AG is the only way for Bush and the Republickers to restore the confidence of the American people…
I’m surprised nobody mentioned Lieberman as a candidate for AG. He would be perfect (for Bush). The press would claim he has bipartisan cover, and he has undying loyalty to the Bush clan.
Morning folks,
Happy birthday, Peanut!
For the grown-ups, there’s a fresh pot of coffee and a stack of documents hot off the scanner.
TPM has links as well, and people are asked to comment as they read. There has been some talk about converting the .pdf’s to text for searching but doI haven’t heard where that is being coordinated.

Great post with your open leader to Pelosi. While reading the comments, I saw the comments about editing, and obviously, it’s very difficult to edit your own stuff.
You might want to read what you write backwards. Since it’s the opposite of what your train of thought was, it could help spot some missing words, etc. It’s a little odd at first, however I found that it helps me sometimes.
I was reading through the second document dump earlier this morning, and while there are certainly some interesting bits, there are also a lot of repeats of identical e-mail attachments. For example, IIRC, set “2-9″ includes almost 75% resumes. Even here, though, some might find it interesting a) Which schools are considered by this group as “first-tier” (yes, I know there’s a technical definition, but still…) and b) The (not-surprising) political activity in several of the candidate’s backgrounds.
Other aspects, such as the poor resume formatting (who really uses 3-1/2″ margins to make it four pages long?!), are just a bit catty, but still mildly entertaining.
Been looking at the “Documents” and so much of it does seem to be a “dump.” Think there has been a lot of scrubbing going on to pretty things up. A lot of fluff and filler as well. Leahy needs to start the subpoenas.
The question no one seems to want to answer shows up in the doc dump.
Who will determine whether whether this requires the President’s attention?
Kyle Sampson commits the mortal sin of mentioning the President specifically (and in an email chain where the underlying, lengthy email, was produced earlier, but somehow they just couldn’t find the rest of the chain until now I guess.
It again raises that question – how do you go from “at the pleasure of the President” to “at the pleasure of some guy named Kyle” legally?
Of course, even after you answer that question, you have the obstruction and Humphrey’s issues.
Who DID determine whether or not the President should get to ok the plan?
perris@19:
Oh, I do love that notion. But it’ll never happen. and actually I hope not. I’m hopin’ fo Fitz as AG in 2009. And the world will aright itself.
This is OT but pertinent to the previous thread. Just wanted to share this little snippity of Ann Coulter’s expert historical analysis of Canada’s involvement in the Vietnam war. Spread it on your morning croissant. It’s a bit delicious.

I saw the picture posted from Pandagon of the soldier and the broken child and felt the pain of others here who reacted to it. Saw someone suggest Lieberman for AG on a right blog last night. Is he a lawyer? What happens in CT if this were to occur? CT has a R gov.
Not clear how all the talk about Lieberman got started in this thread – but I wouldn’t be too surprised if Boltin’ Joe bolted the Dem’s to become the new Attorney General. There was a lot of talk of him taking Rummy’s job, but that’s been filled now. But as prior state AG for CT, he’s qualified to be US AG, and obviously he has drunk the KoolAde, and more than a lot of names mentioned he could probably get confirmed, without too long of a hearing process.

Breaking News from CNN:
President Bush today called embattled Attorney General Alberto Gonzales to reaffirm his support for him, The Associated Press reports.
…can you believe it?
Millineryman @ 66
I’ll give it try on the next one
gonzales is gone, one more willing lackey who, let’s face it, got farther than in his wildest dreams by being the toady and enabler that he was. if it were merely a question of being a yesman, it wouldn’t matter so much, but in the course of his work, the policies he championed — torture, wireless wiretaps and the like — have permanently stained our country.
but rove, just like cheney, will never leave. it’s not even a question of “loyalty.” they control bush — the guy would have trouble dressing himself without them.
Curious @ 83– since Benjamin Franklin said that “The definition of insanity is doing the same thing over and over and expecting different results”
yes, I can believe it.
Those two ghouls have been joined at the hip since they presided over the horrific death penalty cases in TX. Now they are presiding over even more grotesque and wide ranging death penalties and torture.
Curious in Central Texas @ 83
I want him to stay really, really bad, folks. I want to see him wriggle some more and I want the Bush connection there to be solid throughout investigations so that some new guy can’t answer every question with an “I am not aware of that” just because he wasn’t around when it happened.
Bluetoe @ 72
The interesting thing to me is how long this had been in the works. FOr instance, Timothy Griffin’s resume. He was the Rover appointed to be USAtty in Arkansas. The Old USA was bumped in Dec 2006, but Monica Goodling sent his resume to Michael Elston in August 2006. Interesting! These guys know how to plan when it’s important to them.
Another thing I find interestng is the detail of the advance planning. “It is important that all the calls to atty’s and calls to senators be done at the same time”, the actual firing speechs were scripted as were responses to likely questions, participants were warned to be ready to ‘hold firm gainst substantial political upheaval’ and *someone* was obvously developing and driving this USA Project” as they called it for months.
BUt somebody, somewhere fell down. Despite discussions (Mike Elston, mostly) that they that they had to be ready with replacements immediately, there was no follow-up and only *one* USAtty actually was replaced. Thiss is how lame?
My question is what *didn’t* happen here.
President Bush today called Attorney General Alberto Gonzales to reaffirm his support for him, according to White House spokesman Tony Snow. ooops, sorry for the duplicate post.

The Democrats have the power to hold out for whatever AG they care to name.
It should be someone seen as moderate, clean, independent of the Administration, and who has proven they can work with Congress. (nb it should be someone who is seen this way; I’m not saying any of these facets necessarily hold true.)
It should also be a GOP Senator from a state with a Democratic governor :)
We aren’t going to like their AG anyway, might as well get a Senate seat out of the deal. We can neuter Joe here by promoting Arlen Specter into the AG seat.

This is the end of the document dump as a delaying tactic.
Folks over at DKos are worried that the Bushies have already gone through and removed all the really juicy stuff before dumping. But the thing is, if they really are vetting the stuff prior to dumping, they don’t have the warm bodies needed to get it done in a timely and effective manner.
This is where their lack of trust comes around to bite them in the ass: There aren’t that many Bushistas that would a) know what to leave out and b) could be trusted not to blab. (Can you imagine the Bush Junta farming out the vetting job to outsiders, no matter how ideologically friendly? Neither can I.)
By contrast, we don’t have the trust problem — and even overnight, as TPM Muckraker has shown, we can throw a LOT more bodies at picking apart the docs than they can muster trustworthy gunsels to sanitize them. And if they make mistakes in the sanitizing, we can capitalize on them.
Stay, Gonzo. (Another Bush blight in Demos’ plain sight.)

That greasy brown turd bobbing in the MSM bowl proves that some just can’t be flushed away.

You are assuming that the Democratic Party leadership has a problem with Lieberman and his current actions. I think they like him just fine: he protects their right flank, he expresses what a lot of them think about Iraq in particular and liberals in general, and he defeated a netroots-backed candidate. I think insider Dems love him to pieces in private.

Christy,
I’ve heard you’re trying to get the Peanut a Constitution for her birthday. Sadly, I think it’s on backorder. With some luck and some hard work, though, I think we’ll be able to dig one up out back.
So far I’ve just started reading the comments, but I have read the post. By the time I’m done reading the comments, everyone will have moved on to the next post. But I did want to say now, it sure seems as if Justice is no longer blind if the Bush Administration has anything to say about it. And they do. Next election, it appears we will have a whole spate of dirty political tricks to deal with, and no way to punish the perpetrators. Obviously there will be false charges against Dems and withheld charges against Repugs (like the phone blocking charges in Vermont (?) the last election.) The problem is not only the fired USAs, it is the ones that were willing to play ball enough to stay. Of course, there’s nothing wrong with that, now is there? Dirty politics, thy name is Bush. The Bushies main job qualification is both incompetence and having no integrity, a dangerous combination. It’s disgusting!
Kristof behind the NYT wall bashes Cheney unmercifuly, calling him an iranian mole, and then detailing all the things the administration has done to strengthen Iran’s position in the world, and strengthening the current’s government’s position in power.
It goes on like this.
Cranky @ 130– I think you may just be right.

Ann– the phone blocking was in NH.
Yay, Nicholas Kristof– time to discuss Cheney/Haliburton/Iran. Thanks jayackroyd.
perris at 112: Good point. I guess that’s what I was getting at, keeping him will add more fuel to the fire as opposed to trying to extinguish it with a forced resignation.
However, considering this president’s pattern of praising people under fire and then rapidly dumping them (as some others have noted on here), looks like he is on out the door. *sigh*
(Has the right ever addressed this lack of loyalty btw? I mean, I thought he was supposed to be a “man of his word” and “sticks to his guns” and all that jazz. Better yet, why am I asking this question since the right flew out of reality’s orbit long ago.)

Doubtful, I’s say, unless Bush the Lesser actually does have a talk with Jesus, and listens.

What kind of effect on the rest of the country would it have?
Silberman, Silberman, where have I heard that name before? Wasn’t he the judge during the Iran-Contra scandal? I know his name is associated with some scandal or another.
As for Fitz, well, is anybody really surprised? He’s had a target on his head ever since Peter Fitzgerald asked for him. He’s smart, professional and demonstrates integrity over loyalty.

LHP at 137 — The problem is that the A-Team folks have integrity. Which, frankly, cuts them out of the Bushista loop, now doesn’t it? When you have a host of e-mails that detail firing decisions based on “loyalty” questions and willingness to play ball, you aren’t exactly looking for people with a commitment to the rule of law, now are you?
Jeebus, these people piss me off.
The next Attorney General should be a person of impeccable ethics, no Bush sycophants, no appointments by either of the Bushes–the Dems must not allow another Bush Family Crime Syndicate member to reach a cabinet level office. Ever. Or even close to cabinet level.
Bush will probably nominate the most egregiously awful individual he thinks he can muscle through–the Dems must prevent such a thing. They should be going to him right now to tell what kind of person they will accept.
And, of course, do not tell Lieberman anything about Democratic plans.

My thoughts too. Its about the replacements, or lack thereof. If you are going to replace USA because of lack of performance, then you should have replacements ready to go, lest you continue the lack of performance due to vacancy.
It was not about replacing. It was about removing. Slowing the wheels of justice, not speeding them up, or even changing their direction.
This administration has always had the replacement ready to be announced immediately after firings/resignations, so this is a red flag that the firings were political.
jayackroyd @ 133
There is something to that, has been niggling in the back of my mind for a while now.
Did you see Jerome a Paris’ diary at DKos earlier this week (Sunday? can’t remember) about a natural gas OPEC being discussed?

Ok, I was up wading through the e-mails last night. Note – there are supposed to be 3000 pages. Only 1000 were released last night. TPM seems to indicate another 2000 today.
There were a lot of resume’s, and repeating e-mails (you see an e-mail chain of like 10 emails. But in the doc’s, it’s repeated. You see the original e-mail first. Then the reply the original. Then the reply to the reply the original.)
BTW – they got sloppy with redacations sometimes. At one point, Karl Jr’s cell phone was redacated, then in later versions of the same notes, it wasn’t.

This is known as “papering” i.e., dumping so much paper on the adversary that it will keep them out of your face for a while in order to read it all.
Happy to help the out of face time!
nolo @ 21
Remember, there are three categories that Sampson & friends used to categorize the US Attorneys:
1. loyal Bushies
2. “did not distinguish themselves”
3. weak
(Per TPMmuckraker)
So, if you’re not a “loyal Bushie”, the best you can be is non-distinguishable. Now that doesn’t have the ring of political taint, does it?
The new AG won’t be Silbermann because he could hear the Libby appeal. Hence, they want Gonzo to remain until the appeals judge is selected.
I think we need to start asking why our tax dollars are still paying for a political operative whose only function seems to be getting Repugs elected for all time to work in the WH right in the vicinity of the Oval Office. Let him work in the RNC where he belongs, since Bush will not be running for public office again, and let them pay his salary with political contribution. Seems only fair and just.

I’m sure that this has already occured to people here but if Karl Rove was in the loop regarding the attorney firings and if the DOJ people were discussing Fitzgerald, what else were they discussing with Karl Rove? Did they have details about the Plame investigation that they were passing to Rove? Were there any firewalls between Rove and Fitzgerald’s investigation? How would one prove that there was or was not such a direct pipeling that would help Rove stay out of trouble? And wouldn’t that be one of the biggest scandals since Watergate?

I sure think that they might (it might be a non-delegable power) but in any event, the right to remove them really ought to be clearly delegated for someone other than the President to exercise it, IMO and based on statute.
Even without the obstruction issues, “at the pleasure of the President” does not become “at the pleasure of some guy named Kyle” absent some delegation.

RE: Lawrence Silberman. Both he and David Sentelle are two of the absolute worst result-oriented-activist-right-wing-ideologues on the D.C. Cir.
Since Mister Bush will nominate a justice hating wacko for AG to replace a justice subverting liar already at AG no matter what, why not Silberman? I say get Silberman’s ass off the bench where he is doing irreparable harm already and, in conjunction w/Sentelle, is probably doing as much constitutional damage as is possible for a sitting judge.
The GOP did not confirm Clinton’s judicial nominees during the last three years of his presidency. No reason Silberman’s D.C. Cir. seat needs to be filled before 2009 if he goes to the AG post either.
Silberman is not qualified for the job, but getting him off the bench is at least one benefit of nominating him.

Just being discussed on CNN now:
Bush apparently called Gonzales this morning to give the AG “a message of full confidence”. Snow Job apparently has been talking about it in his morning gaggle. CNN’s Ed Henry says the admin is trying to knock down the Politico.com story that they’re dropping names of potential new AGs.
Henry also says you have to read the tea leaves – Bush is saying they’re supporting Gonzoles, but frankly if it comes down to executive privilege and there is a struggle between protecting Rove versus protecting Gonzales, the WH will stand behind and protect Rove and thoss out Gonzo.
Dana Bash: just confirmed the Senate Judiciary Committee has announced that if they don’t get the info they’ve requested today, they will vote to give the Democrat in charge of the Judiciary Committee permission to issue subpoenas to Rove, Miers, Rove’s deputy, Kyle Sampson and others involved.

See, I think I’m with LHP.
Abu G goes today, we end up with Ted Olsen. Unless you can explain how we can prevent Schumer, DiFi, Kohl, and Biden from supporting him because he’s got some real intellectual heft. We need to keep two out of those four on board.
And if Abu G goes and Olsen replaces him, we just continue to implement the process of disenfranchisement that is one of the key points of this whole purge. While the blogosphere has been hammer on those who weren’t fired (like NH’s USA), Schumer and the MSM really don’t want to be bothered to look beyond the purged 8 (not even to the Marianas, where there is a clear 9th).
If Abu G goes now, we don’t get at the underlying issues, and Rove keeps his job. That’s not the goal here.
John Ashcroft should actually be given some credit.
Not for anything, but your story does remind me that Ashcroft, twisted as he may seem, deserves some credit for being decent enough to recuse himself.
He saw something other Bushies did not want to see and got the hell out of the way.
Phoenix @ 130 – my tubes are problems today. Didn’t see your 130 earlier, but it’s nice to know I’m not the only one interested in that one.
I’d so like to see Sampson under oath tell us how that question was answered.
Mary4 @ 207
He absolutely can’t have a Reno. He has to have a Mitchell or an RFK. As Christy pointed out above–and that means the new AG will be a lightweight. If he could get away with Meirs, I think he would. But she is not making it through the Senate.
Olson. Yeah, that’d work. I hope we can get a couple of more days out of this.
Whoops, I mean’t Harry Reid. Sorry for the typo Harry
Happy Birthday Peanut!! This morning on the TODAY Show they metioned that Gonzo’s scheduled appearance for Thursday had been delayed. At that time I figured that it was a signal that he would be gone by then.
I have a question that is.not.snark. in the slightest.
with all the citizen-journalist research going on with the documents (dumped) where does the link to MSM and general knowledge among the populace occur?
Where is the junction of information and realization?
I don’t know if he had to say anything to his supervision.
When his supervision was Comey, you can expect that they talked about the case. It was in the papers that they never spoke about the case again after Comey resigned from DOJ.
I don’t know, if he ever spoke to Marolis at all about the case. I have never seen anything open source on that point
portia.vz @ 178
So, if Elston is talking about ‘informing Karl” I conclude that either
a.) Karl was *not* in on this, it’s a big project and he’d be informed on an ongoing basis if it were his baby, so maybe someone else is master-minding this. Cheney? Someone else? — or –
b.) this is a piece of disinformation. How many times does this piece of info appear, and how ‘in situ’ is it?
c.) neither of the above, of course.
Rayne @ 193
Heh!
Jayackroyd @ 210:
Exactly.
And even if they tried to sanitize them beforehand, they don’t have enough trained and trustworthy (by their lights) warm bodies to do it effectively. We can muster far more detectives than they can muster trustworthy and competent sanitizers.
This is yet another Republican tactic, like redistricting, that not only is not as effective as it used to be, but is now downright self-defeating.
emptywheel @ 212
DiFi and Boxer have a problem, with DiFi having the bigger problem as a member of the SJC.
They’ve been gamed all along and they didn’t know it.
And Ted Olson is a partner at GD&C.
HotFlash @ 221
D) it was KArl’s idea inthe first place, he sent Kyle to go do it. Kyle worked up a battle plan and now needed to get it approved by Karl before they pulled to trigger, to make sure it was what Karl had originally envisioned
Mabel’s Wig Shack @ 219
First you gotta get rid of traffic cops like Roger Ailes & Rupert Murdoch.
Rayne @ 224
That’s worth a diary right there.
Christy for AG!
Rayne @ 224
Gibson Dunne=Fedralist Society only with nicer stationary
I pick D.
In this administration, only Cheney gets to pull the trigger without Karl’s OK.
[Mod Note; please do not re-quote more than twice, thanks]
Thanks for the thread Christy!
If you look at the DOJ’s OSC site you will see Comey’s appointment letter to Fitz — it lays out his very independent powers in the CIA leak investigation. It states:
“I hereby delegate to you all the authority of the Attorney General with respect to the Department’s investigation into the alleged unauthorized disclosure of a CIA employee’s identity, and I direct you to exercise that authority as Special Counsel independent of the supervision or control of any officer of the Department.”
Pectopah @ 202
Yuo’re right, sorry. How about that veterinarian guy who was FDA for women’s health briefly? He’s a loyal Bushie.
looseheadprop @ 229
And guess who helped pick those GD&C folks to sit on that committee?
Parsky Commission.
Did you happen to catch this comment over at my DKos diary? Juicy.
emptywheel @ 227
Hey, you up for having another chat with a Senator’s office?
I think it’s time we revisited Levin’s last reauthorization of the Office of Independent Counsel.
emptywheel @ 212
I agree that keeping Gonzo around is probably better for us now than his departure would be, for various reasons.
But I don’t think that zapping him now will do Bush or Rove any favors. As Mary4 noted earlier, Rove and Bush have now been tied directly to the scandal. It’s already too late to pretend that they weren’t. In fact, zapping Gonzales, far from insulating them, might just make it clear that they and not Abu were calling the shots.
Well, I know that Firedoglake loves Fitz — but I have been a consistent, and lonely, critic of the man. I don’t believe he is the savior of our democracy, and I don’t like the fact that he NEVER goes after the big fish unless they are easy prey (i.e. George Ryan).
So they considered firing Fitz, hey? Well, what has happened since then? Fitz went after Libby — the sacrificial lamb presented to Fitz by Rove. Then announced that there will be no more — the trail has come to an end and Rove and Cheney and Bush can all rest easier.
Does this sound like Fitz is a thorn in their side? Or does it sound like Fitz has decided to play along? You decide.
looseheadprop @

Oh crap, where does this stop? It’s like pulling on a loose thread only to find you’re unraveling an entire slipcover on a massive couch…
Parsky was a senior partner with GD&C before he set up the vulture capital firm Aurora Capital.
God help us if they throw Parsky’s name in the hat for Abu’s replacement.
emptywheel @ 212
I’m gonna weigh in on the stay side, too. If Abu goes there is a discontinuity and Leahy’s committee will get the sh*t that St Henry was getting from Knodell, “I wasn’t there!”* Keep the perps in place and make them talk to that nice Sen Leahy and Chairman Waxman.
Subpeona Kyle, too. BTW, somebody should get him out of DOJ before he can sanitize. Just sayin’
*(for extra marks, name the G&S operetta that is from, the character and the situation.
Rayne wrote it already and there’s even a nasty surprise in it–one of the other partners is choosing Lam’s replacement.
ew–you don’t think Dem Senators could be convinced to get behind a plan to get to 52? Then they suck more than I thought.
Also mods–I noticed the edit on one of my earlier posts. Didn’t know there was such a rule but I suppose it makes sense. Duly noted.
PageUp @ 236
Graymail.
State Secrets.
Figure it out. There are pointed reasons Fitz couldn’t go any further without more evidence, and without obstructions being removed.
Would you rather the entire damned thing got thrown out?
Rayne, would that be the savings-and-loan Gerry Parsky? The Caribbean Gerry Parsky? He’s a very google-able guy, so busy!
Professor Foland @ 239
I think I need to submit all that Wong Yang stuff to another ePM person, think there was somebody focusing on that. My DKos diary was meant to focus on Parsky; can see where the Wong Yang story and the GD&C connection might be something all by themselves since Wong Yang is one of the “dismissed” USA’s that preceded the Gonzales Eight.
The media is really quite slow about this; there are more than Wong Yang.
This from Susan DuQuesnay’s website Kiss My Big Blue Butt http://www.kissmybigbluebutt.com/
“March 18 – Our friend Dave passes this along -
New Republican slogan:
‘Prosecutors will be violated.’”
HotFlash @ 241
Ooh, thank you, HotFlash!! Want to post those to the DailyKos or ePM diaries on Parsky??
Rayne @ 242
leveymg has a diary you may be interested in
Rayne @ 244
Rayne, no time today, I have two deadlines and shuldn’t even be here. And I don’t know how/am not signed up (yet). Although I am reg’d wDKos I have never figured it out and get lost there.
But anyone w/time/skills can follow these up, any volunteers?
Also (I can think of lots of things for other peoplke to do…) It is possible for anyone to transcribe Adobe files to text, use the selector tool on the Adobe toolbar and click copy, then paste to another format, pref something searchable and portable such as .html. And an index, page by page. Staff! We need staff! Off to string clavichords and do some invoicing.
Ted Olson is completely unacceptable as a replacement AG. That’s letting the wolf into the henhouse.
With regard to Tim Griffin replacing Bud Cummins as the USA for Arkansas, I’m wondering if this move was not just to shut down Cummins’s investigation of Roy Blunt, but also to put someone in place to dig for dirt on Hillary Clinton. After all, the Eastern District of Arkansas does encompass Little Rock.
Professor Foland @ 245
Too funny. I just came back here from Mark’s diary.
Good God, this thing is HUGE.
Has to be RICO, doesn’t it?
HotFlash @ 246
No problem, I’ll post them.
Hey, while you’re at it, let me know what you can do on a full-sized viola. My 13-year-old just moved up to her first full-sized; paying $180 a year rent. Ouch!!
Any replacement of the fired Attorney
Generals by Bush would be akin to changing the baby`s soiled diaper. It
was suggested that perhaps Lieberman
could be named, giving the Republicans
control of the Senate with this move.
[I doubt Lieberman would fall into that trap)…In 08 a Democrat “might”
be president, So guess where Lieberman
will land after being tossed for being such a traitor? I`m just saying.

hotflash @ 246
Documents from DoJ are “photocopies”, not text converted to PDF, so not easily converted back to text. I don’t know how good OCR s/w is these days, maybe it’s good enough. Is it possible to request that future dumps be PDFs which are searchable text? That doesn’t work for hand-written notes, but hand-written notes have a charm of their own.

A bit EPU, hope you catch it anyway. This morning it took $1.33 to buy 1.00 Euro. (near record) that only happened when 710 was at peak price range. It can also indicate mucho $s floating arround in the currency market and diminished demand for $s. By buying property in areas Euro zone is expanding, “l#unders” doll#rs into Euros without having to answer “pesky” questions about source – a byproduce of GWOT money tracing addopted everywhere in EuroLand. Idea is when “smart” money starts moving noticably, there is some reason for that movement, what is it? Always keep an eye in the money, isn’t just idle advice. Again, All the best……
Agree with the lightweight analysis. Merely pointing out one of the upsides (and a big one) that comes with this particular unqualified person on the list of potential candidates.

Thanks again, Arnie. Would like a fund that specializes in these newer-to-euro opportunities, but it’ll take time I’m spending on this research stuff.
I think I’ll soften the blow of downside dollars by moving to BRIC until I can move some to the newer-to-euro opportunities. It’s not perfect, but it’s better than being as exposed as I am to declining dollars. Already have half a dozen EU-based funds that have done nicely, so I’m not over-exposed. Thank goodness…and I’m buying stock in companies that are globalized, have considerable income or assets from overseas. Appreciate your comments.
The movement should start this morning – here and now – the only Republican candidate for attorney general that the American people will accept is Patrick Fitzgerald. Period – end of story. Gonzo goes – Fitz steps up – that’s the only way to restore confidence in the DOJ. If Bush cares at all about the confidence of the American people, he’ll nominate Fitz … if Bush has nothing to hide, he’ll nominate Fitz … If the firings weren’t just a cover-up for killing investigations, he’ll nominate Fitz

Comment from abroad, have you ever heard of the saying “The best is enemy of the good”? You may not trust the Democrat leaders but surely, PLEASE they are better than Bushies?
Well, let’s take “Republican” out of the qualifiers, and —> I believe Paul Hackett is an attorney. I think we could come up with many helpful “bi-partisan” suggestions.
BTW, I was around for the Watergate hearings: scheduled law school classes around it. Of course I remember John Dean; Fred Thompson, not so much. As someone remarked, “how did that go for him?”
Re: what happens if Holy Joe gets appointed AG:
A question for our Nutmeggers: wasn’t there some sort of action in CT to pass a bill requiring a special election of a “departed” Senator, rather than leaving the power to appoint in the Governor’s hands? And how’s that going?
Peter @ 205 – No, that’s not it. I know that Gonzales is referred to as “Judge” by some at DOJ and elsewhere.
However, Margolis had an email in the first doc dump notifying some of the players that a CA Fed judge had asked him for info, which he declined to provide – but he had then received an insider tip that the judge was going to keep pressing for the info from other sources.
